REGULAR CITY COUNCIL MEETING MINUTES

February 4, 2020

The City Council of the City of Greenfield, Minnesota, met in regular session on Tuesday, February 4,2020, at 7: 00 p. m. in the Council Chambers at 7738 Commerce Circle.

1. Call Meeting to OrderMayor Johnson called the meeting to order at 7:00 p. m.

MOTION by Klawitter, seconded by Jeska to approve the agenda. All voted in favor 5- 0. Motioncarried.

5. Public Comment.

Richard Holman, 10847 Greenfield! Roved, Lot 12 Riverbend estates. Holman stated he wasrepresenting himself. He was the fiat hom"a,p ryer in the Riverbend Estates development andhas been in Greenfield for 22 years. r ty Of Grewield states there has always been intent tohave a connecting road, he stated the evelopet'nevo~intended it to be a through road toHanover. If the connection made responso time quicker by 1- 2 minutes, he did not feel that itwas a significant enough time savings. He`Wishes current residents would be the priority whendecisions are made.

Ci Council Minutes of February 4 2020rY ,A. Interviews for Planning Commission Vacancy. Brek Perry, the Ione applicant was

interviewed. Perry has had no public service experience. He moved to Greenfield in June 2015and wants to get involved. He is a veterinarian by trade. Hopes with serving on the PlanningCommission, he can show his passion for Greenfield and a desire to learn and grow. He wantswhat's best for Greenfield and its' vision and help where he can. Johnson asked if he had lookedat the 2040 comprehensive plan? He has looked at the 2040 Comprehensive Plan and feels hecan support its' vision. He also understands you can' t please everyone. Klawitter asked what

Perry sees as Planning Commission' s biggest challenges and what can he bring to thecommission. Perry stated a collective group far more intelligent than an individual. He can bringoutside perspective and contribute to the long-term growth of Greenfield. Klawitter asked how doyou balance rural character and development. Perry said build development in spot areas withhigh density and low density. Erickson stated the Planning, Commissioners are appointed by theCouncil and the Council is elected by the residents. It is the Planning Commissionersresponsibility to inform Council on what you think .is best for the city. Jeska liked Perry'senthusiasm and respects the statement that yop" don't know everything about everything.Workcuff asked if he was here for the Riverbend project." Perry said no, I look at the appointmentholistically for what's best for Greenfield. Klawitter summed.It up that Perry does not have theexperience but gave good answers during the interview.MOTION by Klawitter, seconded by Erickson to appoint Brek Perry to the Planning Commission.All voted in favor 5- 0. Motion carried.

B. Rolling Crow Estates Discussion and Staff DirectionScheib noted this was discussed five ears ago. Staff isaskin for direction trom Council and willY 9 9

bring a resolution back to the February 18 City Meeting. Planner Scheib explained all thedifferent challenges of this parcel, Fanning and design perspective would look for a connectionevery time. There is an alternative contion option bit it is more difficult. There is no right of

way in place now but would have a' larger btiWable pattern. Again, connects to Hanover so theywould have to agree-to require a road lconnectior} at the time of their development. The length ofroad that would have to be,built for two tp four homes frriancially-does not pencil out. If the councilwants a road co6nection it`might make a sense to' on right of way off of the GreenfieldRoad cul- de- sac`I"hecity hall a right to re\quest a road connection as stated in our subdivision

ordinance regarding'Tpad conrtectivity. The applicant was not interested in developing at a higherdensity and that would-create a bunch of changes in itself. At higher density would mean citysewer and water services, from Hanover which,,Would probably mean that Hanover would likelywant to annex this parcel into Hanover. Estimated drive times were five minutes long way aroundand three minutes going through Bridges of Hanover. Access into Hanover would require an

agreement between Property Ovlmers, Greenfield and Hanover to assess road improvements.Agreement for access from 1071h, Lit 2 Block 1. Buffer and Berm for Lot 12, Riverbend Estatesscreening. Not opening Greenfield Road up. Hanover will need to reviewKlawitter asked if Greenfield has had adequate discussions with Hanover. Staff feels thatHanover has been kept in the loop and discussions throughout this whole process. Erickson

