1.2 AuxiliaryWaterSystemmeansanywatersystemonoravailabletothepremisesotherthanthepublicwatersystem and includes the water supplied by the system.Theseauxiliary watersmayincludewaterfromanothersupplier's publicwatersystem;orwaterfromasourcesuchaswells,lakes,or streams;or processfluids;or usedwater.Theymaybepollutedorcontaminatedor objectionable or constitute a water sourceor system over which thesupplierofwaterdoesnothavecontrol.
1.3 Backflowmeansaflowcondition,inducedbyadifferentialinpressurethatcausestheflowofwateror other liquids, mixturesor substancesinto the distributionpipesof apotablewatersupplyfromanysourceorsourcesotherthanitsintendedsource.
1.6 BoardofCountyCommissioners:Shall mean the duly elected Board of CountyCommissionersof Tuscarawas County,Ohio.
1.7 BuildingDrain:Shallmean thatpart ofthe lowestpiping ofa drainage systemwhich receives thedischargefromsoil,waste,andotherdrainagepipesinsidethewallsofthebuildingandconveys it to the building (house)sewer beginning three (3)feet outside the buildingwall.
1.14 DoubleCheckValveAssembly:Shallmeananassemblycomposedoftwosingle,independently‐actingcheckvalveswithtightlyclosing shutoff valves located at eachendof the assembly and suitableconnectionsfortestingthewater‐tightnessofeachcheckvalve.
1.28 Non‐potableWateriswaterthathasnotbeencertifiedassuitableforhumanconsumption.Itmaybeused for lawn or gardenpurposes,providedsuchwatershallnotbeaccessible fordrinkingorculinary purposes.ForthepurposesoftheseRulesandRegulationsmeansanywaterthatdoesnotoriginatefromthepublicwatersystemoperatedbytheTCMSD.
1.38 ProcessFluids meanany fluid or solutionwhichmaybe chemically,biologicallyorotherwisecontaminatedor polluted in a formorconcentrationsuchaswouldconstitutea health,pollution,orsystemhazardifintroducedintothepublicoracustomer's potablewatersystem. Thisincludes,butisnotlimitedto:
A. Pollutedorcontaminatedwaters;
B. Processwaters;
C. Usedwatersoriginatingfromthepublicwatersystemwhichmayhavedeterioratedinsanitaryquality;
D. Coolingwaters;
E. Contaminatednaturalwaterstakenfromwells,lakes,streams,orirrigationsystems;
F. Chemicalsinsolutionorsuspension;and
G. Oils,gases,acids,alkalis, andother liquidandgaseousfluidsused in industrialorotherprocesses,orforfirefightingpurposes.
1.39 ReducedPressurePrincipleBackflowPreventermeansa devicecontainingaminimumof two independently‐actingcheck valvestogetherwithanautomatically‐operatedpressuredifferentialreliefvalvelocatedbetweenthe two check valves.During normal flow and at thecessation of normal flow, thepressurebetween thesetwochecks shall be less than thesupply pressure.In case ofleakageofeithercheckvalve,thedifferentialreliefvalve,bydischargingtotheatmosphere,shalloperatetomaintainthepressurebetweenthecheckvalvesatlessthanthesupplypressure. Theunitmustincludetightlyclosingshutoffvalveslocatedateachendofthedevice,andeachdeviceshallbefittedwithproperlylocatedtestcocks.
1.41 SanitarySewagemeans water bornewastes discharging fromthe sanitary facilitiesofbuildingsincluding,butnotlimitedto,houses,hotels,officebuildings,factoriesorinstitutions,andfreefromstormandsurfacewaterandindustrialwastes.
1.42 Sewermeansapipeorconduitforcarryingsewage.
A. Lateral/BuildingSewer means that portionof a sanitary sewer serving asinglestructurefromthestructuretotheservicesewerattheright‐of‐way.
B. CombinedSewermeansasewerreceivingbothsurfacerun‐offandsewage.
C. Interceptor Sewermeansthosesectionsofthesystemthatinterceptsewageandwastesfromtrunkorlocalsewersandthattransportsuchsewageandwastestothewastewatertreatmentplants.
D. Local Public Sewermeansthosesectionsofthesystem,8‐inchandlargerinsize,thataredesignedandconstructedtocollectsewageandwastesfromservicesewersand that transport such sewage andwastes tothe trunk orsub‐trunksewers,saidsewersprovidingserviceforlocalserviceonlyorindividualstreetsonly.
E. PrivateSewermeansasewerthatisnotownedbyapublicauthority.
F. PublicSewermeansasewerownedor controlled by theBoardofTuscarawasCountyCommissionersintheMetropolitanSewerDistrict,anddoesnotincludethebuildingsewer.
G. SanitarySewermeansasewerthatcarriessewageandwastesandtowhichstorm,surfaceandgroundwatersarenotintentionallyadmitted.
H. ServiceSewermeansthatsewer,fromthebuildingsewerattherightofwaytothepointofconnectionwiththesystem.
I. StormSewer/Drainmeansasewerthatcarriesstormandsurfacewatersanddrainage,butexcludessewageandindustrialwastes.
J. TrunkorSub‐TrunkSewermeansthosesectionsofthesystemthatcollectsewageandwastesfromlateralorlocalsewersandthattransportsuchsewageandwastestotheinterceptingsewers.
