Section 2 - Provision C.2 Reporting Municipal Operations

Program Highlights and Evaluation Highlight/summarize activities for reporting year:

Summary: In FY18-19, the Town of Los Gatos (Los Gatos) completed several municipal projects (or substantial progress is underway) including: street improvements with new overlays using recycled rubber pavement on National Avenue, new recycle containers placed at Blossom Hill Park and Belgatos Park, dead tree removal and trash removal from Heintz, Saint Josephs and Belgatos Open Spaces, new storm piping and a drain inlet improvements on Jones Road, installation of trash, recycling containers and pet waste dispensers along Los Gatos Creek Trail. In addition, Los Gatos funded through its FY19-20 CIP the development of: 1) a new Stormwater Master Plan to manage stormwater runoff proactively to protect water quality and to minimize impacts of localized and downstream flooding by identifying infrastructure improvements for the collection, conveyance, and treatment of stormwater runoff; 2) installation of multiple trash capture devices in storm inlets to meet the Municipal Regional Permit Provision (MRP) C.10 trash reduction requirements. Los Gatos staff attended Santa Clara Valley Urban Runoff Pollution Prevention Program’s (SCVURPPP) Rural Roads training on June 25, 2019. Topics included stormwater erosion prevention and sediment control, effects of uncontrolled stormwater and controlling stormwater with BMPs, plus a field session with hands-on BMPs. The West Valley Clean Water Program Authority (Authority) participated in the SCVURPPP’s Municipal Maintenance Ad Hoc Task Group on behalf of Los Gatos and provided on-going information to staff. Refer to the C.2. Municipal Operations section of the SCVURPPP FY18-19 Annual Report for a description of activities implemented at the countywide and/or regional level.

C.3.h.v.(3)(d)-(e) ►Installed Stormwater Treatment SystemsOperation and Maintenance Verification Inspection ProgramReportingProvide a discussion of the inspection findings for the year and any common problems encountered with various types of treatment systems and/or HM controls. This discussion should include a general comparison to the inspection findings from the previous year.

Summary: The findings for FY18-19 were comparable to FY17-18 in that debris was the main factor for corrective measures. All accounts were mediated with a verbal education/warning. The Town of Los Gatos (Los Gatos) continues to monitor all sites to ensure compliance. Provide a discussion of the effectiveness of the O&M Program and any proposed changes to improve the O&M Program (e.g., changes in prioritization plan or frequency of O&M inspections, other changes to improve effectiveness program).

Summary: The O&M program in Los Gatos is working as designed. Los Gatos experienced a large amount of rain at times in FY18-19 and all facilities worked flawlessly. Los Gatos does not feel any changes are necessary at this time.

C.3.i ►Required Site Design Measures for Small Projects andDetached Single Family Home ProjectsOn an annual basis, discuss the implementation of the requirements of Provision C.3.i, including ordinance revisions, permit conditions, development of standard specifications and/or guidance materials, and staff training.

Summary: The Bay Area Stormwater Management Agencies Association (BASMAA) prepared standard specifications in four fact sheets regarding the site design measures listed in Provision C.3.i, as a resource for Permittees. Los Gatos has modified local policies/procedures and forms/checklists to require all applicable projects approved after December 1, 2012 to implement at least one of the site design measures listed in Provision C.3.i. Small projects must implement at least one of six specified LID site design measures as follows: • Direct roof runoff into cisterns or rain barrels for reuse.• Direct roof runoff onto vegetated areas.• Direct runoff from sidewalks, walkways, and/or patios onto vegetated areas.• Direct runoff from driveways and/or uncovered parking lots onto vegetated areas.• Construct sidewalks, walkways, and/or patios with permeable surfaces.• Construct bike lanes, driveways, and/or uncovered parking lots with permeable surfaces.

As part of the GSI Plan development process, Los Gatos reviewed its existing policies, ordinances, and/or other legal mechanisms related to the implementation of stormwater NPDES permit requirements and found that it has sufficient legal authority to implement the GI Plan. The Los Gatos Town Council’s adoption of the GSI Plan has further strengthened this authority.

C.3.j.i.(5)(d) ►Green Infrastructure OutreachOn an annual basis, provide a summary of your agency’s outreach and education efforts pertaining to Green Infrastructure planning and implementation.

Summary: Please refer to Santa Clara Valley Urban Runoff Pollution Prevention Program (SCVURPPP) FY18-19 Annual Report for a summary of outreach efforts implemented by the Program. Additionally, Los Gatos staff training is on-going when opportunities are available. Los Gatos staff, as well as, West Valley Clean Water Program Authority (Authority) staff, attend bi-monthly C3PO AHTG meetings where GSI is discussed at each meeting. In November 2018, the Authority Board received a status presentation on the GSI Plan approval process and information memorandum in July on the Plan and schedule for adoption.

