Amendment 4

What Does the Amendment Say?

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. (December, 1791)”

People have the right to privacy and security of themselves and their possessions, meaning that no one can invade their property without the authorization of a warrant. Warrants will only be granted if there is legitimate reason and a specific description of the area being investigated or of the item to be taken.

What Does the Amendment Say?

“In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed; which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense. (December, 1791)”

When charged with a crime one is guaranteed a fast public trial judged with an unbiased jury from the district where the crime was committed. The accused shall be informed of the crime which they have been accused of. The accused will have both witnesses for them and against them. They will have the help of a lawyer to defend him/her and to acquire witnesses in their favor.