1.45 SuspendedSolidsmeansolidsthateitherfloatonthesurfaceof,orareinsuspensioninwater,sewageorotherliquids,andwhicharelargelyremovableby laboratoryfilteringandas furtherdefinedby the currentedition of StandardMethodsfor theExaminationofWaterandWastewater,APHA/AWWA/WEF.
A. Semi‐PublicDisposalSystemmeansadisposalsystemwhichtreatsthesanitarysewagedischargedfrompubliclyorprivatelyownedbuildingsorplacesofassemblage,entertainment,recreation,education,correction,hospitalization,housingoremployment,butdoesnotincludeadisposalsystemwhichtreatssewageinamountsofmorethantwenty‐fivethousandgallonsperday.
A. ORCSec.6103.02‐TheBoardofCountyCommissionersmaymake,publish,andenforcerulesandregulationsfortheconstruction,maintenance,protectionanduseofpublicwatersuppliesintheCountyoutsideofmunicipalcorporations,andofpublicwatersupplieswithinmunicipalcorporationsin itsCountywhereversuchwatersuppliesareconstructedoroperatedbysuchBoardoraresuppliedwithwaterfromwatersuppliesconstructedoroperatedbysuchBoard,includingtheestablishmentofconnections.
B. ORCSec.6103.29‐Nopersonshall tamperwithor damageany watersupplyorwatermainconstructedunderSection6103.02to6103.30,inclusiveoftheRevisedCodeor anyapparatusor accessoryconnected therewithor pertainingthereto.Noperson shall make any connectionwith such water supply or water mainwithoutpermissionoftheBoardofCountyCommissioners,ormakeanysuchconnectioninamannerorforauseotherthanasprescribedbysuchBoard. Nopersonshallrefusetopermit the inspection by the CountySanitary Engineer ofany such connectionorwillfullycause thepollutionof anywatersupply. Nopersonshall violateSections6103.02to6103.30,inclusive,oftheRevisedCode. AllfinescollectedunderSection6103.99of theRevisedCodeshallbepaidtotheCountyTreasurerandcreditedtosuchfundastheBoarddetermines
C. ORCSec.6103.99‐WhoeverviolatesSection6103.29of theOhioRevisedCodeshallbefinednotmorethanonehundreddollars.
D. ORCSec.6117.01‐TheBoardmaymake,publish,andenforcerulesandregulationsfor theconstruction,maintenance,protection, anduse ofsewers and sewerimprovementsin its Countyoutside of municipalcorporations,and of sewers andsewerimprovementswithinmunicipalcorporationsin itsCountywhereversuchsewersareconstructedoroperatedbysuchBoardordischargeintosewersorsewageorsewagetreatmentplantsconstructedoroperatedbysuchBoard,includingtheestablishmentanduseofconnections.
E. ORCSec.6117.45‐Nopersonsshalltamperwithordamageanysewerorsewagedisposalplantconstructed underSection6117.01to6117.45,inclusive,oftheRevisedCode,oranyapparatusoraccessoryconnectedtherewithorpertainingthereto,or makeany connection into any sewer or sewage disposal plantwithoutpermissionoftheBoardofCountyCommissionersorinamannerorforauseotherthanasprescribedbysuchBoard.NopersonshallrefusetopermittheinspectionbytheCountySanitaryEngineerofanysuchconnection.
F. ORCSec.6117.99‐Whoever violatesSection 6117.45 of theRevisedCode shallbefinednotmorethanonehundreddollars.
2.2 ExcerptsfromtheOhioAdministrativeCode
A. OAC3745‐03‐04‐ProhibitedDischarges‐PollutantsintroducedintoPOTWsbyanindustrialusershallnotpassthroughthePOTWorinterferewiththeoperationorperformanceofthePOTW.Thesegeneralprohibitionsandthespecificprohibitionsinparagraph(B)ofthisruleapplytoallsourcesofindirectdischargewhetherornot
B. OAC3745‐95‐02Cross‐connections.‐(A)Nopersonshallinstallormaintainawaterserviceconnectiontoanypremiseswhereactualorpotentialcross‐connectionstoapublicwatersystemoraconsumer’swatersystemmayexistunlesssuchactualorpotentialcross‐connectionsareabatedorcontrolledtothesatisfactionofthesupplierofwater.(B)Nopersonshallinstallormaintainaconnectionbetweenapublicwatersystemorconsumer’swatersystemandanauxiliarywatersystemunlesstheauxiliarywatersystem,themethodofconnectionandtheuseofsuchsystemhavebeenapprovedbythesupplierofwaterandbythedirectorasrequiredbysection6109.13oftheRevisedCode.
C. OAC3745‐95‐04‐Whereprotectionisrequired.‐Anapprovedbackflowpreventiondeviceshallbeinstalledoneachservicelinetoaconsumer’swatersystemservingpremises,whereinthejudgmentofthesupplierofwaterorthedirector,apollution,system,healthorseverehealthhazardtothepublicwatersystemexists.
