Introduction

What is TSUPU?

The Transforming the Settlements of the Urban Poor (TSUPU) is an Initiative by the Ugandan Government to align urban development efforts at all levels (national, local and community levels) to include the urban poor into the planning and decision-making processes.

This initiative is a direct result of the Government’s desire to proactively manage rapid urbanisation and improve living conditions for the urban poor.

AREAS OF OPERATIONThe areas of operation have been selected taking into account regional balance, size and growth rate as well as an equitable spread of resources. Two different types of secondary cities have been identified as partners under the TSUPU program.

The first category includes municipalities selected on the basis of their institutional capacity and relative good governance, while the second category includes municipalities selected on the basis of their trans-frontier economic potential.

These include:

a) JinjaJinja is the second largest town in Uganda with an approximate population of 132,150 and a population growth rate of 3.2 % per annum. The town was historically the centre for trade and industry within Uganda; however, much of the industrial base has either declined or transferred closer to the markets in Kampala. Besides subsistence agriculture, the immediate region is characterised by cash crop production such as tea, coffee and sugar. Due to the obvious attraction of the Nile, a tourism industry is developing based on white water rafting, horse riding, bird watching and bungee-jumping.

b) MbararaMbarara municipality has an estimated population of 102,926 with a 5.1% annual population growth rate. It is the major urban centre serving the south-western region. The economy is based mainly on a spread of agriculture, commerce and trade, light and small scale industry and informal sector activities.

c) MbaleMbale municipality has an estimated population of 86,642 and a 4% annual population growth rate. Located in the eastern part of Uganda, Mbale is one of the biggest commercial towns in Uganda. It

serves as a regional link and gateway to Uganda, notably from Kenya. It is a transportation hub with good access to roads and railway. It has untapped tourism potential offered by the proximity to the Mount Elgon mountain range, rich biodiversity, historical heritage and cultural attractions.

d) KabaleKabale municipality has a population of 54,407 and a 4% annual population growth rate. It is a regional transport hub with road links to Kisoro, Kanungu, Kihihi, Ntungamu, and Rukungiri districts.

It is located close to the Rwanda border and has historically benefitted from cross-border trade. In recent times, the economy has declined due to stricter controls over cross-border movement with neighboring Rwanda. The municipality has a fledgling tourism industry based on the mountain gorillas.

e) AruaArua municipality has a population of 39,250 and a population growth rate of 4% per annum. It is an important local commercial centre and serves as a base for a large refugee population from Sudan and the Democratic Republic of Congo. In recent years, this population has been the base

for dramatically increased cross-border trade. Furthermore, oil has recently been discovered in close proximity to the town, and it is expected that this will serve to attract a wide range of investments to the town as well as a large influx of new residents eager to search for work.

How the Urban Poor were identified under TSUPUe.g based on vulnerability?

The TSUPU programme has been implemented in five (5) of the thirteen (14) municipalities. One of the program objectives is to bring greater coherence of effort by creating an institutional framework for different stakeholders to align their efforts and finance towards common objectives.

Key to building coherence is the alignment of purpose between national and sub national governments, and urban poor communities. Since the early 1990’s, Uganda has been undergoing a process of decentralization with greater public participation in local issues.

The overarching objective of TSUPU programme was to create inclusive cities without slums in order to maximize the potential of urbanization by proactively managing urban growth.

In achieving the overarching objective, the program support has been used to: Strengthen the capacity and resources available to the urban poor, better enabling them to enter into development partnerships with the local government;

Strengthen the capacity of local government to inclusively plan and manage urban growth; and Support national and local policy dialogue to promote pro poor urban systemic change.

What was achieved?Reaching at least 50,000 slum dwellers living within the municipalities of Jinja, Mbale, Arua, Kabale and Mbarara are now actively engaged in both securing their rights and honouring their responsibilities through improved urban governance;

Reaching at least 50,000 slum dwellers living within the municipalities of Jinja, Mbale, Arua, Kabale and Mbarara to improve their access to municipal services.Development of effective and efficient inclusive urban development policies and strategies that have enabled the better management of future urban growth positively affecting the lives of 200,000 slum dweller households nationwide.

