It’s the middle of summer and it has rained for three days straight.

Tatiana and Sally want to go outside and enjoy some nice weather.

Luckily for them, the next several days are supposed to be sunny and

hot. They’ve made plans to go to their favorite pond this weekend to

swim.

"I can't wait to go to the pond today, Tatiana!"

"I know, Sally! It's so nice out, I can't wait to swim!"

"Oh no! Look at the pond! It's green!"

"What happened? I've never seen it this color before."

Tatiana is extremely sad. "I really wanted to swim today," she says.

"I know, so did I, but I don't think we should until we know what is

wrong with the pond."

"I know! Let's take a sample back to Chloe! She can test it and tell us

what's wrong!"

"Great idea, Tatiana! I'll fill up my water bottle and we can take it back

to her lab. I'll take some of this slime that's growing, too. Maybe that

will help her determine the problem."

"Hi girls! How was the pond?" asks Chloe.

"It was terrible, Chloe! The pond was green! We didn't go swimming

because we didn't know if it was safe," Tatiana said sadly.

"I brought you some of the water, and the green slime that was

growing. We were hoping you could tell us what's wrong," Sally said.

"I'd be happy to look, but I think I may already know what the problem

is."

"Thanks Chloe," Tatiana and Sally said. "We'll be in the garden if you

figure it out."

Chloe gets out her microscope and prepares a slide with some of

the green slime the girls brought back.

She then looks into the microscope and analyzes what she sees.

Just as she thought, the green slime is actually algae. She’s excited

to tell Sally and Tatiana that she knows what the problem is.

"Ladies! I figured out what is wrong with the pond! It's just as I

expected, the water has really high phosphates!" Chloe stated.

"What are phosphates?" asks Sally. "And why did it turn our pond

green?"

"Phosphates are nutrients. They supply plants with food, just like the

plant food you have in your hands, Sally," Chloe informs them.

"What?" Sally asks, dropping the plant food to the ground.

"Don't worry Sally, that food does not contain phosphates, I made sure

of it."

"Chloe, where do these phosphates come from?" asks Tatiana.

"Phosphates come from fertilizers that farmers put on their fields."

"Not all of the fertilizers are absorbed by the plants. When it

rains, the fertilizer washes off into surface water, such as ponds,

streams, and rivers. This fertilizer then acts as food for other

plants, such as algae, which is what the green slime growing in

the pond was."

"Is it dangerous?" Tatiana asked.

"Some algae release toxins. You're lucky you didn't go in the pond, or

you could have become sick." Chloe stated.

"We didn't go in the pond, but it sounds dangerous to the fish that live

in the pond," Sally suggested.

"When these plants die, the decay process utilizes oxygen. This

means there is less oxygen for the fish in the pond, and they could

die," Chloe said.

"What can we do?" asked Tatiana. "We need to save the fish!"

"Let's go talk to the farmer," says Chloe.

The three girls arrive at the farmer’s house. "Hello ladies, what can I do

for you?" he asks.

"Mr. Farmer, Sir, we went to swim in the pond today, and it was green!

Chloe says it's your fault!" Sally says, sobbing.

"Now Sally," Tatiana says, "let’s calm down and explain." Chloe asks the

farmer if he uses fertilizers on his crops.

"I use fertilizers every spring! It helps the crops grow," he says.

Sally, calmed down slightly, informs the farmer how his fertilizers are

ruining the pond.

"Oh my! I had no idea! I don't want to see the fish die either! I grew

up at that pond! I want to see it thrive! But I need my crops to

grow," says the farmer. "Let me check with my supplier and see if

he has something that is safer for the pond."

"Oh! Thank you, Mr. Farmer! We can’t wait to go swimming again!"

A few weeks later, the pond has returned to normal. All three girls go to

enjoy a swim.

"The pond looks so much better! I can't wait to get in! I can't believe

how a few weeks can change how it looks. Thank you, Chloe, for helping

us figure out the problem, and coming up with the solution," Tatiana

said.

"No problem girls! Solving problems is what engirlneers do."

AMENDMENT TO THE IDENTIFICATION OF GOODS REQUIRED

The wording in the identification of goods is indefinite and must be clarified for the reasons set forth below. See 37 C.F.R. §2.32(a)(6); TMEP§1402.01.

Specifically, the applicant must specify the field of subject matter of its “books,” such as “in the field of engineering.”

Please note that the identification “notebooks” is acceptable as written.

Applicant may substitute the following wording, if accurate:

Class 16: Books in the field of {specifying particular field or subject matter, such as “engineering”} ; notebooks.

 

Applicant’s goods may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably

amended. See 37 C.F.R. §2.71(a); TMEP §1402.06. Applicant may clarify or limit the identification by inserting qualifying language or deletingitems to result in a more specific identification; however, applicant may not substitute different goods or add goods not found or encompassed bythose in the original application or as acceptably amended. See TMEP §1402.06(a)-(b).

