THE OKLAHOMA REGISTER is an official publication of the State of Oklahoma. It is published semi-monthly onthe first working day of the month and on the first working day following the 14th day of the month under the authorityof 75 O.S., Sections 250 et seq. and OAC 655:10-15-1. The rules of the State of Oklahoma are codified and publishedin the Oklahoma Administrative Code.

The Oklahoma Register and the documents accepted for publication are AVAILABLE FOR PUBLIC INSPECTIONat the Office of Administrative Rules pursuant to the Oklahoma Open Records Act. Governor’s DeclarationsIf a proposed permanent rule is disapproved by an omnibus joint resolution of the Legislature, as set forth in 75 O.S., Section

308.3, the Governor may issue a Governor’s Declaration declaring the rule to be approved and finally adopted if, after receiving apetition from the issuing agency, the Governor determines that the rule is necessary and that the agency has the authority to makethe rule.

The Governor may also issue a Governor’s Declaration approving and finally adopting rules if:• the Legislature fails to pass an omnibus joint resolution during the legislative session; or• the Governor finds that an omnibus joint resolution has "a technical legal defect preventing approval of administrative

rules intended to be approved by the Legislature" [75 O.S., Section 308.3(D)(4)].A Governor’s Declaration must be published in the Register on or before July 17 following that legislative session.

GOVERNOR'S DECLARATION REGARDINGSUBMITTED AGENCY RULES

Pursuant to Section 308.3 of Title 75 of the OklahomaStatutes, if the Oklahoma Legislature fails to pass an omnibusjoint resolution specifying which proposed permanent ad-ministrative rules (Rules) are approved and which Rules aredisapproved, the Governor may approve Rules by means of asingle declaration published in the Oklahoma Register.

The proposed new rules in 310:2-3-8 are pursuant to Executive Order2020-13, signed by Governor Stitt and filed with the Secretary of State on April8, 2020. The proposed rules are necessary to respond to the emergency byassuring the continuation of critical services regulated by the Oklahoma StateDepartment of Health. During the emergency individuals and organizationsproviding critical services may experience difficulty and delays in satisfyinglicensing requirements and maintaining adequate staffing because of closures,suspensions of business operations or re-scheduling of required examinations.GIST/ANALYSIS:

Executive Order 2020-13 allows for the promulgation of emergency rulesby State agencies to address the emergency. These emergency rules willmaintain and increase staffing shortages and the continuation of businessoperations for those providing critical services during the emergency.

The proposed new rules allow the Department to extend renewal deadlinesfor any occupational or professional license, certificate, permit, or registrationissued by the Department. The rules allow the Department to extend renewaldeadlines for any organization, establishment, facility, shop, or premiseslicense, certificate, permit or registration. Under the rules, the Departmentmay waive, defer or suspend inspection requirements. The Department mayextend completion deadlines for applications for licensure. Fingerprinting

SUBCHAPTER 3. GENERAL OPERATION ANDPROCEDURES

310:2-3-8. Pandemic emergency rules(a) Purpose. The rules in this Section have been adoptedfor the purpose of maintaining and increasing the number ofindividuals, organizations, facilities and premises that providebeneficial and critical services in the State of Oklahoma andare subject to the regulatory authority of the Department.(b) Emergency. means the threat of COVID-19 to the peo-ple of Oklahoma and the public's peace, health, and safety, asdeclared in Executive Order 2020-07, and its amendments (Ex-ecutive Order) and as defined in 63 O.S. § 6104.(c) Suspension of requirements for licensure renewal.

(1) The Department shall extend renewal deadlines forany occupational or professional license, certificate, per-mit, or registration issued by the Department to any in-dividual, business, or organization that has expired or willexpire during the emergency declared in the Executive Or-der. Such licenses, certificates, permits and registrationsshall remain valid until fourteen (14) days following thewithdrawal or termination of the Executive Order.(2) The Department may extend renewal deadlines forany organization, establishment, facility, shop, or premiseslicense, certificate, permit, or registration issued by theDepartment to any individual, business or organizationthat has expired or will expire during the emergency de-clared in the Executive Order. Such licenses, certificates,

permits or registrations shall remain valid until the with-drawal or termination of the Executive Order.(3) The Department may waive any late, delinquent,penalty, or expiration fees associated with any license, cer-tificate, permit or registration referred to in Sections (1)and (2) above until the withdrawal or termination of theExecutive Order.(4) The Department may suspend in-person skills test-ing, certification, re-certification and continuing educa-tion requirements until the withdrawal or termination ofthe Executive Order.

(d) Pending applications. The Department may extendcompletion deadlines for any initial or pending license,certificate, permit, or registration during the emergency.(e) License renewal activities. The Commissioner maywaive, suspend or defer inspection requirements for current,extended or initial applications for any organization, establish-ment, facility, shop, premises license, certificate, permit, orregistration issued by the Department. No inspection waivers,suspensions or deferments may be granted following thewithdrawal or termination of the Executive Order.(f) Continuity of care and continuation of services.

(1) The Department shall take such action, as neces-sary, to maintain and increase healthcare professionals li-censed by the Department, including home health careproviders and emergency medical personnel.(2) The Department may reduce or waive staffing re-quirements and supervisory requirements and waive li-censure requirements, including education requirements,skills testing and experience. All reductions or waiversof staffing and supervisory requirements shall terminateupon the withdrawal or termination of the Executive Or-der. All individuals who receive a license under the termsof this paragraph shall be supervised by an individual whohas completed all licensure requirements, has obtained acurrent license from the Department, and is not the subjectof any administrative proceeding initiated by the Depart-ment.(3) The Department may grant provisional approval ofa license without fingerprinting. Any license issued underthis provision shall remain valid until fourteen (14) daysfollowing the withdrawal or termination of the ExecutiveOrder.(4) Emergency medical personnel applicants with aNREMT Provisional Certification or that have success-fully completed the CareerTech Emergency MedicalResponder cognitive exam shall have their psychomotorskills verified by their employer and be specifically ap-proved by their medical control physician prior to beingscheduled for duty. Specific quality assurance processesshall be developed by the medical control physician toensure quality care is provided by this type of licenseholder. These specific quality assurance processes shallremain in place until:

(A) the license holder successfully completes allaspects of the psychomotor exam; and(B) obtains a non-emergency certification or li-cense by the Department.

(5) Conditional licenses issued under this paragraphwill expire fourteen (14) days following the withdrawalor termination of the Executive Order.

The LP Gas Board affirmed the finding of an emergency for the proposedrule changes at its public meeting on April 20, 2020 because the rule changesare necessary to address a compelling public interest and to maintain publicsafety for Oklahomans.

More specifically, in 420:10-1-1, the amendments delete an out-datedreference to LP Gas appliances. This change is necessary for a compellingstate interest to reduce out-dated rule language.

The amendments to 420:10-1-5, includes a reduction of the renewal feefor Class I dealers. The reduction in fee is necessary for a compelling publicinterest in lowering the cost on licensing fees to operate a small business inOklahoma. Additionally, the amendment to the Class III Transporter Permitrequirements include the sale of LP gas, instead of just the delivery, to ensurethe rule covers LP gas that is being sold out of a facility and not delivered.Additionally two additional endorsements are being added to the Class III tocover the transport of unodorized LP gas and to allow invoicing of the enduser, which is currently only allowed by a Class I. These changes are necessaryfor the safety of Oklahomans because with the legalization of the medicalmarijuana industry in Oklahoma. Producers of medical marijuana are orderingand utilizing unodorized LP gas, which is a safety issue because of the lack ofsmell, which would otherwise provide notice of a leak or other safety hazard.Unodorized gas is preferred presumably to keep the odorized additive outof the product. Also, the Class III permit holder must have a way to chargecustomers for the bulk delivery, which currently is only allowed by Class I's.

