PUBLIC HEALTH AGENCY OF CANADA ACT
SUMMARY
This enactment establishes the Public Health Agency of Canada to
assist theMinister of Health in exercising or performing the
Ministers powers, dutiesand functions in relation to public health.
It also provides that the Governor inCouncil may make regulations
respecting the collection and management ofpublic health
information and the protection of confidential
information,including personal information. It also makes related
and consequentialamendments to certain Acts.

An Act respecting the establishment of thePublic Health Agency
of Canada andamending certain Acts
[Assented to 12th December, 2006]
WHEREAS the Government of Canadawishes to take public health
measures, includingmeasures relating to health protection
andpromotion, population health assessment, healthsurveillance,
disease and injury prevention, andpublic health emergency
preparedness andresponse;
WHEREAS the Government of Canadawishes to foster collaboration
within the fieldof public health and to coordinate federalpolicies
and programs in the area of publichealth;
WHEREAS the Government of Canadawishes to promote cooperation
and consultationin the field of public health with provincial
andterritorial governments;
WHEREAS the Government of Canada alsowishes to foster
cooperation in that field withforeign governments and international
organiza-tions, as well as other interested persons
ororganizations;
AND WHEREAS the Government of Canadaconsiders that the creation
of a public healthagency for Canada and the appointment of aChief
Public Health Officer will contribute tofederal efforts to identify
and reduce publichealth risk factors and to support
nationalreadiness for public health threats;

NOW, THEREFORE, Her Majesty, by and withthe advice and consent
of the Senate and Houseof Commons of Canada, enacts as follows:
SHORT TITLE
1. This Act may be cited as the Public HealthAgency of Canada
Act.
INTERPRETATION
2. The following definitions apply in thisAct.
Agency means the Public Health Agency ofCanada established by
section 3.
Chief Public Health Officer means the ChiefPublic Health Officer
appointed under subsec-tion 6(1).
Minister means the Minister of Health.

3. The Public Health Agency of Canada isestablished for the
purpose of assisting theMinister in exercising or performing the
Min-isters powers, duties and functions in relation topublic
health.
4. The Minister presides over the Agencyand has the management
and direction of it.
5. (1) The Minister may, subject to anyterms and conditions that
the Minister specifies,delegate to an officer or employee of
theAgency any of the powers, duties and functionsthat the Minister
is authorized to exercise orperform under any Act of Parliament or
anyorder made by the Governor in Council inrespect of public
health.
(2) Subsection (1) does not authorize theMinister to delegate a
power to make regula-tions nor a power to delegate under
thatsubsection.

6. (1) The Governor in Council shall appointa Chief Public
Health Officer, who is the deputyhead of the Agency.
(2) The Chief Public Health Officer shall bea health
professional who has qualifications inthe field of public
health.
7. (1) The Chief Public Health Officer is thelead health
professional of the Government ofCanada in relation to public
health.
(2) The Chief Public Health Officer may,with respect to public
health issues, commu-nicate with governments, public health
author-ities or organizations in the public health field,within
Canada or internationally.
(3) The Chief Public Health Officer maycommunicate with the
public, voluntary orga-nizations in the public health field or the
privatesector for the purpose of providing information,or seeking
their views, about public healthissues.
8. (1) The Chief Public Health Officer holdsoffice during
pleasure for a term not exceedingfive years.
(2) The Chief Public Health Officer may bereappointed for one or
more additional terms.
9. The Chief Public Health Officer has therank and status of a
deputy head of adepartment.
10. (1) The Chief Public Health Officer shallbe paid, for the
performance of his or her dutiesand functions, the remuneration
fixed by theGovernor in Council.
(2) The Chief Public Health Officer shall bepaid, in accordance
with Treasury Boarddirectives, for reasonable travel, living
andother expenses incurred in performing his orher duties and
functions while absent from hisor her ordinary place of work.
11. The Chief Public Health Officer maydelegate any of the
powers, duties and functionsthat the Chief Public Health Officer is
author-

