S.R.O. 3 96 (1)/2013: — Pursuant to Section 31(4) of the Regulation of Generation, Transmission and Distribution of Electric Power Act, 1997 as amended through Regulation of Generation, Transmission and Distribution of Electric Power (Amendment) Act 2011, the National Electric Power Regulatory Authority makes and notifies the following adjustment in the approved tariff on account of variation in fuel charge for the month of August 2012 in respect of Ex-WAPDA Distribution Companies (XWDISCOs):

Fuel Charges Variation for the month of August 2012 (Decrease)

Note: The assessed fuel charges adjustment (decrease) of Rs.0.0566/kWh for the month of August 2012 is lower by Rs 0.90863;Wh than the adjustment (increase) of Rs.0.8520/kWh for the month of July 2012; therefore, effectively there will be a decrease of lks.0.9086/1:Wh in the bill of the consumers on account of fuel charges adjustment as compared to the previous month, i.e. July, 2012.
2. The above adjustment (decrease) of Rs.0.0566/kWh shall be applicable to all the consumer categories except lifeline and agricultural consumers of all the XWDISCOs. The said adjustment shall be shown separately in the consumers' bills on the basis of units billed to the consumers in the month of August 2012 by the XWDISCOs. XWDISCOs shall recover the fuel charges adjustment in respect of August 2012 in the billing month of June 2013.
3. While affecting the recovery of Fuel Adjustment Charges, the concerned DISCOs shall keep in view and strictly comply with the orders of the courts notwithstanding this order.

Fuel Charges Adjustment for XWDISCOs
DECISION OF THE AUTHORITY IN THE MATTER OF FUEL CHARGES ADJUSTMENT
FOR THE MONTH OF AUGUST 2012 FOR EX-WAPDA DISCOS
1. Pursuant to the provisions of Section 31(4) of the Regulation of Generation,
Transmission and Distribution of Electric Power Act 1997, (XL of 1997) read with the
mechanism/formula determined by the Authority in the tariff determinations for Ex-WAPDA DISCOs for the Financial Year 2011-12, the Authority has to make
adjustments in the approved tariff on account of any variations in the fuel charges on a
monthly basis.
2. In order to make adjustments in the approved tariff of the XWDISCOS due to variations
in the fuel charges for the month of August 2012, necessary information as to the
details of fuel charges etc was obtained from Central Power Purchasing Agency (CPPA).
3. Notwithstanding the fact that the monthly adjustment on account of fuel charges variation is made in pursuance of the provisions of section 31(4) of the Act XL of 1997 as well as on the basis of a mechanism/formula already determined by the Authority, yet the impact of such adjustments, if any, is to be paid by the consumers of electricity, therefore, the salient features and details of the proposed adjustments in the approved tariff were advertised in the national newspapers for information of all concerned. In order to provide an opportunity of hearing to all concerned and to meet the ends of natural justice, it was also decided to conduct a public hearing on 3rd October 2012 in NEPRA Main Office; and the date of hearing was also specified in the advertisement dated 25th September, 2012 whereby participation in the hearing and filing of comments/objections from any interested person was invited.
4. On the date fixed for the hearing, representatives from Central Power Purchasing
Agency (CPPA), Wapda Private Power Organization (WPPO), National Power Control
Cell (NPCC), Ministry of Water & Power and media were present; however, no
representative from Ministry of Finance attended the public hearing despite the service
of notice. Despite service of notice to personally attend the hearing, Chief Operating
Officer (COO) CPPA did not participate. No objections/comments were filed by any
interested person against the proposed adjustment.
5. From the perusal of the information so provided by CPPA, it has been observed that the
actual pool fuel charges of Rs. 6.6502/kWh for the month of August 2012 decreased by
Rs. 0.0463/kWh (Annex-I&II) as compared to the reference fuel charges, i.e. Rs.