The amendments to the Class VI permits are necessary for safety becausethe amendments require the permits to be displayed at all time, which allowsthe Safety Code Inspectors and the public to know immediately if the LP gasdispensing station is properly licensed and has been inspected by the LP GasAdministration. Additionally, training requirements are being increased by therule amendments to help prevent accidents and unsafe filling operations at thedispensing stations, which has been a recent issue the Safety Code Inspectors

have encountered. The Un-OdorizedLP Gas End User endorsement is a newrequirement to address the medical marijuana producers who are utilizingunodorized LP gas in their production operations, but are currently doing sowithout any regulation or safety requirements.

The amendments to the Class VI-A permit adds those persons "engagedin" dispensing LP gas, not just those in charge of the operation to ensure thatall people involved in the dispensing are properly licensed and trained, notjust those persons "in charge" of the dispensing station. Also, the trainingrequirements are amended to require a Board-approved class, not just trainingby the Class VI permit holder, who is the employer of the Class VI-A permitholder. The amendments require the permit to be posted at the facility wherethe permit-holder is employed. These amendments are an effort to increase thesafety requirements on all employees of LP gas dispensing stations in order toincrease safety for Oklahomans.

The amendment to the Class VII permit specifies that it is for odorized gasonly, so as to prohibit unodorized gas from being used in the cylinder exchangelocations, which are frequently used by homeowners to obtain propane tanksfor residential use. Only allowing odorized gas in these locations maintains ahigher level of safety for Oklahomans who are obtaining LP gas in this manner.

The amendment to 420:10-1-8 is a compelling state interest to deleteoutdated rule language for examinations that do not exist.

The amendments to 420:10-1-14 add a requirement for those facilitiesthat are using unodorized LP gas to get a permit endorsement and to havethe plans for the facility be reviewed and a site inspection be conducted bya Safety Code Inspector. These additions are necessary for the safety ofOklahomans because with the legalization of the medical marijuana industryin Oklahoma, producers of medical marijuana are utilizing unodorized LP gasin their facilities, and under the current rules, may do so without any oversightor safety inspections.

The amendments to 420:10-1-16 seek to include Sole Proprietorshipsin the requirements for Class I training, because they were inadvertentlyleft out of the rule. Usually Class I permits are obtained by the company,and those Sole Proprietorship companies have not been obtaining a Class I.Additionally the amendments specify that the training for the Class I and X'sis management training. These amendments are necessary to increase thesafety of Oklahomans by ensuring all Class I's are included in the trainingrequirements, and that the required training is directed at managers rather thanjust employees.

The amendments to 420:10-1-18 are an increase in amount of insurancethat Class IV Installers must have. This change is necessary to protectOklahomans by ensuring that the person installing the LP gas system in theirhome or business has adequately insurance coverage in the event of an accidentor injury to compensate the customer adequately.GIST/ANALYSIS:

The proposed revisions to the rules delete an out-dated reference toLP gas appliances; reduces the renewal fee for Class I permits; amendsthe requirements for Class III DOT Transporter permit and provides for anendorsement for transport and an endorsement for bulk delivery; amendsthe requirements for Class IV permit display and training requirements andprovides for an endorsement of Un-Odorized LP Gas End User; amendsthe requirements for Class IV-A permit; amends the language for Class VIIpermit to limit for odorized LP Gas only; deletes out-dated examinationlanguage; adds language requiring the submittal of plans for any facility usingun-odorized LP Gas and requiring permit; cleans-up language regarding safetyschools; increases insurance requirements for Class IV permits.CONTACT PERSON:

PURSUANT TO THE ACTIONS DESCRIBED HEREIN,THE FOLLOWING EMERGENCY RULES ARECONSIDERED PROMULGATED AND EFFECTIVEUPON APPROVAL BY THE GOVERNOR AS SETFORTH IN 75 O.S., SECTION 253(F):

420:10-1-1. PurposeThe public policy of this State, as declared by the Legisla-

ture, requires that all persons, firms, corporations, associationsand other legal entities that engagein the manufacture, fab-rication and assembly, or sale of LP Gas appliances or in

the sale of LP Gas or in the transportation of the same over thehighways of the State of Oklahoma shall not engage in suchbusiness unless they have first secured a permit as required bythe laws of the State of Oklahoma and the rules and regulationsadopted pursuant to such laws. The rules of this chapter areintended to implement the policy and carry out the Board'sstatutory duty of regulation in the interest of public safety.

420:10-1-5. Permits(a) Permits required. No person, firm, corporation, as-sociation or other entity shall engage in the manufacturing,assembling, fabrication, installing or selling of any system,container, or apparatus to be used in this State in or for thetransportation, storing, dispensing, or utilization of LPG,nor shall any transporter, distributor, or retailer of LPG store,dispense and/or transport over the highways of this State anyLPG for use in this State in any system, container, apparatusor appliance without having first obtained a permit to do so asprovided in this section.(b) Permit classifications. The permits required forengaging in business shall be divided into the following classi-fications:

(1) Class I - Dealer permit. The Class I Dealer Permitpermits the holder to engage in any phase of the LP Gasbusiness. A Class X Manager's permit must be securedfor the person actually in charge of an LP Gas operationat each separate branch or base of operation of a Class Ipermit holder. The initial permit fee for a Class I is OneThousand Dollars ($1,000.00) The annual renewal feerequired to be paid for the Class I permit is NineFive Hun-dred Dollars ($900.00$500.00).

(A) Class I holder can go on inactive status, butwill have to meet all the requirements of the per-mit, including paying the annual renewal fee, andhaving proper insurance requirements filed with theAdministrator, before going back on active status.If requirements are not met the permit will then berevoked. The annual renewal fee required to be paidfor a Class I permit holder on inactive status is FourHundred Dollars ($400.00).(B) Applicant must furnish to the Board, evidenceof the following insurance:

(i) A minimum of $1,000,000.00 general lia-bility insurance, as per 420:10-1-18;(ii) Worker's Compensation insurance shall berequired as per state requirements;(iii) Motor vehicle insurance must meet Stateand Federal requirements.

(C) Brokers/wholesalers selling LP Gas to anyoneother than Class I permit holders or refinery/gas pro-cessing type facilities shall obtain a Class I permit andmeet the requirements thereof, except for minimumstorage and metering, when said sales are by transportbulkhead to bulkhead.(D) Before testing for a Class I permit, an applicantmust meet the following requirements as approved bythe Board:

(i) Five (5) years experience as an active ClassX Manager or equivalent; and(ii) Forty (40) hours of specified training.

(2) Class II - Truck Transporter permit. The ClassII Transporter Permit permits the holder to transport LPGas as a common carrier or private carrier to another ofthe following: a person, firm, or corporation engaged inthe production or manufacture of LP Gas and/or sellingor reselling LP Gas to transporters, industrial consumers,processors, distributors, retailers, and/or to holders ofClass I, III, or VI permits. A Class II permit shall notauthorize the resale of LP Gas to an end-user. A Class IIpermit shall not be a substitute where a Class I is needed.A transport must meet all CFR 49 requirements. Theinitial permit fee for a Class II is One Thousand Dollars($1,000.00). The annual fee for a Class II permit is FourHundred Dollars ($400.00). All LP Gas transport driversemployed by a Class II permit holder are required to ob-tain a fuel handlers card. The annual filing fee for a fuelhandlers card is Ten Dollars ($10.00).(3) Class III - DOT Cylinder Transporter Permit.