The Authority launched a new website that provides easier access to the public and municipal staff for information on every aspect of the Stormwater Pollution Prevention Program, including Green Stormwater Infrastructure. The GSI Plan will be available on both the Los Gatos and Authority websites. The Authority website is advertised on business cards, in staff newsletters and on promotional items given to the public. The webpage on Green Infrastructure can be found at http://www.cleancreeks.org/161/Green-Stormwater-Infrastructure

C.3.j.ii.(2) ►Early Implementation of Green InfrastructureProjectsOn an annual basis, submit a list of green infrastructure projects, public and private, that are already planned for implementation during the permit term and infrastructure projects planned for implementation during the permit term that have potential for green infrastructure measures. Include the following information:

• A summary of planning or implementation status for each public and private green infrastructure project that is not also a RegulatedProject as defined in Provision C.3.b.ii. (see C.3.j.ii.(2) Table B - Planned Green Infrastructure Projects).

• A summary of how each public infrastructure project with green infrastructure potential will include green infrastructure measures to themaximum extent practicable during the permit term. For any public infrastructure project where implementation of green infrastructuremeasures is not practicable, submit a brief description of the project and the reasons green infrastructure measures were impracticable toimplement (see C.3.j.ii.(2) Table A - Public Projects Reviewed for Green Infrastructure).

Describe how this provision is being implemented by your agency, including the process used by your agency to identify projects with potential for green infrastructure, if applicable.

Summary of Early Implementation Planning:

Los Gatos identifies and reviews potential GSI projects yearly. Section 4 – Provision C.4 Industrial and Commercial Site Controls Program Highlights and Evaluation Highlight/summarize activities for reporting year:

Summary: The West Valley Clean Water Program Authority (Authority) continued to coordinate industrial and commercial inspections on behalf of the West Valley communities. The Santa Clara County Fire Department (SCCFD) and Authority contract staff conduct industrial and commercial inspections. In FY18-19, 81 inspections were conducted in the Town of Los Gatos (Los Gatos). Four of those inspections were conducted at facilities receiving IDDE inspections the previous year. One verbal warning was issued. The most common issues found during inspections was poor housekeeping of outdoor storage and disposal areas. The Authority, on behalf of Los Gatos, participated in the Santa Clara Valley Urban Runoff Pollution Prevention Program (SCVURPPP) IND/IDDE Ad Hoc Task Group (AHTG). Refer to the C.4. Industrial and Commercial Site Controls Selection of the SCVURPPP FY18-19 Annual Report for a description of SCVURPPP’s activities. In FY19-20, the Authority will be hiring a part-time storm water compliance inspector on staff and updating Los Gatos’s Business Inspection Plan and Emergency Response Plan.

Summary: In FY18-19, the Town of Los Gatos (Los Gatos) developed new standard operating procedures (SOPs) for yearly inspection and cleaning of the storm drain collection system. The new SOPs require all storm drain inlets in Los Gatos to be cleaned once every two years, rotating half each year. During inspections, crews are required to report illicit discharges to the West Valley Clean Water Program Authority (Authority). The Authority, on behalf of Los Gatos, will respond and investigate IDDE reports in accordance with its Emergency Response Plan (ERP). The Authority participated in the Santa Clara Valley Urban Runoff Pollution Prevention Program’s (SCVURPPP) IND/IDDE Ad Hoc Task Group (AHTG) on behalf of Los Gatos and provided information to municipal staff as needed. SCVURPPP provided an IND/IDDE Training on May 30, 2019. Authority staff attended the training on behalf of Los Gatos. Refer to the C5 Illicit Discharge Detection and Elimination section of SCVURPPP’s FY18-19 Annual Report for a description of activities at the countywide and regional levels.

C.5.c.iii ►Complaint and Spill Response Phone Number Summary of any changes made during FY18-19: No change for the Town of Los Gatos’s (Los Gatos) website. However, during FY18-19, the Authority developed and launched a new website that provides easier access to the public, and municipal staff for information on every section of the Stormwater Pollution Prevention Program, including a new online complaint and spill response reporting feature. The “report a spill” tab is located on the home screen for easy, prominent access. The website is advertised on business cards, in newsletters and promotional items given to the public. Initial response to complaints is handled by the Authority, contract inspector, or city staff, as appropriate. All complaints are logged, investigated and followed up per the ERP. Resolution may be in the form of “no discharge or incident found.” There were 12 reported incidents of discharges in Los Gatos. Two were reported by citizens, six reported by other agency staff referrals, and four reported by an illicit discharge inspector. Of the 12 reported incidents, two were associated with a business, and will be added to the IND Business Inspection List for additional stormwater inspections in FY19-20. The most common types of incidents to occur were related to vehicle/equipment leaking. During the term of this permit, since FY15-16, reported discharges have declined from a high of 22 to a low of nine last year and twelve this year. Discharges reaching the storm drain have ranged from six to sixteen incidents per year since FY15-16.