6.6965/kWh as indicated in the Annexure-IV of the Authority's determination pertaining to the Ex-WAPDA DISCOs for FY 2011-12.
6. As per details provided by CPPA, 80.87 GWh were purchased from small, captive and new captive power plants during August 2012. CPPA provided actual details of energy of 80.87 GWh purchased from these plants. According to the details provided by CPPA, the actual cost of this energy is Rs. 846.32 million. Since the Authority has prescribed provisional gas tariff of Captive Power Plants comprising fuel cost component which is Rs. 6.789/kWh on gas price of Rs. 560/MMBtu and fixed cost component of Rs. 1.53/kWh for new captive power plants, the cost of energy of 80.87 GWh is worked out Rs. 783.514 million. Accordingly in the instant adjustment, cost of Rs. 783.514 million for 80.87 GWh purchased from small, captive and new captive power plants has been considered provisionally, subject to adjustment on the basis of tariff determined/approved by the Authority on case to case basis.
7. CPPA stated that the Miscellaneous Supplemental Charges of Rs. 7.325 million being part of the capacity charges of Japan Power Generation Limited was wrongly included in the energy charges of August 2012. Accordingly, the energy charges for the month of August 2012 have been reduced by Rs. 7.325 million.
8. The Authority also noted that during August 2012 NTDC reported 4.09% transmission losses against the determined losses of 2.50% as per the Authority's determination dated 9th May 2011 (Case No. NEPRA/TRF-165/NTDC-2010). However, CPPA has already reduced the energy charge by Rs. 972.83 million on account of NTDC transmission losses beyond 2.5%. The financial impact of increased transmission losses is, therefore, not being passed on to the consumers.
9. The Authority has reviewed and assessed a decrease of Rs. 0.0566/kWh in the applicable tariff for Ex-WAPDA DISCOs on account of variations in the fuel charges for the month of August 2012 as per the following details:

10. The assessed fuel charges adjustment (decrease) of Rs. 0.0566/kWh for the month of August 2012 is lower by Rs. 0.9086/kWh than the adjustment (increase) of Rs. 0.8520/kWh for the month of July 2012, therefore, effectively there will be a decrease of Rs. 0.9086/kWh in the bill of the consumers on account of fuel charges adjustment as compared to the previous month, i.e., July, 2012.
11. The adjustment as referred to in Para 9 above ;
i) shall be applicable to all the consumer categories except lifeline ckv...1 (4'<_, Klima ku, consumers of all the DISCOs;
ii) shall be shown separately in the consumers' bill on the basis of units billed to the consumers in the month of August 2012.

DECISION OF THE AUTHORITY IN THE MA11hR OF FUEL CHARGES ADJUSTMENT FOR THE MONTH OF SEPTEMBER 2012 FOR EX-WAPDA DISCOS
1. Pursuant to the provisions of Section 31(4) of the Regulation of Generation, Transmission and Distribution of Electric Power Act 1997, (XL of 1997) read with the mechanism/formula determined by the Authority in the tariff determinations for Ex-WAPDA DISCOs for the Financial Year 2011-12, the Authority has to make adjustments in the approved tariff on account of any variations in the fuel charges on a monthly basis.
2. In order to make adjustments in the approved tariff of the XWDISCOS due to variations in the fuel charges for the month of September 2012, necessary information as to the details of fuel charges etc was obtained from Central Power Purchasing Agency (CPPA).
3. Notwithstanding the fact that the monthly adjustment on account of fuel charges variation is made in pursuance of the provisions of section 31(4) of the Act XL of 1997 as well as on the basis of a mechanism/formula already determined by the Authority, yet the impact of such adjustments, if any, is to be paid by the consumers of electricity, therefore, the salient features and details of the proposed adjustments in the approved tariff were advertised in the national newspapers for information of all concerned. In order to provide an opportunity of hearing to all concerned and to meet the ends of natural justice, it was also decided to conduct a public hearing on 31" October 2012 in NEPRA Main Office; and the date of hearing was also specified in the advertisement dated 24'h October, 2012 whereby participation in the hearing and filing of comments/objections from any interested person was invited.
4. On the date fixed for the hearing, representatives from Central Power Purchasing Agency (CPPA), Wapda Private Power Organization (WPF0), National Power Control Cell (NPCC), the Network for Consumer Protection, and media were present; however, no representative from Ministry of Water & Power and Ministry of Finance attended the public hearing despite the service of notice.
5. The Network for Consumer Protection (hereinafter "the Network") filed motion for leave to intervene which was considered as comments by the Authority. According to the Network fuel charges adjustment should be based on performance and efficiency of the DISCOs rather than the cost and expenditures and such incentive must be only available to the DISCOs which have improved efficiency.
6. The Authority has carefully considered the concerns raised by the Network and is of the view that the commentator's concerns have already been addressed at the time of