(A) The Class III DOT Cylinder Transporter Permitpermits the holder to operate a cylinder delivery ser-vice. The separate endorsement will be as follows:III-A, permits the holder to invoice the end-user forbulk deliveries only when the LP Gas is delivered bya Class I permit holder. the holder to operate a LP Gascylinder sale or delivery service for LP Gas in accor-dance with all other rules and regulations and NFPAPamphlets 54 and 58.(B) The annual fee for a Class III permit is OneHundred Fifty Dollars ($150.00). The annual fee forthe separate endorsement is Three Hundred Dollars($300.00).Class III DOT Cylinder Transporter Permitfor Un-Odorized LP Gas Endorsement. A separateendorsement to a Class III permit is required, if appli-cable, and in addition to the Class III DOT CylinderTransporter Permit, and allows the holder to operate aDOT cylinder sale or delivery service for un-odorizedLP Gas in accordance with all other rules and regula-tions, NFPA Pamphlets 54 and 58, and the following:

(i) Pursuant to this Endorsement, un-odorizedLP Gas shall be sold or delivered in approved DOTcylinders only.(ii) All deliveries shall be made in appropri-ately marked and placarded vehicles.(iii) Delivery vehicles shall be operated by li-censed personnel holding appropriate certificatesand qualifications for the safe handling of LP Gas.(iv) Prior to application or renewal of any ClassIII DOT Cylinder Transporter Permit for Un-Odor-ized LP Gas Endorsement the applicant or holdershall provide the Administration as part of this ap-plication or renewal a complete list of facilitiesand each delivery location, including name of fa-cility, street address of facility, name of contactperson and contact information of said facility andthe name and location of the Class I permit dealer

supplying the Un-Odorized LP Gas to the permitholder.(v) Sales or deliveries of un-odorized LP Gasmade pursuant to this Endorsement shall be madeto facilities properly permitted by this Administra-tion only.

(C) The Bulk Delivery Class III A Endorsement.The separate Class III A Bulk Delivery Endorsementto the Class III permit is required if applicable andshall permit the holder to invoice the end user for bulkdelivery of odorized LP Gas to the facility of the enduser only when the LP Gas is delivered to that locationby a Class I permit holder.(D) The annual fee for a Class III permit is $300.The annual fee for the Un-Odorized LP Gas Endorse-ment is $300. The annual fee for the Bulk DeliveryEndorsement is $300.(E) All DOT cylinder transport drivers employedby a Class III permit holder are required to obtain afuel handlers card. The annual filing fee for a fuelhandlers card is Ten Dollars ($10.00).

(4) Class IV - Installer permit.(A) The Class IV Installer Permit permits theholder to install and service LP Gas systems, appli-ances, and other LP Gas equipment. The applicant isrequired to have immediate supervision for two (2)weeks with a Class IV, IV-D, Class X, or a personlicensed by Oklahoma Construction Industries Boardwith a Mechanical License, and then shall be requiredto pass a written examination for each separate en-dorsement. The endorsements will be as follows:

(i) LP, Low Pressure systems covered byNFPA 54;(ii) HP, High Pressure systems covered byNFPA 58;(iii) RV, Recreational Vehicle systems coveredby NFPA 1192;(iv) MC, Meter Calibration systems covered byNIST Handbook 44;(v) TI, Truck Inspections and Piping coveredby NFPA 58 and CFR 49;(vi) DO, Dispenser Operator for Class IV per-mit holders that also dispense propane.

(B) Exception from two (2) week training periodwould be anyone already licensed by Oklahoma Con-struction Industries Board with a Mechanical License.If the supervising person determines that the new ap-plicant is properly trained, proper documentation ofthe training is on file, and a Class IV application hasbeen forwarded to the LP Gas Administration, theapplicant at that time may begin performing the dutiesof a Class IV permit holder until such time as the testis administered and the permit issued. This time shallnot exceed thirty (30) days or the applicant shall ceaseto perform these duties. Current Class IV's, as ofSeptember 1, 1994, are not required to take a writtenexam. Upon renewal, endorsements will be based

on services provided as authorized by the Adminis-trator. The annual fee for a Class IV permit with one(1) endorsement is Seventy Dollars ($70.00). Eachadditional endorsement is Ten Dollars ($10.00).(C) Class IV permit does not permit the holder toinstall or service LP-Gas carburetion systems.(D) Any installer not under the personal and directsupervision of a Class X holder at the immediate timeand location of installation shall be required to have aClass IV or IV-D permit.

(5) Class IV-D - Driver/Installer Permit.(A) The Class IV-D Driver/Installer Permit permitsthe holder to deliver LP Gas by bobtail and installand service LP Gas systems, appliance, and otherLP Gas equipment. Class IV-D permit can only beissued under a Class I permit. New applicants mustbe under immediate supervision from a current ClassIV-D, or Class X while in a minimum of a two (2)week training period before testing. Permit holdershall be required to pass a written examination. Thetests shall be given according to current policies of theLP Gas Administration. If the supervising Class Xdetermines that the new applicant is properly trained,proper documentation of the training is on file, and aClass IV-D application has been forwarded to the LPGas Administration, the applicant at that time maybegin performing the duties of a Class IV-D permitholder until such time as the test is administered andthe permit issued. This time shall not exceed thirty(30) days or the applicant shall cease to performthese duties. Current Class IV permit holders, as ofSeptember 1, 1994, properly trained in delivery ofLP Gas will not be required to take the test and willbe issued a IV-D permit. The annual fee for a ClassIV-D is Fifty Dollars ($50.00).(B) Class IV-D permit does not permit the holder toinstall or service LP Gas carburetion systems.(C) Any installer not under the personal and directsupervision of a Class X holder at the immediate timeand location of installation shall be required to have aClass IV or IV-D permit.

(6) Class VI - DOT Cylinder &/or LP Gas MotorFuel Station Operator Permit.

(A) The Class VI DOT Cylinder and/or LP GasMotor Fuel Station Operator Permit permits theholder to operate DOT cylinder dispensing stationand/or a motor fuel dispenser for public resale. SaidPermit must be prominently displayed for public andofficial inspection at all times. A permit is requiredfor each DOT cylinder dispensing station and/or mo-tor fuel station. The endorsements will be as follows:

(i) AAG, This Attended Autogas "AAG" en-dorsement permits the holder to operate LP Gasdispenser stations that fill DOT cylinders and/orAttended LP Gas motor fuel refueling dispensersfor resale.

(ii) UAG, This Unattended Autogas "UAG"endorsement permits the holder to operate Unat-tended self-service LP Gas motor fuel dispenserstations; however, these installations require morestringent regulations than those that are attended.In addition to the requirements in this section, thepermit holder shall be required to install equipmentthat meets or exceeds the minimum installation andperformance standards described in OAC Section420:10-1-14(28). For the purpose of defraying thecost and expenses of administering and enforcingthis rule, persons, firms and corporations shallpay at the time of initial inspection a fee of ThreeHundred Dollars ($300.00) for each unattended LPGas motor fuel dispenser station. Thereafter, theannual inspection fee is One Hundred Fifty Dollars($150.00) for each unattended LP Gas motor fueldispenser station.

