ARIZONA
SUNSET REVIEWS
Requires periodic audits and legislative review and reauthorization of state agencies to determine if “the merits of the program justify its continuation rather than a termination or its continuation at a level less than or greater than the existing level.” ARS Section 41-2952
SUNRISE REVIEW PROCESS
Established by Laws 1985, Title 32, Chapter 31 Arizona’s sunrise review process provides a mechanism for both health professions and nonhealth professions to request regulation and, for health professions, expansion in scope of practice.
ELEMENTS OF PROCESS
• By September 1 written report submitted to President and Speaker which provides evidence related to factors of ARS 32-3106
• President and Speaker assign to Committee of Reference
• COR required to study (normally conduct a hearing) and make recommendations before December 1 of the year the report is submitted
FACTORS: INCREASE IN SCOPEARS 32-3106
• 1. Problem & why scope change is necessary; benefit to consumers
• 2. Are practitioners competent including: regulatory protection; quality assurance; adequate educational preparation
• 3. Potential harm to public; restriction of entry to practice from other jurisdictions
• 4. Cost to state and general public
JOINT LEGISLATIVE AUDIT COMMITTEE
• 12 members 6 from House, 6 from Senate; not more than 3 members of each House from same party
• Oversees legislative and agency audit functions
• Assigns Committee of Reference though traditionally chosen by standing committee chairs.

• 5 House members, 5 Senate; not more than 3 from a party in each House
• House and Senate members meet jointly• Generally made up of members from standing
committee likely to hear legislation• Reviews and evaluates submission based on
sunrise factors• Submits report
LEGISLATIVE ACTIVITIES
• Prepare report• Identify and meet with stakeholders• Meet with COR members• Provide testimony• Draft legislation and find sponsors• Lobby bill