prescribing adjustment formula in the original determination. It is also to be noted that in the fuel charges adjustment even the impact of technical losses of the distribution system is not considered. It is further clarified that the monthly fuel charges adjustment does not include the impact of any inefficiencies either on the part of company or any other government agency.
7. From the perusal of the information so provided by CPPA, it has been observed that the actual pool fuel charges of Rs. 6.6070/kWh for the month of September 2012 increased by Rs. 0.0586/kWh (Annex-I&II) as compared to the reference fuel charges, i.e. Rs. 6.5484/kWh as indicated in the Annexure-IV of the Authority's determination pertaining to the Ex-WAPDA DISCOs for FY 2011-12.
8. As per details provided by CPPA, 82.77 GWh were purchased from small, captive and new captive power plants during September 2012. CPPA provided actual details of energy of 82.77 GWh purchased from these plants. According to the details provided by CPPA, the actual cost of this energy is Rs. 894.29 million. Since the Authority has prescribed provisional gas tariff of Captive Power Plants comprising fuel cost component which is Rs. 6.789/kWh on gas price of Rs. 560/MMBtu and fixed cost component of Rs. 1.53/kWh for new captive power plants, the cost of energy of 82.77 GWh is worked out Rs. 854.87 million. Accordingly in the instant adjustment, cost of Rs. 854.87 million for 82.77 GWh purchased from small, captive and new captive power plants has been considered provisionally, subject to adjustment on the basis of tariff determined/approved by the Authority on case to case basis.
9. The Authority also noted that during September 2012 NTDC reported 3.44% transmission losses against the determined losses of 2.50% as per the Authority's determination dated 9rh May 2011 (Case No. NEPRA/TRF-165/NTDC-2010). However, CPPA has already reduced the energy charge by Rs. 506.78 million on account of NTDC transmission losses beyond 2.5%. The financial impact of increased transmission losses is, therefore, not being passed on to the consumers.
10. The Authority has reviewed and assessed an increase of Rs. 0.0522kWh in the applicable tariff for Ex-WAPDA DISCOs on account of variations in the fuel charges for the month of September 2012 as per the following details:

11. The assessed fuel charges adjustment (increase) of Rs. 0.0522/kWh for the month of September 2012 is higher by Rs. 0.1088/kWh than the adjustment (decrease) of Rs. 0.0566/kWh for the month of August 2012, therefore, effectively there will be an increase of Rs. 0.1088/kWh in the bill of the consumers on account of fuel charges adjustment as compared to the previous month, i.e. August, 2012.
12. The adjustment as referred to in Para 10 above ;
i) shall be applicable to all the consumer categories except lifeline consumers of all the DISCOs;
ii) shall be shown separately in the consumers' bill on the basis of units billed to the consumers in the month of September 2012.
iii) DISCOs shall recover the fuel charges adjustment in respect of September 2012 in the billing month of January 2013.

