The maps below highlight which states follow certain criteria. The first map identifies each state’s Tier II reporting format which includes Tier II Submit, E-Plan* and Other**. The second map identifies whether a state’s hazardous chemical thresholds/critera are the same or different than those at the Federal level. It is important to note that each state’s EHS¹ list is the same as the Federal EHS list with the exception of New Jersey. In addition to the Federal EHS list, New Jersey has Environmentally Hazardous Substances (EHSs) that are reportable under what satisfies Tier II requirements. Each state has a Tier II report due date of March 1. Each state listed at the bottom of the page is linked to a unique URL. By clicking on the desired state, you will be directed to a webpage with additional Tier II reporting information. ¹EHS is defined as a substance listed under 40 CFR 355 Appendix A or B. When determining whether the threshold quantity of an extremely hazardous substance (EHS) has been met, facilities must include the total quantity of that EHS present in the pure form as well as in any mixture, even if any mixture including the EHS is also being reported as a hazardous chemical.