Establishment of Municipal wide Development Forums Currently all the MDFs are fully functional. In the 14 Municipalities, expenditure guidelines were handed over to the MDFs to guide their operations and during the training/ capacity building sessions with the MDFs.

MDFs formed thematic working groups like transport, environment, and education, water and sanitation among others. Settlement Level Forums were also formed in the 14 Municipalities with support from ACTogether the support NGO including other sub-activities like slum mobilization, mapping, enumeration and profiling.

Over the years MDFs have demonstrated that they are a multi-stakeholder group creating an enabling environment of dialoguing and engaging the MCs for improved service delivery.MDFs bridge a gap between Councils and the Communities. MDFs are functioning as platforms where key urban problems are identified, debated and recommendations made and presented to councils and other stakeholders to respond.

Overall, across the 5 MCs the Municipal Development Forums were re-constituted and a number of deliverables developed. These include:

• A customized MDF Charter to capture the new stakeholders;

• The Municipal Wide Strategic/ Infrastructure Investment Plans to implement integrated planning approaches;

• the ToRs for the Forums to guide working relationships and operations between the Municipal Councils and Municipal Development Forums; and

• the Detailed Work plans for the Forums.

Achievements and Lessons Learnt in the Implementation of the MDF Philosophy in the 5 Municipalities

1) The MDF arrangements have been incorporated in the Final Draft of the National Urban Policy (NUP) for their institutionalization and roll out to all urban centers in Uganda.

2) The Exchange Visits across the different MDFs buttressed cross-learning and interaction between MDF Members, the Council and the Technical and leadership in the MCs for collective participation and improved service delivery.

3) The project is participatory which encourages community ownership and involvement, this is important in the sustainability of the project. The forums have positively enabled this participation.

4) Forum resolutions have been forwarded to council and have been supported across the 5 MCs.

Participatory Action Research into issues that affect access to land and increased security of Tenure for the urban poor

Research studies into the issues that affect access to land and increased security of tenure for the urban poor was carried out. The objective of conducting the research studies was to investigate, document and disseminate research findings on Security of Tenure in Informal Settlements and define urban problems which would inform the National Urban Policy.

The research themes included:

i) Land Tenure and Access to Land by the Urban Poor;ii) Effect of the Existing Land Tenure Systems on Urban Development;

iii) Mechanisms of Land Dispute Resolutions in Urban Poor Settlements.

The key findings were:

i) Settlements for the urban poor in Uganda are predominantly under the customary land tenure system, which is characterized by informal land transactions. Land exchanges hands without involvement and knowledge of the formal land administration institutions;

ii) Land owners in the urban poor settlements have some understanding of the value of land registration, however, they are limited by lack of financial resources to process land titles;

iii) Most landowners in the urban poor settlements are likely to continue operating in the in the informal sector if the current sporadic approach to land adjudication is maintained;

iv) Most of the land disputes resolved successfully in informal settlements were handled by informal institutions such as clan leaders, elders or local councils. These institutions are trusted by the urban poor because of their low cost, timely judgment,

flexibility and ability to handle cases in local languages, among others.

The key recommendations were:

i) Government should simplify the procedure and cost of formalising land ownership/rights in informal settlements of the urban poor in Uganda;

ii) The requirements for approving building plans should be modified to lessen the requirement for proof of land ownership

iii) Formalisation of land rights in informal settlements for the urban poor should be done in a participatory incremental manner so as to avoid possible resistence from the dwellers of the informal settlements.

Commissioning of research into Defined Urban Problems identified at the National Urban Forum

The aim of commissioning research into defined urban problems was to make sure that the results are used for improved land management and administration, urban planning and management, housing, and service delivery.

The areas identified by the National Urban Forum included:

i) Urban sprawl; Causes and Implications for the Urban Managers in Uganda;

ii) Constraints to Urban Planning and Management;

iii) Access to Housing by the Urban Poor in Informal Settlements of Uganda;

iv) Urban Planning and the Quality of life in the Informal Urban Settlements of Uganda.

Constraints to Urban Planning and Management

i) To identify the current nature of urban planning processes, practices and management styles in use;

ii) To identify if there has been any planning interventions for the slum settlements;

iii) To identify best practices in urban planning and management in other countries that provide learning experience that could be tailored to the Ugandan situation;

iv) Make recommendations on issues identified to be included in the National Urban Policy.