Notwithstanding the fact that the monthly adjustment on account of fuel charges variation is made in pursuance of the provisions of section 31(4) of the Act XL of 1997 as well as on the basis of a mechanism/formula already determined by the Authority, yet the impact of such adjustments, if any, is to be paid by the consumers of electricity, therefore, the salient features and details of the proposed adjustments in the approved tariff were advertised in the national newspapers for information of all concerned. In order to provide an opportunity of hearing to all concerned and to meet the ends of
natural justice, it was also decided to conduct a public hearing on 29th November 2012
in NEPRA Main Office; and the date of hearing was also specified in the advertisements dated 17th and 25th November, 2012 whereby participation in the hearing and filing of comments/objections from any interested person was invited.
4. On the date fixed for the hearing, representatives from Central Power Purchasing Agency (CPPA), Wapda Private Power Organization (WPPO), National Power Control Cell (NPCC) and media were present; however, no representative from Ministry of Water & Power and Ministry of Finance attended the public hearing despite the service
of notice.
5. From the perusal of the information so provided by CPPA, it has been observed that the actual pool fuel charges of Rs. 7.0348/kWh for the month of October 2012 increased by Rs. 0.0439/kWh (Annex-I&II) as compared to the reference fuel charges, i.e. Rs. 6.9909/kWh as indicated in the Annexure-IV of the Authority's determination
pertaining to the Ex-WAPDA DISCOs for FY 2011-12.
6. As per details provided by CPPA, 87.60 GWh were purchased from small, captive and new captive power plants during October 2012. CPPA provided actual details of energy

of 87.60 GWh purchased from these plants. According to the details provided by CPPA, the actual cost of this energy is Rs. 905.96 million. Since the Authority has prescribed provisional gas tariff of Captive Power Plants comprising fuel cost component on applicable gas price (Rs. 6.1830/kWh on gas price of Rs. 510/MMBtu) and fixed cost component of Rs. 1.53/kWh for new captive power plants, the cost of energy of 87.60 GWh is worked out Rs. 885.85 million. Accordingly in the instant adjustment, cost of Rs. 885.85 million for 87.60GWh purchased from small, captive and new captive power plants has been considered provisionally, subject to adjustment on the basis of tariff determined/approved by the Authority on case to case basis.
7. The Authority also noted that during October 2012 NTDC reported 3.62% transmission losses against the determined losses of 2.50% as per the Authority's determination dated 9th May 2011 (Case No. NEPRA/TRF-165/NTDC-2010). However, CPPA has already reduced the energy charge by Rs. 609.09 million on account of NTDC transmission losses beyond 2.50/0. The financial impact of increased transmission losses is, therefore, not being passed on to the consumers.
8. The Authority has reviewed and assessed an increase of Rs. 0.0393/kWh in the applicable tariff for Ex-WAPDA DISCOs on account of variations in the fuel charges for the month of October 2012 as per the following details:

9. The assessed fuel charges adjustment (increase) of Rs. 0.0393/kWh for the month of October 2012 is lower by Rs. 0.0128/kWh than the adjustment (increase) of Rs. 0.0522/kWh for the month of September 2012, therefore, effectively there will be a decrease of Rs. 0.0128/kWh in the bill of the consumers on account of fuel charges adjustment as compared to the previous month, i.e. September, 2012.
10. The adjustment as referred to in Para 8 above ;
i) shall be applicable to all the consumer categories except lifeline consumers of all the DISCOs;
ii) shall be shown separately in the consumers' bill on tlpe basis of units billed to the consumers in the month of October 2012.

In my earlier dissenting notes in the matter of monthly Fuel Charge Adjustments for Ex-
WAPDA Distribution Companies, I had disallowed "fuel charge adjustments" on account of
serious inefficiencies prevailing in the public sector GENCOs, which is on record. As per
available information these inefficiencies still persists in GENCOs which are burdening the end
consumer.
2. So far no reference for -fuel cost adjustment" for the month of October 2012 has been
determined by the Authority. The petitions regarding determination of tariff filed by Ex-
WAPDA DISCOs for the year 2012-13 are pending before the Authority, as such fuel cost
reference has not yet been established. In the absence of an approved "fuel cost reference" for
the year 2012-13 adjustment for the month of October 2012 cannot be allowed. Law in the
matter is very clear which stipulates that the adjustment are to be made in the "approved tariff",
therefore, no adjustments could be allowed for a tariff which is neither determined nor approved.
3. For the reasons explained above, I decline the subject "fuel charge adjustment"
accordingly.