(B) Permit holder is responsible for the safetyof the dispensing operation and training and safetyof the employees dispensing LP Gas.Permit holdermust comply with reasonable training requirementsof the Class 1 and Class 10 manager of the LP Gasprovider insuring that all employees dispensing LPGas at each location of permit holder are trained andpermitted by this agency including notification tothe Class 10 manager whenever training is necessaryfor new and/or unpermitted employees. Class VIlocations may not become operational until a permithas been issued. A Class VI-A LP Gas Dispensingpermit must be secured for the person actually incharge of an LP Gas dispensing operation of a ClassVI permit holder. A permit will not be issued until theproper fee has been paid and certificate of insuranceis received by the LP Gas Administration. The annualfee for a Class VI permit is One Hundred Fifty Dollars($150.00).(C) Un-Odorized LP Gas End User Endorsement.Facilities obtaining un-odorized LP Gas in approvedDOT cylinders or otherwise for use must obtain anUn-Odorized LP Gas End User Endorsement. To ob-tain such an endorsement, detailed plans describingsuch use and location of cylinder storage, and anyand all LP Gas plumbing in said facility must be sub-mitted in writing and approved for any facility usingun-odorized LP Gas in any manner. These plans mustbe submitted to the Administration Office along withthe proper fee, and an on-site inspection must be per-formed by a Safety Code Enforcement Officer priorto final approval and before the introduction of LPGas into the system. A $100.00 plan review fee mustaccompany all plans submitted. The fee for the in-spection is $100.00. The annual fee for the Un-Odor-ized LP Gas End User Endorsement is $500. This en-dorsement must be prominently displayed for officialinspection at any time.

(7) Class VI-A - LP Gas Dispensing Permit. Allemployees involved in dispensing LP Gas must acquire

a Class VI-A permit, except a Class IV, Class IV-D, andClass X. A Class VI-A LP Gas Dispensing permit is re-quired for a person actively in charge of or engaged inLP Gas dispensing operations for the holder of a ClassVI permit. All Class VI-A permit holders must be anemployee of said Class VI permit holder. Class VI-Aapplicants must be properly trained by a Class VI or ClassX or at a Board-approved training class on proper fillingof ASME tanks and DOT cylinders, and inspection thereofper NFPA 58. Applicants shall be required to pass anapproved written examination. Test shall be administeredby a Safety Code Enforcement Officer, or by Class X man-ager. In either case, the test fee for the Class VI-A permitis Ten Dollars ($10.00). Holder must post permit at thefacility they are employed by carry permit and attend theaBoard-approved annual safety school once every year.This does not prohibit any person, firm or corporationfrom filling his own equipment from his own supply line,or dispensing motor fuel from an approved limited accessself-service dispenser. The annual fee for a Class VI-Apermit is Thirty Five Dollars ($35.00).(8) Class VII - Cylinder Exchange Program Permit.The Class VII Cylinder Exchange Program Permit permitsthe holder to participate in the cylinder exchange programfor odorized LP Gas only. A permit is required for eachcylinder exchange location. Class VII locations maynot become operational until a permit has been issued.Permits will not be issued until the proper fee has beenpaid and certificate of insurance is received by the LP GasAdministration. The annual fee for a Class VII permit isFifty Dollars ($50.00).(9) Class IX - LP Gas Container Sales Permit. TheClass IX Gas Container Sales Permit permits the holder tomanufacture and/or sell LP Gas containers. This permit isrequired by both wholesalers and retailer. The annual feefor a Class IX permit is Seventy Dollars ($70.00).(10) Class IX-A - Manufactured Homes and Recre-ation Sales Permit.

(A) The Class IX-A Manufactured Homes andRecreation Sales Permit permits the holder to man-ufacture, fabricate and sell all LP Gas facilities orsystems used in manufactured homes, campers, recre-ational vehicles and portable buildings whether suchLP Gas system is manufactured, fabricated or soldseparately or as an integral part of such trailer, camper,recreational vehicle or portable building. The annualfee for a Class IX-A is Seventy Dollars ($70.00).(B) This shall not be construed to require a permitfor a sale by the owner of a manufactured home orrecreational vehicle who is not engaged in such busi-ness on a commercial basis and does not make overtwo such sales in one year.

(11) Class X - Manager's Permit.(A) A Class X Manager's permit is required fora person actively in charge of LP Gas operation forholder of Class I permit and at each separate branchor base of operation of a Class I permit. All Class Xholders must be a full-time employee of said Class

I holder. The annual fee for a Class X permit is OneHundred Fifty Dollars ($150.00).(B) Before testing for a Class X permit, an ap-plicant must meet the following requirements asapproved by the Board:

(i) Hold an active Class IV or Class IV-D per-mit and employed under an active Class I Dealerfor a minimum of three (3) years or equivalent; and(ii) One (1) year of the minimum three (3)years required experience can be satisfied withforty (40) hours of specified training.

(C) Temporary exemptions for emergency condi-tions can be granted by the Administrator.

(12) Additional permits required for employees ofClass I dealers. Class IV, IV-D, VI-A, and X permits arethe only additional permits that may be required for theemployees of a Class I dealer, or as may be required byfuture Board action.(13) LP Gas Trailer, Bobtail or Cargo Tank inspec-tions. For the purpose of defraying the cost and expensesof administering and enforcing this act, persons, firmsand corporations shall also pay at the time of inspectionan annual inspection fee of One Hundred Fifty Dollars($150.00) for each LP Gas bobtail, MC 330 or MC 331trailer or cargo tank that transports LP Gas in this State.All requirements imposed subsequent to these inspectionsmust be met within thirty (30) days of the initial inspec-tion. Failure to comply will necessitate a re-inspection ata charge of One Hundred Fifty Dollars ($150.00) for eachinspection. The inspection fee shall increase to ThreeHundred Dollars ($300.00) for each LP Gas bobtail, MC330 or MC 331 trailer or cargo tank that transports LPGas in this State if said LP Gas bobtail, MC 330 or MC331 trailer or cargo tank is not initially inspected withinsixty (60) days following the current permit expirationdate, or if requirements imposed subsequent to the initialinspection are not completed within sixty (60) days of theinitial inspection, whichever is later, or at the discretion ofthe Administrator.(14) Containers or cylinders. There is hereby leviedthe following fee, to be paid to the Administrator, uponall first sales, purchases, rentals or uses in this state ofliquefied petroleum gas containers or cylinders; on allDepartment of Transportation (DOT) cylinders, vehiclefuel containers, a fee of Three Dollars ($3.00) each, and onall other containers, a fee of Ten Dollars ($10.00) each.

420:10-1-8. Processing and handling of applicationsand examinations

(a) Scheduling. Upon the receipt of an application for apermit for Class I or Class X permit the Board or Administratorshall schedule the applicant provided therein for examinationat the next periodic written examination, unless the applicationbe filed less than 30 days prior to the next scheduled writtenexamination.(b) Passing score. A score of 80% correct shall be a passinggrade for all examinations.(c) Examinations.

