PUBLIC FINANCE MANAGEMENT (VIHIGA COUNTYCOMMUNITY EMPOWERMENT FUND) REGULATIONS 2015
IN EXERCISE of the powers conferred by section 116 of the PublicFinance Management Act, 2012, the Executive Committee Member forFinance makes the following Regulations—
PART I — PRELIMINARY
1 These regulations may be cited as the Public FinanceManagement (Vihiga County Community Empowerment Fund)Regulations 2015 and shall come mto operation on the date ofpublication in the Gazette
2 In these regulations unless the context requires otherwise-
' County Assembly means the County Assembly of Vihiga
"County Executive means the County Executive Committee ofVihiga County constituted m accordance with Section 35 of the CountyGovernments Act
Executive Committee member' means the County ExecutiveCommittee Member for the time being responsible for Industrialization,Trade and Tounsm,
Youths' mean individuals who are aged between eighteen andthirty five years old
small scale traders and businessmen' means business personswhose trade turnover per year does not exceed one hundred thousandKenya shillings.
Stubborn defaulter' means a loan defaulter whose loan account
IS m arrears of three or more months without a proposal on resumptionof repayment,
'Chief Officer means the relevant Chief Officer for TradeIndustnalization and Tounsm,
marginalized community means people who are disadvantagedm terms of numbers or histoncal injustices
3 The purpose of these Regulations are to provide for the legalframework and management structure for the implementation of theCounty policy on community empowerment
PART n— ESTABLISHMENTAND ADMINISTRATION OF THEFUND
4 (1) There is established The Vihiga County CommunityEmpowerment Fund
(2) The Fund shall, subject to regulation 35 remain m force for amaximum penod of ten years

5 The purpose of the Fund is to -
(a)
(b)

provide for a sound financial base for the empowerment ofthe communities m the County mcludmg small scale tradersand businessmen women youths, persons with disabilitiesand other marginalized communities
enable capacity building for the administrators and thebeneficianes of the Fund
Object and purposeof the Fund
provide for the necessary capital base for the advancementof the economy trade, marketing agricultural output andother small scale business enterpnses in the County
6 The capital of the Fund shall consist of-
(a) monies allocated m the annual budget and approved by theCounty Assembly for county community empowerment
(b) funds that may be advanced by development partners orother mterested persons or well-wishers
(c) interest and loans recovered from beneficianes orguarantors,
(d) monies retamed as admmistrative costs
(e) moneys realized from the disposal of any asset belongmgor due to the Fund and
(f) such other monies as may be lawfully due to the Fund
7 (1) There is established a County Community EmpowermentFund Committee consisting of-
(a) the Chairperson appointed by the Executive CommitteeMember
(b) the Chief Officer responsible for trade mdustnalization andtounsm
(c) not less than five and not more than seven other personsappointed by the County Executive Committee Membertakmg into account gender youth, persons with disabilitiesand regional balance
(d) the Officer admmistenng the Fund who shall be theSecretary to the Committee
(2) The County Committee shall operate within the department ofIndustnalization Trade and Tounsm at the county headquarters
8 The functions of the County Committee are to—
(a) Control and oversee the management of the Fund
(b) supervise and oversee the operations of Ward Committeesand Fund coordinators
(c) to open and operate the Fund s bank accounts at the Countylevel

(d) to make periodic and annual reports of the Fund to theExecutive Committee Member and the County Treasuryand
(e) facilitate training of the beneficiaries of the Fund
(f) to perform such other function as may be prudent for theeffective administration of the Fund or as may be directedby the County Treasury after consultation with theExecutive Committee member
9 A person shall not qualify to be a member of the CountyCommittee unless he or she-

10 (1) A County Committee Member shall serve for a term ofthree years and shall be eligible for re -appointment for one more term
(2) Notwithstanding the provisions of sub regulation (1) a CountyCommittee member may vacate office —
(a) in the case of death
(b) where by reason of mental or physical impairment,certified by a qualified medical doctor he or she is unableto perform the functions of the office
(c) if the member ceases to hold the office by virtue of whichhe or she became a member
(d) on failure to attend three consecutive meetings withoutreasonable excuse or prior authonzation of the Chairpersonand m the case of the Chairperson the relevant CountyExecutive Committee member
(e) if convicted of a cnmmal offence punishable by a term ofimpnsonment exceeding six months or
(f) if removed from office by the Executive CommitteeMember m wntmg for reasonable cause after the dueprocess,
(g) if the member resigns from office m wntmg addressed tothe Executive Committee Member,
(h) if the Fund is wound up