D. OAC3745‐95‐07–Nopersonshallinstallormaintainawaterserviceconnectiontoanyone,twoorthreefamilydwellingwhereaboosterpumphasbeeninstalled,unlessanairgapseparationisprovidedtoensurethattheboosterpumpcannotexertsuctionontheserviceline.
urinals,laboratories,normalkitchen,bathroomandlaundryfixtures,refrigerators,sodafountains,cellarandgaragefloordrainsorotherfixtureswhichmaybedesignatedbytheSanitaryEngineerwhether from residences,factories,commercial buildingsorenterprises,trailers,schoolsorotherpublicorprivatebuildings,whereverandhoweverlocated,andfornootherpurposeexceptbyspecialwrittenpermissionoftheSanitaryEngineer.
3.4 If thebuilding sanitaryseweriscompletebeforetheplumbingcanbeconnectedthereto,thebuilderorsewertappershallkeeptheendofthebuildingsanitarysewertightlyclosedwithaplumber's plugorotherwatertightplug.
3.5 Itshall be unlawful forany person, firm or corporation to discharge or permit thedischargeofanyofthefollowingdescribedwatersorwastestoanypublicsanitarysewer:
A. Anygrease,oils,acids,cyanides,explosivesorinflammablecompounds,industrialchemicals,poisonsandanyother substances,gas or liquid,whichmayin anywaydamageor interferewiththeuseoroperationofthesanitarysewers,orsewagetreatmentplantinexcessofmaximumconcentrationsasdeterminedbytheSanitaryEngineerorwhichmaycreateahazardtolife.
B. Anygarbagethathasnotbeenproperlyshredded.
C. Anyashes,cinders,sand,mud,straw,shavings,metal,glass,rags,feathers,tar,plastics,wood, paunchmanure,or any other solid or viscoussubstancecapableofcausingobstructiontotheflow insewersorotherinterferencewiththeproperoperationofthesewageworks.
D. Anywatersorwastescontainingsuspendedsolidsofsuchcharacterandqualitythatunusualattentionorexpenseis requiredtohandlesuchmaterialsatthesewagetreatmentplant,orhavingachlorinedemandgreaterthan25ppm.
sanitarysewagesystemorwhichwillinterferewiththetreatmentprocessesshallbebarredfromthesanitaryseweragesystem.Innocasewillanindustryorcommercialestablishmentbeallowedtodischargegrease,oils,gasoline,thinners,orotherhighlyvolatilesubstancesoranyhighlyacidicorbasic substances or any other waste whichmay tend to damage the sanitary sewagesystemorcauseastoppageofthesame.TheSanitaryEngineerorhisauthorizedagentshallhaveauthoritytoenteranypropertyforthepurposeofobtainingsamplesofwastedischargedintothesewers.
4.2 FurnishingofChemicalAnalysis‐TodetermineifawastewaterfromanindustrycanbeacceptedbytheCounty,theindustrymust,uponapplicationforsewerservice,presenttotheSanitaryEngineer,atabulationofthechemicalanalysisofthewastetobedischargedintothesanitarysewagesystem and the volume of such waste, or if thisis not available, the expected wasteanalysisbasedonsimilarprocessesnowinoperation.
4.3 Pre‐Treatment‐TheCountywillnotacceptanywastewaterfromanindustrythatrequirespre‐treatmentof a wasteinordertosatisfyrequirementsforacceptanceintotheCounty’ssanitarysewagesystem.
negligentlybreak,damage,destroy, uncover, deface, ortamper with any structure,appurtenances or equipmentwhich is a part of the County sanitary sewage orwater supply system.Any personviolatingthisprovision shallbesubjecttoimmediateprosecutionunder chargeofdisorderlyconduct.
5.2 ProhibitedActstoSystem
A. The following activities, with respect to the County'saforesaid sanitary sewageandwaterimprovementsor interconnectedwaterlinesandplumbingor sanitarysewersandsewerservice,areprohibitedtoanypersonnotspecificallyauthorizedbytheBoard:
1. The deposit of filth or any deleterious substance on or in the County'spropertyrelatedtosuchimprovementsandequipmentorthedoingofanydamageornuisanceofanykindinconnectiontherewith.
2. Any unauthorizedtamperingwhatsoeverwithsuch County property,including theunauthorizedopeningoruseoffirehydrantsandotheroutlets,theunauthorizeduncoveringof any branch lines or equipment and anyunauthorizedattachmentorattemptedattachment.
3. Any tampering with or removal of a water meter by the owner ofthepremisesmeteredorbyanother.
A. Sanitarysewerserviceisavailableandmandatoryforanystructurewithsanitaryfacilitieswherethefoundationofanyportionofthestructureiswithin200feetofpublicrightofwayorsanitarysewereasementinwhichthesanitarysewermainislocated.Theconnectionshallbemadewithin90daysafternoticetodosobytheCounty.
A. Aseparateandindividualsanitarysewerconnectionshallbemadetoeachinhabitablebuilding.NoconnectionshallservemorethanonebuildingunlessspecificauthorityisgivenbytheSanitaryEngineer.
D. Allinformationrequiredonthepermitmustbecompletebeforethepermitapplicationwillbeaccepted.
E. Afeewillbechargedforanysuchpermitbasedonthenumberofequivalentdwellingunitsbeingserved.ThisfeemaybechangedfromtimetotimebytheBoardofCountyCommissioners.
