Background

West Oakland has 33 off-sale liquor licenses in the form of small markets, liquor stores, and convenience stores. Based on a 1996 CA Alcoholic Beverage Control regulation, West Oakland has an over concentration of off-sale alcohol outlets (liquor stores). For example, in census tracts 4014 and 4016, only two off-sale retail licenses are authorized. However, according to our data, there are four alcohol outlets in each census tract. Of the twelve census tracts in West Oakland, eight have an over concentration of liquor stores.

Throughout the past six weeks, we have conducted a research-based project on the West Oakland off-sale alcohol liquor licenses, where we have found that 58% of the liquor stores have disciplinary histories.

In this report, we will present disturbing facts we have gathered about West Oakland’s liquor stores.

West Oakland Liquor Stores Fact SheetWe combined quantitative information about the West Oakland population with the liquor store violation findings.

Of the 33 liquor stores in West Oakland, 19 of them have a disciplinary history.

The 19 liquor stores with disciplinary histories have a total of 31 violations.

10 of the 19 liquor stores with disciplinary history have multiple violations.

•9 of the 10 liquor stores with multiple violations have had their license suspended more than once.

13 of the 19 liquor stores with disciplinary history have been fined for a total of $44,861.64.

15 of the 19 liquor stores with disciplinary history have sold alcoholic beverages to minors.

•6 of 15 liquor stores that sold to minors had done so more than once.

3 of the 19 liquor stores with disciplinary history have fenced stolen property.

1 of the 19 liquor stores with disciplinary history has sold drug paraphernalia.

58% of these liquor stores have broken the law; that is more than half located in West Oakland alone.

79% of the liquor stores with disciplinary history have sold alcoholic beverages to minors.

West Oakland is overconcentrated by 12 liquor stores, as defined by the Alcoholic Beverage Control in 1/1/2008.

This contains census tracts 4014 thru 4027 (+ 1 liquor store in census tract 4028). This area is bound by I-580 to the north, I-980 to the east and I-880 to the west and south. There are a total of 33 liquor stores with off-sale retail liquor licenses in this part of West Oakland.

Using information from the Alcoholic Beverage Control website, we mapped out the locations for each liquor store within census tracts 4014 thru 4028 (and bordered by the 580/880/980 freeways). We added schools and community centers to show their proximity to youth related activities.

A Message From EPIC Youth Interns Elisa Chan and Brianna Pang

Living in Oakland for all seventeen years of our lives, we realize that these violations by off-sale retail licensees of West Oakland must be halted for the sake of our communities' health. From our research, we would like to highlight three main points:

1)The over-concentration - According to the 1996 ABC regulation, only one off-sale retail license is authorized per population of 1,518 people in Alameda County. Nonetheless, several census tracts have managed to acquire 200% in excess of what is approved. This over-concentration exposes youth early on to alcohol. There are even more liquor stores than libraries! Furthermore, why is the number of licenses granted even based on a general human population? Why are youth under 21 included in this count when they are not legally allowed to drink?

2)The violations - One of our main concerns is that there has been minimal action taken as a result of these violations. In several cases, the licensees, who were fined for breaking the ABC regulations or had licenses suspended, were pardoned. Why is it that the 19 liquor stores with disciplinary history, ranging from fencing stolen property to selling alcoholic beverages to minors to selling drug paraphernalia, are even allowed to continue their business today?

3)The locations - After mapping out the license locations, schools, and community centers, we noticed that location is vital to interpreting and analyzing the violations' trends. For example, the licenses that contain "fencing stolen property" charges were all from 34th St. In addition, the licenses that include "selling to minors" charges are centered around some schools (namely, McClymonds High School). All the liquor stores without violations are located in the same general area. Is it really just a coincidence that most of the liquor stores near large populations of youth have "selling to minors" offenses? How can one expect to clean up the community when youth have so much detrimental propaganda around them?

We conclude that the West Oakland liquor stores' actions must be somehow regulated in a more efficient manner. We hope that this research can contribute to efforts of creating a better community and healthier Oakland youth. After all, right now, the West Oakland liquor stores are pretty ugly.

About EPIC

Environmental Prevention in Communities is a youth driven environmental prevention and advocacy project of the Alcohol Policy Network that trains youth aged 15-20 from Alameda County to identify problems around alcohol in their community. We then create strategies for prevention and education through campaigns, research-based projects, and policy development around alcohol and tobacco related issues.

Environmental prevention is an essential part of a comprehensive approach to the prevention of alcohol and tobacco problems, and a proven strategy for helping youth and adults make healthy choices. To achieve this outcome, we promote responsible actions by government, communities and the alcohol and tobacco industry.

Data Collection

Starting in July and over a period of six weeks, our EPIC interns began this study by conducting observational storefront surveys and cold calls in West Oakland including photo documentation of all the liquor stores within the boundaries of I-580, I-880 and I-980 freeways. EPIC interns then developed a data chart, google map, fact sheet and wrote an editorial about their findings.

All other West Oakland liquor store data used in this report was obtained from the California Alcoholic Beverage Control’s (ABC) website in July 2009. The demographics data was obtained from the 2000 US Census.
