THE OKLAHOMA REGISTER is an official publication of the State of Oklahoma. It is published semi-monthly onthe first working day of the month and on the first working day following the 14th day of the month under the authorityof 75 O.S., Sections 250 et seq. and OAC 655:10-15-1. The rules of the State of Oklahoma are codified and publishedin the Oklahoma Administrative Code.
The Oklahoma Register and the documents submitted for publication are AVAILABLE FOR PUBLICINSPECTION at the Office of Administrative Rules pursuant to the Oklahoma Open Records Act. Notices of Rulemaking Intent
SUMMARY:The Department of Environmental Quality (DEQ) is
proposing amendments to Subchapter 5, Registration,Emission Inventory and Annual Operating Fees, that wouldincrease the annual operating fees for stationary sources thatemit hazardous air pollutants (HAP) regulated under Section112 of the Federal Clean Air Act, toxic air contaminants(TAC) as listed in proposed Appendix O, and volatileorganic compounds (VOC) as defined in OAC 252:100-1-3,252:100-37-2 and 252:100-39-2. The proposed rule willestablish groups for classifying regulated air pollutants forfee purposes only. The proposed fee increase should generateapproximately $835,000 and will be used to fund the toxicsprogram proposed in 252:100-42. Should adequate funding beobtained from other sources, such as general appropriations,DEQ will not pursue an additional toxics fee.
DEQ is proposing to redefine the state air toxics program.Amendments are proposed to Subchapter 41, Controlof Emission of Hazardous Air Pollutants and Toxic AirContaminants, to partition existing Subchapter 41 intotwo subchapters. The proposed amendments will clarifyand modify the state-only requirements for emissions fromstationary sources, and relocate these requirements into thenew Subchapter 42. Subchapter 41 will contain the federalrequirements for HAP and asbestos. Two new sections wouldbe added to Part 3 as 252:100-41-3 and 252:100-41-4.
The program proposed in Subchapter 42 intends toprovide a more effective approach to the control of TAC,while continuing to protect the public and environmentfrom the potentially harmful effects of TAC. When ambientair monitoring indicates that a TAC Maximum AcceptableAmbient Concentration (MAAC) Action Level is exceeded insuch a way as to endanger the public health, DEQ may proposeand then may designate an Area of Concern (AOC). After afinal designation, DEQ shall develop a strategy for bringingthe ambient air concentration of the TAC in the AOC under theTAC MAAC.
Proposed Appendix O, "Toxic Air Contaminants (TAC)Maximum Acceptable Ambient Concentrations (MAAC)",includes substances that are considered toxic and harmful tohuman health, are emitted within the State of Oklahoma, andare able to be monitored at the proposed ambient standardlevels with available technology. Appendix O was establishedusing the United States Environmental Protection Agency's(EPA) Residual Risk Report to Congress, which includesinformation on risk assessment and the risk managementprocess. The EPA's IRIS database was used to gather humanhealth affects information for each substance in Appendix O.
Additional funding will be required in order for theproposed air toxics program set forth in Subchapter 42 tobe implemented. If Subchapter 42 is not approved, or if newfunding is not provided, DEQ will maintain the toxics programas it currently exists in Subchapter 41. If Subchapter 42 isapproved but not funded, DEQ will ask that the Subchapterbe revoked before it goes into effect. Language is includedin Subchapter 42 stating that when effective, Subchapter 42
supersedes all of Subchapter 41 except for Part 3. Languageis included in Subchapter 41 stating that the Subchapter willonly remain effective if Subchapter 42 does not supersede it.Language is also included in Subchapter 41 stating that Part 3will not be superseded.
DEQ proposes to submit Subchapter 42 to the EPA forinclusion in the Oklahoma SIP. This hearing shall also serve asthe public hearing to receive comments concerning proposedrevisions to the SIP under the requirements of 40 Code ofFederal Regulations (CFR) § 51.102 of the EPA regulationsconcerning the SIPs and 27A O.S. § 2-5-107(6)(c).AUTHORITY:

Emergency AdoptionsAn agency may adopt new rules, or amendments to or revocations of existing rules, on an emergency basis if the agency
determines that "an imminent peril exists to the preservation of the public health, safety, or welfare, or that a compelling public interestrequires an emergency rule[s] . . . . [A]n agency may promulgate, at any time, any such [emergency] rule[s], provided the Governorfirst approves such rule[s]" [75 O.S., Section 253(A)].
An emergency action is effective immediately upon approval by the Governor or on a later date specified by the agency in thepreamble of the emergency rule document. An emergency rule expires on July 15 after the next regular legislative session followingpromulgation, or on an earlier date specified by the agency, if not already superseded by a permanent rule or terminated throughlegislative action as described in 75 O.S., Section 253(H)(2).
Emergency rules are not published in the Oklahoma Administrative Code; however, a source note entry, which referencesthe Register publication of the emergency action, is added to the Code upon promulgation of a superseding permanent rule orexpiration/termination of the emergency action.