C.5.e.iii.(2) ►Control of Mobile Sources

(a) Provide changes to your agency’s minimum standards and BMPs for each of the various types of mobile businesses since the 2017 Annual Report (C.5.e.iii.(2)(a)))

Los Gatos and the Authority follow the minimum standards and BMPs described in the “Mobile Businesses - Best Management Practices” brochure developed by the SCVURPPP IND/IDDE AHTG in May 2012 when investigating the following mobile business categories: automobile washers/detailers, power washers, carpet cleaners, steam cleaners, pet care services. There have been no changes to the BMPs since the 2017 Annual Report and no additional BMPs for other mobile business types have been developed.

(b) Provide changes to your agency’s enforcement strategy for mobile businesses (C.5.e.iii.(2)(b)

The Authority, on behalf of the West Valley Communities, responds to most discharge complaints. If complaints are received by Los Gatos, the information is forwarded to the Authority for investigation. Mobile businesses improperly discharging wash water are usually found and reported through calls to the illegal dumping hotline by citizens, interagency referrals or from inspector or field crew observations. The Authority’s inspectors respond and investigate referrals for mobile business discharges. Enforcement and follow-up are conducted in accordance with the C5 Emergency Response Plan. The mobile business, if identified, is tracked by sending data to SCVURPPP. No IDDEs were reported from mobile businesses in Los Gatos in FY18-19. In FY18-19 SCVURPPP’s countywide enforcement strategy was updated to include tracking mobile business enforcement actions from SCVURPPP agencies in a table available on the SCVURPPP members only website. The tracking table is periodically updated.

SCVURPPP, the Authority and the West Valley Communities have not developed any new minimum standards and BMPs for additional types of mobile business other than those described in (a) above.

The Authority developed a new website that provides easier access to the public, and municipal staff for information on every section of the Stormwater Pollution Prevention Program, including a section for businesses http://www.cleancreeks.org/165/Business with information on Mobile Businesses and access to all SCVURPPP BMP brochures. The website is advertised on business cards, in newsletters and promotional items given to the public. The website can be found at www.cleancreeks.org. No targeted outreach or education was conducted specifically to mobile businesses during FY18-19 other than what took place at the Countywide level by SCVURPPP. Refer to the C.5 Illicit Discharge Detection and Elimination section of countywide program’s FY18-19 Annual Report for description of activities at the countywide or regional level.

In 2014 the SCVURPPP compiled an inventory of mobile businesses located in Santa Clara County. The inventory was developed by reviewing business licenses, yellow page searches and online business searches. The inventory includes automotive washing, steam cleaning, power washing, pet care services and carpet cleaning mobile businesses. The inventory is periodically updated with mobile businesses stormwater inspectors observe during routine field activities, including responding to illicit discharges. The inventory is made available to all Co-permittees on the SCVURPPP members only webpage. The inventory is included in the Program’s FY18-19 Annual Report. The inventory currently has over 190 mobile businesses in Santa Clara County. Of those, one has a business located in Los Gatos.

Enforcement actions are typically taken in response to a complaint or illicit discharge through our IDDE Program. Enforcement actions are tracked in the city’s spill and discharge complaint tracking system required by MRP C.5.d.ii. In FY18-19 there were no enforcement actions taken for mobile businesses.

C.5.f.iii ►MS4 Map Availability

Discuss how you make your MS4 map available to the public and how you publicize the availability of the MS4 map.

This past year, MS4 maps created by the Oakland Museum, that provide detailed watershed features including the location of municipal storm drains that are 24 inches or more in diameter in the West Valley Communities, were made available on the Authority’s new website at www.cleancreeks.org/164/Stormwater-Pollution. In addition, the maps are made publicly available through SCVURPPP’s website. The direct web link to access the maps is :http://www.mywatershedwatch.org/about-watersheds/ The availability of these maps is publicized through local, SCVURPPP and the countywide Watershed Watch campaign. The Authority promotes these maps through its website. Physical maps are provided for viewing at the Authority’s public outreach table events (see Section C7 for list of Outreach events). Additionally, Los Gatos provides public access to town storm drain system maps at the Public Works department.

Comments: Public Works Engineering Division inspects construction projects that are also C3 projects. The Building Department inspects all other construction projects.

Over the course of FY18-19, Building Department inspectors conducted approximately 3,900* inspections for construction projects throughout the Town of Los Gatos (Los Gatos). All construction sites must have site-specific, seasonally, and phase appropriate, effective BMPs. Inspectors are trained to keep construction sites compliant with stormwater BMPs year-round.