B. AllmaterialsandworkmanshipshallbeinstrictaccordwiththesanitarysewerspecificationsoftheSanitaryEngineergoverningsuchworkandthesameisherebymadeapartoftheserules,regulations,procedures,andspecificationsandasspecifiedintheserules,regulations,proceduresandspecifications.
A. Allexcavationforabuildingsewerinstallationshallbeadequatelyguardedwithbarricadesandlightssoastoprotectthepublicfromhazard.
6.5 RestorationofPublicProperty
A. Streets,sidewalks,parkways,andotherpublicpropertydisturbedinthecourseoftheworkshallberestoredinamannersatisfactorytoandinconformancewiththeregulationsoftheCounty.
B. TheOwnershallindemnifytheCountyandholdtheCountyharmlessforallclaims,damages,lossesandexpenses,includingattorney'sfees,arisingoutoforresultingfromOwner'swork.TheCountyshallhavetherighttoselectitsownattorneyattheOwner’sexpense.
6.6 ApprovalofMaterial&Workmanship
A. TheSanitaryEngineershallapprovethequalityofallmaterialsandworkmanshipandshallhavetherighttoinspectthesameatalltimes.
B. TheSanitaryEngineermayorderremovedfromthejobanyinferiorordefectivematerialsandmaycausetobere‐laidanyportionofaserviceconnectionwhichisnotsatisfactorilyinstalled.
3. Three working days notification shall be given to the Tuscarawas CountyMetropolitan Sewer District, Sewer Department Superintendent prior to thestartofanyconstructionsoastoallowtheampletimetoscheduleaninspector.
a. This notice shall state the permit number, street, sub‐lot number andanticipatedconstructiontimerequiredfortheinspectionrequested.
5. The sewer builder shall immediately inform the Sewer DepartmentSuperintendentofanyunforeseendelaysorpostponementspriorto8:15A.M.ofthedayforwhichinspectionwasarranged.
6.9 ConstructionStandards
A. ThehouselateralsanitarysewersandtheirconnectionstothepublicsewersystemshallbeinstalledinconformancewiththemostcurrentdetailsandspecificationsonfileattheTCMSDoffice.
B. Thehouselateralsanitarysewershallbelaidsoastobecenteredinadrytrenchandinastraightlineonauniformslope.
C. Theminimumslopeshallbe1/4inchperfoot(2.08%).
D. Sewerclean‐outsshallbeinstalledonthehouselateralsanitarysewerwithin10feetofthebuildingfoundation,atallchangesindirectionofthesewerlateralandatthepropertylineoreasement/right‐of‐wayline.
E. Nosurfaceorgroundwatercollectinginbasementorfoundationexcavationsshallbeallowedtoenterthesanitarysewer.
F. Thesanitarysewerpipeshallbesolaidthatthebarrelwillbesupportedoveritsfulllengthonaminimumfour(4)inchesofgranularbedding.
a. Thebackfillshallbeplacedin6inchliftsandmechanicallycompactedbeforethenextliftisplaced;and
b. Thetop1footofthetrenchbackfillshallconsistoftopsoil.
6.10 Testing
A. AllsanitarysewersinstalledunderpermitsissuedbytheTuscarawasCountyMetropolitanSewerDistrictarerequiredtobetestedforleakageusinglowpressureairtestinginaccordancewithASTMF1417andTuscarawasCountyMetropolitanSewerDistrictstandardspecifications.
B. TelevisioninspectionmayberequiredatthesolediscretionoftheSanitaryEngineer.
6.11 CorrectingDamagedWork
A. Inthecaseofpavingorsidewalksthataredamagedorremovedinthelayingofanyservicesewerorindoingotherworkspecifiedundertheserulesorthatshallneedrepairorrenewalwithinoneyearafterthecompletionandapprovalofsuchwork,theOwner,shall,uponreceivingnotificationinwritingfromtheSanitaryEngineerofthenecessityforsuchrepairsorrenewal,immediatelyperformorhaveperformedtheworkwithinaperiodof96hoursaftersuchnotification.
B. Ifnotcorrectedintheallottedtime,theSanitaryEngineermaycausesuchworktobedoneeithercontractwithsomecapableperson,withoutadvertising,orbysuchotherarrangementsasmaybemostconvenientandsatisfactory,andthebillfortheentirecostofthesameshallberenderedtotheOwnerwhoshallbeliableforandshallpaysuchbillatonce.
6.12 MaintenanceoftheSanitarySewerConnection
A. TheCountywillperformallmaintenanceofthesanitarysewermain.Thehomeownerwillbeheldresponsibleforthemaintenanceofthehousesanitarysewerbetweenthesanitarysewermainandthehouse.TheCountymayrequirethepropertyownertomakewhateverrepairsorperformanymaintenancethattheCountydeemsnecessaryfortheproperfunctioningofthesanitarysewagesystems.
B. IftheCountyfindsitnecessarytomakecorrectiveactioninvolvingthedisconnectionandreconnectionorrelocationofimproperinflowsintotheCounty’ssewers,suchworkshallbedonepursuanttoORCSection6117.012.
