E-Tender Notice

1. Request for Quotation (RFQ) Supply of drinking water jars at Jawahar Vyapar

Bhawan, New Delhi (Brand – Aquafina/Bisleri/Kinley only).

STC invites online bids (E-Tender) under two bid system (Technical & Financial) from

authorised distributors of Aquafina/Bisleri/Kinley brand only for a period of one year starting

from 2017 to 2018. The period may be extended further on mutually agreeable terms.

The agencies/parties interested in responding to this RFQ must submit their bids online using

e-Procurement portal of NIC (eprocure.gov.in) in the prescribed formats along with all

necessary documents and information requested herein.

The bids may be submitted latest by 03.00 PM on 24.08.2017.

Financial bids for only those bidders will be opened who are declared qualified in technical

evaluation. The date and time for opening of Financial bids shall be separately notified on

NIC’s e-Procurement Portal (eprocure.gov.in). STC may seek any further clarifications or

documents as felt necessary but not obliged to do so.

All details regarding the subject RFQ are available on websites: www.stc.gov.in,

www.tenders.gov.in and www.eprocure.gov.in/eprocure. Any changes/modifications/

corrigendum in connection with this RFQ will be intimated through one or more of these

websites only. Prospective bidders are therefore requested to visit above mentioned websites

regularly to keep themselves updated. STC shall not be liable to send any individual

information or issue a public notice.

2. Electronic Submission of Bids

Bids against this RFQ shall be received only electronically through the e-Procurement

Portal of NIC (eprocure.gov.in). No bids shall be accepted in hard copy or in any

other form.

For submission of e-bids, bidders are required to get themselves registered with

eprocure.gov.in website using Digital Signature Certificate (DSC) essentially having

signing certificate.

The details of EMD deposited by the bidder (copy of Bank documents towards

digital/online mode) should tally. Otherwise, the bid is liable to be rejected.

The bidders are required to upload soft copies of the following:

- Technical Bid (prepared on Company’s Letter head);

- Copy of PAN No. TIN No. & GST No., scanned copy of RTGS/NEFT submitted

towards Earnest Money Deposit, etc. as mentioned in technical bid.

- Financial Bid (prepared on Company’s Letter head).

3. Earnest Money Deposit (EMD)

All Bidders are requested to furnish an EMD of Rs. 15,000/- (Rupees fifteen

thousand only). The interest-free Earnest Money Deposit only through digital/online

mode in Indusind Bank, Bank details are given hereunder:-

The bidders who are registered with either NSICL or DGS&D are exempted from

submitting the EMD. However, in place of EMD the bidder will have to submit

Registration/Exemption certificate.

Bids for which EMD is not received (other than the exempted cases) in the prescribed

manner shall be rejected summarily.

STC shall not be responsible for non-receipt/non-delivery/delayed receipt of the EMD

due to any reason whatsoever. EMD shall not carry any interest.

EMD shall not carry any interest and EMD of unsuccessful bidders shall be returned

after Award of Contract to the Successful Bidder. EMD of the successful bidder shall

remain with STC as Security Deposit and shall be refunded after expiry of the

contract without interest within a period of two months

4. Bid Details

Bidders are required to furnish the unit price per jar including all taxes etc.,

strictly in the prescribed Performa of Financial bid. Financial bid shall contain price

only and no other documents shall be enclosed with the financial bid.

5. Scope of Work

Supply of drinking water jars at various floors before the office hours i.e. 8.00 AM to

9.00 AM with 16 nos. Hot & Cold dispensers facility free of cost, all damages

including plastic parts with maintenance and cleaning of dispensers fortnightly or as

per requirement.

6. Other Terms and Conditions

The tenderer shall quote their rates in the Financial Bid for 20 ltrs. capacity of

drinking water jars for approx. 1500 water jars per month. The rates to be quoted by

the tenderer should be inclusive of all taxes, cartage etc. The rates shall be firm for a

period of one year of the contract and no revision of rates on any account whatsoever

shall be considered. If the contractor desires to extend the contract on the same rates,

term & conditions, he shall apply in writing to the Dy. General Manager (Civil), STC,

during the currency of the contract.