11 (1) There is established for every ward a CommunityEmpowerment Ward Fund Committee which shall be a decentralizedoffice of the County Community Empowerment Fund Committee
(2) The Ward committee shall compnse of-
(a) a Chauperson appointed by the Chief Officer responsiblefor trade industrialization and tounsm after, consultationwith the County Committee;,
(b) not less than five and not more than seven personsappointed by the Chief Officer responsible for tradeindustrialization and tounsm m consultation with the area
member of the County Assembly having regard to theinterests of gender youths persons with disabilities andcommunal and religious diversities
(c) the ward administrator
(d) the officer administering the fund who shall be thesecretary and officer administenng the fund
(3) The area member of the County Assembly shall be the patronof the Ward Committee
(4) The Ward Committee Members shall elect a treasurer fromamongst its members at the first sitting
12 (1) The functions of the Ward Committee are -
(a) carrying out public awareness on the communityempowerment policy
(b) issuing application forms to persons wishing to benefitfrom the Fund
(c) receiving and analyzing the applications and forward themto the County Committee for approval
(d) disbursing funds to successfu' applicants
(e) keeping records of the operations of the Fund in the ward
(f) performing any other function that is necessary for thesustamabihty of the Fund or as may be directed by theCounty Committee through the coordinator,
(g) to constantly update the coordinator on the operations ofthe Fund and,
(h) to open and operate the Fund account m the ward
(2) The Ward Committee shall regularly report to the CountyCommittee through the officer administering the fund on the operationsof the Fund
(3) The officer administenng the fund shall ensure that thefunctions assigned under these regulations are performed by the WardCommittee

13 A person shall not be ehgible for appointment as member ofthe Ward Committee unless be or she
(a) IS a Kenyan citizen with a national identification card
(b) a resident of the Ward for at least three years precedmg theappointment,
has satisfied the requnements of Chapter Six of theConstitution,
(c)

14 (1) A Ward Committee Member shall serve for a term ofthree years and shall be eligible for re appointment for one more term
(2) Notwithstanding the provisions of sub regulation (1), amember of the Ward Committee may vacate office -
(a) m the case of death
(b) where by reason of mental or physical impairmentcertified by a qualified medical doctor he or she is unableto continue m office
(c) if the member fails to attend three consecutive meetingswithout reasonable excuse or prior written permission ofthe chairperson or Chief Officer
(d) where the member violates any law which for the timebeing IS valid in Kenya
(e) if he or she ceases to hold office by virtue of which he orshe became a member, or
(f) if the Chief Officer so decides for reasons to be recorded inwriting after the due process
(g) if convicted of a cnminal offence punishable by a term ofimprisonment exceeding six months or
(h) the member resigns office in wntmg addressed to the ChiefOfficer
(i) if the Fund is wound up
15 (1) The County Committee and the Ward Committee shallsubject to sub regulation (2) meet at least once in every month and maymeet m case of emergency
(2) The total number of meetings of the County Committee andthe Ward Committee shall not exceed eighteen times in a year
16 A member of the County Committee or a Ward Committeeshall be paid a sitting allowance for every day of a meeting attended asshall be determined by the County Executive Committee memberresponsible for Trade Industrialization and Tounsm m consultationwith the County Executive Committee member responsible for Finance

