But just because buyers are busy buying (or trying to buy), doesn’t mean they are always happy with their home. Better home affordability, lower mortgage rates and conservative bank lending are likely key factors helping buy-ers avoid major housing regret, the real estate firm notes.

So for us buyers, the key is riding out this crazy market. For sellers, enjoy the demand and the multiple offers on your home!

The real estate market is heating up! A lot is going on and you are busy with your real estate business. Levert Hill v Associated Holding Group: Buyer’s Lawsuit ContinuesAn Ohio appellate court has considered whether a buyer’s action for misrepresentation against a brokerage and its salesperson could proceed when the salesperson incorrectly told the buyer that she could lease the property to third-parties after purchase.

In March 2010, Billie Levert-Hill (“Buyer”) contacted real estate professional Jason Caccamo (“Salesperson”) of Associated Hold-ing Group, LLC, d/b/a Prudential Select Proper-ties (“Brokerage”) about her interest in one of the Salesperson’s listings. She told the Salesperson that she planned to purchase the property as an investment and would lease the property following purchase.

The Salesperson’s listing was in a condominium complex, and the so the Salesperson showed the Buyer two other units in the complex as well. The Salesperson provided the Buyer with an agency disclosure form stating that he represented the seller, not the Buyer, in the negotiations for his listing. The Buyer submitted offers for each of the units, but only the Salesperson’s client accepted the Buyer’s offer. Because the Buyer was not represented by a real estate professional, the Brokerage retained the entire commission from the sale.

The Buyer requested the association’s bylaws from the Salesperson a number of times so that she could confirm that she had the ability to lease the property. The Salesperson never provided the Buyer with the bylaws and admitted that he forged her signature on a document which stated that she had received the bylaws. The Buyer had called the Salesperson in the midst of the closing to again confirm that she would be able to lease the property, and the Salesperson testified that he had told her that he had reviewed the bylaws and that she would be able lease the property.

Following the closing, the Buyer was told by an officer of the condominium association that she could not lease the unit. In fact, the bylaws stated that unless the unit had been registered in 1994, it could not be leased without prior, written approval from the associa-tion’s board. Because the Salesperson knew that the Buyer would have only purchased the property if she could lease it, he asked the Brokerage to intervene and help the Buyer because of the bad information the Buyer had received from him. The Brokerage refused to help the Buyer, causing the Salesperson to move to a different firm. The Buyer filed a lawsuit against the Salesperson and Brokerage, alleging breach of contract, breach of fiduciary duty, and fraud. The trial court ruled in favor of the Salesperson and the Brokerage, and the Buyer appealed. continued on pg 15

Treasury’s Maggiano defends push for looser credit standards

Laurie Maggiano, director of policy for the Treasury’s Hom-eownership Preservation Office, told attendees at the REOMAC 2013 Summit & Expo that, while the housing crisis is in full recovery, consumers continue to lack confidence.

Maggiano shared with the crowd how difficult the lending rulemaking process is and how many complaints she hears on a daily basis. “This stuff is not easy,” she noted. Maggiano informed the crowd that the administration is acutely aware of the struggles many homeowners are still facing and guaranteed actions are being taken. In fact, just last week there were three housing initiatives announced by the Administration in order to connect struggling homeowners with corrective programs that can assist them.

The first initiative is a partnership between the Treasury and NeighborWorks America to increase outreach and support for struggling homeowners seeking assistance via the Making Homes Affordable Program. Through this initiative, counselors will seek homeowners in need, helping them complete and submit application documents to their servicers, free-of-charge.

Secondly, the Department of Labor is encouraging American Job Centers throughout the country to inform unemployed homeowners about their foreclosure prevention options.

The final initiative is an effort from the U.S. Department of Housing and Urban Development to launch the Housing Counseling Office, which was established by Dodd-Frank. Through this initiative, 2,500 HUD-ap-proved counselors will provide free or low-cost information about foreclosure prevention as well as advice regarding homeownership and renting.

Maggiano continued by addressing the recent request from President Obama to loosen lending standards last week, an action that has drawn much criticism after the Consumer Financial Protection Bureau recently announced regulations to tighten credit standards.

Between 2007 and 2012, new home purchases dropped 30% for those with a FICO score over 780, said Maggiano. In that same period of time, new home sales dropped 90% for borrowers with a FICO score be-tween 620 and 680.

