Plaintiff, ESTATE OF LUQMAN AMEEN ABDULLAH, through its personal
representative,MUJAHIDCARSWELL,andbyitsundersignedcounsel,statesasfollows:
Parties
1. Thedecedent,LuqmanA.Abdullah(“Abdullah”),wasaresidentofWayneCounty,and
wasatalltimesrelevant,acitizenoftheUnitedStates.
2. MujahidCarswellisAbdullah’soldestbiologicalsonandhasbeendulyappointedas
thepersonalrepresentativeoftheEstateofLuqmanA.Abdullah.
3. Abdullah is survived by his widow, Amina Abdullah, and ten biological children,
MujahidCarswell,AmatuallahCarswell,MaryamCarswell,JamilCarswell,AsiyahAbdullah,
MuhammadAbdullah,ShuaibAbdullah,MaimunahAbdullah,ZakiyyahAbdullah,andZainab
Abdullah.
4. DefendantAndrewG.ArenaisformerSpecialAgentinChargeoftheFederalBureau
ofInvestigation,DetroitDivision.DefendantArenaisbeingsuedinhisindividualcapacity.
5. DefendantGeorgeNikolopolousisamemberoftheFBI‐DetroitSpecialWeaponsand
TacticsTeam(the“FBI‐DetroitSWATTeam”)andtheteamleaderinchargeoftheoperations
insidethewarehousethatresultedinthedeathofAbdullah.DefendantNikolopolousisbeing
suedinhisindividualcapacity.
6. DefendantsUnidentifiedFBIAgentNos.1,2,3,and4(togetherthe“UnidentifiedFBI
Agents”)areemployedbytheFederalBureauofInvestigation(“FBI”),andarethefourFBI
agentshootersinvolvedinthetacticaloperationinsidethewarehousethatresultedinthe
deathofAbdullah.TheUnidentifiedFBIAgentsarebeingsuedintheirindividualcapacities.1

DetroitJointTerrorismTaskForce(the“FBI‐DetroitJTTF”),theFBIHostageRescueTeam

8. Upon information and belief, Unidentified FBI Agent No. 1 is the FBI HRT Team
Leader.
9. Upon information and belief, Unidentified FBI Agent No. 2 is the FBI HRT K‐9
(“Freddy”)Handler.
10. Upon information and belief, Unidentified FBI Agent No. 3 is the FBI HRT K‐9

11. Uponinformationandbelief,UnidentifiedFBIAgentNo.4isanFBIDetroit–SWAT
Agent.TheUnidentifiedFBIAgentsarebeingsuedintheirindividualcapacities.
JurisdictionandVenue
12. UnderU.S.Const.Art.III§2,thisCourthasjurisdictionbecausetherightssoughtto
beprotectedhereinaresecuredbytheUnitedStatesConstitution.
13. Jurisdiction is proper pursuant to 28U.S.C. § 1331,Bivens v. SixUnknownNamed
AgentsofFederalBureauofNarcotics,403U.S.388(1971),andfederalcommonlaw.
14. Additionally,asubstantialpartoftheunlawfulactsallegedhereinwerecommitted
withinthejurisdictionoftheUnitedStatesDistrictCourtfortheEasternDistrictofMichigan.
15. Venueisproperunder42U.S.C.§1391(e)astoallDefendantsbecauseDefendants
areofficersofagenciesoftheUnitedStatessuedintheirindividualcapacitiesandbecause
shooters, who include the FBI K‐9 handler that deployed the FBI K‐9 to attack and maul Abdullah. Plaintiff therefore puts Defendants on notice that it may seek to amend this Complaint to add other unidentified FBI agents whose identities become known during discovery that were involved in the death of Abdullah and should be added to the Complaint.