10. (1) Ladministrateur en chef reoit, pourlexcution de ses

12. (1) The Chief Public Health Officershall, within six months
after the end of eachfiscal year, submit a report to the Minister
on thestate of public health in Canada.
(2) The Minister shall cause the report to belaid before each
House of Parliament on any ofthe first 15 days on which that House
is sittingafter the Minister receives the report.
(3) The Chief Public Health Officer mayprepare and publish a
report on any issuerelating to public health.
(4) The Chief Public Health Officer shall, tothe extent
possible, in any report submitted orpublished under this section,
set out the sourceof the data and information used in
thepreparation of the report and the methodologyemployed to arrive
at the reports findings,conclusions or recommendations.
(5) The Chief Public Health Officer may, inany report submitted
or published under thissection, refer to public health problems and
theircauses, as well as any measures that may, in hisor her
opinion, be effective in preventing orresolving those problems.
GENERAL PROVISIONS
13. The officers and employees necessary forthe proper conduct
of the work of the Agencyshall be appointed in accordance with the
PublicService Employment Act.
14. (1) The Minister may establish advisoryand other committees
in relation to public healthand provide for their membership,
duties,functions and operation.
(2) Members of a committee shall be paid,for the performance of
their duties and func-tions, any remuneration that may be fixed by
theGovernor in Council.
(3) Members of a committee are entitled tobe paid, in accordance
with Treasury Boarddirectives, for reasonable travel, living and
otherexpenses incurred in the performance of theirduties and
functions while absent from their

ordinary place of work, in the case of full-timemembers, or from
their ordinary place ofresidence, in the case of part-time
members.
15. (1) The Governor in Council may, on therecommendation of the
Minister, make regula-tions respecting
(a) the collection, analysis, interpretation,publication and
distribution of informationrelating to public health, for the
purpose ofparagraph 4(2)(h) of the Department ofHealth Act; and
(b) the protection of that information if it isconfidential
information, including if it ispersonal information as defined in
section 3of the Privacy Act.
(2) Every person who knowingly possesses,uses or discloses
information in contraventionof a regulation made under subsection
(1) isguilty of an offence and is liable, on summaryconviction, to
a fine not exceeding $50,000 or toimprisonment for a term not
exceeding sixmonths, or to both.
TRANSITIONAL PROVISIONS
16. The following definitions apply insections 17 to 19.
former agency means the portion of thefederal public
administration known as thePublic Health Agency of Canada.
new agency means the Public HealthAgency of Canada established
under section3.
17. (1) The person occupying the office ofChief Public Health
Officer on the day onwhich this section comes into force remains
inoffice and is deemed to have been appointedunder subsection
6(1).
(2) Nothing in this Act is to be construedas affecting the
status of an employee who,immediately before the coming into force
ofthis section, occupied a position in the former

renseignements en contra-vention des rglements pris en vertu

18. (1) Any amount that is appropriated,for the fiscal year in
which this section comesinto force, by an appropriation Act based
onthe Estimates for that year for defraying thecharges and expenses
of the federal publicadministration for the former agency andthat
is unexpended on the day on which thissection comes into force is
deemed, on thatday, to be an amount appropriated fordefraying the
charges and expenses of thefederal public administration for the
newagency.
(2) If a power, duty or function is, underany Act, order, rule
or regulation, or underany contract, lease, licence or other
docu-ment, vested in or exercisable by an officer oremployee of the
former agency, the power,duty or function is vested in and shall
beexercised by the appropriate officer oremployee of the new
agency, unless theGovernor in Council, by order, designates adeputy
minister or an officer of the federalpublic administration to
exercise or performthat power, duty or function.
19. (1) A reference to the former agencyin any of the following
schedules and ordersis deemed to be a reference to the
newagency:
(a) Schedule I to the Access to InformationAct, under the
heading OTHER GOVERN-MENT INSTITUTIONS;
(b) Schedules I.1 and IV to the FinancialAdministration Act;
(c) the schedule to the Privacy Act, underthe heading OTHER
GOVERNMENT IN-STITUTIONS;

DEPARTMENT OF HEALTH ACT
21. The Department of Health Act isamended by adding the
following aftersection 4:
4.1 The Minister shall coordinate the activ-ities of, and
establish strategic priorities for, anyboard or agency for which
the Minister isresponsible and may, subject to any terms
andconditions that the Minister considers appro-priate, delegate
those powers, duties and func-tions to the Deputy Minister of
Health.
4.2 (1) The Department may provide ser-vices to, and receive
services from, any board oragency for which the Minister is
responsible andany of those boards or agencies may alsoprovide
services to each other.