Comments: During various rain events between October and April, seven sites lacked appropriate BMPs for erosion control leading to actual discharges observed during inspections. Inspectors worked with the contractors through verbal notices to install necessary BMPs to control discharge. Only one site escalated to a Stop Work order. This site needed additional time to comply but corrections were made in a timely period before the next rain event.

Describe your evaluation of the tracking data and data summaries and provide information on the evaluation results (e.g., data trends, typical BMP performance issues, comparisons to previous years, etc.).

Summary: Comparisons to last fiscal year could not be made due to lost data in FY17-18. This year’s data shows minor BMP issues that are usually resolved after one verbal warning. A few sites required more than one verbal warning and one site received a stop work order. Next fiscal year, inspectors will escalate from verbal warning to written warning, as needed, to obtain better conformance with stormwater BMPs.

C.6.e.iii.(4) ►Evaluation of Inspection Program Effectiveness

Describe what appear to be your program’s strengths and weaknesses, and identify needed improvements, including education and outreach.

Summary: In FY18-19, the Building Department made stormwater construction site inspections a top priority. Los Gatos updated their C6 Inspection Program. and an in-house training occurred on November 14, 2018. Forms and the data collection process were reviewed and clarified. During this fiscal year, inspectors provided data in a timely manner. The process is clearer, and Los Gatos will continue to make updates to the program, as needed, for improved effectiveness. In addition to the in-house training, Los Gatos’s inspectors attended the Santa Clara Valley Urban Runoff Pollution Prevention Program (SCVURPPP) NPDES training from on March 5, 2019. In FY18-19, the West Valley Clean Water Program Authority (Authority) developed and launched a new website that provides consolidated information about how construction activities contribute to water pollution, state and local requirements for developers, best practices for residents, and resources for home repair and remodeling projects, landscaping and gardening, painting and application of solvents and adhesives, general construction and site supervision, concrete and mortar application, road work and paving, earth-moving and heavy equipment operations, dewatering activities, and copper roofs and architectural features (http://www.cleancreeks.org/166/Construction). Authority staff, on behalf of Los Gatos, participates in SCVURPPP’s Construction AHTG meetings and shares information with town staff as needed. School Outreach Events: The Authority conducted nine presentations at local school, reaching approximately 766 students, teachers, and parents. Events range from classroom presentations with Enviroscape demonstrations, science fairs, Earth Day events, to open house events, and creek cleanups. Approximately 130 educational brochures and over 1,000 giveaways were distributed including: pencils, pens, Pest or Pal Activity booklet, Watershed Watch backpacks, native plant seed packets, cutlery, take-out containers, stickers, tattoos, sports bags, stainless steel straws, snack bags, and water bottles. Santa Clara Valley Water District’s Trail Grant: The Town of Los Gatos (Los Gatos) and Campbell received grant funding from the Santa Clara Valley Water District to develop and install a series of ten environmental interpretive signs and new trash and recycling receptacles with doggie waste bag receptacles along a six mile stretch of the Los Gatos Creek Trail. The project is intended to educate the public about water quality issues including litter and help reduce litter along the trail. The project is underway with installation planned to begin in Fall 2019. Website Redesign: The Authority redesigned its website at http://www.cleancreeks.org to improve the way residents and businesses get information about storm water pollution. The web site represents several design and technology changes intended to improve navigation, offer better organization of content, engage the community. and provide much improved interactive communication functionalities and current web technologies. Development of Mission and Values Statements: The Authority held its first ever strategic planning retreat and developed a mission statement, values and a strategic plan. The Authority’s mission is to provide facilitation of collaborative stormwater management and pollution prevention efforts to assist the West Valley Communities to comply with the municipal stormwater permit and improve water quality.” The Authority’s values are integrity, teamwork, efficiency, excellence, and technology and innovation. Development of New Brand: The Authority created a new logo, color palette and style guide to represent the new Joint Powers Authority. New brand assets were developed including business cards, stationery, letterhead, etc. Creek Connections Newsletter: In 2019, the Authority created and began publishing a “Creek Connection” newsletter. The newsletter is periodically distributed to Board members and municipal staff to improve communication and collaboration. It serves as a platform to share information about local, regional, state, and federal activities, regulations and events that will leverage the efficiency, effectiveness and cost benefit from collective stormwater pollution prevention efforts. New Board Member Orientation Packet: The Authority developed and conducted an orientation with new board members to assist in informing elected officials about the goals and requirements of the municipal regional permit (MRP), budget, and work of county-wide and regional agencies. Recipient of Volunteer Award: On December 3, 2018, the Authority received the “2018 Creek Cleanup Volunteer of the Year” on behalf of its members agencies, Campbell, Los Gatos, the City of Monte Sereno (Monte Sereno) and the City of Saratoga (Saratoga). The Santa Clara Valley Water District presented the award in recognition of the volunteer efforts of local residents for both National River Cleanup Day and California Coastal Cleanup Day.

