Chairman Garrison welcomed everyone & called meeting to order with Commissioner Lampp, Brown, Healan, Berry, Parks & Hendrix in attendance.

Stood for Pledge of Allegiance to the Flag & Commissioner Parks gave the invocation.

1. APPROVAL OF JUNE 24, 24008 MINUTES Commissioner Brown made motion to approve minutes, Commissioner Lampp seconded. Motion carried unanimously.

PUBLIC COMMENT ON AGENDA ITEMS-NONE

2. NICOLE SMITH-RFB2008-7-F250 CREW CAB PICKUP This is to purchase of a new 2008 Ford F-250 4x2 Crew Cab pickup & will be a SPLOST purchase.

Bids: Akins Ford $22,621.00 available immediately Legacy Ford $22,902.00 120 days delivery Wade Ford $23,164.00 45-60 day delivery

Commissioner Berry made motion to approve low bid from Akins Ford of $22,621.00, Commissioner Hendrix seconded. Motion carried unanimously.

3. KEITH LEE-RFPQ2008-22-ADMINISTRATIVE & RELATED GRANT SERVICES

This is for the selection of a grant administrator for CDBG and/or EIP Projects for 2008-2010. Two proposals were received & evaluated: Allen-Smith Consulting & Precision Planning. The fees proposed for both firms were 6% of the total project cost & both firms received good references. Recommendation is to go with Allen­Smith Consulting.

Commissioner Healan made motion to go with Allen-Smith Consulting for administrative & related grant services, Commissioner Berry seconded. Motion carried unanimously.

4. TERRY DARRAGH-DELEGATION AGREEMENT FOR REVIEW & APPROVAL OF SEWER SYSTEM EXTENSION

This is an agreement with EPD to allow the County to review our own sewer plans & approve them. Currently H.S. Feldman does our preliminary reviews on plans & then forwards them to EPD for approval. This agreement will allow the County to approve our own sewer plans for sewers greater than 36 inches in diameter & pump stations with capacity of 700 gallons per minute & greater. This will streamline our permitting process without going through EPD.

Commissioner Healan made motion to authorize Chairman to sign & enter into the agreement with EPD for review & approval of sewer system extensions, Commissioner Lampp seconded. Motion carried unanimously.

5. CHAIRMAN GARRISON (1) SENTINEL OFFENDER SERVICES AGREEMENTS-SUPERIOR AND

PROBATE COURTS

These contracts have been signed by the Judges & have been reviewed in house & by our County Attorney. The Attorney has suggested that compliance

with the state law concerning participation in the federal work authorization program to verify the legal status of employees should be reviewed & included in the contracts to the extent it is determined that the company is required to participate in the program under state law. The number of employees needs to be verified with the company & this issue addressed accordingly.

Commissioner Brown made motion to authorize the Chairman to execute the agreement on behalf of the Superior Court & Probate Court with Sentinel Offender Services, LLC, contingent upon the addition of Appendix A to the contract concerning participation in the federal work authorization program to verify the legal status of employees, unless Sentinel demonstrates that the state law on this issue does not currently apply to them based on its number of employees, in which case, Appendix A does not have to be added, Commissioner Lampp seconded. DISCUSSION

Commissioner Healan made motion to amend to authorize the Chairman to execute the agreements on behalf of the Superior Court & Probate Court contingent upon the addition of Appendix A to the contracts with the language that is required by the State for illegal aliens & should Sentinel not accept these terms, the contracts will be brought back before the board to review with the County Attorney, Commissioner Berry seconded. Motion carried unanimously.

VOTE ON MAIN MOTION: Motion carried unanimously.

2. PROVIDENCE COMMUNITY CORRECTIONS-MAGISTRATE

Commissioner Berry made motion to authorize the Chairman to execute the agreement on behalf of the Magistrate Court with Providence Community Corrections, LLC contingent upon the negotiation with the company for the removal of Paragraph 8 concerning the limitation of liability & contingent upon addressing the applicability of participation in the federal work authorization to verify the legal status of employees & should Providence Community Corrections not accept these terms, the contract will be brought back before the board to review with the County Attorney, Commissioner Parks seconded. Motion carried unanimously.

With no further business, Commissioner Berry made motion to adjourn, Commissioner Hendrix seconded. Motion carried unanimously. Meeting adjourned at 7: 17 PM

Dear Barrow County Planning Commission and Board of Commissioners,

I am applying for a special use permit for the property I own located at 738B Tucker Road Winder, GA 30680. The proposed tenant MC Plastics Recyclers, Inc will use the facility to receive high-density polyethylene plastics such as dairy crates, rollout trash bins and bakery trays. These items will then be processed in a machine called a grinder that will shred them into 3/8ths tol/2 inch sized pieces. The pieces are then shipped away in boxes to users. There is no heat, emissions or air borne residue from the process. There is no water, solvents or any other liquids used in the process that creates liquid waste. The property is currently zoned M-1 which permits this process with a special use permit as referenced in the UDC on chart 2-26 under the NAICS Code 56292 Recycling and Materials Recovery Facilities. The existing facility is a 10,000 square foot building that sits on a 1.5 acre lot. It has 16 parking spaces and is 22 ft high. I am not requesting any change in the buffers.

Any injection molding company will have a "grinder" at their facility.

Re: Final Comprehensive Plan and Comprehensive Transportation Plan Presentation

The final presentation to the Board of Commissioners and all stakeholders will be held at the July 22nd Board of Commissioners meeting. Our consultants, Mactec Engineering and Jacobs Carter Burgess, will be presenting the final product to you and the public. I have included copies of the documents for your review.

This is the culmination of three County wide meetings, four Regional Visioning Workshops, six Stakeholder Committee Meetings, five Community Advisory Committee Meetings and countless hours of County and Municipality Staff time. During this process, we had a tremendous amount of input from stakeholders across the County. The documents before you reflect the input of the citizens of Barrow County. These documents are designed to be guides for quality growth and the basis for proactive infrastructure placement to encourage economic development.

The adopting resolution will be before you at the August 26th meeting after the Municipalities have adopted at their regularly scheduled meetings during the month of August.
