Remarks: Hazardous characteristics and hazardous constituents of the Basel Convention are not identical with EU legislation transposed into Czech legislation. Moreover, the wording of a number of Annex IX entries is broad. Consequently, the question of hazardousness of Annex IX entry according to Czech legislation cannot always be answered unambiguously. Control procedures for transboundary movements of waste in the Czech Republic are not based on the definition of hazardous waste but on a specific waste listing system (OECD Green, Amber and Red List of Wastes). Consequently, imports of a number of Annex IX entries are controlled. The information in the questionnaire is given with reservation and no legal validity can be claimed from this publication.

GENERAL REMARKS

In Finland, the wastes subject to control procedures when moved transboundary are defined by the Council Regu lation (EEC) on the supervision and control of shipments of waste within, into and out of the European Community (259/93), and the regulations issued on the basis of the said regulation.

According to the aforementioned Regulation, all shipments of waste intended for final disposal (D-operations) are subject to control procedures. For wastes that

are intended for recycling or recovery (R-operations) within the OECD area, the control is based on the waste lists defined in the OECD Council Decision C(92)39 (Green, Amber and Red lists of waste). All wastes listed in Annexes III (OECD Amber list of wastes) and IV (OECD Red list of wastes) of Council Regulation 259/93 as well as all wastes not listed in any of the OECD waste lists are subject to control procedures. Only wastes listed in Annex II of Council Regulation 259/93 are not subject to control when moved transboundary. Annex II of Council Regulation 259/93 is identical to the OECD Green list of wastes.

When waste is shipped to non-OECD countries (i.e. countries to which the OECD Council Decision C(92)39 does not apply) there are also some additional

control procedures for non-hazardous, Green listed wastes. These control procedures vary depending on the request by the importing country concerned. Please notice, that in cases where wastes mentioned in a certain entry of the Basel B list are partly classified as hazardous or controlled under domestic

legislation, we have marked the appropriate tick box with (X). In case all the wastes covered by one B-list entry are controlled/not controlled, the appropriate box is ticked with X.
