INTRODUCTIONThe Defend Trade Secrets Act was established to provide industry with the optionof asserting civil claims for trade secret misappropriation in federal courts. Withmore than 300 complaints filed over in the first year of enactment, the DTSA iscited as the most significant expansion of federal intellectual property law since theLanham Act in 1946 and provides clear advantages to counsel. The MIP TradeSecrets Forum will return to Palo Alto, clarifying a number of issues that have arisenover the past year.
The growth in trade secrets threats needs to be managed appropriately in yourorganisation. It is imperative IP counsel are equipped with strategies to protecttrade secrets from internal threats such as data contamination, cyber and cloudstorage issues. Under the DTSA intellectual property can be seen as a weapon, theintersection of patent and trade secret protection will be analysed to determine thepros and cons of keeping innovations ‘secret’.
Rulings on early-stage issues will be addressed, with particular reference to Uberv Waymo and track the relationship between civil and criminal prosecution oftrade secret misappropriation. Other discussions will advise on ex-parte seizuretips and how to enforce an ITC exclusion order.