Application for Hack-a-thon Grant: The Authority developed and submitted a grant proposal to the Santa Clara Valley Water District to conduct a day-long hackathon was declined. The purpose of the hack-a-thon was to identify new and innovative solutions to enhance education and outreach in order to 1) increase permeability in urban areas, 2) to increase trash free locations in riparian areas, and 3) to reduce waste and other pollutants in our waterways. Although the grant was not funded, the Authority will evaluate alternative sources of funding for FY19-20 to conduct the hack-a-thon. West Valley Collections & Recycling (WVC&R) Newsletters: The Authority has partnered with WVC&R to publish articles for their quarterly residential and commercial newsletters, which are mailed out to 30,740 residential customers and 3,051 commercial customers located in the West Valley communities. The articles provided tips on topics such as stormwater pollution prevention, pesticide use, and waste disposal BMPs. Storm Drain Markers: Eight hundred new storm drain markers have been purchased for installation in Campbell, Monte Sereno, and Los Gatos. The stamped metal markers read, “No Dumping, Flows to Bay.” Los Gatos Beautification Month: Los Gatos held its annual “Keep Los Gatos Beautiful” Month (KLGBM) in April to educate, engage, and inspire the community with activities focused on the beautification of Los Gatos, Earth Day, Arbor Day, and other sustainability efforts promoting a cleaner and greener community. The month-long celebration included a “Spring into Green” event celebrating Earth Day that hosted over 20 booths from local non-profits and organizations sharing their organization's mission and how they're doing their part to keep Los Gatos Beautiful. Los Gatos issued an e-book with activities, resources, and a calendar of events that promoted sustainability in the community. The event also included a tree planting ceremony, farmer's market, family-friendly activities, and live music.

C.7.c ►Stormwater Pollution Prevention Education No change for Campbell’s, Los Gatos’s, Monte Sereno’s, and Saratoga’s websites. However, the Authority redesigned and launched its new website, www.cleancreeks.org in June 2019. The website provides information about the Authority and its Board meetings, and stormwater pollution, In addition, a new online complaint and spill response reporting feature was added to the Authority website and a new online request form for teachers to request an "Enviroscape" presentation, materials or information for classrooms. A new feature to the website, “Notify Me” also allows visitors to register to receive notifications from the Authority. The website is advertised on business cards, in newsletters and promotional items given to the public.

137 The Don Edwards San Francisco Bay National Wildlife Refuge manages the program. The free educator-led field trip actively involves teachers, outdoor education leaders, adult volunteers, and students are actively involved in investigating and exploring diverse habitats and wildlife at the refuge. Students participate in a variety of hands-on, small-group activities that are designed to teach ecological concepts that focus on the refuge’s resource management issues. All programs have been correlated to the appropriate State of California Education Standards.

This was the program’s first time at this school, and the teachers expressed interest in scheduling the presentation again. The Authority, along with several other community partners, participated in the school’s Science Fair Night. The Authority’s tables were placed with great visibility at the entrance of the multipurpose room. Students and their families were drawn to the colorful Enviroscape and given a short presentation along with a demonstration. A table top display also explained watershed, storm drains and POCs, and provided information brochures and native plant seeds. Older students were more interested in the activity worksheet where larvae is matched to their adult forms. Participants received Clapper Rail pens and Watershed Watch tattoos. Many took packets of native plant seeds.

IPM Tactics and Strategies Used:

The Town of Los Gatos Parks Department (Parks) implemented the following IPM tactics during FY18-19. 1. The removal of gophers in parks and nearby facilities is completed by using mechanical trapping devices. The use of poisonous bait in this

process is not allowed. 2. The use of pesticides is nonexistent in controlling vegetation in the Town of Los Gatos’s (Los Gatos) open space. Vegetation mitigation is

accomplished by means of mechanical mowing, weed whipping and labor with the assistance of the Santa Clara County Work Furlough Program participants.

Annual IPM Training. Los Gatos contracts with Wildland Vegetation Strategies to provide IPM training to Parks staff. The training covers Los Gatos’s IPM Policy and SOPs, monitoring for pests, monitoring contractors, Pest Specific Plans, and proper disposal of pesticides. This year nine staff members attended IPM training on April 29th, 2019. Wildland Vegetation Strategies reviewed new/current IPM methods for pest control.

Other training: One staff member from Los Gatos Parks Department attended a 4-day Rescape (Bay Friendly) training in mid-June. Topics covered included: IPM, water conservation, and Green Stormwater Infrastructure maintenance.