The party shall supply 16 nos. (Sixteen numbers) new Dispensers with Hot & Cold

facility and maintain the same during the period of contract by carrying out

repair/replacement of parts free of cost including cleaning the dispensers fortnightly.

The tenderer shall make arrangement to supply the drinking water jars within a period

of 7 days from the issue of award letter, at various floors during 8.00 AM to 9.00 AM

during week days. In case, the party fails to supply the water jars in time and no

alternative arrangement is made, then a penalty of Rs.2,000/- (Rupees two thousand

only) shall be levied every time and deduction shall be made from the monthly bills.

The tenderer must inspect the STC premises/site, before quoting the rates.

The rates quoted by the tenderers shall be valid for acceptance for a period of 90 days

from the date of opening of the tender.

Payment to the contractor shall be released by STC monthly on the basis of actual

quantity/ water jars supplied by the party duly certified by the Chief Manager (Civil).

The tenderer shall furnish a copy of self attested PAN card & TIN Number. The

Income Tax and Surcharge thereon will be deducted from the monthly bills as

applicable.

The contractor shall abide by all municipal bye-laws and safety regulations during the

contract period.

In case of any dispute, decision of General Manager (BP&MD), STC shall be final

and will be binding on both the parties.

The tenderer shall furnish an EMD of Rs. 15,000/- (Rupees fifteen thousand only)

through digital/online mode (as per Clause 3 above). The tender without EMD shall

be summarily rejected.

The EMD of un-successful tenderer shall be refunded without interest within a period

of three months after opening of the tender. The EMD of successful tenderer shall

remain with STC as Security Deposit and shall be refunded after expiry of the

contract without interest within a period of two months.

The tenderer shall submit a copy of “Quality Certificate” issued by BIS along with

tender documents.

The contractor shall execute an agreement on non-judicial stamp paper of Rs. 100/-

with- in one week’s time from the date of issue of award work as per approved

performa. The cost of stamp paper shall be borne by the party. This notice of tender

shall form a part of the contract agreement.

STC reserves the right to accept or reject all the tenders without assigning any reason

thereof.

The following documents shall be submitted with the technical bid. The documents

must be enclosed and arranged as per following sequence with the technical bid:-

Failure to submit all the required documents or submission of incomplete document

will render the quotation liable to rejection.

STC reserves the right to accept or reject any bid, and/or to annul the bidding process

and reject all bids, at any time prior to award of contract, without thereby incurring

any liability from the affected bidder or bidders nor shall STC have any obligation to

inform the affected bidder or bidders of the grounds for STC’s action.

In case the selected party backs out of the contract midstream or does not provide

service to the full satisfaction of STC, the security deposit shall stand forfeited.

7. Information relating to evaluation of bids and recommendations concerning awards shall

not be disclosed to the parties submitting the offers or to other persons not officially

concerned with the process, until the contract is entered into with the selected bidder.

8. Jurisdiction

The tenderer hereto agrees that the courts or Tribunals at New Delhi shall have exclusive

jurisdiction to settle any or all disputes which may arise. All disputes arising out of this

Tender shall be decided in accordance of Laws of India.

9. Indemnity

The tenderer shall keep STC indemnified at all times against any claims/

liabilities/proceedings etc. from any third party or otherwise arising out/or in connection

with this tender.