“Where are these folks supposed to live?” asked Maggiano.First-time homebuyers and folks who have faced the misfortune of unemployment (no matter how short it may have been) likely no longer have the credit score necessary to get a mortgage. She noted that the current average FHA credit score is only 700. We need to get back to a place where it’s no longer only those with perfect credit scores and 25% to 30% down getting a loan, Maggiano concluded.

The Court of Appeals of Ohio, Eighth District, partially reversed the lower court and sent the case back to the lower court for further proceedings. The court first looked at the misrepresentation claims. While there was no evidence of intentional misrepresentation because the Salesperson had believed that the condominium complex allowed the leasing of units, the evidence could support a negligent misrepresen-tation claim.

A negligent misrepresentation claim can include allegations that a person who, during the course of his/her business, supplies false information to others and these individuals rely on this information to their detriment, if the person providing the information fails to exercise reasonable care or competence when communicating the information. Here, the Salesperson had failed to investigate whether units could be leased and had provided false information to the Buyer. Thus, the court ruled that a jury should consider the negligent misrepresentation allegations.

Next, the court looked at the breach of fiduciary duty allegations. The Salesperson had purportedly repre-sented the Buyer in only two of three offers she had made, providing a form stating that he was not rep-resenting her while she made an offer for the Salesperson’s own listing. There was testimony from both the Buyer and the Salesperson that they thought, despite the form’s language, that the Salesperson was representing her in that transaction as well and thus acting as a dual agent. Therefore, the court ruled that a jury should consider these allegations as well and sent the case back to the trial court.Levert-Hill v. Associated Holding Group, L.L.C., 975 N.E.2d 575 (Ohio Ct. I finally had the opportunity to watch the movie “Lincoln”. And it was incredible! It showed the life of President Abraham Lincoln within a four month span. It shows the debate of the 13th Amendment to the Constitution, the Civil War and ultimately, his death. The one thing that was a constant, was how Lincoln believed in bettering oneself.

President Lincoln was self educated and became a country law-yer, a Whig Party leader, Illinois state legislator during the 1830s, and a one-term member of the United States House of Representatives during the 1840s. And of course, became the 16th President of the United States in 1861.

Education is paramount in any profession. While you have to have 16 hours of continu-ing education for your license renewal, what other education are you pursuing? Have you thought about a designation? What about knowledge for knowledge sake? VPAR has continued through our committees, Professional Development, New Homes and Property Management, to bring varied educational offerings to you, the VPAR member, to help you do better business.

LOCAL ISSUES

HAMPTON

The final state budget that goes into effect July 1st for the next two years included appropriations to the Joint Langley Air Force Base/Ft. Eustis clear zone efforts, allowing for the purchase of land near both installations from willing sellers. (With the state money in place along with funds set aside locally, eminent domain likely will not be used to protect the bases from encroachment.) Already, willing sellers have approached the City of Hampton to inquire as to the process.

VPAR was very involved in the Joint Langley Air Force Base/Ft. Eustis Joint Land Use Study (JLUS) a couple of years ago, where we again worked on noise and crash issues near both bases. In addition, members may recall that over a decade ago, VPAR worked with LAFB officials, officials from the City of Hampton and Department of Defense brass to develop meaningful disclosure language regarding the Air Installation Compatible Use Zone (AICUZ) that now is part of the Virginia Residential Real Property Disclosure form. TAKE PRIDE, VPAR! Your efforts and work on that issue are spreading! VPAR has been contacted by officials at Marin Corps Base Quantico to provide information and details regarding the local JLUS, particularly with regard to the AICUZ language. Nice to know your resourcefulness and influence are making it to the beltway!

HAMPTON/NEWPORT NEWS

VPAR is receiving details from agents throughout the region, but most notably in Hampton and Newport News, advising that copper thefts again are on the rise. HVAC units are a common source of the vandalism, with the entire units being lifted off their pads and stolen. Copper pipes and wires from other sources also are on the hit list. If you have information regarding these incidents, certainly contact your local law enforcement and also advise Susan Gaston at [email protected]. VPAR is working with local law enforcement to provide education and details to stem the tide.

POQUOSON

Mark your calendars! VPAR’s REALTOR® Day in Poquoson will be held on Tuesday, May 7th beginning at 9:00 AM at the Poquoson Yacht Club and running through 1:30 PM. Both breakfast and lunch are included in this FREE event! Hear from City leaders and take away new details on City efforts and issues. More details to come!