Note: Los Gatos’s facilities are pesticide free, except when there is a pest emergency, then an IPM-certified contractor is used. Facilities department staff have been trained to prevent pest infestations using proper sanitation methods and are trained to monitor for pests.

Summary:

Los Gatos uses IPM certified contractor(s) as needed, if their own IPM and less-toxic pest control methods fail. The following are examples of how Los Gatos monitors compliance:

• Quarterly meetings are held with the landscaping contractor to identify new products and/or issues of concern. • A form for contractors and Los Gatos staff must be completed prior to each herbicide use, with a review to determine whether an IPM

strategy could be successful. The form requires listing IPM methods considered/attempted prior to the request to use herbicides, and written justification for choosing the herbicide, along with other details. The form must be signed by the Parks and Public Works Operations Manager prior to herbicide use.

• If landscape contractor observes insect infestation, or a new weed infestation, the information is relayed to Parks Superintendent – the situation is then discussed with contractor, to implement an IPM strategy.

• Los Gatos staff refer to Los Gatos’s “Pest Specific IPM Plans”; if there is no existing IPM Plan for a particular pest, then an IPM strategy is developed, based on discussion with Parks Operations Manager. The landscape contractor implements these methods.

• Each year the pest control contractor certifies they have read, and follow, Los Gatos’s IPM Policy/Plan and SOPs.

Summary: Improvements to IPM Practices in the Last Five Years

Los Gatos updated its Standard Operating Procedures for contractors managing pest control in the Town. Los Gatos no longer sprays swarming bees and wasps, and instead relocates hives and traps wasps, and has discontinued the use of Round-up as a means of weed and brush abatement in Town parks, trails, and ROWs. In addition, Los Gatos employs prevention practices such as careful sanitation and visual inspections. For example, picnic tables are washed regularly, trash cans are emptied frequently, and potential nesting sites in trees are closed with caulk. Los Gatos also added IPM training to routine tailgate safety meetings.

Enhancements to IPM Practices Planned for the Next Permit Term

In the next permit term, Los Gatos will create pesticide-free parks and buildings through increased use of mechanical removal of pest vegetation and building pests. Los Gatos will discontinue using pesticides on roadsides and public rights-of-way. Discussion of Trash Load Reduction Calculation and Attainment of the 80% Mandatory Deadline: The Town of Los Gatos (Los Gatos) reported 78.1% trash load reduction (including trash offsets) in its FY17-18 Annual Report. During FY18-19, Los Gatos continued to implement a robust trash control measure program, which helped Los Gatos maintain its trash load reduction above the mandatory 80% trash load reduction requirement (by July 2019) included in the MRP. The total (jurisdiction-wide) percent trash load reduction in FY18-19 is 92.4% (includes 1.2% reduction for treatment of 3.9 acres of non-jurisdictional public K-12, college and university school land areas). Los Gatos has 30 full capture devices located in public streets. Inspection and cleaning takes place each year prior to the wet season. In FY18-19 the first inspection and cleaning took place in January 2019 for all 30 devices due to staffing issues. During the inspection, none of the devices were observed plugged/ blinded and none were greater than 50% full. All the devices were cleaned. Additional cleanings were not needed during FY18-19.

The next inspections and cleanings are scheduled for September-October 2019 in advance of the wet weather season. With additional inspections/cleanings as needed per SOPs. Visual spot inspections will continue during FY19-20 with cleaning as necessary.

Additionally, volunteer efforts with the Adopt-A-Highway Program provided approximately nine volunteers once per month collecting an average of 11 to 15 bags of trash, plus removal of large items at Highway 17 on and off ramps.

These TMA’s abut Highway 17 and Highway 85. In 2019, the Santa Clara Valley Urban Runoff Pollution Prevention Program (SCVURPPP) conducted a preliminary study on completed, planned, or potential trash full capture projects in Los Gatos’s drainage areas that address trash in stormwater that is generated on Caltrans Right-of-Way (ROW). The study was submitted to the Water Board in May, 2019. The study found that the level of opportunity for collaboration with Caltrans on additional full capture system(s) with Los Gatos is low because Caltrans ROW generally drains directly to receiving water bodies or is not near high trash generating areas in Los Gatos.