The scope of the goods sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of thewording in the identification. TMEP §§1402.06(b), 1402.07(a)-(b). Any acceptable changes to the goods will further limit scope, and oncegoods are deleted, they are not permitted to be reinserted. TMEP §1402.07(e).

The filing date of pending U.S. Application Serial Nos. 87690220 and 87820069 precede applicant’s filing date. See attached referenced

application. If the mark in the referenced application registers, applicant’s mark may be refused registration under Trademark Act Section 2(d)

because of a likelihood of confusion between the marks. See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP §§1208 et seq. Therefore, upon

receipt of applicant’s response to this Office action, action on this application may be suspended pending final disposition of the earlier-filed

referenced applications.

 

In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict

between applicant’s mark and the marks in the referenced applications. Applicant’s election not to submit arguments at this time in no way

limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.

SPECIMEN REFUSAL

Registration is refused because the specimen does not show the applied-for mark in use in commerce in International Class 41. Trademark Act

Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a), 1301.04(g)(i). Specifically, the

submitted screenshots do not show the provision of information in the fields of engineering, science, technology, or math.

An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each

international class of services identified in the application or amendment to allege use. 15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv),

2.56(a); TMEP §§904, 904.07(a).

Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and

webpages that show the mark used in the actual sale, rendering, or advertising of the services. See TMEP §1301.04(a), (h)(iv)(C). Specimens

comprising advertising and promotional materials must show a direct association between the mark and the services. TMEP §1301.04(f)(ii).

Applicant may respond to this refusal by satisfying one of the following for each applicable international class:

(1) Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing

date of the application or prior to the filing of an amendment to allege use and (b) shows the mark in actual use in commerce for

the services identified in the application or amendment to allege use. A “verified substitute specimen” is a specimen that is

accompanied by the following statement made in a signed affidavit or supported by a declaration under 37 C.F.R. §2.20: “The

substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing

date of the application or prior to the filing of the amendment to allege use.” The substitute specimen cannot be accepted without

this statement.

(2) Amend the filing basis to intent to use under Section 1(b), for which no specimen is required. This option will later necessitate

additional fee(s) and filing requirements such as providing a specimen.

IDENTIFICATION OF SERVICES REQUIREMENT

The wording “educational information” in the identification of services is indefinite and too broad and must be clarified because the wording

does not specify the subject matter of the services and could identify services in more than one international class. See 37 C.F.R. §2.32(a)(6);

TMEP §§1402.01, 1402.03, 1402.11(b). Classification of educational information services is based on the subject matter of the information

provided rather than the intention that the information provided be educational. See TMEP §1402.11(b). For example, “providing educational

information in the field of finance” is classified in International Class 36, “providing educational information in the field of travel” is classified

in International Class 39, “providing information relating to education services” is classified in International Class 41, and “providing a website

featuring educational information in the field of medicine” is classified in International Class 44.

Applicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as

acceptably amended. See 37 C.F.R. §2.71(a); TMEP §1402.06. Applicant may clarify or limit the identification by inserting qualifying language

or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or services or add goods

and/or services not found or encompassed by those in the original application or as acceptably amended. See TMEP §1402.06(a)-(b). The scope

of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the

wording in the identification. TMEP §§1402.06(b), 1402.07(a)-(b). Any acceptable changes to the goods and/or services will further limit scope,

and once goods and/or services are deleted, they are not permitted to be reinserted. TMEP §1402.07(e).

MULTIPLE-CLASS APPLICATION REQUIREMENTS

The application references goods and/or services based on use in commerce in more than one international class; therefore, applicant must satisfy

all the requirements below for each international class:

(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest

numbered class (for example, International Class 3: perfume; International Class 18: cosmetic bags sold empty).

(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule).

Specifically, the application identifies goods and/or services based on use in commerce that are classified in at least 3 classes;

however, applicant submitted a fee(s) sufficient for only 2 classes. Applicant must either (a) submit the filing fees for the classes not

covered by the submitted fees or (b) restrict the application to the number of classes covered by the fees already paid.

(3) Submit verified dates of first use of the mark anywhere and in commerce for each international class. See more information

(4) Submit a specimen for each international class. The current specimen is acceptable for class 35; and applicant needs a specimen

What has helped you the mos in your career as anenGIRLneer?

Being in an environment where I'm the only female and stereotypes exist, my

biggest tool has been to ask questions and learn to say "Let me get back to

you." I have truly embraced the fact that I don’t have to know everything and

I'm not expected to. As an engineer, I'm expected to know how to find

answers, be resourceful, and learn from experience, but that does not mean I'm

supposed to be an expert. Whether this means looking through a specification,

rule, finding someone who can provide an answer or point me elsewhere, it's

okay. It's progress towards the right answer. For the longest time, I let

stereotypes and self-doubt affect my learning because I was afraid of what

others would think if my question was "dumb." I learned to accept that I will

never know everything, no matter the years of experience.