StatuteofLimitations
16. AstheUnitedStateshasadmittedinitsResponseoftheUnitedStatestotheCourt’s
OrderofMarch19,2013(ECF#11),thestatuteoflimitationsforPlaintiff’scauseofactionis
threeyears.Dkt.12.
17. Forthereasonsstatedinparagraphs53‐79below,Plaintiff’scomplaintistimely,and
thestatuteoflimitationsforthisinstantactionwillexpirenextyearonOctober25,2014.
18. Asfurtherallegedbelow,statelawgovernsthetimelinessoftheinstantaction.
19. Pursuant toMichigan law, specifically, M.C.L.A. 600.5855, the time period for the
statute of limitations is tolled for a cause of actionwhereby aDefendant engages in the
fraudulentconcealmentoftheexistenceofacauseofactionand/ortheidentityofanyperson
whoisliablefortheclaimfromthepersonentitledtosue.
20. Onceaplaintiffdiscoversacauseofactionand/ortheidentitiespersonsliableforthe
claim,aplaintiffmaybringtheactionwithintwoyearsafterdiscovery.M.C.L.A.600.5855.
21. PlaintiffengagedinextensiveFreedomofInformationAct(FOIA)litigation,filingsix
lawsuitsagainstsixgovernmentagencies including theFBI, inaneffort todetermine the
eventsthatactuallytranspiredthatresultedAbdullah’sdeathaswellastodeterminethe
identitiesoftheUnidentifiedFBIAgentsliablefortheclaims.
22. Eachofthegovernmentagenciesrefusedtoreleaseanyinformationinconnection
withtheeventsthatresultedinAbdullah’sdeath.

23. In this instantaction, andas furtherallegedbelow,Plaintiffdiscovereda causeof
action on October 25, 2012, which provides for a time period of two years thereafter
(October25,2014)toinitiateanaction,renderingthisactiontimely.
24. Asfurtherallegedbelow,Defendantsengagedinthefraudulentconcealmentofthe
existenceofacauseofactionandtheidentitiesoftheUnidentifiedFBIAgentsliableforthe
claims.
FactualBackground
25. OnOctober28,2009,atapproximately12:04p.m.,Abdullah,alongwithfourother
men,wereatawarehouselocatedat5171MillerRd.,Dearborn,Michigan.
26. Abdullahandthefourmenwereloadingboxesataloadingdockatthewarehouse.
27. Uponinformationandbelief, thewarehousewasunderthecontroloftheFBIwho
leasedthewarehouseinanundercovercapacity.
28. OnOctober28,2009,atapproximately12:04p.m.,FBIagentssetoffnoiseandflash
bangtacticaldiversionarydevicesthatcausedthedisorientationofAbdullahandtheother
fourmeninthewarehouse.
29. OnOctober28,2009,atapproximately12:04p.m.,approximatelytwenty‐eightFBI
AgentsconsistingoftheFBI‐DetroitSWATTeam,theFBI‐DetroitJTTF,theFBIHRT,andthe
FBIcanineteam(together“FBItacticalteam”),includingthefourUnidentifiedFBIAgents,
enteredthewarehouseandsurroundedAbdullahandthefourothermen.
30. The members of the FBI tactical team were clothed in clearly marked tactical
uniformsthatread“FBI.”
31. TheFBItacticalteamorderedthefivemen,includingAbdullah,to“Getdownonthe
ground!”

32. All fivemen, includingAbdullah, immediately showedbothof theirhandsandgot
downfacedownonthegroundwiththeirarmsoutstretchedinfrontofthem.
33. Abdullah and the fourmen did not pose a threat to the FBI tactical team or the
UnidentifiedFBIAgents’safety.
34. Abdullahlaiddowninsideatrailerfacingeastward,theleftsideofhisbodyclosestto
theentranceofthetrailer.
35. UnidentifiedFBIAgentNo.1deployedanFBIK‐9named“Freddy”intothetrailerand
inthedirectionofAbdullah.
36. Upon information and belief, Unidentified FBI Agent No. 1 ordered the FBI‐K9 to
attackandmaulAbdullah.
37. TheFBIK‐9repeatedlyattackedandmauledAbdullah,causingsevereinjuriestohis
leftarm,including,butnotlimitedto,hiselbow,backarm,innerarm,andforearm.
38. AbdullahrolledontohisrightsideandattemptedtofendofftheFBIK‐9withbothof
hishandsinanattempttoprotecthimselfandpreventtheFBIK‐9fromfurthermaulinghim.
39. AsAbdullahstruggledwiththeFBIK‐9,Abdullah’sbodyturnedsuchthathewaslying
onhisbackandfacingwestward,theleftsideofhisbodyclosesttotheentranceofthetrailer.
40. TheFBIK‐9repeatedlyattackedandmauledAbdullah’sface,causingsevereinjuries
to,includingbutnotlimitedto,hisforehead,uppereyelid,leftcheek,lowerlip,lowerjaw,
andbothhands.
41. TheFBIK‐9 toreoffadenturedevice in theroofofAbdullah’smouth,andcaused
Abdullah’supperjawtobreak.