जो निविदाकताष एिएसआईसीएल या डीजीएसएंडडी के साथ पंजीकृत हैं उन् हें ईएमडी जमा करिे स ेछूट है । तथावप, ईएमडी के स् थाि पर निविदाकताष को पंजीकरण / छूट प्रमाणपि जमा करिा होगा ।

निविदाए ँल्जिके ललए नििाषररत तरीके से ईएमडी प्राप् त िहीं हुई है (छूट िाले मामलों के अलािा), उन् हें तत् काल रद्द कर र्दया जाएगा ।

एसटीसी फकसी भी कारण से ईएमडी के प्राप् त ि होिे / डडलीिर ि होिे / प्राल्प् त में देरी होिे के ललए ल्जम् मेदार िहीं होगा । ईएमडी पर कोई ब् याज िही ंलमलेगा ।

ईएमडी पर कोई ब् याज िहीं लमलेगा और असिल निविदाकताषओं की ईएमडी सिल निविदाकताष को संविदा देिे के िाद लौटा दी जाएगी । सिल निविदाकताष की ईएमडी एसटीसी के पास प्रनतभूनत जमा के रूप में रहेगी और संविदा के समापि के िाद 2 माह की अिधि के भीतर बििा ब् याज लौटा दी जाएगी ।

4. ननवविा का ब् यौरा

निविदाकताषओं से अिुरोि है फक प्रनतजार इकाई मूल य सभी करों सर्हत वित् तीय निविदा के नििाषररत प्रोिामाष में प्रस् तुत करें । वित् तीय निविदा में केिल मलू य निर्हत होगा और उसके साथ कोई अन् य कागजात संलग् ि िहीं होंगे ।

5. कायगक्षेत्र

पेयजल के जारों की आपूनत ष विलभन् ि तलों पर कायाषलय समय से पहले यानि 8 िज ेप्रात: से 9 िजे प्रात: तक और 16 संख् या में ठंड ेऔर गमष डडस् पेंसरों की निशुल क सुवििा, डडस् पेंसरों का पाक्षिक रूप से या आिश् यकता के अिुसार रखरखाि और साि-सिाई सर्हत ।

6. अन् य ननििंधन और शतें

निविदाकताष प्रनतमाह लगभग 1500 पािी के जारों के ललए 20 लीटर की िमता िाले पेयजल जारों हेतु वित् तीय निविदा में अपिी दरें उद्िररत करेगा । निविदाकताष द्िारा उद्िररत की जािे िाली दरों में सभी कर, काटेज आर्द शालमल होंगे । दरें संविदा से एक िर्ष की अिधि के ललए पक् की होंगी और फकसी भी कारण दरों में संशोिि पर विचार िहीं फकया जाएगा । यर्द ठेकेदार संविदा को उन् हीं नििंििों और शतों पर िढाि े का इच् छुक है तो िह उप महाप्रिंिक (लसविल), एसटीसी को संविदा के जारी रहिे के दौराि ललखखत रूप में आिेदि करेगा ।

पाटी, गमष और ठंड े की सुवििायुक् त 16 (सोलह) िए डडस् पेंसर की आपूनत ष करेगा और संविदा की अिधि के दौराि पाक्षिक रूप से डडस् पेंसरों की साि-सिाई सर्हत उिकी मरम् मत/पुजों को नि:शुल क िदलिा जारी रहेगा ।

निविदाकताष सप् ताह के र्दिों के दौराि पूिाषह्िि 8.00 िजे से पूिाषह्िि 9.00 िजे के दौराि विलभन् ि तलों पर पि जारी करिे से 7 र्दिों की अिधि के अदंर पेयजल जारों की आपूनत ष की व् यिस् था करेगा । यर्द पाटी समय पर पािी के जार की आपूनत ष िहीं कर पाती है और कोई िैकल्ल पक व् यिस् था भी िहीं की जाती है तो हर िार 2,000/- रूपए का जुमाषिा िसूल फकया जाएगा तथा कटौती मालसक बिलों से की जाएगी ।

निविदाकताष को दरें उद्िररत करिे से पहले एसटीसी पररसर/स् थल का निरीिण करिा चार्हए ।

निविदाकताषओं द्िारा उद्िररत दरें निविदा खलुिे की तारीख से 90 र्दिों की अिधि हेतु स् िीकृनत के ललए िैि होंगी ।

ठेकेदार को एसटीसी द्िारा भुगताि जारी फकया जाएगा जो मुख् य प्रिंिक (लसविल) द्िारा विधिित सत् यावपत पाटी द्िारा आपूनत ष की गयी िास् तविक मािा / पािी के जारों के आिार पर होगा ।