Single Use Bag Ordinance

Los Gatos adopted an ordinance banning plastic and paper bags on September 3, 2013. In FY2011-2012 Los Gatos participated in the San Mateo County Environmental Impact Report (EIR) and ordinance development. The ordinance prohibits the distribution of plastic bags and requires a 10 cent charge for paper or reusable bags. The ban applies to commercial businesses that sell perishable or nonperishable goods (i.e. food and clothing), excluding restaurants and nonprofit charitable reuse organizations. Most retail business occurs in downtown (TMAs LG06-2a, LG07-2b, LG08- 2a, LG10-2a) and along Los Gatos Blvd (TMA LG03-2b). Retailer toolkits were mailed to approximately 800 business license holders in November 2013. The toolkits contained information about the adopted ordinance, the effective date, information on reusable bag distributors, in addition to posters and cashier tent cards. Residential outreach took place in December 2013 through the date of implementation on February 3, 2014, and included a postcard mailing, press releases, and advertising placed in local newspaper publications.

Los Gatos participated in a countywide study in FY15-16 to characterize trash in full capture systems. The study conducted by SCVURPPP was intended to assist Santa Clara Valley Permittees in determining the current levels of litter-prone items (i.e., single-use bags and EPS food service ware) in stormwater and evaluate whether these levels have changed since ordinances prohibiting the distribution of these items were put into effect. For additional details on the study design and methods, see the SCVURPPP FY15-16 Annual Report – Section 10 Trash Controls.

According to the Bay Area Stormwater Management Agencies Association (BASMAA) “San Francisco Bay Area Stormwater Trash Generation Rates” report finalized on June 20, 2014, single use carry out bags contribute about 8% of the total litter loading to local receiving waters by municipal stormwater. Results from the SCVURPPP Study, which characterized trash in full trash capture systems pre- and post- ordinance in the Santa Clara Valley, indicate that 72% fewer single-use bags are observed in stormwater since ordinances have gone into effect. For additional details on results of the study, see the SCVURPPP FY15-16 Annual Report – Section 10 Trash Controls. The Los Gatos Town Council adopted a Town-wide polystyrene ordinance in FY14-15. Los Gatos partnered with the City ofCampbell to host a Foam FoodwareVendor Fair on August 25, 2014 toshowcase acceptable alternatives topolystyrene containers and to educatebusiness owners about the proposedordinance. Los Gatos participated in theinitial study of the environmental reviewfor the Polystyrene Foam and FoodService Ware Ordinance conducted bythe City of San Jose. Los Gatos’sordinance was based on the proposedordinance as outlined by the initial study.

Los Gatos participated in a countywide study in FY15-16 to characterize trash in full capture systems. The study conducted by SCVURPPP was intended to assist Santa Clara Valley Permittees in determining the current levels of litter-prone items (i.e., single-use bags and EPS food service ware) in stormwater and evaluate whether these levels have changed since ordinances prohibiting the distribution of these items were put into effect. For additional details on the study design and methods, see the SCVURPPP FY15-16 Annual Report – Section 10 Trash Controls.

According to the BASMAA “San Francisco Bay Area Stormwater Trash Generation Rates” report finalized on June 20, 2014, expanded polystyrene food service ware contributes about 6% of the total litter loading to local receiving waters by municipal stormwater. Results from the SCVURPPP Study, which characterized of trash in full trash capture systems pre- and post-ordinance in the Santa Clara Valley, indicate that 74% less expanded polystyrene food service ware is observed in stormwater since ordinances have gone into effect. For additional details on results of the study, see the SCVURPPP FY15-16 Annual Report – Section 10 Trash Controls.

C.10.b.v ►Trash Reduction – Receiving Water MonitoringReport on the progress of developing and testing your agency’s trash receiving water monitoring program.

In FY18-19, Los Gatos continued implementing the BASMAA Regional Receiving Water Trash Monitoring Program Plan that was approved by the Water Board’s Executive Officer. Implementation included preparing for and conducting qualitative assessments and quantitative monitoring in receiving water locations within Los Gatos. Implementation occurred through both Los Gatos’s own efforts and participation in the SCVURPPP. Consistent with MRP requirements, a preliminary report describing data results and findings to-date was submitted to the Water Board via BASMAA on July 1, 2019 on behalf of all Permittees. The final report for the development and testing of the Bay Area trash receiving water monitoring program will be submitted by BASMAA by July 1, 2020, consistent with the MRP requirements, following peer review.

In addition to implementing the BASMAA Monitoring Plan, the Town coordinated (via SCVURPPP) on the Statewide Trash Monitoring Methods Project, which is funded by the California Ocean Protection Council and State Water Board and administered via the Southern California Coastal Water Research Project (SCCWRP) and San Francisco Bay Estuary Institute (SFEI).

Descriptions of control measures implemented in all TMA’s Summary of Trash Control Measures Other than Full Capture Devices:

Street Sweeping

Los Gatos’ street sweeping program includes sweeping arterial streets in Los Gatos once per month and the downtown area one time per week. Each fiscal year street sweeping is evaluated for enhancements, if needed, and availability of funding.