6.13 FailuretoComply
A. Failurebythesewerbuildertocomplywithanyoftheserulesandregulations,orthedirectordersoftheSanitaryEngineerorhisdulyauthorizedassistantsshallresultinrevocationofthepermit.
B. WheretheCountyconstructsnewsewerstoserveexistinghomesandbusinesses,allattemptsshallbemadetohavethesystemdesignedtoprovidegravitysewerservicetoallexistingstructures.
1. Ifgravityservicecannotbeprovided, theCountywill includeagrinderpumpstationand forcemain toallpropertywithexisting structures that cannotbeservedbyagravityconnectiontothenewseweraspartoftheproject.
A. Aseptictankshallbeinstalledbyownerontheapplicant’spropertybetweenthestructurebeingservedandtheCountyownedseweratalocationapprovedbytheSanitaryEngineerorauthorizedrepresentative.
B. OnceinstalledtheseptictanksandthesewerlinefromtheseptictankandthemainsewerlinebecomethepropertyoftheCountyandareoperatedandmaintainedbytheCounty.
C. Theapplicant,inmakingapplicationforservice,grantsaneasementtotheCountythatextendstenfeetinalldirectionsfromoutsidewallsoftheseptictankformaintenanceofthetank.
D. Theapplicantalsograntsa20feeteasementcenteredonthesewerlineconnectingtheseptictanktothecounty’smainsewer.
A. AnyprospectivewaterconsumerwhohascontractedforwaterwiththeTCMSDbysigningandsubmittingtheApplicationforWaterServiceConnection,authorizedandprovidedbytheaforesaidwaterimprovements,shallbeentitledtoconnecttheservicebranchlineintothepremisesforwhichserviceisdesired,provided,however,thatsuchwaterconsumerunderstands,agreestoandcomplieswiththetermscontainedinsaidapplicationandtheseregulations,theiramendments,andotherrequirementsoftheTCMSD.
a. Thepermitshallbeshowntotheinspectoratthecommencementofconstructionandshallbekept"on‐the‐job"atalltimes,whileworkisinprogress.
b. TheWaterServiceConnectionPermitisvalidforoneyearfromdateofissuance.Thepermitcanberenewedforthedifferenceinthepermitfeeattimeofexpirationandthedateofissuance,butnolessthana$100.00renewalfee.Ifthepermitisnotrenewedbydateofexpiration,thepermitisnullandvoidandanewapplicationisrequired.
a. Thepremisestobeservedmustabuttheroad,streetorrightofwayonwhichtheservicemainislocated.
b. Theseparateservicebranchshallbeusedforeachconsumertobeserved.
c. Aseparatemetershallbeinstalledforeachconsumer,whenthesamebecomesavailable.
d. ThewatermetershallbeinstalledbytheTCMSDoritsauthorizedagentsinthemannerspecifiedbytheplansandspecificationsfortheaforesaidwaterimprovements.
e. Themetershallbelocatedatorintheproximityofthepropertylineoftheconsumer,orattheedgeoftheroad,oratapointwithintheconsumer'sproperty,oratastreetcrossingtheconsumer'sproperty,asdesignatedbytheTCMSDoritsauthorizedagent.
a. Theapplicant’sshareshallbeconsidereda“contributioninaidofconstruction”.
b. Shouldsubsequentcustomersconnecttothebranchlinewithinthefirsttenyearsafterinstallation;theoriginalapplicantwillberefundedanamountequaltotheTCMSDshareforeachcustomerconnected.
a. Inthecaseofmetersinstalledinthestructure,TCMSDshallinstalltheservicebranchlinefromthemaintothecurbstopvalve,locatedatthepropertyorright‐ifwayline.
7.2 CountyInspectionofWork
A. Thewaterservicelinefromthewatermetertotheconsumershallbeinstalledbytheconsumerathisowncostandshallconnecttothewatermaindistributionsystematthe"user'spointofconnection"providedatthewatermetersetting.
A. Allexcavationforawaterservicelineinstallationshallbeadequatelyguardedwithbarricadesandlightssoastoprotectthepublicfromhazard.
7.4 RestorationofPublicProperty
A. Streets,sidewalks,parkways,andotherpublicpropertydisturbedinthecourseoftheworkshallberestoredinamannersatisfactorytoandinconformancewiththeregulationsoftheCounty.
B. TheownershallindemnifytheCountyandholdtheCountyharmlessforallclaims,damages,lossesandexpenses,includingattorney’sfees,arisingoutoforresultingfromOwner'swork.TheCountyshallhavetherighttoselectitsownattorneyattheOwner’sexpense.
7.5 ApprovalofMaterial&Workmanship
A. TheSanitaryEngineershallapprovethequalityofallmaterialsandworkmanship,andshallhavetherighttoinspectthesameatalltimes.
B. TheSanitaryEngineermayorderremovedfromthejobanyinferiorordefectivematerialsandmaycausetheapplicanttorelayanyportionofaserviceconnectionwhichisnotsatisfactorilyinstalled.