42. Uponinformationandbelief,whileAbdullahwasonhisbackandtheFBIK‐9was
repeatedly mauling, including but not limited to, his face, left arm, and hands, the
UnidentifiedFBIAgentsfiredapproximatelytwentyroundsatAbdullah.
43. Theroundswerefiredat,andnotlimitedto,Abdullah’schest,abdomen,lefthip,left
leg,scrotumandback,causinghispainfuldeath.
44. TheFBItacticalteamfailedtoprovideAbdullahwith,and/ordeniedtheprovisionof,
propermedicalattention.
45. TheFBIK‐9wasairliftedviaFBIMedivachelicopter to theVeterinaryEmergency
ServiceHospitalinMadisonHeights,Michigan,formedicalattention.
46. TheOperationsPlanwasreviewedandapprovedbyDefendantArena.
47. DefendantArenawas in theFBICommandCenterapproximatelyahalfmileaway
fromthewarehousewheretheoperationcommenced,anddirectedandsupervisedtheFBI
tacticalteamandtheentireabove‐describedoperationthatresultedinthedeathofAbdullah.
48. DefendantNikolopolouswastheFBItacticalteamleaderandinchargeoftheentire
above‐describedoperationinsidethewarehousethatresultedinthedeathofAbdullah.
49. Defendant Arena, Defendant Nikolopolous, and the Unidentified FBI Agents
purposely, knowingly, recklessly, improperly andwithout cause used excessive force by
deployingtheFBIK‐9toattackandmaulAbdullahandfiringapproximatelytwentyrounds
atAbdullah,causinghiswrongfuldeath.
50. Inawidelyvieweddocumentaryentitled“TheDeathofanImam,”describedbelow,
DefendantArenastatedthat“Imadethefinaldecisiontousethatdog. Thatwasthe last
decisionImade.”

51. A sworn affidavit signed by one of the four men, Muhammad Abdul Salaam, is
referencedasanExhibittothisComplaint.
52. MuhammadAbdulSalaamisaneyewitnesstotheeventsthatresultedinAbdullah’s
death.
FraudulentConcealmentoftheExistenceofaCauseofActionandtheIdentitiesofUnidentifiedFBIAgents
53. In an effort to try to escape liability in a highly publicized case, the FBI‐Detroit
Division,underthedirectionofDefendantArena,engagedinaconcertedefforttomanipulate
andconcealtheevidenceconcerningthebrutaldeathofAbdullah.
54. ThesamedayAbdullahwaskilled,theFBI‐DetroitDivisionissuedapressreleasethat
grosslymischaracterizedtheeventsthattranspired,statingthat“LuqmanAmeenAbdullah
didnotsurrenderandfiredhisweapon.AnexchangeofgunfirefollowedandAbdullahwas
killed.AnFBIcaninewasalsokilledduringtheexchange.”
55. ByfalselyclaimingthatAbdullahwasarmed,didnotsurrender,andfiredhisweapon,
theFBIfraudulentlyconcealedfromPlaintifftheexistenceofacauseofaction.
56. As a result of a number of settlement agreements reached with each of the
governmentagenciesnot includingtheFBI,Plaintiffreceivedoveronethousandpagesof
evidenceconcerningAbdullah’sdeath, includingphotographs,sketches,audio,policecam
footage,andvideofootage.
57. Thedocumentsproducedbythegovernmentagenciesprovidedthenamesofallof
theFBIagentsinvolvedinthetacticaloperation,howeverredactedtheidentitiesofonlythe
UnidentifiedFBIAgents.