stated Greenfield has to have a road. If the road is not connected through for emergency purposeshow will Council look themselves in the mirror. Jeska feels there will not be any residentsinterested in the traveling the new road. He said building a road does not make any sense anddoes take into account the residents of this neighborhood. Workcuff said there has been enoughroad discussion and the road has to go through. Johnson stated it is not just emergencies butthere are bigger issues. A right of way was planned from Hanover off of 107th Ave and a right ofway was planned for extension of Greenfield Road by the City of Greenfield. It doesn' t makesense for a driveway to go all the way from Hanover to Lot 1, Block 1 Rolling Crow Estates. Bareminimum would be road right of way requirement for future development. Klawitter said preservethe route without infringing on the neighbors and allows the developer to build. Erickson unique

trees and agency wanted to purchase properties for park. Property would increase tax capacity ifwe hold out and get what we need. It has potential.

Applicant John Geis has owned the property for 20 years. He currently lives in the Bridges inHanover. If they access off of Greenfield Road it has to be built to street standards and disturbs

two neighbors. It is a unique property that is why they want to build their homes there. They don' twant to disturb a lot of low land and beautiful trees by adding higher density. He has spoken withMarvin Bursch, the previous developer and he stated that council didn' t want a road. It was just

isso Geis property wouldn' t be land locked. Hanover purposely extended 107th so he could accessthe property from Hanover. Erickson stated a package plant might be an option with higherdensity. Klawitter asked how many lots would work from our zoning. Answer is 4. Scheib stateda package plant has a lot of hurdles to work through. So hooking up to Hanover would be thesimplest since it is right next door. Jeska said we can discuss this forever but doesn' t want to

hinder applicant's wishes. Johnson wants to preserve Greenfield' s road rights and preserve road

right of way within the property. Klawitter asked if 3 lots can access from current access points.Planner said currently only two lots can share driveway. Klawitter is in favor of the development

with the condition of road right of way easement within the property for road connection whenfurther development happens. Staff will work on the resolution with an additional condition that a

road right of way easement that would be required when further development happens. Staff willcontinue to communicate with Hanover regarding the intent for future road connection off of10711Ave or off of the cul de sac of Greenfield Road abutting the Bechtold property in Hanover.Staff will bring a resolution for approval to the next council meeting.C. Approve Resolution 20- 11: Amending Planning Commission By-Laws. By- Laws were reviewedby Council with Scheib weighting in on a council liaison. Liaison does have value but is a timecommitment. It was discussed that a Planning Commissioner can attend City Council meetingsas a liaison to give updates as and when needed.

MOTION by Klawitter, seconded by Erickson to approve Planning Commission By- laws asamended. All voted in favor 5- 0. Motion carried.

9. Information/Miscellaneous

A. Comments/ reports from Mayor. None.

B. Comments/ reports from Councilors. Jeska and Klawitter attending leader's training and statedit was a lot of good information.

C. Comments/reports from City Administrator/Staff. Webb met with Larry Cook and Clete Kotterfrom Veolia Water to introduce Clete and review how things are going. Dave Osmek will be at thenext Council meeting with an update. Webb asked Hennepin County for an update on the ShellStation: No response yet.

D. Sheriffs Acttvity Report. Reports included in packet.

John Geis is requesting the subdivision of an approximately 21 acre parcel located north of Greenfield Rd, alongthe Crow River. The applicant intends to split the parcel into two single-family lots. The applicant' s requestrequires a preliminary and final plat approval.

Discussion and direction from February 4 2020 City Council DiscussionThe City Council heard the request at its meeting on 02/ 04/ 2020 and directed staff to prepare a resolution thatincludes a condition of approval requiring an easement for a future local road connecting the existing plattedright of way that extends to Greenfield Road from the proposed Lot 1 to the right of way extending fromHanover via 107th Avenue N. The easement would be a dedicated local road easement enabling the city torequire construction of a road within the easement should any action be requested in the future to furthersubdivide the property.

The following findings of fact are established in support of this action:1. The Comprehensive Plan states as Goal 8- 20: Enhance the connectivity of the roadway network to

provide easier mobility throughout the City( bike and vehicle) and policy 8- 58: Encourage

interconnections between development projects where connections do not cause significant

negative impacts on wetlands or other significant natural resources.

