The Parliament of Queensland enacts—

Part 1 Preliminary

1 Short title

This Act may be cited as the Transport and Other Legislation(Road Safety, Technology and Other Matters) Amendment Act2020.

2 Commencement

(1) The following provisions commence on a day to be fixed byproclamation—

(a) part 10, division 3;

(b) sections 53 to 60 and section 62, to the extent it insertsdefinition video.

(2) Part 10, division 2, other than section 45(2), commences onthe later of the following—

(a) the date of assent of this Act;

(b) the commencement of the Road Vehicle Standards Act2018 (Cwlth), section 15.

(3) Schedule 1, part 2 commences on the later of the following—

(a) the date of assent of this Act;

(b) immediately after the commencement of thePersonalised Transport Ombudsman Act 2019, section135(2) to the extent it inserts definition driverauthorisation.

This part amends the Gaming Machine Act 1991.

4 Amendment of s 257 (Seizure of document wrongly used as evidence of age)

Section 257—

insert—

(3) Subsection (1) does not require a person to seizeor confiscate a document stored or displayed on adigital device if—

(a) the device is used in the contravention ofsection 255; and

(b) in contravening the section a personproduced the device to display the followingthings, or an image or other designpurporting to be the thing—

(i) a digital authority;

(ii) a digital evidence of age;

(iii) a digital evidence of identity.

6 Amendment of s 259 (Seizure of material associated with representation of age)

Section 259—

insert—

(2) Nothing in this section authorises an inspector toseize and confiscate a digital device if—

(a) the inspector reasonably believes or suspectsthe device was used in the commission ofthe offence mentioned in section 255(2)(a)or (b) or 256(1) or (2); and

(b) in committing the offence the person usedthe device to display the following things, oran image or other design purporting to bethe thing—

(i) a digital authority;

(ii) a digital evidence of age;

(iii) a digital evidence of identity.

7 Amendment of s 329 (General powers of inspectors)

Section 329—

insert—

(13) Nothing in this section authorises an inspector toseize and confiscate a digital device if—

(a) the inspector reasonably believes a personhas committed an offence mentioned insection 255 or 256; and

(b) in committing the offence the person usedthe device to display the following things, oran image or other design purporting to bethe thing—

(i) a digital authority;

(ii) a digital evidence of age;

Section 184—

insert—

(2) Nothing in this section authorises an inspector toseize a digital device if—

(a) the offence is an offence mentioned insection 166(3); and

(b) in committing the offence a person used thedevice to display the following things, or animage or other design purporting to be thething—

(i) a digital authority;

(ii) a digital evidence of age;

(iii) a digital evidence of identity.

(3) In this section—

14 Amendment of s 6 (Acceptable evidence of age)

Section 6—

insert—

(1A) Also, for this Act, acceptable evidence of the ageof a person is—

(a) a digital authority that complies withsubsection (1)(c) and (d); or

(b) a digital evidence of age; or

(c) a digital evidence of identity.

15 Amendment of s 160 (Seizure of document wrongly used as evidence of age)

Section 160—

35 Amendment of s 240 (Sublease of land to railway managers)

the owner of the acquired land as a party tothe interest.

(2) Section 240(7C)(b)—

omit, insert—

(b) despite the Land Act 1994, section 372(5),any public utility easement over the freeholdland continues in the rail transport corridor;and

(3) Other than as stated in this section, a person hasno right to compensation for the inclusion of landin the perpetual lease under section 240.

(4) In this section—

registration confirmation statement, for land,means a document issued by the registrar underthe Land Title Act 1994 showing all registeredinterests under that Act in the land.

37 Amendment of s 302 (Declaration of land as busway land)

Section 302—

insert—

(1A) The Minister may, in a declaration undersubsection (1), declare that a stated interest in landdeclared to be busway land continues in relationto the lease of the land to the State under section303(4).

38 Amendment of s 303 (Effect on land of busway declaration)

(1) Section 303—

(2B) Subsection (2C) applies to the following that isdeclared under section 302(1) to be buswayland—

(a) unallocated State land;

(2) In the absence of proof to the contrary—

(a) the vehicle depicted in the image or video istaken to be moving but not reversing, orstationary but not parked; and

(b) the vehicle depicted in the image or video istaken to be fitted with an approved seatbeltin the seating position occupied by thedriver or passenger; and

(c) if the image or video depicts the driver orpassenger not wearing a seatbelt, the driveror passenger is taken not to be wearing anapproved seatbelt.

(3) In this section—

approved seatbelt, in relation to a prescribedoffence, has the meaning it has for the prescribedoffence.

120E Photographic or video evidence of mobile phone use

(1) This section applies to a proceeding for aprescribed offence in which the use of a mobilephone by the driver of a vehicle is relevant if,under section 120, the prosecution intends to relyon an image or video made by a photographicdetection device as evidence of the driver’s use ofa mobile phone.

(2) In the absence of proof to the contrary, the vehicledepicted in the image or video is taken to bemoving, or stationary but not parked.

(3) In this section—

mobile phone, for a prescribed offence, has themeaning it has for the prescribed offence.

120F Report about offence detected by photographic detection device

(1) This section applies to a proceeding for aprescribed offence if, under section 120, theprosecution intends to rely on an image or a seriesof images, or a video or a series of videos, madeby a photographic detection device as evidence ofparticular elements of the offence.

(2) The prosecution may produce a report complyingwith this section in the proceeding.

