SETTLEMENT AGREEEMENT
‒ For products manufactured prior to
January 1, 2015 an 18 month grace
period (July 1, 2016) for non-
enforcement of regional standards
will be allowed to sell-through
existing inventory.
• This only applies to products
manufactured prior to 1/1/2015.
‒ Products manufactured on and after
1/1/2015, must meet the minimum
efficiency level and installation date
requirement.
National and Regional Standards for Residential Air Conditioners
and Heat Pumps
New Federal Minimum Efficiency Standards for Residential CAC/HPs
(single-phase models less than 65,000 btu/h)
System Type North Region South Region Southwest Region Off Mode
Any condensing unit model that has a certified combination that is below
the regional standard cannot be installed in the region.
• For Example:
• 14 SEER ratings obtained by using an ECM equipped air mover are
NOT allowed in the Southeast and Southwest
– RA13 SEER condensing units that achieve a 14 SEER rating when
combined with an ECM equipped gas furnace are NOT allowed to be
installed in the Southeast or Southwest
– 1.5 - 3.5 ton RA14 SEER condensing units that do not also achieve a
12.2 EER rating cannot be installed in the Southwest Region
Definitions
Contractor
•A person (other than the manufacturer or distributor) who sells to and/or installs for an end user a central air conditioner subject to regional standards
•For Example: Internet Reseller; brother-in-law
Dealer
•A type of contractor, generally with a relationship with one or more specific manufacturers
Installation
•Installation of a central air conditioner is the connection of the refrigerant lines and/or electrical systems to make the central air conditioner operational
Distributor
•The term “distributor” means a person (other than a manufacturer or retailer) to whom a consumer product is delivered or sold for purposes of distribution in commerce