17 The Executive Committee Member for Finance shalldesignate in writing with the approval of the County Assembly aperson responsible for administering the Fund
(2) There shall be opened at every ward in the County a branchoffice of the Fund
(4) The Officer administering the fund at the County level shallm wnting after consultation with the County Executive CommitteeMember for Trade Industrialization and Tourism and with theapproval of the Executive Committee Member for finance designatepersons to be a officers administering the fund for the respectiveWards
(5) The Sub County Administrator shall on being designated inwriting by the Administrator of the Fund coordinate the administrationof the Fund in his or her area of junsdiction
(6) The Administrator of the Fund shall be answerable to therespective Committee
(7) At least ten per cent of revenue held in the Fund at each levelof the Fund shall be used in the administration of the Fund as may bedirected by the County Committee
18 (1) There shall be maintained at the County level and at theWard level a savings account with a reputable bank operating m thecounty into which all monies due to the Fund shall be paid
(2) No monies shall be advanced or paid to the Fund except byway of transfer to an operation Account opened in a reputable bankoperating m the county as is provided under sub regulation (1) and outof which all the disbursements shall be made
19 (1) For any valid transaction on both the Fund and theOperation Account the signamres of the Chairperson the Secretary anda third signatory elected by the County Committee members or WardCommittee Members respectively shall be mandatory
(2) The signatones to the bank accounts shall comprise of at leastone person of the opposite gender
PART III — FUNDING PROCEDURES AND DISBURSEMENT OFFUNDS
20 (I) All funds granted under these regulations shall be m theform of a loan granted to the applicant and recoverable upon conditionsthat may be set by the County Committee
(2) A person granted a loan under these Regulations shall have agrace period of two months from the date the loan is received to thedate the first recovery installment of the loan falls due
21 The County Committee shall from time to time and maddition to the categones and conditions of loans specified in the FirstSchedule to these Regulations determine—

22 The Fund shall be for the benefit of small scale traders andbusinessmen women the youths, persons with disabilities and othermarginalized communities as individuals or operating within registeredgroups
23 A person shall not qualify for funding under these regulationsunless he or she—
(a) IS a resident of Vihiga County and holds a Kenyan NationalIdentification Card
(b) IS some small scale trader or involved in some small scalelawful business in a ward within the county,
(c) submits sound and viable business proposal to the WardComimttee
operates an active bank account within the county
in the case of an individual other than a person living withdisabihty is appraised by some group that is recognizedand guaranteed by at least four members of the group
demonstrates good history of credit worthiness andbusiness entrepreneurship
IS registered for the purpose by the relevant countygovernment body or produce evidence of engagement inbusiness in the County by producing revenue collectionreceipts or other operatiomd status,
demonstrates willingness to undergo pre disbursementtraining and
m the case of groups has been in active operation for atleast two months from the date of registration
24 (1) A person wishing to benefit from the Fund shall firee ofcharge, submit an application to the secretary of the relevant WardCommittee together with the supporting documents in the Formprovided in the Second Schedule to these Regulations
(2) The Secretary shall record and compile a list of allapplications received m every month and submit the same to theChairperson of the Ward Committee at least seven days pnor to thesitting of the Committee

(3) The Chairperson shall cause to be considered all theapplications received for funding at the meeting of the WardCommittee
(4) The Ward Committee shall within seven days of its meeting,prepare and submit to the Officer admmistenng the County Fundthrough the Sub county admmistrator the recommendation for fundingof all successful applicants considered at its meeting
(5) An application submitted under this regulation shall not mItself guarantee the applicant the funding applied for
(6) The final decision on the funding of applicants shall rest withthe County Committee on the recommendation of the WardCommittees
25 (1) Any disbursement of fiinds to a successful applicant shall Disbursement ofbe by du-ect transfer of the money to the bank account of thebeneficiary or by way of cheque drawn m favour of that beneficiary
(2) The County Committee and Ward Committees shall ensurethat funds are disbursed to every successful applicant within fourteenworking days after the approval of the loan by the County Committee
26 1) Every loan disbursed under these Regulations shall berepaid within such period as shall be determined by the CountyCommittee
(2) The County Committee may on the recommendation of therelevant Ward Committee taking into account the circumstances of theindividual case, reduce extend vary or adjust the loan repaymentpenod and where the loan repayment penod is extended beyond theinitially agreed period the County Committee may charge interest onthe outstanding balance at a rate not exceeding ten per cent as theCommittee shall determine
(3) A beneficiary who defaults to repay a loan granted underthese regulations beyond three months shall be liable to legal action forthe recovery of the pnnciple amount owing, interest accrued and costsoccasioned by such action as may be determined by the CountyCommittee
(4) The County Committee and each Ward Committee shallmaintain a loan recovery data card for each borrower for accuraterecord of loan repayment of which the borrower shall keep a copy
(5) Every loan granted under these Regulations shall be insuredfor the benefit of the borrower and the premium in respect thereof shallbe debited to the account of the borrower
(6) In case of death of a loan beneficiary while still repaying theloan the insurance cover under sub regulation (4) shall clear theoutstanding balance of the loan