58. Moreover,becausematerialevidencewaswithheldfromlocalgovernmentagencies
bytheFBI,Plaintiffdidnotreceive,fromtheselocalgovernmentagencies,materialevidence
thatwouldhaveenabledPlaintifftodeterminetheexistenceofacauseofaction.
59. AswornaffidavitsignedbyoneofPlaintiff’scounsel,LenaF.Masri,Esq.,isreferenced
asanExhibittothisComplaint.
60. Upon informationandbelief, theentire interiorwarehouse crimescene, including
entryandexit control,wereunder thecompletecontrolof theFBI,DetroitDivisionuntil
approximately1:00p.m.
61. Uponinformationandbelief,duringthetimethattheFBIhadcompletecontrolofthe
interiorwarehouse crime scene, and pursuant to instructions by Defendant Arena, local
police crime scene investigators and medical personnel were denied entry into the
warehousetoassessthecrimesceneandprovidemedicaltreatmenttoAbdullah.
62. Uponinformationandbelief,duringthetimethattheFBIhadcompletecontrolofthe
interior warehouse crime scene, Defendant Arena arranged for the evacuation of the
UnidentifiedFBIAgentsandtheirtransporttoFBIHeadquarters.
63. Accordingly, the Unidentified FBI Agents were unavailable to provide witness
statementstolocalpolicecrimesceneinvestigators.
64. Uponinformationandbelief,duringthetimethattheFBIhadcompletecontrolofthe
interiorwarehousecrimescene,andpursuanttoinstructionsbyDefendantArena,analleged
semi‐automatic handgunwas allegedly removed from the crime scene and taken to FBI
Headquarters.
65. Accordingly, the alleged semi‐automatic handgun was unavailable for forensic
analysisbylocalcrimesceneinvestigators.

66. Uponinformationandbelief,duringthetimethattheFBIhadcompletecontrolofthe
interior warehouse crime scene, and pursuant to instructions by Defendant Arena, FBI
Agents removed all hard drives and video surveillance equipment from the warehouse
beforelocalcrimesceneinvestigatorswereallowedtogainaccesstotheharddrivesorview
thevideofootage.
67. Uponinformationandbelief,duringthetimethattheFBIhadcompletecontrolofthe
interiorwarehousecrimescene,andpursuanttoinstructionsbyDefendantArena,thebody
ofAbdullahwasalreadymoved to adifferent location inside thewarehousebefore local
crimesceneinvestigatorsandthemedicalexaminerwereallowedtogainaccesstothecrime
scene.
68. Moreover,subsequenttotheshooting,Defendantscontinuedtomischaracterizethe
eventssurroundingAbdullah’sdeathbyrepresentingtothemedia,tothepublic,andtothe
PlaintiffthatAbdullahwasarmed,thathefiredinthedirectionoftheFBItacticalteam,and
thatthefourUnidentifiedFBIAgentsreturnedfireinself‐defense.
69. Forexample, onOctober13,2010, theDepartmentof JusticeCivilRightsDivision
announcedthatitcompleteditsreviewofthe“circumstancesrelatingtotheshootingdeath
of ImamLuqmanAmeenAbdullahduringanarrest conductedby theFBIonOctober28,
2009.”(Hereinafter,the“DOJReport”).
70. ThefirstsentenceoftheDOJReportreads:“OnOctober28,2009,afterImamLuqman
AmeenAbdullahfiredahandguntowardFBIagentswhowereattemptingtoarresthim,four
agentsshotandkilledImamAbdullah.”
71. Defendant Arena also appeared on a documentary film entitled “The Death of an
Imam,”todiscusstheeventssurroundingthedeathofAbdullah.