DECISION OF THE AUTHORITY IN THE MA iThR OF FUEL CHARGES ADJUSTMENT
FOR THE MONTH OF NOVEMBER 2012 FOR EX-WAPDA DISCOS
1. Pursuant to the provisions of Section 31(4) of the Regulation of Generation,
Transmission and Distribution of Electric Power Act 1997, (XL of 1997) read with the mechanism/formula determined by the Authority in the tariff determinations for Ex-
WAPDA DISCOs for the Financial Year 2011-12, the Authority has to make adjustments in the approved tariff on account of any variations in the fuel charges on a
monthly basis.
2. In order to make adjustments in the approved tariff of the XWDISCOS due to variations
in the fuel charges for the month of November 2012, necessary information as to the details of fuel charges etc was obtained from Central Power Purchasing Agency
(CPPA).
3. Notwithstanding the fact that the monthly adjustment on account of fuel charges variation is made in pursuance of the provisions of section 31(4) of the Act XL of 1997 as well as on the basis of a mechanism/formula already determined by the Authority, yet the impact of such adjustments, if any, is to be paid by the consumers of electricity, therefore, the salient features and details of the proposed adjustments in the approved tariff were advertised in the national newspapers for information of all concerned. In order to provide an opportunity of hearing to all concerned and to meet the ends of natural justice, it was also decided to conduct a public hearing on 26th December 2012 in NEPRA Main Office; and the date of hearing was also specified in the advertisements dated 20'h December 2012 whereby participation in the hearing and filing of comments/objections from any interested person was invited.

On the date fixed for the hearing, representatives from Central Power Purchasing Agency (CPPA), Wapda Private Power Organization (WPPO), National Power Control Cell (NPCC) and media were present; however, no representative from Ministry of Water & Power and Ministry of Finance attended the public hearing despite the service

From the perusal of the information so provided by CPPA, it has been observed that the actual pool fuel charges of Rs. 7.2298/kWh for the month of November 2012 increased by Rs. 0.9169/kWh (Annex-I&II) as compared to the reference fuel charges, i.e. Rs. 6.3129/kWh as indicated in the Annexure-IV of the Authority's determination pertaining to the Ex-WAPDA DISCOs for FY 2011-12.
6. As per details provided by CPPA, 83.14 GWh were purchased from small, captive and
new captive power plants during November 2012. CPPA provided actual details of

energy of 83.14 GWh purchased from these plants. According to the details provided by CPPA, the actual cost of this energy is Rs. 847.48 million. Since the Authority has prescribed provisional gas tariff of Captive Power Plants comprising fuel cost component on applicable gas price (Rs. 6.1830/kWh on gas price of Rs. 510/MMBtu) and fixed cost component of Rs. 1.53/kWh for new captive power plants, the cost of energy of 83.14 GWh is worked out Rs. 829.28 million. Accordingly in the instant adjustment, cost of Rs. 829.28 million for 83.14 GWh purchased from small, captive and new captive power plants has been considered provisionally, subject to adjustment on the basis of tariff determined/approved by the Authority on case to case basis.

6. As per details provided by CPPA, 107.10 GWh were purchased from small, captive and new captive power plants during December 2012. CPPA provided actual de is of

energy of 107.10 GWh purchased from these plants. According to the details provided by CPPA, the actual cost of this energy is Rs. 1,089.18 million. For the purpose of calculating fuel charges adjustment, the cost of energy of NCPPs has been adjusted on the basis of fuel cost component of Rs. 5.1411/kWh and Variable O&M of Rs. 0.3822/kWh. The cost of energy delivered by gas based CPPs have also been adjusted on the similar lines in accordance with the approved tariff. The cost of energy delivered by bagasse based CPPs has been adjusted on the basis of fuel cost component of Rs. 6.9855/kWh and fixed cost of Rs. 1.53/kWh according to the approved tariffs. The tariffs of captive/small/new captive power plants, in respect of which power acquisition requests (PARs) are in process, have been allowed on provisional basis which will be subject to adjustment on the basis of tariff approved by the Authority. For the purpose of provisional application of tariff, those power plants have been considered in respect of whom PARs have been admitted. Since no PARs have been either filed or admitted for Agar Textile (Private) Limited for its 2 MW captive plant, Hi-Tech Pipe & Engineering Industries (Private) Limited for its captive plant and Ramzan Sugar Mills for its captive plant, energy and its cost from these plants has not been considered. Accordingly for the instant adjustment, 99,024,564 kWh and cost of Rs. 821,160,030 has been considered on account of energy purchased from small, captive and new captive power plants.