B. Waterservicelinesshallnotbelaidinthesametrencheswithsewerlinesorconnectionsorseptictanksandtheirappurtenances.
7.11 ProtectionfromDamage
A. Nounauthorizedpersonshallmaliciously,willfully,ornegligentlybreak,damage,destroy,uncover,deface,ortamperwithanystructure,appurtenancesorequipmentwhichisapartoftheCountywatersupplysystem.Anypersonviolatingthisprovisionshallbesubjecttoimmediateprosecutionunderchargeofdisorderlyconduct.
B. NounauthorizedpersonshalltamperinanywaywithsuchCountyproperty,includingtheunauthorizedopeningoruseoffirehydrantsandotheroutlets,theunauthorizeduncoveringofanybranchlinesorequipmentandanyunauthorizedattachmentorattemptedattachment.
C. Nounauthorizedpersonshalltamperwithorremoveawatermeterfromanymeteredpremises.
D. CorrectionofDamagedWorkRepairsorreplacementofTCMSDwatersystemproperty,includingbranchlines,metersanddistributionsystem,damagedthroughthefaultoftheconsumershallbepaidforbytheconsumer.
E. TheTCMSDanditsemployeesandagentsshallhavetherighttoenteranypremisesoftheconsumertoperformmeterreadingandanynecessaryinspectionorrepairofanyportionofthewatersystem,thebranchservicelines,andanyotherlinesorplumbingconnectedtosaidsystemandlines.
F. If,inthecourseofmakingrepairstothewaterdistributionsystemormaintenancesuchasflushingofthesystemortheuseoffirehydrantsbythefiredepartments,damageisdonetotheconsumerplumbingorplumbingfixturesorappliancestheconsumershallholdharmlesstheCountyand/orauthorizedfiredepartments.
G. Anypersonviolatinganyoftheabove(AthroughF)prohibitionsshallbedeniedwaterservicefromTuscarawasCountyuntilallwaterusedandanyothercost,damageorexpensetothewatersystemhasbeenpaidforincludinginspectioncosts,turnoncharges,monthlycharges,delinquencychargesandanyotherchargesapplicable.
9. BasicWaterCustomerPlumbingRequirements9.1 Water
A. Anaccessible,fullsize,fullportballshut‐offvalvewithadrainplugshallbeprovidedandmaintainedbythecustomerinsideneartheentranceofthewater servicepipeintothebuilding.
B. Wherethewatermeterislocatedinsidethebuildingasecondfullsize,fullportballshut‐offvalvewithadrainplugshallbeprovidedandmaintainedbythecustomeronthecustomersideofwatermeter.
C. SeparateControlsforEachFamilyUnit.Intwo‐familyormultipledwellingsthereshallbeashutoffvalvewhichpermitswatertoeachfamilytobeshutoffwithout interferencewiththewatersupplytoanyotherfamilyunitorportionofthebuilding.
D. Apressurereliefvalveorexpansiontankmustbeinstalledonthehotwaterportionofthebuildingwaterdistributionsystem.
10.5 TheTCMSDwillassess theadequacyof therates and fees thatmake‐up theUserChargeSystemon an annualbasisand,whennecessary,makerecommendationstotheBoardofCountyCommissionersastomodificationstotheUserChargeSystem.
10.6 Allwaterandseweruser chargesandfees are found in the latest rateresolutionenacted bytheBoardofCountyCommissioners.
A. AnEquivalentResidentialUnit(ERU)isbasedupontheestimatedaveragedailysanitarysewageflowestablishedbytheOhioEPAandfoundinOAC3745‐42‐05,TableA‐1dividedby400.
B. Inthecaseofleasedlots,parcelsoflandorpremiseshavingaconnectionwiththeCounty’swaterand/orsewersystem,theownerofsaidlots,parcelsoflandorpremisesshallbebilledandbeliableforthepaymentofallcharges.
C. NometerreadingwillbecombinedforbillingpurposesandreadingsandbillingswillbeinunitsestablishedintheRateResolution.
A. SuchshutoffwillnotrelievethecustomeroftheirobligationtopaytheapplicablemonthlyrateassetforthintheRateSchedule.
B. TheTCMSD’s“WaterServiceTerminationPolicy”ismadepartoftheseRulesandRegulationbyreference,copiesofwhichareonfileandavailableforreviewattheTCMSDoffice.
C. AccountsthatremaindelinquentwillbecertifiedtotheCountyAuditorforcollectioninthemannerauthorizedandprescribedbylaw.
11.2 Nothingin theserules,regulations,proceduresandgeneralspecificationsshallprohibittheBoardofCountyCommissionersortheCountySanitaryEngineerfromenteringintoanagreementwithany person,firm,corporationorgovernmentalagencyforthefurnishingof a service or performanceof any act not specificallymentionedin theserules,regulations,proceduresandgeneralspecifications.
A. Plansshall be prepared by aProfessionalEngineerlicensed to practice in theStateofOhio,whoisexperiencedinsuchworkandshallbesubmittedtotheTuscarawasCountySanitaryEngineerforapproval.
12.2 PlansRequiringApprovalbytheCounty
A. Proposedpublicsanitarysewageorwatersupplysystemsincludingtreatmentplants,sanitarysewageconveyancesystemsandwaterdistributionsystemsandanychangesinexistingstructuresormethodsoftreatmentlocatedwithintheTCMSDshallnotbeconstructedwithouttheapprovalandauthorizationoftheBoardofCountyCommissionersortheirauthorizedrepresentative.