(1) Class I examination. Questions for a Class I ex-amination shall be selected at random from a reservoir ofquestions consisting of no less than 500 questions but nomore than 1000 questions. Questions shall be of four-part,multiple choice. Prior to being placed in the reservoir thequestions shall be reviewed by the Administrator and ap-proved by the Board. For each examination a total of 150questions shall be drawn from the reservoir. All applicantssitting at one time shall receive identical examinations.Questions shall be from NFPA pamphlets 58 and 54 andrules and regulations promulgated by the Board. All ex-ams shall be coded in such a manner that identity of theapplicant shall be unknown to the grading authority.(2) Qualified Managers examination. Questionsfor a Class X Qualified Managers Examination shall beselected at random from a reservoir of questions con-sisting of no less than 500 questions but no more than1000 questions. Questions shall be of four-part, multiplechoice. Prior to being placed in the reservoir the questionsshall be reviewed by the Administrator and approved bythe Board. For each examination a total of 100 questionsshall be drawn from the reservoir. All applicants sitting atone time shall receive identical examinations. Questionsshall be from NFPA pamphlets 58 and 54 and rules andregulations promulgated by the Board. All exams shall becoded in such a manner that identity of the applicant shallbe unknown to the grading authority.(3) Class IV and IV-D examinations. Class, IV andIV-D examinations consist of standardized examinations.Class IV examinations will consist of 50 questions andClass IV-D exam will consist of 75 questions, each to beprepared by the Administrator.(4) Class II, III, VI-A, VII examinations. ClassII, III, VI-A, and VII examinations shall be standardconcerning basics of safety and handling of LP Gas. Theexamination to be prepared by the Administrator.

(d) Applicant information.(1) All applicants for the same type permit sitting at anyone time shall receive identical examinations.(2) All applications and examinations except Class Iand Class X shall be scheduled by the Administrator atsuch times as he may deem appropriate.(3) Applicants may review their examination papers atthe Administration Office within 30 days after examina-tion date.

420:10-1-14. Standards for the storage and handling ofliquefied petroleum gas

(a) NFPA standards. The standards for the storage andhandling of liquefied petroleum gases adopted by the NationalFire Protection Association and published in its pamphlets No.58, and the standards for the installation of gas appliances andgas piping adopted by said National Fire Protection Associa-tion published in its pamphlet No. 54 have been adopted bythe Legislature in 52 O.S. 1991, Section 402.3 (e) and shallbe accepted standards for the State of Oklahoma. All Class Ipermit holders must have a current copy of NFPA 58 and 54 onfile at each separate branch.

(b) Supplemental standards. The following standards aresupplemental to NFPA pamphlet No. 58 and shall be part ofthe rules and regulations of the Oklahoma Liquefied PetroleumGas Board:

(1) Definitions.(A) The word "approved" as used in this sectionmeans acceptable to the State Liquefied PetroleumGas Administrator. A device or system having ma-terials or forms different from those detailed in thissection may be examined and tested according to theintent of the regulations and if found equivalent, maybe approved.(B) In this section those provisions which are con-sidered essential for adequate protection of life andproperty from fire are indicated by the words "shall"and "must". The words "should" or "preferably" indi-cate advisory provisions concerning which the StateLiquefied Petroleum Gas Administrator of Oklahomashould be consulted.(C) In each place mentioned in NFPA No. 54 andNFPA No. 58 where it refers to "the authority havingjurisdiction" this would mean the Liquefied Petro-leum Gas Administrator.(D) An "important building" shall be any building,open to the public, or inhabited by people, in whichany LP Gas system or any type is installed

(2) Submittal of plans.(A) Prior to the installation of new, or the modifi-cation of liquefied petroleum gas plumbing systems,excluding tank change outs, in school buildings,churches, courthouses, office building and otherbuilding to which the public is invited, such as cafes,dance halls, tourist courts and parks, plans and spec-ifications for such installation in duplicate, shall besubmitted to, and approved, by the State LiquefiedPetroleum Gas Administrator, and before such sys-tems are filled with liquefied petroleum gas, they shallbe physically inspected and approved by a licensedinstaller and a report made by him to the State Lique-fied Petroleum Gas Administrator on LPG Form 4, orits revision, furnished by the LP Gas Administrator'soffice.(B) Plans must be submitted and approved on anydispenser used to fill DOT cylinders and/or ASMEcontainers, and used for public resale of LP Gas, in-cluding unattended self-service LP Gas motor fueldispenser stations. These plans must be submitted bya Class I permit holder to the Administration officealong with the proper fee, and an onsite inspectionmust be performed by a Safety Code EnforcementOfficer prior to final approval and before the dis-penser can be placed into service. A One HundredDollar ($100.00) plan review fee must accompany alldispenser plans submitted. If a dispenser is taken outof service, written notice must be given to the Admin-istration office within seven (7) working days. If adispenser is moved to a new location, new plans must

be submitted to the Administrator and onsite inspec-tion performed by a Safety Code Enforcement Officerprior to final approval and dispenser being placed intoservice. A complete list of dispensers by locationshall be submitted to the LP Gas Administration asindicated on Class I permit renewal forms.(C) Plans must be submitted to, and approved, bythe Administrator on any fixed installation with in-dividual water capacity of 2,000 gallons or more, oraggregate water capacity exceeding 4,000 gallons.(D) Plans must be submitted and approved for anyfacility using Un-Odorized LP Gas in any manner anda permit endorsement must be obtained pursuant to420:10-1-5(b)(6)(C). These plans must be submittedto the Administration Office by the permit holder orapplicant proposing to service such facility with prod-uct along with the proper fee. An on-site inspectionmust be performed by a Safety Code Enforcement Of-ficer of the LP system prior to final approval and be-fore the introduction of LP Gas and the system placedinto service. A $100 plan review fee must accom-pany all plans submitted. The final inspection fee is$100.00.

(3) Report of accident. In case of accident or fire atany location where a liquefied petroleum gas system orequipment is involved, or any accident involving liquefiedpetroleum gas systems or equipment, the dealer owning,operating or servicing the equipment or installation shallnotify the State Liquefied Petroleum Gas Administrator.This notification shall be forwarded as soon as feasiblypossible after the dealer has knowledge of the accident inorder that an inspection may be made by the State Lique-fied Petroleum Gas Administrator before the site has beendisturbed(4) Piping - including pipe, tubing and fittings.

(A) No person, firm, or corporation shall connecta liquefied petroleum gas tank to any piping withouthaving first determined that such piping complieswith the laws of the State of Oklahoma and the rulesand regulations of the State Liquefied Petroleum GasAdministrator relative to liquefied petroleum gaspiping.(B) All installations, installed after July 1, 2002, ofstorage containers, with more than 4,000 gallon watercapacity, shall have internal valves installed as perNFPA 58.(C) On installations of stationary or portable stor-age, with an aggregate of more than 4,000 gallonwater capacity, a bulkhead approved by the LP GasAdministrator shall be required on each liquid line ofone and one-half (1-1/2) inch or larger and each vaporline of one and one-quarter (1-1/4) inch or larger.

(5) Vaporizers and housings.(A) The minimum capacity of the storage containerfeeding the vaporizer shall not be less than ten (10)times the hourly capacity of the vaporizer in gallons.(B) The minimum capacity of a storage containerbeing heated by a direct fired tank heater shall not be

less than ten (10) times the hourly vaporizing capacityof the tank heater in gallons.

(6) Liquid metering systems. Each bulk retail deliv-ery of liquid LP Gas shall be measured by a suitable LPGas liquid meter system, except those deliveries of liquidLP Gas in cylinders which are filled by weight, deliveriesof LP Gas vapor through vapor meters and a delivery of afull transport load from the terminal to the end-user witha bill of lading, are exempt from the requirements of thisparagraph.