निविदाकताष एक स् ियं प्रमाखणत पैि काडष,र्टि िंिर और GST िंिर प्रस् तुत करेगा ।

आयकर और उस पर सरचाजष मालसक बिलों से काटे जाऍगें जैसा लागू हो ।

ठेकेदार सभी िागररक उपकािूिों और सुरिा विनियमों का संविदा अिधि के दौराि पालि करेगा ।

फकसी वििाद के होिे पर, महाप्रिंिक (िीपीएंडएमडी), एसटीसी का निणषय अनंतम होगा तथा दोिों पार्टषयों पर िाध् यकर होगा ।

असिल निविदाकताष की ईएमडी निविदा खलुिे से 3 माह की अिधि के भीतर बििा ब् याज लौटा दी जाएगी । सिल निविदाकताष की ईएमडी एसटीसी के पास प्रनतभूनत जमा के रूप में रहेगी और संविदा के समापि के िाद 2 माह की अिधि के भीतर बििा ब् याज लौटा दी जाएगी ।

निविदाकताष, िीआईएस द्िारा जारी “गुणित् ता प्रमाणपि” की एक प्रनत निविदा कागजातों के साथ जमा करेगा ।

ठेकेदार अिुमोर्दत प्रोिामाष के अिुसार नियत कायष जारी होिे की तारीख से एक सप् ताह के अदंर 100/- रूपए के गैर न् यानयक स् टॉम् प पेपर पर एक करार करेगा । स् टॉम् प पेपर की लागत पाटी द्िारा िहि की जाएगी । यह निविदा सूचिा संविदा करार का एक भाग होगी ।

एसटीसी के पास बििा कोई कारण िताए सभी निविदाओं को स् िीकार या रद्द करिे का अधिकार सुरक्षित है ।

तकिीकी निविदा के साथ निम् िललखखत कागजात जमा फकए जाऍगें । ये कागजात तकिीकी निविदा के साथ निम् िललखखत िम में संलग् ि फकए जाऍगें और लगाए जाऍगें ।

सभी अपेक्षित कागजातों को जमा ि कर पािा या अिरेू कागजातों को जमा करिे पर कोटेशि रद्द कर दी जाएगी ।

एसटीसी के पास संविदा प्रदाि करिे से पहले फकसी भी समय फकसी निविदा और / अथिा िावर्षक निविदा प्रफिया और सभी निविदाओं को स् िीकार करिे या रद्द करिे का अधिकार सुरक्षित है, इसके बििा प्रभावित निविदाकताष या निविदाकताषओं से फकसी देयताओं के होिे पर, ि ही एसटीसी का इसकी कायषिाही के आिार पर प्रभावित निविदाकताष या निविदाकताषओं को सूधचत करिे का कोई दानयत् ि है ।

यर्द चयनित पाटी संविदा से िीच में से ही हट जाती है या एसटीसी के पूणष संतोर् पर सेिाऍ ंप्रदाि िहीं करती, तो प्रनतभूनत जमा जब् त कर ली जाएगी ।

7. निविदाओं के मूल यांकि तथा प्रदाि करिे संििी लसिाररशों से संिंधित सूचिा ऑिर प्रस् तुत करिे िाली पार्टषयों को या इस प्रफिया से सरकारी तौर पर िहीं जुड ेहुए अन् य व् यल्क् तयों को िहीं दी जाएगी जि तक फक संविदा चयनित निविदाकताष के साथ िहीं की जाती है ।

8. अधधकार-क्षेत्र

निविदाकताष एतद्द्िारा सहमत है फक िई र्दल ली में ल्स् थत न् यायालय या न् यायाधिकरण फकसी या सभी वििादों, जो भी हों, को निपटािे में विशरे् अधिकार-िेि रखेंगे। इस निविदा से उठिे िाले सभी वििाद भारतीय कािूि के अिुसार निपटाए जाएँगे।