B. A public sanitary sewageor water supply system shall be construed to meananysystemwheretheTCMSDmaintainsthecompletedprojectorwhichmay,intheopinionoftheSanitaryEngineer,bemadetoserveadditionaldwellingsorbuildings,existingor proposed, along its line,or whichmay beextendedto serve additionaldwellingsorbuildings.
C. Proposedsanitarysewageorwatersupplyforindustrialorcommercialestablishmentswhichdischarge their wastesinto a sanitary sewage systemorreceive their watersupplyfromawatersupplysystemoperatedandmaintainedbytheTCMSD.
1. For the purposesof these regulations,an industrialestablishmentshall beoneengagedinthemanufactureofaproduct,andacommercialestablishmentshallbe one which is engaged in selling goods or services to either apublicor aprivateclientele.
12.3 PlanApprovalRequirements
A. Provideareportpreparedbythedesignengineer,givingallpertinentdataregardingtheproject.
B. Providethree(3)copiesofsatisfactorydetailedplansandspecifications,estimatesofcost, manufacturerproductcatalog data, pump performancecurves, etc. for allimprovementsproposed.
A. TheSanitaryEngineer,uponthe County'sacceptanceoftheproposedproject’splansandspecifications,will notifyOhioEPA oftheacceptance of theplansandtheacceptance tomaintain andoperatetheproposedprojectwhencompleted.
A. No provision inthis article shall be so construed as to relieve the Owner fromtheresponsibilityto furnishallprivateengineering,surveyingandinspectionservicesnecessaryinconnectionwiththeimprovements.
12.7 County'sResponsibilityforInformation
A. TheCountyexpresslydisclaimsany responsibilityfor theaccuracyorcompletenessofinformationgivenondrawingsororallyorinwritingbyanyofitsemployeesinregardtoexisting structures, and the contractor shall have no claimagainst the County on theaccountofsuchinformationgiven.
B. SanitarymanholesshallbeManholeNo.3(StandardConstructionDrawingMH‐1.2)inaccordancewiththeOhioDepartmentofTransportation“StandardConstructionDrawings”mostrecenteditionwiththefollowingclarifications.
C. Allsanitarysewersshall belaid onapprovedgranularbedding,from six inchesbelowthebottomof thepipeplacedto thepipespring‐lineandshall havea hand‐placed,compactedgranularbackfilltwelveinches(12")abovethetopofthepipe.
13.3 RequirementsforWaterMains
A. ThedesignofwatersystemsshalladheretoOhioEPArequirements andshallmeetthe requirements in the latest edition of the 10‐State Standards for DrinkingWater.TheCounty’sminimum specifications applying towater mains, otherthanwaterserviceconnections(whicharediscussedinChapter7),areasfollows:
a. Allfittingsshallbeductilecast ironpipe.Allfull‐bodiedductileironfittingsshallconformtoAWWAC110.Fittings12"andsmallershallberatedfora250psiworkingpressure.
b. Thenormalminimumsizewatermainshallbe8inchesinsidediameter(ID).
c. Allwatermainsshallbedesignedsoastoprovideaminimumserviceatthecurbstopof35psipressure,andprovideminimumpressuresandfireflowsascurrentlyrecommendedbytheNationalBoardofFireUnderwriters.
2. Provide fire hydrantsthat meetAWWAC502 standardand are UL/FMapproved.
a. ProvideMueller Model A‐423orapprovedequal, with5.25inch mainvalve, 2hose and1pumpernozzles.Thenozzle threadsshallbeapprovedby the firedepartmentinthe areato be served. A gatevalve,valvebox and covershall beinstalledoneveryhydrant lead.
b. Fire hydrantsshallbe spacedno greaterthan 500feet in residentialareasand nogreater than300feetincommercial andindustrial areas.
3. Valves shall be insidenon‐rising stem, resilient wedge gate valves, MuellerModelNo. 2360 or approvedequalmeetingrequirementsof AWWAC509andNSF61Certified.
a. Main valves shall bespacednogreater than1,000 feetand shallbeinstalled ateverystreetintersection onrightofwaylinesproduced.
A. Connectionswithsanitarysewersconstructedunderthisarticleshallbesubjecttoalltherequirementsof Chapter6of theserules,regulations,proceduresandgeneralspecifications. TherequirementsforwaterserviceconnectionsarefoundinChapter7.
2. Designshallconformtothelatesteditionof"GLUMRB Recommended Standards forWastewaterFacilities” (10‐StateStandards) and/orOhioEPA's"Sewage:Collection,Treatment & Disposal‐Where public Sewers arenotAvailable" and the same shall beconsidered aspartoftheserules,regulations, procedures,andgeneralspecifications.
A. SanitarySewageandWaterSupplyImprovementsincludewaterandsewerlines,sewerforcemains,sewerpumpstations,waterboosterpumpstations,wastewatertreatmentplants,watertreatmentplants,waterstoragetanksandanyothercomponentofawaterand/orsewersystem.
B. UponreceiptoftheOEPAPlanApprovaland/orPermittoInstalltheOwner/DevelopershallscheduleameetingwiththeSanitaryEngineerforthepurposesofschedulingconstructionoftheproposedproject.