PART IV- MISCELLANEOUS PROVISIONS
27 1) There shall be maintained by the officer administenng theFund at the County and Ward levels records for the Fund which shallinclude—
(a) accounting and financial records
(b) accurate records of all the applications received in everyyear
(c) registers each reflecting separately the beneficiaries in thecategones of small scale traders and businessmen womenthe youths, persons with disabilities and other marginalizedcommunities
(d) names and particulars of loan defaulters
(e) the total number of beneficiaries within the year and theamount granted to each,
(f) particulars of the guarantors
(g) loan recovery status and
(h) any other information relevant to the administration of theFund
(2) The records kept under this regulation shall be m both softand hard form and shall be submitted to the Executive CommitteeMember
28 (1) There shall be submitted a quarterly reports of theoperation of the Fund by the Ward Committee to the CountyCommittee through the coordinator and by the County Committee tothe Executive Committee Member responsible for finance through theExecutive Committee Member
(2) The Executive Committee Member shall cause the reportsreceived under sub-regulation (1) to be consolidated into annual reportnot later than the 31st day of December, m every year and submit thesame to the Governor who shall not later the 31st day of January of thefollowing year submit the annual reports to the County Assembly
29 The Officer administenng the Fund shall regularly cause theaccounts of the Fund to be audited and submit annual reports to theAuditor General and the Executive Committee Member who shall tablea copy to the County Assembly not later than the 31st day of January ofevery year following the year of the audit
30 (1) There is established a Dispute Resolution Panel for theFund compnsmg of—
(a) a Chairperson who shall be a practicing advocate of theHigh Court of Kenya of not less than five years experience
(b) two other persons who must be university graduates msocial sciences commerce or business administration withworking expenence of not less than three years and whosatisfy the requirements of Chapter Six of the Constitution

(2) The Panel members shall be competitively sourced by theCounty Public Service Board and appointed by the Governor with theapproval of the County Assembly and shall hold office for a non-renewable term of three years
(3) The Panel members shall be entitled to such allowances asshall be determined by the County Executive Committee member inconsultation with the County Public Service Board
(4) A Panel member may vacate office—
(a) m case of death
(b) on removal through a resolution of the County ExecutiveCommittee for just and reasonable cause after the dueprocess
(c) by resignation
(5) Any dispute coming before the Panel shall be resolved withinseven days of receipt of the dispute and a decision shall becommunicated m wntmg to the affected parties and the CountyCommittee not later than seven days
A dispute arising from non payment of a loan by a stubborndefaulter shall not be treated as a dispute under this regulation and maybe addressed by the County or Ward Committee m any other legalmanner including legal action for recovery
31 Any person who—
(a) with intend to benefit from the Fund posts falseinformation m any document used m loan processing bythe Fund
(b) personates or misrepresents anything to the officeradmmistenng the Fund
(c) uses insulting unpleasant or abusive language at anymeeting or occasion called for the purpose ofadministration of the Fund or
(d) upon being granted the monies for a specific purposediverts or misdirects the said money with the intention ofdefeating the objective of the Fund,
Commits an offence and is liable on conviction to a fine notexceeding fifty thousand shillings or to imprisonment to a term notexceeding nine months or to both and m addition shall repay the suminvolved
32 The County Committee may in recognition of anyoutstanding or best performing beneficiary of the Fund award acertificate or any other form of recognition or honor to such beneficiaryas may be approved by the Executive Committee Member
33 No member of the County or Ward Committee or Officer oremployee of the Fund shall be liable to any proceedings for anythingdone in good faith m the administration of the Fund

34 (1) The fund may be wound up—
(a) by a resolution of the County Executive Committee withthe approval of the County Assembly
(b) by a resolution of the County Assembly on a motionsupported by at least sixty five percent of all the members
(c) at the expiry of ten years from the date of these regulationsunless extended by the County Assembly
(2) All the assets and liabilities of the Fund on the date ofwinding up shall be taken over by the County Government of Vihiga
35 (1) The County Executive Committee may on therecommendation of the County Committee amend these Regulations toaccord with prevailing cu-cumstances and the amended Regulationsshall be subject to the approval of the County Assembly before cominginto operation