(A) LP Gas Liquid meters shall indicate deliveriesin terms of gallons and to the nearest tenth of a gallon.(B) The LP Gas liquid meter shall meet, in addi-tion to the other requirements of this paragraph, thefollowing requirements:

(i) The system shall include a device (such asa differential back-pressure regulator) so designedand installed that the product being measured willremain in a liquid state during passage through themeter.(ii) No means shall be provided by which anymeasured liquid can be diverted from the measur-ing chamber, differential valve equipment or thedischarge line therefrom.(iii) Effective January 1, 1994, in accordancewith the National Institute of Standards and Tech-nology (NIST) Handbook 44, all LP Gas Liquidmeters used for bulk delivery shall be designedwith the necessary equipment for mechanicallyprinting gallons on a delivery ticket and the cus-tomer served thereby shall be given a ticket me-chanically imprinted by the printing device. Thecustomer's name and Class I Dealer's name mustbe included on the metered ticket. Meters usedfor stationary dispensing of motor fuel will not berequired to be equipped with such printing device.(iv) All bulk metered sales of propane, viabobtail or transport, shall be made by temperaturecompensated measure. Except, any truck now op-erating without a temperature compensation metershall be retrofitted by no later than July 1, 2003.

(C) All meters where product is sold to the pub-lic must be proved annually by an approved metertester/inspector and have written certification on fileat permit holders place of business. All meters andtemperature compensators must be accurate withinthe manufacturers tolerance not to exceed + or -1%at any time. The LP Gas liquid meter system shallbe designed and constructed to provide for applyinglead-and-wire seals in such a manner that no mod-ifications or adjustments which would affect theaccuracy of deliveries, can be made without mutilat-ing the seal or seals. If a seal is broken, notificationmust be made to the Administrator and resealed by aSafety Code Enforcement Officer, an approved metertester, or a person approved by the Administrator.In addition, the Administrator at his discretion may

require proving of metering system to determine theaccuracy.(D) No dealer or firm controlled or affiliated with adealer may calibrate or certify its own meters. All me-ters must be tested with a volumetric meter prover.

(7) Qualified personnel. Each holder of an LP Gaspermit shall be responsible for having qualified personneloperating and installing LP Gas equipment.(8) Filling unsafe or unapproved dispensing or stor-age tanks prohibited. No person, firm, or corporationshall introduce liquefied petroleum gas into a dispensingor storage tank in the State with knowledge that suchdispensing or storage tank or piping is known to be in anunsafe operating condition.(9) Basement installations. No appliance shall beinstalled in any basement or semi-basement unless it isfully automatically controlled and properly vented andmust have the approval of the State Liquefied PetroleumGas Administrator.(10) Standards for containers.

(A) In accordance with 52 O.S. Sec. 420.5, all firstsales, rentals, purchases or uses of DOT cylindersand ASME tanks in this State, must have OklahomaIdentification tags attached to such cylinders or tanks.However, all DOT cylinders and ASME tanks in Ok-lahoma, with a manufacturers date prior to September1, 1993, are not required to have Oklahoma Identifi-cation tags. These Oklahoma Identification tags arenot transferable from one cylinder or tank to another.(B) Any new container sold or installed in Ok-lahoma for use in this State shall carry a five yearwarranty covering workmanship and material. Thiswarranty shall provide that any container not in com-pliance with this regulation must be repaired or re-placed by the fabricator at no expense to the dealer orcustomer. This provision is to take care of "pin-hole"leaks in the weld that were not detected at the time offabrication and does not apply to fittings.(C) Containers shall be filled or used only uponauthorization of the fee simple owner. The name ofthe fee simple owner, if other than the consumer, shallbe conspicuously shown on the container.(D) Any stationary storage container convertedfrom anhydrous ammonia to propane shall be con-verted as follows:

(i) The container shall be purged of anhy-drous ammonia by water flooding, steam or othermethods described by the National Propane GasAssociation's (NPGA) Recommendation for Pre-vention of Ammonia Contamination; and(ii) It shall then be properly purged withpropane vapor and tested with the red litmuspaper as described in NFPA 58 or by any other testapproved by the Board; and(iii) The test shall be completed by the permitholder that performs the conversion; and

(iv) The results shall be documented and shallcontain the container manufacturer, water ca-pacity, serial number, the results of the test, thecapacity of the relief valve, the date of the test, andthe signature of the permit holder conducting thetest. A copy of the results shall be provided to theowner of the container; and(v) Any dealer filling a converted anhydrousammonia container for the first time shall either beprovided a copy of the test or complete the test asdescribed above; and(vi) The container shall meet all requirementsof NFPA 58.

(11) Underground containers.(A) Underground containers before being rein-stalled must be inspected by the State LiquefiedPetroleum Gas Administrator, and a fee of One Hun-dred Dollars ($100.00) paid to the State LiquefiedPetroleum Gas Administrator's office, and reinstalledby a licensed LP Gas installer.(B) Underground containers shall be dug up at theexpense of the owner at any time at the discretion ofthe State Liquefied Petroleum Gas Administrator.(C) Prior to performing an installation of an un-derground container a person must complete Boardapproved Cathodic Protection training.

(12) Minimum storage. All new Class I permit holdersmust provide bulk propane storage capacity of not lessthan an aggregate of 18,000 water gallons. The mini-mum storage must be maintained and operational, withinstallation approved by the authority having jurisdic-tion, and within a fifty (50) mile radius of the corporateoffice or branch location. The minimum storage shall beconsidered maintained if the area meets the requirementsof NFPA 58, the rules and regulations established by theBoard and is kept reasonably clear of long, dry grass,weeds, debris, and any other combustible material. Anyexceptions to the minimum storage requirement maybe granted by the Board. Current active Class I permitholders, as of September 1, 1994, are not required to meetthis minimum storage requirement. After a change ofownership the new Class I permit holder must secure theminimum storage requirement within one year.(13) Painting. All bulk storage containers of a capacity120 gallons water capacity or greater shall be painted aheat reflection color.(14) Lettering bulk storage and dispensers.

(A) All bulk storage 2,000 gallons and above shallbe lettered with the name of the contents, such as LPGas, butane, propane, and a "No Smoking" sign inletters not less than six (6) inches high.(B) In addition to subparagraph (A) of this para-graph, all bulk storage used for loading and unloadingfacilities, and all container filling storages (dis-pensers) shall include the name of the person, firm,or corporation operating the bulk storage or dispenserand their phone number in letters not less than two (2)

inches high. This information shall be placed so as tobe readily visible to the public.(C) For all size bulk storage containers the nameof the fee simple owners, if other than the consumer,shall be conspicuously shown on the container.

(15) Extinguishers required. Extinguishers of the drychemical type, with a B:C or A:B:C rating, are required.Extinguishers shall have a net content of not less than thecurrent NFPA 58 requirements and shall be inspected atleast once each year by an authorized inspector such asFire Departments or Fire Appliance Company represen-tatives. Current weatherproof inspection tags shall beattached to the extinguisher.(16) Marking cargo vehicles. Every tank vehicle usedfor transportation of liquefied petroleum gas shall bemarked and placarded according to current DOT require-ments. Each tank vehicle must also have the name of theperson, firm or corporation on each side of the cargo tankin letters a minimum of two (2) inches in height. Thisinformation shall be placed so as to be readily visible tothe public. This name shall be the same as permit holderhas designated on the Class I or Class II permit.(17) Parking and garaging LP gas tank vehicles. Anytank vehicle used for transportation of Liquefied petro-leum gas shall not be parked beneath or adjacent to anyelectric transmission line in such position that there is apossibility of a conductor contacting the tank in event ofbreakage.(18) Filling unapproved truck, trailer or cargo tanksprohibited.