(2) The Minister may fix the fees to be paidfor services
provided by the Minister or theDepartment to any board or agency

(3) The amounts to be recovered for servicesprovided under
subsection (1) and the mannerof calculating the amounts are subject

(4) Subject to any conditions imposed by theTreasury Board, any
amounts received by theDepartment or a board or agency for
servicesprovided under subsection (1) may be ex-pended, in the case
of the Department, for anypurpose of the Department, or, in the
case of aboard or agency, for any purpose of the board
oragency.
QUARANTINE ACT
22. Paragraph 9(b) of the Quarantine Actis replaced by the
following:
(b) may appeal the detention to the ChiefPublic Health Officer,
or any other personthat the Chief Public Health Officer
maydesignate, who may allow the appeal, dismissit or make any order
with respect to thedetention or the release of the detained
personthat a quarantine officer may make undersubsection 8(2).
COORDINATING AMENDMENT
23. (1) If section 82 of the Quarantine Act(the other Act),
being chapter 20 of theStatutes of Canada, 2005, comes into
forcebefore section 22 of this Act, then, on thelater of the day on
which that section 82comes into force and the day on which thisAct
receives royal assent or, if those daysare the same day, then on
that day section22 of this Act and the heading before it
arerepealed.
(2) Par drogation au paragraphe 6(1), leministre peut fixer les

Whereas it appears by message from HerExcellency the Right
Honourable MichalleJean, Governor General of Canada, and
theEstimates accompanying that message, that thesums mentioned
below are required to defraycertain expenses of the federal
publicadministration, not otherwise provided for, forthe financial
year ending March 31, 2007, and forother purposes connected with
the federal publicadministration;
May it therefore please Your Majesty, that itmay be enacted, and
be it enacted by the QueensMost Excellent Majesty, by and with the
adviceand consent of the Senate and House ofCommons of Canada,
that:
1. This Act may be cited as the AppropriationAct No. 2,
2006-2007.
2. From and out of the Consolidated RevenueFund, there may be
paid and applied a sum notexceeding in the whole fifteen billion,
threehundred and fifty-six million, two hundred andthirty-four
thousand, nine hundred and sixty-fivedollars and fourty-one cents
towards defrayingthe several charges and expenses of the

5. An appropriation that is granted by this orany other Act and
referred to in Schedule 1 maybe charged after the end of the fiscal
year forwhich the appropriation is granted at any timeprior to the
day on which the Public Accounts forthat fiscal year are tabled in
Parliament, for thepurpose of making adjustments in the Accountsof
Canada for the fiscal year that do not requirepayments out of the
Consolidated Revenue Fund.
6. (1) An appropriation that is granted by thisor any other Act
and referred to in Schedule 2may be charged after the end of the
fiscal yearthat is after the fiscal year for which theappropriation
is granted at any time prior to theday on which the Public Accounts
for that secondfiscal year are tabled in Parliament, for thepurpose
of making adjustments in the Accountsof Canada for that second
fiscal year that do notrequire payments out of the
ConsolidatedRevenue Fund.
(2) Notwithstanding any other provision ofthis Act, amounts
appropriated by this Act andset out in items of Schedule 2 may be
paid andapplied at any time on or before March 31, 2008,so long as
every payment is charged first againstthe relevant amount
appropriated under any Actthat is earliest in time until that
amount isexhausted, next against the relevant amountappropriated
under any other Act, including thisAct, that is next in time until
that amount isexhausted and so on, and the balance of amountsso
appropriated by this Act that have not beencharged, subject to the
adjustments referred to insection 37 of the Financial
Administration Act,lapse at the end of the fiscal year following
thefiscal year ending March 31, 2007.
7. Amounts paid or applied under theauthority of this Act shall
be accounted for in thePublic Accounts in accordance with section
64 ofthe Financial Administration Act.

Based on the Main Estimates 2006-2007, the amount hereby granted
is $14,323,272,465.41, being the total of the amounts of theitems
in those Estimates as contained in this Schedule less Supply to
date ($51,861,097,928.59).
Sums granted to Her Majesty by this Act for the financial year
