Traffic Negative Averment Counterclaim

The negative averment is putting the burden of proof on the ones making an accusation and the counterclaim is to make a claim for the damages that the state has caused to by detaining an individual on a misdemeanor, which is a non arrestable offense as long as the crime does not continue.