The Authority also noted that during December 2012 NTDC reported 3.11% transmission losses against the determined losses of 2.50% as per the Authority's determination dated 9th May 2011 (Case No. NEPRAJTRF-165/NTDC-2010). However, CPPA has already reduced the energy charge by Rs. 343.54 million on account of NTDC transmission losses beyond 2.5%. The financial impact of increased transmission losses is, therefore, not being passed on to the consumers.
8. The Authority has reviewed and assessed an increase of Rs. 1.3326Wh in the applicable tariff for Ex-WAPDA DISCOs on account of variations in the fuel charges for the month of December 2012 as per the following details:

2. The above adjustment of Rs.1.5588/kWh shall be applicable to all the consumer categories except lifeline consumers of all the XWDISCOs. XWDISCOs shall recover the fuel charges adjustment in respect of January 2013 in the billing month of August 2013.

Fuel Charges Adjustment for XIVDISCOs
DECISION OF THE AUTHORITY IN THE MATTER OF FUEL CHARGES ADJUSTMENT FOR THE MONTH OF JANUARY 2013 FOR EX-WAPDA DISCOS
1. Pursuant to the provisions of Section 31(4) of the Regulation of Generation, Transmission and Distribution of Electric Power Act 1997, (XL of 1997) read with the mechanism/formula determined by the Authority in the tariff determinations for Ex-WAPDA DISCOs for the Financial Year 2011-12, the Authority has to make adjustments in the approved tariff on account of any variations in the fuel charges on a monthly basis.
2. In order to make adjustments in the approved tariff of the XWDISCOS due to variations in the fuel charges for the month of January 2013, necessary information as to the details of fuel charges etc was obtained from Central Power Purchasing Agency (CPPA).
3. Notwithstanding the fact that the monthly adjustment on account of fuel charges variation is made in pursuance of the provisions of section 31(4) of the Act XL of 1997 as well as on the basis of a mechanism/formula already determined by the Authority, yet the impact of such adjustments, if any, is to be paid by the consumers of electricity, therefore, the salient features and details of the proposed adjustments in the approved tariff were advertised in the national newspapers for information of all concerned. In order to provide an opportunity of hearing to all concerned and to meet the ends of natural justice, it was also decided to conduct a public hearing on 28th February 2013 in NEPRA Main Office. However, on the specified date, senior officials of CPPA were not present; therefore, the hearing was postponed and rescheduled on 14th March 2013. The dates of hearings were also specified in the advertisements dated 215' February 2013 and 9'h March 2013 respectively whereby participation in the hearing and filing of comments/objections from any interested person was invited.
4. On the date fixed for the hearing, representatives from Central Power Purchasing Agency (CPPA), Wapda Private Power Organization (WPPO), National Power Control Cell (NPCC) and media were present; however, no representative from Ministry of Water & Power and Ministry of Finance attended the public hearing despite the service of notice.
5. From the perusal of the information so provided by CPPA, it has been observed that the actual pool fuel charges of Rs. 10.5535/kWh for the month of January 2013 increased by Rs. 1.5974/kWh (Annex-I&II) as compared to the refer nce fuel charges, i.e. Rs. 8.9561/kWh as indicated in the Annexure-IV of the Authority's determination pertaining to the Ex-WAPDA DISCOs for FY 1-12.