72. The film premiered at the University ofMichigan‐Dearborn in October 2010. The
documentary received a King Foundation Best of Festival award from the Broadcast
EducationAssociationin2011,takingtophonorsinthecategoryofMixedVideo(forstudent
and faculty collaborations) aswell. Itwas nominated for a regional EmmyAward in the
categoryofhistoricalfilms.Thefilmhasbeenscreenedinseveralfestivals,atconferences
andatuniversitiesintheUnitedStatesandCanada.FestivalscreeningsincludeCapitalCity
Film Festival (East Lansing,Mich.); DetroitWindsor International Film Festival (Detroit,
Mich./Windsor, Ont.); and the Islamic Society of North America Islamic Film Festival
(Chicago,Ill.).
73. Inthisdocumentary,DefendantArenastated“Onepersonmadeabaddecisionthat
dayanditwasn’tme…I’mgladIdidit…because…Iprobablywould’velostatleastoneagent
thatday.”
74. DefendantArenamadethesestatementsonawidelyvieweddocumentarywiththe
intent to mislead the media, the public and Plaintiff about the facts and circumstances
surroundingAbdullah’sdeath.
75. However,duetoDefendants’effortsasdescribedherein, itwasnotuntilfourdays
beforetheexpirationofthestatuteof limitationsthatPlaintiff learnedandconfirmedthe
existenceofacauseofaction.
76. OnOctober25,2012,MuhammadAbdulSalaam,theonlycivilianeyewitnesstothe
eventsthatresultedinAbdullah’sdeath,havingbeenjustreleasedfromprison,provideda
swornstatementthat isbothconsistentwithforensicevidenceandprovidesaversionof
eventsthatdirectlycontradictstheversionofeventsprovidedbytheFBI.

77. As shown above, Plaintiff exercised due diligence to determine the existence of a
causeactionandtheidentitiesoftheUnidentifiedFBIAgents.
78. Yet,inanattempttothwartPlaintiff,Defendantsengagedintheongoingfraudulent
concealmentoftheexistenceofacauseofactionandtheidentitiesoftheUnidentifiedFBI
Agents.
79. Therefore, because Plaintiff has filed the instant action within the statute of
limitations,thestatuteoflimitationsisequitablytolledpursuanttoM.C.L.A.600.5855.
TheDefendantsHaveClearandActualNoticeoftheInstantAction
80. TheUnitedStatesAttorneyfortheEasternDistrictofMichigan,theAttorneyGeneral
oftheUnitedStatesandtheDirectoroftheFBIallwereproperlyservedwiththeSummons
andComplaint and JuryDemandandhave clear andactualnotice regardingof the exact
identitiesoftheUnidentifiedFBIAgentslistedasDefendantstotheinstantactionastheyare
describedwithspecificityasthoseFBIAgentsthatwereinvolvedinthetacticaloperation
thatresultedinthedeathofAbdullah.
81. Defendantshavenonethelessfailedtopleadorotherwisedefendthemselvesdespite
beingproperlyserved.
82. PlaintiffwaspreparedtofileitsMotionforDefaultJudgmentonFebruary26,2013.
83. That sameday, counsel forPlaintiff received a letter fromAssistantUnited States
AttorneyWilliamL.WoodardrequestingthatPlaintiffsetasidetheClerk’sEntryofDefault
AgainstUnidentifiedFBIAgents,Dkt.9,becausetheUnidentifiedFBIAgentswereallegedly
notrequiredtorespondtoPlaintiff’sComplaint.
84. Thefollowingday,counselforPlaintiff,inateleconferencewithMr.Woodard,offered
tosetasidethedefaultinexchangeforthenamesoftheUnidentifiedFBIAgents.

85. Counsel for Plaintiff further informed Mr. Woodard of Plaintiff’s fraudulent
concealmentclaimtoexplainthatPlaintiff’sclaimsweretimelyinlightofitsrecentdiscovery
ofthewrongfuldeathclaim,amongotherclaims.
86. Mr.Woodardagreedtoacceptserviceofasubpoenatodiscovertheidentitiesofthe
UnidentifiedFBIAgentsifPlaintiffagreestoremovethedefault.
87. OnMarch19,2013,PlaintifffiledaMotiontoVoluntarilySetAsideClerk’sEntryof
DefaultAgainstUnidentifiedFBIAgents.Dkt.10.
88. OnMarch19,2013,theCourtorderedthe“governmenttofilewiththeCourt,within
30daysofthedateofthisOrder…answer(s)toPlaintiff’sComplaint.” Dkt.11(emphasis
supplied)(the“Order”).
89. TheCourtfurtherstatedinitsOrderthat“itisunacceptablethatneithertheOfficeof
theUnitedStatesAttorneynortheOfficeoftheAttorneyGeneralhasfiledanappearanceor
ananswertoPlaintiff’sComplaintformorethanfourmonthsafterbeingserved.”Dkt.11.
90. The government’s failure to answer the Complaint in violation of the Order is an
ongoingfraudulentconcealmentoftheexistenceofacauseofactionandtheidentitiesofthe
UnidentifiedFBIAgents.
91. Instead, theUnitedStates filedwhat it titled“Responseof theUnitedStatesto the
Court’s Order of March 19, 2013 (ECF #11),” which sought a dismissal of Plaintiff’s
Complaint,onApril5,2013.Dkt.12.
92. Treating the Response of the United States as “a pleading to which a responsive
pleading isrequired,”as it isa thinlyveiledmotion todismisspursuant toFed.R.Civ.P.