STATE

VPAR and most every other local Association in Virginia is working diligently with VAR to levy influence at the Department of Professional and Occupational Regulation (DPOR) so that licensee transfers may be completed in a more timely fashion. Of critical importance is the work we are doing to insure that licensees in transfer are able to conduct business. VPAR will include this is-sue in its 2014 Legislative Package. In the meantime, if you are having difficulty in a license transfer, please contact us so that we can continue to press the importance of this issue.

While the 2013 Session just adjourned, it never is too early to start thinking about 2014! VPAR’s Public Policy Committee will begin consideration of issues for the 2014 Session within the coming weeks. STATE ELECTIONS

November will see Virginia voters return to the ballot box to elect new statewide leaders: Gover-nor, Lt. Governor and Attorney General. VAR and the RPAC of Virginia Trustees will interview all candidates following the convention and primary elections. Typically, the statewide candidates interview in August. We will keep you informed as to the state association efforts on this important election.

Closer to home, VPAR’s Public Policy Committee will conduct candidates interviews post-Labor Day for our House of Delegates members. This process is critical to the success of our legislative agenda: VPAR, through member’s RPAC investments, support candidates who support our pro-housing and pro-business legislative agenda. Much more to come on the elections!

FEDERAL Your Federal Political Coordinators are working hard to schedule May meetings in Washington with their team members! There will be much to follow at the conclusion of those sessions, but hats off to Mary Beth Pauley and Chandra Patterson for their outstanding work as the REALTOR® points of contacts for Congressmen Wittman and Scott, respectively.

NAR President Testifies on FHA

NAR President Gary Thomas testified this week before the House Financial Services Subcommittee on Housing and Insurance about the importance of the FHA mortgage insurance program.

This was the fourth in a series of hearings being held by the Committee since FHA’s 2013 actuarial report showed a negative net value of $13.48 billion. FHA has made significant changes to improve their financial standing, including raising premiums and lender enforcement.

NAR believes Congress can provide additional tools to FHA including program flexibility, increased risk management controls, and improved management. President Thomas cautioned Congress from making significant changes to FHA that could hamper our housing recovery and disenfranchise qualified borrowers. “The current organizational model for HUD is not sustainable from a financial and a ser-vice delivery point of view,” said Maurice Jones, deputy secretary of HUD. “We’re in a different budget environment and we’re at a point where we must make some extremely tough choices.”

The U.S. Department of Housing and Urban Development is downsizing by consolidat-ing its Office of Multifamily Programs into 10 sites, the agency announced Wednesday.

The decision to restructure HUD comes at a time when sequester cuts are impacting every aspect of the economy, including federal agencies.

The restructuring of HUD is expected to generate up to $45 million in annual savings once complete after consolidating field employees — who are now scattered throughout the nation in 50 offices — into 10 offices that report to five multifamily hubs.

The office’s restructuring plan involves streamlining multifamily’s organization at both the headquarters level and in the field, while implementing several other operational improvements.

This more streamlined model will allow more consistent, efficient processing of loans and servicing of existing assets and will help ensure continued work that creates afford-able rental housing opportunities, HUD said.

The implementation will undoubtedly challenge the agency’s employees and as a result, HUD is giving all employees the opportunity to continue working at the agency though in some cases in a new location or role.

Completion of the entire restructuring process is expected to take two and a half years, with construction beginning this fall.

The Office of Multifamily Programs provide mortgage insurance to approved lenders to facilitate the construction, substantial rehabilitation, purchase and refinancing of multi-family housing projects as well as the administering a number of project-based assis-tance programs.

“We have to change in order to be nimble and keep pace with the marketplace by lever-aging technology, reducing our footprint as appropriate, and enhancing customer service in ways that will help ensure that we perform as a 21st century institution,” said Marie Head, deputy secretary for multifamily housing programs.

She added, “In today’s budget climate, we must also look for every opportunity to in-crease our operating efficiency, but we also have to keep in mind the impact of these changes on our employees.”

HUD’s Office of Field Policy and Management is also managing towards the future, clos-ing 16 of its 80 field offices this year in a cost-cutting move that is estimated to save the agency between $110 and $150 million over the next 10 years.

The closures, which will be completed in 2014, will affect 120 employees.

“The most difficult part of implementing these changes is the appreciation of the very per-sonal impact they have on employees who have dedicated years of their life to the mis-sion of HUD,” Jones said.

He added, “Realistically, there is no way to make the kind of structural changes we are talking about without there being some impact on our staff, but, again, we are committed to taking all necessary steps to reduce the negative impact they will feel.” Author: Christina Mlynski, HousingWire