Fuel Charges Adjustment for XIVDISCOs
6. As per details provided by CPPA, 122.94 GWh were purchased from small, captive and new captive power plants during January 2013. CPPA provided actual details of energy purchased from these plants. According to the details provided by CPPA, the actual cost of this energy is Rs. 1,294.01 million. For the purpose of calculating fuel charges adjustment, the cost of energy of NCPPs has been adjusted on the basis of fuel cost component of Rs. 5.4257/kWh on prevailing gas price of Rs. 538.23/MMBtu including GID Cess of Rs. 50/MMBtu and Variable O&M of Rs. 0.3822/kWh. The cost of energy delivered by gas based CPPs have also been adjusted on the similar lines in accordance with the approved tariff. The cost of energy delivered by bagasse based CPPs has been adjusted on the basis of fuel cost component of Rs. 6.9855/kWh and fixed cost of Rs. 1.53/kWh according to the approved tariffs. The tariffs of captive/small/new captive power plants, in respect of which power acquisition requests (PARs) are in process, have been allowed on provisional basis which will be subject to adjustment on the basis of tariff approved by the Authority. For the purpose of provisional application of tariff, those power plants have been considered in respect of whom PARs have been admitted. Since no PARs have been admitted for Agar Textile (Private) Limited for its 2 MW captive plant, Hi-Tech Pipe & Engineering Industries (Private) Limited for its captive plant and Ramzan Sugar Mills for its captive plant, energy and its cost from these plants has not been considered. Accordingly for the instant adjustment, 115,622,908 kWh and cost of Rs. 1,003,535,499 has been considered on account of energy purchased from small, captive and new captive power plants.
7. The Authority also noted that during January 2013 NTDC reported 3.53% transmission losses against the determined losses of 2.50% as per the Authority's determination dated 9th May 2011 (Case No. NEPRA/TRF-165/NTDC-2010). However, CPPA has already reduced the energy charge by Rs. 654.85 million on account of NTDC transmission losses beyond 2.5%. The financial impact of increased transmission losses is, therefore, not being passed on to the consumers.
8. The Authority has reviewed and assessed an increase of Rs. 1.5588/kWh in the applicable tariff for Ex-WAPDA DISCOs on account of variations in the fuel charges for the month of January 2013 as per the following details:

1. In order to provide an opportunity of hearing to all concerned and to meet the ends of natural justice, it was also decided to conduct a public hearing on 2nd April 2013 in Shalimar Hall, Lahore Chamber of Commerce & Industry, Shahra-e-Tijarat, Lahore and the date of hearing was also specified in the advertisement dated 28th March 2013 whereby participation in the hearing and filing of comments/objections from any interested person was invited.
4. On the date fixed for the hearing, representatives from Central Power Purchasing Agency (CPPA), Wapda Private Power Organization (WPPO), National Power Control Cell (NPCC) and media were present; however, no representative from Ministry of Water & Power and Ministry of Finance attended the public hearing despite the service of notice.

From the perusal of the information so provided by CPPA, it has been observed that the actual pool fuel charges of Rs. 8.3124/kWh for the month of February 2013 increased by Rs. 0.6707/kWh (Annex-I&II) as compared to the reference fuel charges, i.e. Rs. 7.6418/kWh as indicated in the Annexure-IV of the Authority's determination pertaining to the Ex-WAPDA DISCOs for FY 2011-12.

6. As per details provided by CPPA, 109.68 GWh were purchased from small, captive and new captive power plants during February 2013. CPPA provided actual details of energy purchased from these plants. According to the details provided by CPPA, the actual cost of this energy is Rs. 1,166.56 million. For the purpose of calculating fuel charges adjustment, the cost of energy of NCPPs has been adjusted on the basis of fuel cost component of Rs. 5.4257/kWh on prevailing gas price of Rs. 538.23/MMBtu including GID Cess of Rs. 50/MMBtu and Variable O&M of Rs. 0.3822/kWh. The cost of energy delivered by gas based CPPs have also been adjusted on the similar lines in accordance with the approved tariff. The Authority also noted that during February 2013 NTDC reported 3.36% transmission losses against the determined losses of 2.50% as per the Authority's determination dated 9th May 2011 (Case No. NEPRA/TRF-165/NTDC-2010). However, CPPA has already reduced the energy charge by Rs. 376.72 million on account of NTDC transmission losses beyond 2.5%. The financial impact of increased transmission losses is, therefore, not being passed on to the consumers.
8. The Authority has reviewed and assessed an increase of Rs. 0.6301/kWh in the applicable tariff for Ex-WAPDA DISCOs on account of variations in the fuel charges for the month of February 2013 as per the following details:

From the perusal of the information so provided by CPPA, it has been observed that the actual pool fuel charges of Rs. 9.1365/kWh for the month of March 2013 increased by Rs. 1.3764/kWh (Annex-I&II) as compared to the reference fuel charges, i.e. Rs. 7.7601/kWh as indicated in the Annexure-IV of the Authority's determination pertaining to the Ex-WAPDA DISCOs for FY 2011-12.
6. As per details provided by CPPA, 116.26 GWh were purchased from small, captive and new captive power plants during March 2013. CPPA.provided actual details of energy purchased from these plants. According to the details provided by CPPA, the actual

cost of this energy is Rs. 1,220.68 million. For the purpose of calculating fuel charges
adjustment, only fuel cost components of these plants have been considered. The tariffs of captive/small/new captive power plants, in respect of which power acquisition requests (PARs) are in process, have been allowed on provisional basis which will be subject to adjustment on the basis of tariff approved by the Authority. For the purpose of provisional application of tariff, those power plants have been considered in respect of whom PARs have been admitted. Since no PARs have been admitted for Agar Textile (Private) Limited for its 2 MW captive plant, Hi-Tech Pipe & Engineering
Industries (Private) Limited for its captive plant and Ramzan Sugar Mills for its captive plant, energy and its cost from these plants has not been considered. 7. The Authority also noted that during March 2013 NTDC reported 165.01 GWh (2.67%) transmission losses against the determined losses of 2.50% as per the Authority's determination dated 9th May 2011 (Case No. NEPRA/TRF-165/NTDC-2010). However, CPPA has already reduced the energy charge by Rs. 91.432 million on account of NTDC transmission losses beyond 2.5%. The financial impact of increased transmission losses is, therefore, not being passed on to the consumers.
8. The Authority has reviewed and assessed an increase of Rs. 1.3325/kWh in the applicable tariff for Ex-WAPDA DISCOs on account of variations in the fuel charges for the month of March 2013 as per the following details:

10. The adjustment as referred to in Para 8 above ;

CORRIGENDUM DECISIONs OF THE AUTHORITY IN THE MATTER OF FUEL CHARGES
ADJUSTMENT FOR EX-WAPDA DISCOS
Due to the decision of the Islamabad High Court dated 24'h October, 2012 whereby the application of fuel charges adjustment was declared unlawful, the recovery of fuel adjustment could not be implemented. Intra Court Appeal was filed against the said order of the Islamabad High Court and recently the said order of the Islamabad High Court has been suspended by a divisional bench of the Islamabad High Court. In separate petitions, Lahore High Court vide its order dated 28-01-2013 maintained the decision of the Authority in respect of fuel price adjustment except that residential consumers consuming 350 units will be exempt from the levy of fuel price adjustment.
2. The Authority in its decisions for the month of August 2012 to November 2012 directed the DISCOs to charge the adjustments in the billing month of January 2013 which has already expired therefore, modification for charging the billing month is required to be made in the perspective decisions of the Authority. In view thereof the corresponding billing month pertaining to the period of August 2012 to =1013 are being replaced with the following.
Para 11(iii) of the Decision for August 2012 9—
DISCOs shall recover the fuel charges adjustment in respect of August 2012 in the billing month of June 2013.
Para 12(iii) of the Decision for September 2012
DISCOs shall recover the fuel charges adjustment in respect of September 2012 in the billing month of June 2013.
Para 10(11) of the Decision for October 2012
DISCOs shall recover the fuel charges adjustment in respect of October 2012 in the billing month of June 2013.