(3) The report must—

(a) be made in the way prescribed by regulationfor the photographic detection device; and

(b) contain only 1 or more of the following—

(i) a copy of the image or some or all ofthe images in the series, or a still imageor images taken from the video or someor all of the videos in the series;

(ii) a summary of the things depicted in theimage or images, or the still image orimages from the video or videos;

(iii) for a copy of images in a series or stillimages of videos in a series—thenumbers of the images or videos andthe times they were taken, as identifiedunder section 120(3);

(iv) a matter mentioned in section120A(4)(a), (b) or (c) or 120B(5)(a),(b), (c), (d) or (e);

(v) a matter prescribed under subsection(4)(b); and

(c) include a certification, or be accompaniedby a certificate, signed by the commissionerstating that the report—

(4) If the way prescribed under subsection (3)(a) for aphotographic detection device requires orotherwise involves analysis or a determinationbeing made by a person, the regulation muststate—

(a) the class of appropriately qualified personswho may conduct the analysis or make thedetermination; and

(b) the matters about the proper conduct of theanalysis or making of the determination thatmust be stated in a report under this section.

(5) A report produced under this section is evidenceof the following—

(a) the things depicted in a copy of an image, ora still image from a video, contained in thereport;

(b) if a copy of an image or still image from avideo contained in the report has a markingor writing associated with the image orvideo—each thing in relation to the imageor video that the marking or writing isprescribed to mean under a regulation;

(c) a matter stated in a summary mentioned insubsection (3)(b)(ii) contained in the report;

(d) a matter mentioned in subsection (3)(b)(iii),(iv) or (v) contained in the report.

(b) a relevant authority that is a correspondingauthority that is—

(i) encoded in a digital form; and

(ii) able to be displayed on a digital device.

29AD Meaning of digital evidence of age

A digital evidence of age, for a person, means thefollowing information contained in the person’sdigital authority that can be displayed on a digitaldevice using the approved app other than as adigital authority—

(a) the person’s digital photo;

(b) information, by reference to the person’sdate of birth or otherwise, that indicates theperson has attained a particular age.

29AE Meaning of digital evidence of identity

A digital evidence of identity, for a person, meansthe following information contained in theperson’s digital authority that can be displayed ona digital device using the approved app other thanas a digital authority—

(a) the person’s name;

(b) the person’s digital photo;

(c) the person’s date of birth.

29AF Chief executive may approve app

(1) For the purposes of this part, the chief executivemay, by notice published on the department’swebsite, approve an app to store and display anyof the following things—

(a) a digital authority;

29AG Definitions for division

In this division—

access includes—

(a) read; and

(b) copy; and

(c) download; and

(d) photograph; and

(e) scan; and

(f) use an electronic system, or othertechnology that provides connectivitybetween digital devices, to do anythingmentioned in paragraphs (a) to (e).

authorised officer means—

29AH Use of digital authority

(1) This section applies if an Act requires or permitsa person to produce a relevant authority to anotherperson to evidence—

(a) the person holds the relevant authority; or

(b) the information stated in the authority.

(2) For the Act, the person is taken to produce therelevant authority if the person displays the digitalauthority for the relevant authority.

(3) Subsection (2) does not apply if—

(a) when the person displays the digitalauthority, the other person is not able toaccess the digital authority in a way, or to anextent, that the other person is authorised toaccess the relevant authority under the Act;or

(b) after being requested by the other person todo so the person does not refresh the digitalauthority.

(1) This section applies if an Act requires or permitsa person to produce a document to another personto evidence—

(a) the person has attained a particular age; or

(b) the person’s identity.

(2) For the Act, the person is taken to produce thedocument if the person displays a digital evidenceof age or digital evidence of identity thatevidences the information stated in the document.Example—

A person may use a digital evidence of identity toevidence that the person has attained a particular age.

(3) Subsection (2) does not apply if—

(a) when the person displays the digitalevidence of age or digital evidence ofidentity, the other person is not able toaccess the digital evidence of age or digitalevidence of identity in a way, or to an extent,that the other person is authorised to accessthe document under the Act; or

(b) after being requested by the other person todo so the person does not refresh thedisplayed digital evidence of age ordisplayed digital evidence of identity.

47 Transitional regulation-making power

(1) A regulation (a transitional regulation) maymake provision about a matter for which—

(a) it is necessary to make provision to allow orfacilitate the doing of anything to achievethe transition from the operation of this Actas it was in force immediately before thecommencement to the operation of this Actas amended by the Transport and OtherLegislation (Road Safety, Technology andOther Matters) Amendment Act 2020; and

(b) this Act does not make provision orsufficient provision.

(2) A transitional regulation may have retrospectiveoperation to a day not earlier than the day ofcommencement.

(3) A transitional regulation must declare it is atransitional regulation.

(4) A transitional regulation may only be made within2 years after the commencement.

(5) This division and any transitional regulationexpire 3 years after the day of commencement.

70 Amendment of s 40 (Seizure of document wrongly used as evidence of age)

Section 40—

insert—

(3) Nothing in this section authorises a person toseize a digital device if—

(a) the device is used in the contravention ofsection 38(2) or (3); and

(b) in contravening the section a person used thedevice to store or display the followingthings, or an image or other designpurporting to be the thing—

(i) a digital authority;

(ii) a digital evidence of age;

(iii) a digital evidence of identity.
