Disclosure is central to fairness in our criminal justice system.   Getting it rightmatters – to defendants, complainants and the public interest in criminal prosecutions. Miscarriages of justice, flowing from disclosure failures and resulting in loss ofliberty, are obvious disasters.  Conversely, disclosure must neither be perceived as, norallowed to become, unduly burdensome, so derailing trials which should otherwise haveproceeded to a conclusion – or acting as a deterrent to the prosecution of(electronically) document heavy cases, a socially corrosive outcome.  The law, contained in the Criminal Procedure and Investigations Act 1996, together withthe applicable Rules and other guidance, is settled and straightforward.    Theapplication of the law has proved less so.  The right mindset is of the first importance; the exercise must be thought through anddisclosure must never be a box-ticking exercise. So too, an investigative mindset iscrucial; for example, investigations must not be skewed by mis-characterisingcomplainants (entitled of course to respect, dignity and the protection of their ownHuman Rights) as victims in cases where the issue in dispute is whether any crime hasbeen committed.  All concerned have a part to play in correctly applying the law ondisclosure.  As I suggested in my (2011) “Review of Disclosure in Criminal Proceedings”:

“Improvements in disclosure must be prosecution led or driven, in such a manner as to requirethe defence to engage – and to permit the defence to do so with confidence. The entireprocess must be robustly case managed by the judiciary. The tools are available; they need tobe used.” (at para. 8(iii)). 

A key current concern relates to problems of scale given the volume of digital material,routinely generated.  Technology may be said to have created this problem and, I amconfident, technology (very likely AI) will one day solve it – but not yet.  In themeantime, it is right that much effort is devoted by the CPS, the police, the professionsand the Judiciary to addressing disclosure problems through the National Disclosure Plan;improvements in disclosure are correctly seen as essential to public confidence in thecriminal justice system.  Against this background, the authors, Narita Bahra QC and Don Ramble, are to be commended– for their clear definition of the nature of the disclosure problem and their practicalapproach to tackling it.  Notably, the structure of the book is easy to follow; it isalso comprehensive, dealing alike with disclosure in the magistrates’ court and the CrownCourt.    As is readily apparent, the authors speak with the real benefit of practicalexperience.  Tackling Disclosure in the Criminal Courts – A Practitioner’s Guide, is amost helpful addition to the literature in an area where the need for problem-solving isever necessary.

In May 2019 the multi-million pound fraud case R vSulley, in which Narita Bahra QC appeared, collapsedafter numerous failures of "expert" witness AndrewAger were exposed. Following this landmark case, the CPS have opted toupdate the ACPO Guidance, which should be read byall practitioners before instructing or challengingexpert witnesses.