(A) An inspection form, when properly completed,and a LPG registration decal (the serial number ofwhich is shown on the inspection form), shall be ev-idence that the liquefied petroleum gas truck, traileror cargo tank described on the inspection form by itsserial number has been approved by the LiquefiedPetroleum Gas Administrator for use in the trans-portation of liquefied petroleum gas. Such LPGregistration decal and inspection form also shall au-thorize the person, firm or corporation whose nameappears on the inspection form or its bona fide em-ployees to operate the truck or trailer tank describedon the inspection form, and further shall authorizethe filling of such truck, trailer or cargo tank withliquefied petroleum gas.(B) The LPG registration decal shall be displayedat all times in an easily visible location on the leftfront of the cargo tank, which is on the driver's side.A copy of the inspection form shall be retained, untilthe expiration date, in the office of the person, firm orcorporation whose name appears thereon. It will notbe necessary to keep or display a copy of the inspec-tion form on the truck, trailer or cargo tank.(C) No person, firm or corporation shall operate atruck, trailer or cargo tank in the transportation of liq-uefied petroleum gas in this State unless such person,firm or corporation has been issued a LPG registrationdecal and an inspection form certifying that such tank

has been registered with and approved by the StateLiquefied Petroleum Gas Administrator, or unless itsoperation has been specifically approved by a com-munication from the State Liquefied Petroleum GasAdministrator.(D) The LPG registration decal and the inspectionform required in this paragraph are not transferableby the person, firm or corporation to whom they areissued or from one truck, trailer or cargo tank to an-other, and they are not to be used after the expirationdate of the fiscal year for which they were issued, orin the event the Class I permit becomes inactive.

(19) Vaporizers. Exhaust gases shall not be used as a di-rect means of heat supply for the vaporization of fuel.(20) Stationary engines in building.

(A) All engine rooms shall be well ventilated at thefloor level.(B) When engines are installed below grade level,suitable floor level mechanical exhaust ventilationshall be provided and operated continuously or ad-equate means shall be provided to purge the roombefore the engine is started. In any case the mechani-cal ventilation shall be in operation when the engine isrunning. Before and during any repairs to the enginethe room shall be ventilated.(C) Automatic fire doors shall be provided at open-ings in the engine room that open into other sectionsof the building.(D) Exhaust gases shall be discharged outside thebuilding in a manner that will not create a fire or anyother hazard.(E) Regulators and pressure relief valves installedin buildings and engine rooms shall be vented to theoutside and discharge at least five feet away from anybuilding opening. Such venting will not be requiredfor combination engine fuel vaporizing - fuel reduc-ing - fuel metering devices providing an acceptableautomatic shut-off valve is installed immediatelyahead of such devices.

(21) Storage outside of buildings. Valves and safety re-lief devices shall be protected against accumulations of iceand snow. Protective caps shall be deemed adequate.(22) Appliances. Any mobile home, travel trailer,camper or recreational vehicle shall be delivered to thebuying public by the permit holder with the system prop-erly installed and free of leaks.(23) Maximum vapor pressure and container work-ing pressure.

(A) The maximum vapor pressure of the product at100 degree Fahrenheit which may be transferred to acontainer shall not exceed the design working pres-sure of the container. Exception: 200 psig ASMEworking pressure vessels in LP Gas service in Okla-homa prior to January 1, 1994, may be continued inservice for commercial propane, provided that theyare fitted with relief valves and meet the start-to-leaksetting in relation to the design pressure of the con-tainer, shall be in accordance with NFPA 58. purpose of this exception, "commercial propane" isdefined as having a vapor pressure not in excess of210 psig at 100 degree Fahrenheit. This exceptiondoes not apply to LP Gas motor fuel and mobile fuelcontainers.(B) Any stationary 200 psig ASME containersbrought into Oklahoma from out of state and intendedfor stationary LP Gas installation in Oklahoma at anyfacility requiring submission of plans and specifica-tion must be tested by at least two (2) of the followingnondestructive test methods recognized by ASME todetermine if the container or assembly is safe for LPGas use in Oklahoma. The following test results mustbe submitted to the Oklahoma LP Gas Administrationfor approval.

(i) Hydrostatic Test;(ii) Ultrasonic thickness test;(iii) Wet particle fluorescent or magnaflux.

(24) Testing, leakage and visual inspection, and me-ter calibration.

(A) Hydrostatic testers operating in Oklahoma thatare hydrostatic testing cargo containers for LP Gasuse in Oklahoma must be approved by the OklahomaLP Gas Board and shall:

(i) Hold a Federal C.T. number;(ii) Include in their testing the use of a cali-brated pressure chart recorder;(iii) Hold a Class IV installer permit.

(B) Leakage and visual inspectors operating inOklahoma and performing this inspection on cargocontainers and their systems for LP Gas use in Ok-lahoma must be approved by the Oklahoma LP GasBoard and meet the following requirements:

(i) Inspectors shall hold a Federal C.T. num-ber;(ii) If the inspection includes repairs that re-quire the LP Gas system to be re-plumbed, a ClassIV permit is required.

(C) Meter calibrators operating in Oklahoma thatare calibrating meters for LP Gas use in Oklahomamust be approved by the Oklahoma LP Gas Board andmeet the following requirements:

(i) Meters shall be tested in accordanceto Oklahoma Rules and Regulations, Section420:10-1-14(7);(ii) Meter calibrators shall furnish the meterowner a copy of the calibration showing the cor-rect gear numbers and temperature compensatorsettings;(iii) Meter calibration results shall be on a formapproved by the LP Gas Administrator and a copyof the completed form shall be furnished to the me-ter owner:(iv) Meter calibrators shall hold a Class IV per-mit.(v) Meter calibration testers shall test metersaccording to National Institute of Standards andTechnology (NIST) standards.

(25) Cylinder exchange stations.(A) Cylinder exchange cabinets shall be con-structed as per NFPA 58.(B) The cabinet shall have the following signs af-fixed to it and readily visible to the public:

(i) "Propane" or "Flammable Gas" and "NoSmoking" in letters not less than two (2) incheshigh;(ii) "Net Weight ___ lbs." with the net weightof the cylinders to be specified, all of which shallbe displayed on the front of the cabinet in lettersnot less than two (2) inches high;(iii) Name of Class I permit holder who sup-plies the cylinders;(iv) 24-hour Emergency telephone number.

(C) The cabinet shall be located for distance andnumber of cylinders as per NFPA 58.(D) The cylinder storage area shall be kept freeof wood, debris and other combustible/flammablematerial not necessary to the storage for a distance often (10) feet, not to include the construction materialsof the building itself.(E) Protection against vehicle impact shall be pro-vided in accordance with good engineering practicewhere vehicle traffic normally is expected at the loca-tion as per NFPA 58.(F) A fire extinguisher shall be provided as perNFPA 58(G) A warning sign shall be posted at or near anyentrance doorway stating the "LP GAS EXCHANGECYLINDERS EMPTY OR FULL SHALL NOT BETAKEN INDOORS FOR ANY REASON."(H) The Class I permit holder shall provide safetytraining materials to the Class VII permit holder. TheClass VII permit holder is responsible for provid-ing appropriate safety information to the individualexchanging the cylinder. This documentation oftraining will be kept by the Class VII permit holder atthe Class VII location.(I) Automated cylinder exchange cabinets thatinclude an automated vending system for exchangingcylinders shall comply with the following additionalrequirements:

(i) Electrical equipment installed in cylinderstorage compartments shall comply with the re-quirements for Class I, Division 2 equipment inaccordance with NFPA 70, National ElectricalCode;(ii) Cabinets shall be designed such that cylin-ders can be placed inside only in the upright posi-tion;(iii) Door releases for access to stored cylindersshall be permitted to be pneumatic, mechanical orelectrically powered;(iv) A manual override control shall be permit-ted for use by authorized personnel;(v) The vending system shall not be capableof returning to automatic operation after a manual

override until the system has been inspected andreset by authorized personnel.