On-Land Trash Cleanups

Los Gatos’s staff regularly maintains medians, sidewalks, landscaped areas, roads, and parks and trails for trash control. Los Gatos documents high trash areas through their maintenance management system. All reported or discovered illegal dumping or high-volume trash areas are cleaned up within 24 business hours. In addition, depending on availability of staff and site needs, volunteer cleanups are organized by Los Gatos, as schools and volunteer groups often reach out to the Town for cleanup projects.

As a Santa Clara Valley Urban Runoff Pollution Prevention Program (SCVURPPP) Co-Permittee, Los Gatos continues to assist in developing partnerships with transportation agencies such as Caltrans to address areas it does not have jurisdiction over, or permission to access for litter cleanup or the implementation of other control measures such as physical barriers or trash capture devices. Los Gatos continues to work with Caltrans through the Adopt-A-Highway Program where volunteers work with municipal staff to clean on and off ramps on Hwy. 17.

Partial-Capture Treatment Devices

Los Gatos funded through its FY2019-20 CIP installation of multiple trash capture devices in storm inlets to meet the Municipal Regional Permit Provision (MRP) C.10 trash reduction requirements.

Enhanced Storm Drain Inlet Maintenance

Storm drain system maintenance was enhanced from pre-MRP levels. The Town cleans their storm system over a continuous two-year cycle with all storm drain inlets cleaned every two years. Town staff monitors for problem inlets or devices that may need enhanced maintenance. Crews are trained to identify IDDEs and report to WVCWPA. The Town will continue to evaluate the need for enhanced storm drain inlet maintenance through its annual inspection program.

Activities to Reduce Trash from Uncovered Loads

Los Gatos’s municipal ordinance requires that all conveyances used to haul waste and other materials be covered and enclosed to prevent the contents from entering the public right-of-way and adjacent lands. The Police Department enforces CA Vehicle Code Sections 23114 and 23115 that prohibits uncovered loads.

Anti-Littering and Illegal Dumping Enforcement

Los Gatos’s Streets and Parks staff respond to all reported or discovered illegal dumping within one business day and code enforcement provides outreach to the violator, if identifiable.

Improved Trash Bin Container Management

The municipal ordinance prohibits the accumulation of waste on any property in the Town and the hauler may require changes to service levels or container types in order to prevent the accumulation of excess waste. The solid waste JPA agreement includes stormwater language for litter prevention.

Promote less toxic pest control and landscape management and use of drought tolerant & native plants

The West Valley Clean Water Program Authority (Authority), on behalf of Los Gatos, provides public outreach about water conservation, less toxic pest control, drought tolerant planting, and appropriate irrigation practices through advertising events and classes and through distribution of outreach materials such as SCVURPPP’s “You are the Solution to Water Pollution” brochure, “The 10 Most Wanted Bugs” brochure, Clean Care and Clean Creeks brochure, South Bay Green Gardeners flyer, and the Watershed Watch discount card, at many public events in the WV Communities. The Authority also co-hosted a native plants class with the Town of Los Gatos for West Valley residents in April 2019 (see Section C7 for all events).

Los Gatos Parks Department staff attended a 4-day Rescape (Bay Friendly) training in mid-June hosted by the City of Campbell. Topics covered included: IPM, Water Conservation, and Green Stormwater Infrastructure Maintenance. The West Valley Clean Water Program Authority (Authority) assisted Rescape with outreach materials and distribution.

Additionally, the Authority completed a new website in FY18-19 that provides information to the public related to less toxic pest control. The website is located at www.cleancreeks.org. During FY19-20, the website will be expanded to include a members-only section where Los Gatos staff can access up to date information for their municipal pest control programs.

Los Gatos and the Authority continues to promote relevant public events, such as SCVURPPP’s free car wash days, Native Plant tours, composting classes and Green Gardener events; by posting on their websites, on social media and providing brochures and flyers at Town Hall offices and libraries. Websites may also provide links to Valley Water (previously: Santa Clara Valley Water District) Water Conservation Rebate Programs, and promote less toxic pest control methods for home and yard. IDDE response for large volume landscape runoff

Streets, Parks & Facilities supervisory staff continue to remind staff of the importance of reporting and addressing ongoing, large volume landscape irrigation runoff throughout their jurisdictions. The Authority responds to IDDE referrals and citizen complaints through their C5 IDDE Program. Refer to Section C.5 for any responses associated with overwatering and irrigation-related runoff and any subsequent enforcement response.

Pesticide Toxicity Control sections of the SCVURPPP FY18-19 Annual Report for information on public outreach concerning runoff/water conservation, Green Stormwater Infrastructure, car washing and information on promotion of less toxic pest control and landscape management. In addition, the SCVURPPP website, and Valley Water websites link to one another, and Valley Water provides extensive outreach to residents and businesses throughout Santa Clara County, promoting water conservation.