2. The City of Greenfield subdivision code section 151.08 Minimum Subdivision Design Standardssubpart( A) ( 1) enables the City to require the continuation of existing streets: The arrangementof rights-of-way and streets in new subdivisions shall make provision for the appropriate

continuation of the existing streets in adjoining areas.3. Greenfield Road currently ends in a cul- de- sac that is nearly a mile long and has no alternative

outlet for emergency service needs.4. Existing platted right-of-way exists withing the River Bend Estates subdivision with the stated

intent of providing access to the subject parcel from Greenfield Road; and, existing platted rightof way exists within Hanover' s Bridges of Hanover development providing access to the subject

property via 107th Avenue. These existing platted rights of way provide an opportunity to connect

a local road and thus provide an alternative connection for existing and future developments.

Requested Action

Staff is requesting the City Council discuss the above findings of fact and the proposed subdivision and takeaction to adopt the attached resolution in its existing form or revised form pending the Council discussion.Please refer to the January 30 Council report on this item for further background information.

RESOLUTION APPROVING THE FINAL PLAT FOR ROLLING CROW ESTATESSUBDIVISION

WHEREAS, the applicant, John Geis, has requested preliminary and final plat approvalfor the property legally described as follows:

1. The Preliminary and Ficial Plat drawing shall be revised to show an easement fora future local road 'agnnecting the existft platted right of way that extends toGreenfield Road from the proposed Lot 1 to the right of way extending fromHanover via 1011th Avenue N. The easement would be a dedicated local roadeas@ment enabling, the city4p require construction of a road within the easementshould any action befequested in the future to further subdivide either Lot 1 or Lot2 of Block 1 of the proposed Rolling Crow Estates subdivision. The easement shallbe drawn to ensure the most logical and feasible construction of a city street basedon current street standards. The easement shall be reviewed and approved by theCity Engineer.

2. All necessary driveway agreements for the shared driveway serving Lot 1 shall bereviewed and approved by the City Attorney and recorded with the final plat.

3. Construction of the shared driveway will require a plan review by Greenfield andHanover prior to issuance of a driveway permit. The plans shall include:

a. A landscape plan to provide adequate screening and buffers to mitigateglare to adjacent properties from headlights;

b. A grading and drainage plan to maintain existing drainage patterns andprevent runoff to adjacent properties; and

c. A driveway plan to ensure adequate grades, radii, materials, and

surface/subsurface preparations to meet city and emergency servicesstandards.

4. Evidence of an executed agreement with Hanover for the construction of a street

or use of the right of way in 107th Avenue shall be submitted prior to recording ofthe final plat.

5. The building pad for Lot 2 should be located in an area not to impact futureexpansion of 107th Ave N. An expansion could mean an extension of the

residential development and provide future utilities should the City of Greenfieldsupport it. This will be enforced at time of building permit issuance.

6. An agreement shall be recorded against Lots 1 and 2 between the property owners), City of Greenfield and City of Hanover for future assessment capabilities when

106th Ave N or 107th Ave N needs improvements. This agreement would be inaccordance to Hanover policies at time of road improvement project. The

agreement is subject to review and approval by the City attorney and shall beprovided prior to release of the final plat.

7. The proposed septic areas shall meet all setback requirements for jurisdictionalwetlands and wells and shall not be located within drainage and utility easementareas. The proposed septic system for Lot 1 shall be set back a minimum of 35feet from the easterly lot line. Revised septic site locations shall be submitted toHennepin County Environmental Services and an approval letter shall be receivedprior to release of the final plat for recording.

8. A current wetland delineatio report shall be submitted to PSCWMC and allconditions met prior to release of the final plat for recording.

9. The drainage and utility easements shall be modified to cover wetland buffers of25' ar d any culvert required for construction of the private shared driveway. Therevised"drainage and utility easements shall be reviewed and approved by the CityEngineer.'

10. All fees and financial obligations shall be received by the City prior to the releasingof the plat for recording.

11. The applicant shall be responsible for all costs associated with the preliminary andfinal plat application.

12. The applicant shall provide the plat and all required information to the City withinninety (90) days after the date of the City Council approval, otherwise the approvalof the final plat shall be considered void. An extension to the ninety (90) day limitmay be granted at the discretion of the City Council in response to a written requestfrom the applicant. The applicant shall record the final plat with the County

BE IT FURTHER RESOLVED, that the City Council of the City of Greenfield does herebyapprove the following findings of fact in support of this approval:

1.