thisComplaintasiffullysetforthherein.
95. Asstatedmorefullyabove,theactionsofDefendantArena,DefendantNikolopolous,
andtheUnidentifiedFBIAgentsonOctober28,2009,amounttoexcessiveuseofforceand
conduct so recklessandunreasonableas todemonstratemaliciousandsadistic intent to
causeinjuryorwrongfuldeathtoAbdullah,orsubstantiallackofconcernforwhetherinjury
orwrongfuldeathtoAbdullahwouldresult,inviolationoftheUnitedStatesConstitution.

96. Defendant Arena, Defendant Nikolopolous, and the Unidentified FBI Agents owed
Abdullah,thedecedent,adutytouseduecareundertheUnitedStatesConstitution,andthe
lawsof the State ofMichigan. Bivensv.SixUnknownNamedAgentsofFederalBureauof
Narcotics,403U.S.388(1971),andM.C.L.A.691.1407(2).

that duty and other federal legal obligations by their excessive use of force and by
demonstrating a deliberate indifference to whether Abdullah would suffer injury or
wrongfuldeathbydeployinganFBIK‐9toattackandmaulhimandfiringapproximately
twentyroundsatAbdullah,whenheofferednoresistance,therebycausinghisdeath.
98. Defendant Arena, Defendant Nikolopolous, and the Unidentified FBI Agents
intentionallyand/orwithrecklessdisregardfailedtousesuchcareanddiligencetoavoid
Abdullah’sinjuriesandwrongfuldeath.
99. Abdullahsufferedinjuriesanddiedasadirectandproximateresultoftheactionsof
DefendantArena,DefendantNikolopolous,andtheUnidentifiedFBIAgentsonOctober28,
2009describedabove.
100. BytheactionsofDefendantArena,DefendantNikolopolous,andtheUnidentifiedFBI
AgentsonOctober28,2009describedabove,Defendantsbreachedthedutyofcareowedto
Abdullah and proximately caused him to suffer economic and non‐economic damages,
includingbutnot limited to, consciouspainandsuffering,andpainandphysical injuries,
whichultimatelyresultedinhiswrongfuldeath.
101. Plaintiff,onbehalfoftheEstateofLuqmanA.Abdullah,andallindividualsentitledto
damagesunderM.C.L.A.691.1407(2),requestsalldamagesthatarefairandjust,including,
withoutlimitation,thefollowing:
i. Reasonablemedical,funeralandburialexpenses;
ii. Reasonable compensation for conscious pain and suffering, and pain and
physicalinjuries,Abdullahsufferedbeforehisdeath;and,

WHEFEFORE, Plaintiff requests a judgment against Defendants for compensatory
damages inwhatever amount the jury findsnecessary, and furtherdemands a judgment
against individual Defendants for punitive damages for whatever amount the jury finds
necessary,plusallsuchotherreliefthisCourtdeemsjustandequitable,includingcostsand
attorneys’feesincurredinthisaction.

theirdutyofcareandotherfederallegalobligationsbytheirexcessiveuseofforceandby
demonstrating a deliberate indifference to whether Abdullah would suffer injury or

personal safety, and the failure toprovide and/or allow theprovisionof propermedical
attentiontoAbdullah,therebyproximatelycausingthelossofAbdullah’slife.

intentionallyand/orwithrecklessdisregardfailedtousesuchcareanddiligencetoavoid
Abdullah’sinjuriesandwrongfuldeath.