C. Listofsuccessfullycompletedprojectsofasimilarnature.
D. Submittingofdetailedshopdrawingsforallequipmentandmaterials;includingpipe,fittings,valves,valveboxes,hydrant,pre‐castmanholes,castingdetailsandothermaterialsandequipmentthatarepartof theprojectin triplicatetotheSanitaryEngineer.
1. Beforereceivinga permit foranyworkrequiringexcavation in anystreet,highwayorroad right‐of‐way, the persondesiring to makesuch excavationshall obtain from theproperauthority,therequiredpermitforsuchwork,andshallagreetocomplywithallrequirementsof theauthorityissuingsuch"roadopeningpermit."
2. If no"road openingpermit" isrequiredbytheauthorityhavingjurisdiction overaparticular streetorhighway,awrittenstatementtothateffectmustbeobtainedfromtheauthority.
G. Ownershallsubmitasatisfactoryperformancebondinthetotalamountof100percentoftheengineer’scertificatedestimateofprobableconstructioncostandaone‐yearmaintenancebondintheamountof10percentoftheengineer’scertificatedestimateofprobableconstructioncost.
H. Necessaryeasements,permanentmaintenanceeasementsandtemporaryconstructioneasementsbytheOwner/DevelopershallbeassignedtotheCounty.
14.3 ProtectionofStructures
A. Inexcavatingandbackfillingtrenches,andconstructingsanitarysewageandwatersupplyfacilities,caremustbetakennottomoveorinjureanystructuresandwatercourses,whetherabove,atorbelowthesurfaceoftheground.
A. NoconstructionworkinconnectionwiththeimprovementshallbedoneexceptinthepresenceofaTCMSDrepresentativeauthorizedbytheSanitaryEngineer.Forty‐eight(48)hoursofnoticeoftheintentiontobeginworkshallbegiventotheSanitaryEngineertoenablehimtoarrangetoplaceoneormore,ifneeded,inspectorsonthework.
B. TheOwner'sEngineershallalsoactasResidentEngineerfortheimprovement.
14.5 ImproperConstruction
A. TheOwnerand/orhiscontractorsareresponsiblethattheworkisconductedinasafemannerandincompliancewithanyandallStateandFederalsafeworkingrulesandregulations.
B. IftheSanitaryEngineerhasprooforevidenceinwritingthatanysuchworkisbeingimproperlydone,hemayorderallworkstoppedandtheOwnerorhiscontractorshallthereuponstopandshallnotresumeuntilauthorizedinwritingbytheSanitaryEngineertodoso.
14.6 TestingofWaterandSewerLineConstruction
A. Allsanitary sewers, including lateral connections, shall undergoaleakage testwhichshall bealow pressure airtest forPVCsewer,in accordancewithASTMF1417 andtheTCMSDstandardspecifications.
B. Allsanitarysewersshallbe subjecttoatelevisionand/orphotographicinspection.
C. The Sanitary Engineermay require thatanycracked or settled pipeor otherfaulty constructionbe corrected as the result ofsuchinspection
D. ManholesshallbetestedforleakagewithavacuumtestinaccordancewithASTMC1244
E. Allwatermains willbehydrostaticallytestedatapressure of 150pounds persquareinchatthehighestpointofthemainortwotimesthesystemstaticpressure,whichever isgreater. Theleakageshouldnotexceed20gallons/inchdiameter/mile ofmain/day.
16.2 Nothingin theserules, regulations,proceduresandgeneralspecificationsshallprohibittheBoardofCountyCommissionersortheCountySanitaryEngineerfromenteringintoanagreementwithanyperson,firm,corporationorgovernmentalagencyforthefurnishingof a service or performanceof any act not specificallymentionedin theserules,regulations,proceduresandgeneralspecifications.
17.1 All rules and regulations heretoforeadoptedby the TCMSD for the governingof theinstallationandoperationofwatersupplyandsanitarysewageimprovements,inanywayinconflictherewith,areherebyrepealed.
18.1 In anyinstancewherethesourceofsupplyforoneormoreoftheaforesaidwaterimprovementsisanotherpoliticalsubdivision,andthecontractforsuchsupplyprovidesthatcertain rules and regulationsapplicableto that politicalsubdivision'swater utilitymustbefollowedinconnectionwiththeCounty's distributionsystemconnectedtosuchsourceofwater,thensuchrulesandregulationsareadoptedby theBoardofCommissionersandareapplicabletosomuchoftheaforesaidwaterimprovementsasareconnectedtosuchsourceofwater.
18.2 In anyinstancewheretheconveyanceanddisposalofsewageforoneormoreoftheaforesaidsewerimprovementsisconveyedthroughanotherpoliticalsubdivision,andthecontractforsuchsewageconveyanceanddisposalprovidesthatcertain rules andregulations applicableto that politicalsubdivision'ssewer utilitymustbefollowedinconnectionwiththeCounty's sewercollectionsystemconnectedtosuchpoliticalsubdivision,thensuchrulesandregulationsareadoptedby theBoardofCommissionersandareapplicabletosomuchoftheaforesaidsewerimprovementsasareconnectedtotheotherpoliticalsubdivision.
