Aaron Mills Scott, being first duly sworn on oath, states as follows:
1. My name is Aaron Mills Scott and I am an attorney representing Plaintiff
BP Group, Inc. (“BP Group”) in this matter. I make this Affidavit in support of BP
Group’s Request for Attorney Fees and Costs and its Motion to Add Interest to Judgment.
I make this Affidavit of my own personal knowledge. I am above eighteen years of age,
of sound mind, and, if called to testify, could and would competently testify hereto.
2. Attached hereto as Exhibit A is a true and correct copy of the Aircraft
Management Agreement.
3. Legal work on this dispute began in April 2009, leading to the filing of the
Complaint in August 2009. Numerous depositions were taken in this case. Defendant
David Kloeber noticed and took the depositions of BP Group, Inc., Ben Price, Dennis

Blackburn, and Wachovia Bank. BP Group noticed and took the depositions of David
Kloeber, Brian Overvig, Mike Victor, and Terry Adams. BP Group drafted several
written motions and submission in the case. First, Defendant David Kloeber made a
demand for trial by jury, necessitating a motion to strike that demand by BP Group in
light of the jury trial waiver contained in the Aircraft Management Agreement. After BP
Group’s motion to strike the jury demand was filed, Kloeber withdrew the demand.
Later, the parties brought complex cross-motions for summary judgment, arguing
numerous issues that were briefed and argued at length. Kloeber also designated an
expert witness to testify at trial on subjects that were, in BP Group’s view, improper
subjects of expert testimony. BP Group’s motion to strike the expert was ultimately
denied as moot once BP Group’s motion for summary judgment was granted.
4. Attached hereto as Exhibit B is a true and correct summary identifying the
attorneys who performed work on behalf of BP Group in this matter, the number of hours
they worked, and their billing rates. BP Group hereby makes available to Defendant
David Kloeber, upon request, redacted copies of all time entries for work performed on
this matter (redacted to avoid disclosure of attorney-client privileged or work-product
material). Unredacted copies of all time entries are available to the Court for in camera
review upon request.
5. Attached hereto as Exhibit C are true and correct copies of invoices and
supporting documentation supporting all costs and legal expenses for which
reimbursement is sought.

6. Attached hereto as Exhibit D is a true and correct copy of an email from
JetChoice employee Brian Overvig produced in this litigation.
7. Attached hereto as Exhibit E is a true and correct spreadsheet identifying
and indicating the calculation of all amounts of interest that BP Group seeks to have
added to the judgment in this case.
