9. Laxey Pavilion Refurbishment

The Minister for Environment, Food and Agriculture to move - That Tynwald approves the Department of Environment, Food and Agriculture incurring expenditure not exceeding £233,000 on the “Laxey Pavilion Refurbishment Scheme”. 12. GP Surgery and Health Care Facility – Jurby

The Minister for Health to move: That Tynwald – 1. approves the Department of Health incurring expenditure not

exceeding £1,646,000 in respect of GP Surgery and Health Care Facility – Jurby;

2. authorises the Treasury to spend out of the Capital Transactions

Account during the financial year ending 31st March 2011, a sum not exceeding £455,000;

3. approves and sanctions borrowings not exceeding £1,646,000 being

made by Government, such borrowings to be repaid within a period of 30 years.

13. Housing Planned Maintenance Works

The Minister for Social Care to move - That Tynwald -

1. approves the Department of Social Care incurring expenditure not

2. approves the associated transfer from the Housing Reserve Fund and

authorises the Treasury to spend out of the Capital Transactions Account during the financial year ending 31st March 2011, a sum not exceeding £570,400;

3. approves and sanctions borrowings not exceeding £570,400 being

made by Government, such borrowings to be repaid within a period of 20 years.

15. First Report of the Standing Committee on Economic Initiatives 2010

The Chairman of the Standing Committee on Economic Initiatives (Mr Speaker) to move -

That the First Report of the Standing Committee on Economic Initiatives be received and the following recommendations be approved:

1. That the Council of Ministers consider the Committee’s findings and

report back to Tynwald by June 2011 on: (a) the economic potential of cruise ships and

(b) its plans for improving the system for assessment of the economic potential of particular initiatives.

2. That the Department for Economic Development pursue the matter of

medical devices and look at the matter afresh. The DTI had not been well advised to go to Minnesota. The oral evidence clearly indicated that new markets were available and expanding in other areas. The Department should report on this in June 2011.

3. That the Council of Ministers review the political, economic and other

advantages of the Isle of Man Freeport as well as the strategic potential of this resource and report to Tynwald in June 2011. [PP 122/10]

16. Select Committee on Legal Aid in Family Matters (Petition for Redress of

Grievance) Second Report 2010 - 11

The Chairman of the Select Committee on Legal Aid in Family Matters (Petition for Redress of Grievance) (Mr Teare) to move -

That the Second Report of the Select Committee on Legal Aid in Family Matters (Petition for Redress of Grievance) be received and the following conclusions and recommendations approved:

Conclusions

1. The independence of the Certifying Officer, as established by the Legal Aid (General) Regulations 1997 [SD144/97], must be maintained.

2. The experiences of Mr Smith, Mr Broad and others have highlighted a

shortcoming of our administrative arrangements which cannot be allowed to continue.

3. We do not accept that the risk of vexatious abuse need be an insurmountable barrier to putting in place some improvement to the current procedures. In fact, we think an improved procedure may well reduce the number of complaints being submitted to the Advocates Disciplinary Tribunal.

4. We recognise the importance of the secrecy provision in section 14 of

the Legal Aid Act 1986. The requirement for such secrecy need not, however, be a bar to the effectiveness of an improved mechanism for handling representations made by opponents.

5. Procedures are in place for the handling of representations made by

the opponent of an assisted person, but that these procedures are inadequate in a number of important respects. First, they are not made clearly enough known to the public. Second, they do not provide for review by any other person, or body, of decision-making by the Legal Aid Certifying Officer, leading to the unfortunate perception that the holder of that office is “unassailable”. Third, despite what it says in the published procedures, outcomes do not appear to be reported back in a timely and consistent manner to the people who have made the representations. And fourth, depersonalised statistical information is not published – or even routinely produced for internal use – on the numbers of representations made and their outcomes.

Recommendations

1. That an opportunity be provided for review by another person or body, of action taken by the Legal Aid Certifying Officer in response to representations made by the opponent of an assisted person.

2. That the Legal Aid Certifying Officer should adopt standards for the handling of complaints in line with those adopted by Government Departments, and that provision should be made to allow the Legal Aid Certifying Officer’s administrative practices to be investigated by the proposed Tynwald Commissioner for Administration.

3. That a new Board should be put in place with a general remit to oversee the administration of the legal aid system, and a specific responsibility to review the actions of the Certifying Officer in response to representations from the opponent of an assisted person. The Board should be unable to sit unless a majority of members present are non-lawyers.

4. That detailed plans be made for the implementation of Recommendations 1 to 3 above and that a report be made to Tynwald, with recommendations, no later than the sitting in April 2011. [PP 123/10]

The Chief Minister to move – That Her Majesty be requested to direct by Order in Council that the provisions of the Cluster Munitions (Prohibitions) Act 2010 (an Act of the United Kingdom Parliament) shall extend to the Isle of Man with modifications (including additions or omissions) or without modifications.

60. Reciprocal Healthcare Agreement

The Hon Member for Rushen (Mr Gill) to move - That Tynwald notes that a new Reciprocal Healthcare Agreement between the United Kingdom and the Isle of Man has been signed and that the new Agreement came into force on 1st October 2010 following the expiry of the temporary Agreement on 30th September 2010, which had been in place since 1st April 2010 and that the new Agreement will ensure that Isle of Man residents visiting the UK will continue to receive free healthcare, should the need arise, and that UK residents visiting the Isle of Man will have reciprocal rights, without any funding changing hands between the two Governments; believes that the process by which this agreement was made necessary, negotiated and signed holds important lessons about the relationship between the United Kingdom and the Isle of Man; and appoints a Committee of three members with powers to take written and oral evidence pursuant to sections 3 and 4 of the Tynwald Proceedings Act 1876, as amended, to examine matters relating to the removal of the previous reciprocal healthcare arrangements between the United Kingdom and the Isle of Man and the creation of the temporary Agreement in April and subsequently the current Agreement; and to report with recommendations by July 2011.

61. IRIS West The Hon Member for Douglas East (Mr Robertshaw) to move - That Tynwald –

1. considers that a sewage treatment works at Peel may no longer be the

most cost-effective option for the treatment of sewage from the west of the Island;

2. calls upon the Water and Sewerage Authority to suspend with

immediate effect the implementation of “IRIS West” as currently proposed; and

3. appoints a Committee of three Members with powers to take written

and oral evidence pursuant to sections 3 and 4 of the Tynwald Proceedings Act 1876, as amended:

(i) to assess the available technical evidence as to the cost-

effectiveness of constructing a western sewage treatment works as compared with the alternative option of connecting sewage flows from the west to the existing works at Meary Veg;

(ii) to examine the handling of that evidence by the Water and

Sewerage Authority and the response of the Authority to objections which have been put forward to “IRIS West”;

(iii) to consider any implications for the way in which capital

projects are overseen by Tynwald; and

(iv) to report with recommendations by June 2011 62. Summerland Site

The Hon Member for Douglas North (Mr Houghton) to move – That Tynwald is of the opinion that the Summerland Site should not be sold on the open market but that the Department of Community Culture and Leisure should use the site for an establishment to provide leisure facilities in conjunction with the private sector.