(J) A Class I permit shall be required in order tosupply exchange cylinders for the cylinder exchangepermit holder.(K) A busy sidewalk and thoroughfare, as refer-enced in NFPA 58, shall be further defined as notbeing located on private property. A busy sidewalk isalongside a public road and a thoroughfare is a publicroad.

(26) Recreational vehicles. Installations or repairson LP Gas systems on recreational vehicles shall be per-formed as per NFPA 1192, Standard on RecreationalVehicles.(27) Minimum installation and performance stan-dards of unattended self-service LP Gas motor fuel dis-penser stations.

(A) Unattended self-service LP Gas motor fuel dis-penser stations shall meet the applicable sections ofthe rules and regulations of the Oklahoma LiquefiedPetroleum Gas Board and NFPA 58.(B) Any unattended self-service LP Gas motor fueldispenser shall also meet all Alternative Provisionsfor Installations of ASME containers found in NFPA58 regardless of tank size. This includes RedundantFail Safe Product Control and Low Emission Transferrequirements.(C) The delivery valve and nozzle combinationshall be designed, installed, and operated, so that LPGas will not be released unless the valve is correctlyattached to the filler coupling on the receiving valveof the LP Gas motor fuel container.(D) To maintain minimum performance standards,the following shall be considered minimum systemperformance requirements:

(i) Dispensing rate minimum of eight (8)gallons per minute (GPM) per manufacturer'sspecifications;(ii) Vehicle fueling area, ground where vehicleis parked, shall be reasonably level to allow forcomplete fuel fills.

(E) The dispenser shall have the following signs af-fixed to the dispenser and readily visible to the public:

(i) Step by step operating instructions, ap-proved in advance by the Administrator;(ii) A warning sign(s) stating, "WARNING,STATE LAW PROHIBITS FILLING ANYPORTABLE DOT CONTAINERS AT THISDISPENSER" and "All vehicles refueling at thisdispenser must have an appropriate ASME con-tainer fitted with an operational OPD valve" inletters not less than two (2) inches high;(iii) Proper name of LP Gas being dispensed, asspecified by federal regulations at CFR-Title 49, inletters not less than two (2) inches high;(iv) "No Smoking" in letters not less than two(2) inches high;

(v) 24-hour emergency telephone number inletters not less than two (2) inches high;(vi) Name of the Class 1 permit holder thatservices the dispenser, in letters not less than two(2) inches high.

420:10-1-16. Training schools(a) Safety schools for Class I dealers and X managers.It shall be the continuing responsibility of all Class I holders,including Sole Proprietorships and Class X permit holdersto attend a Board sanctioned management safety seminar atleast once every two years. Seminars shall be available atleast annually, with biennial attendance a requisite for licenserenewals.(b) Safety school for fuel handling personnel. Class IV,IV-D, VI, and VI-A, and X permit holders must attend a Boardsponsored or sanctioned safety school at least once a year.

(1) Schools will be held at least annually at such timesand places as may be deemed advisable. It shall be theadministration policy to make available regional schoolsfor the convenience of the industry.(2) Such schools in no way relieve the dealer of the re-sponsibility of training new employees adequately throughon the job training.(3) A fuel handlers card is required for all LP Gas trans-port drivers to demonstrate their qualifications per CFR 49requirements for transporting LP Gas.

(c) Compliance. Failure to comply with this section shallbe cause for suspension or revocation of the permit underwhich such person, firm or corporation might be operating.

420:10-1-18. Insurance requirementsInsurance pursuant to the provisions of this section shall

be maintained in full force and effect during the operation ofthe business for which the coverage was issued. Except as oth-erwise provided for in this section, no registration permit shallbe issued until said certificate is filed with the Administrator.No insurance coverage shall be canceled or terminated withoutthirty (30) days prior written notice of cancellation or termi-nation to the Administrator. The following are the minimuminsurance requirements for LP Gas permit holders licensed bythe State of Oklahoma

(1) Class I - Dealer Permit.(A) General liability, Bodily Injury, PropertyDamage, including products and completed opera-tions liability coverage shall be obtained as follows:$1,000,000 per occurrence; $1,00,000 aggregate.(B) Motor vehicle insurance must meet State andFederal requirements.(C) Workers' compensation insurance shall be ob-tained as required by Oklahoma State statutes.

(2) Class II - Truck Transporter Permit.(A) General liability, Bodily Injury, PropertyDamage, including products and completed opera-tions liability coverage shall be obtained as follows:$1,000,000 per occurrence; $1,000,000 aggregate.

(3) Class III - DOT Cylinder Transporter Permit.(A) General liability, Bodily Injury, PropertyDamage, including products and completed opera-tions liability coverage shall be obtained as follows:$1,000,000 per occurrence; $1,000,000 aggregate.(B) Motor vehicle insurance must meet State andFederal requirements.(C) Workers' compensation insurance shall be ob-tained as required by Oklahoma State statutes.

(4) Class IV - Installer Permit.(A) General liability, Bodily Injury, PropertyDamage, including products and completed opera-tions liability coverage shall be obtained as follows:$50,000 $500,000 per occurrence; $50,000 $500,000aggregate.(B) Workers' compensation insurance shall be ob-tained as required by Oklahoma State statutes.

(5) Class IV -D - Driver/Installer Permit. The ClassIV-D permit is only issued in conjunction with the ClassI permit; therefore, the insurance coverage of the Class Ipermit holder will cover the Class IV-D permit holder.(6) Class VI - DOT Cylinder &/or LP Gas MotorFuel Station Operation Permit.

(A) General liability, Bodily Injury, Property Dam-age, including products and completed operations lia-bility coverage shall be obtained as follows: $100,000per occurrence; $100,000 aggregate.(B) Workers' compensation insurance shall be ob-tained as required by Oklahoma State statutes.

(7) Class VI-A - LP Gas Dispensing Permit. TheClass VI-A permit is only issued in conjunction with theClass I, II, III, VI and/or VII permit; therefore, the insur-ance coverage of the Class I, II, III, VI and/or VII permitholder will cover the Class VI-A permit holder.

(8) Class VII - Cylinder Exchange Program Permit.(A) General liability, Bodily Injury, Property Dam-age, including products and completed operations lia-bility coverage shall be obtained as follows: $25,000per occurrence; $25,000 aggregate.(B) Workers' compensation insurance shall be ob-tained as required by Oklahoma State statutes.

(9) Class IX - LP Gas Container Sales Permit.(A) General liability, Bodily Injury, PropertyDamage, including products and completed opera-tions liability coverage shall be obtained as follows:$25,000 per occurrence; $25,000 aggregate. Thisinsurance coverage is only necessary when the permitholder engages in manufacturing and/or installing LPGas containers.(B) Workers' compensation insurance shall be ob-tained as required by Oklahoma State statutes.

(10) Class IX-A - Manufactured Homes and Recre-ation Sales Permit.

(A) General liability, Bodily Injury, PropertyDamage, including products and completed opera-tions liability coverage shall be obtained as follows:$25,000 per occurrence; $25,000 aggregate. Thisinsurance coverage is only necessary when the per-mit holder engages in manufacturing, fabrication orinstallation of LP Gas systems.(B) Workers' compensation insurance shall be ob-tained as required by Oklahoma State statutes.

(11) Class X - Manager's Permit. The Class X permitis only issued in conjunction with the Class I permit; there-fore, the insurance coverage of the Class I permit holderwill cover the Class X permit holder.