The OAB's financial statements for the past several years reflect that theOAB's expenditures exceeded revenue. The OAB was aware of the decline inits net assets, but it was not until the financial results of the computerized CPAexamination became known to the OAB and the projections compiled for theannual Budget Request that the decline showed an escalated decrease from thatof past years. Because of the escalated decline, the OAB's primary programfor public protection, enforcement, is endangered. While the number of caseshandled by the OAB fluctuates each year (i.e., 117 cases opened in 2003; 58opened in 2004) the costs of professional investigators, court reporters, etc.continue to rise. In 1993, the cost for one enforcement case totaled $315,000.If the same case were to be heard today, it could have the potential of depletingthe OAB's fund entirely.
With the passage of the permanent rules, the rules to increase the feeswould be effective when the OAB's annual registration cycle begins in May2006. With approval of the emergency rules, which are identical to thepermanent rules, the increase in revenue would start with the 2005 renewalcycle. If the increase in fees is not effective for the 2005 registration, theprojected loss for Fiscal Year 2005 is in excess of $370,000 and $430,000 forFiscal Year 2006.
Additionally, in 2004 the Board passed amendments to its rules toimplement a mandatory peer review program. Peer review is considered oneof the most important aspects of protecting the public interest, in addition tothe OAB's enforcement program. The start up costs, salary and benefits for thePeer Review Coordinator are budgeted at this time with no expected revenuefrom the program for at least one year.
ANALYSIS:Section 15.14.E of the Oklahoma Accountancy Act allows for a registration
fee of $200 for each two year period. Since 1977, the Board has charged onlyhalf the amount allowed in the statute. The proposed amendments increasethe registration fee to $50 per year. The amendments also provide for a feefor late registration after July 31 but within 12 months after the lapse dateof the certificate or license of $100. The fee for registering later than 12months following the lapse date of the certificate or license is increased to$200. Section 15.14.E.3 of the Act allows for a maximum limit for these lateregistration fees of $300 and $600 respectively. The registration fee for anindividual who has reached the age of 65 is increased to $25 per year, whichis only slightly more than $2 a month. The late fee for these individuals isincreased to $50. Section 15.14.F of the Act provides that the Board "shall useits discretion in determining conditions required for retirement or disability."
The registration fee for firms other than sole proprietorships is increased to$50 per year. Section 15.15 of the Act allows for an annual registration firm feeof $100 and a late fee of $200.
Amendments increase the individual permit fee to $100, the maximumamount allowed for in Section 15.14A.E of the Act, but revoke the requirementfor a fee for late filing of the permit.
Section 15.15A.E of the Act allows for a maximum fee for the firm permitof $200. The proposed amendments increase the firm permit fee to $100, onlyhalf the allowed amount. (1) be arranged to provide for individual and grouplearning experiences(2) be equipped with movable furniture of the correctsize(3) have adequate materials and supplies available insufficient quantities to meet the needs of the children inthe class(4) have restroom facilities that will accommodatefour-year-olds(5) provide for a playground area that is accessible andsafe
(f) It is recommended that space requirements be based onthirty-five (35) square feet per child, and that the classroomhave a sink with running water.(g) The curriculum shall be appropriate for the age anddevelopmental level of the students. A process to providecontinuity between the early childhood program and thekindergarten program shall be established.(h) The school district shall provide for individual studentscreening and referral for vision and hearing.

(a) Pursuant to 70 O.S. § 6-189, individuals seeking alter-native certification as a superintendent or principal who do nothave a master's degree in educational administration are herebyrequired to successfully complete a minimum of 60 hours of
workshops or seminars approved by the State Department ofEducation in the following areas:
(1) Leadership and school district culture;(2) Policy and governance;(3) Communications and community relations;(4) Organizational management;(5) Curriculum planning and development;(6) Instructional management;(7) Human resource management;(8) Ethics of leadership; and(9) School law and finance.
(b) The applicant will provide documentation of completionof workshops and seminars in these areas prior to the issuanceof the certificate. This requirement shall be in addition to theother requirements set forth in 70 O.S. § 6-189(c). Any indi-vidual who wishes to claim credit through education or priorwork experience in any of these areas may present documenta-tion and apply for a review to the State Department of Educa-tion. The State Department of Education will review the docu-mentation and determine if it supports the claim to be eligiblefor certification. If the department determines that the individ-ual has met the competency in the area the individual shall beexempt from the requirements in that competency area.

Alternative requirements for licensure(a) Pursuant to 59 O.S. ss3006, the Board may issue a provi-sional license to practice as an orthotist and/or prosthetist underalternative qualifications.(ab) Every person seeking licensure as an orthotist and/orprosthetist under alternative qualifications must comply withthe following:
(1) achieve a passing score on a licensure exam ap-proved by the Board; and(2) execute an alternative qualification contract withthe Board. The terms and length of the contract will beset by the Board upon recommendation of the Committeeafter review of the applicant's experience and the determi-nation of further experience needed or other requirementsto be met.
(c) During the length of the contract the Board may renewthe provisional license pursuant to the provisions in section435:55-5-2 and verification that the licensee is making satis-factory progress as required by the contract.(bd) No person shall be permitted to enter into an alterna-tive qualification contract after October 31, 2004. A personwho has not done so by October 31, 2004 shall not be issueda license to practice orthotics or prosthetics without meetingstandard qualifications.