The study identifies a number of constraints to urban planning and management and makes the following recommendations to fill the gaps in the

National Urban Policy:

i) Have deliberate urban planning intervention of the informal sector in urban areas;

ii) Get communities and urban councils together into planning and management partnerships to achieve plans implementation;

iii) Every Municipality should mandatorily prioritize urban planning and management as one of the key fields of operation of Municipal Councils;

iv) Have substantial budget allocated to urban planning as a key area to facilitate planning operations;

v) Make Planning units into fully fledged Departments and have more than one Physical Planners;

vi) All Municipalities should as a rule revise their planning schemes twice during the plan period, and where the plans fail to work have a complete overhaul;

vii) Have Municipal Land Boards within Municipalities instead of the District Land Boards;

viii) Urban Planning actors should be accountable to both the Councils and the communities;

ix) Physical Planners and those other professionals involved in urban planning must register with the Institute of Physical Planners to be allowed to practice.

Access to Housing by the Urban Poor in Informal Settlements of Uganda

The objectives of the study were:

i) To investigate how the urban poor in informal settlements access housing;

ii) To determine measures that improve access to decent and affordable housing by the urban poor in informal settlements

The study identifies challenges and proposes interventions in the following housing parameters:

Accessibility and affordability;

i) Accessibility and affordability; ii) Physical Conditions; iii) Housing Infrastructure and Utilities; iv) Housing Services; v) Housing Supply; vi) Housing Demand.

Achievements and Lessons Learnt from the in the Implementation of the MDF Philosophy in the 5 Municipalities

1) The two categories of participatory action research on defined urban problems and security of tenure informed the National Urban Policy and service delivery processes in MLHUD.

2) The research studies were subjected to a number of consultative reviews by MLHUD officials, other MDAs, the NUPWG, the UNUF among others.

3) The research teams developed policy briefs which were used to inform the development of the National Urban policy and legal framework by the Ministry of Lands, Housing & Urban Development.

The Establishment of the National Urban Forum

This activity aimed at facilitating debate on urban issues and, most significantly on how urbanization will gradually change the social and economic fabric of the country. The National Urban Development Forum (UNUF) was managed by an executive committee drawn from the forum members and was headed by Prof. Wavamunno.

The Forum was platform for structured dialogue focusing on the need to develop policy to resolve real problems experienced by poor, heterogeneous urban communities. UNUF was intended find a way to enable inputs from the communities and the local authorities into the national urban debate for instance input from MDFs.

The debates needed to be enriched by the participation of the wide variety of actors who have urban programming experience both nationally and internationally.

1) UNUF cleared the research topics, which were commissioned to Makerere University.

2) UNUF contributed greatly in the development of publicity materials afore mentioned as well as inputting into the National Urban Policy Development Process.

3) UNUF also contributed to the fine-tuning of the deliverables under the Internship program particularly the Settlement Level Plans and the Planning Reports.

4) UNUF is provided for under the Institutional Arrangement of the USMID Program and PST will spearhead the rejuvenation of the UNUF including its leadership and strategic plan.

Achievements and Lessons Learnt

The development of a Sustainable Urbanization campaign

The objective of the campaign was to increase widespread public understanding of the broad urban development agenda through the creative use of media and other communication forms, tailored to Ugandan needs and priorities. This campaign was an integral part of the Development of the National Urban Policy process.

Development of the National Urban Policy and Strategic Urban Development Plan for Uganda

The National Urban Policy aims at:

i) Putting in place a framework for planned, balanced, organized and sustainable development of urban areas;

ii) Strengthening urban administration and governance system;

iii) Improving urban environmental management;

iv) Creating a conducive environment in order to ensure equitable social development;

v) Improving access to affordable and decent urban housing;

vi) Ensuring efficient delivery of urban infrastructure and amenities;

vii) Supporting the development of an integrated and efficient urban transport system;

viii) Developing and strengthening a competitive and productive urban economy; and

ix) Promoting integrated planning both at national and local government levels.

Strategic urban development plan

The strategy is designed to provide the operational, institutional and financial framework for the implementation of sector wide reforms and management including the national urban policy. It is intended to guide government, the private sector and civil society in the management of Uganda’s growing urban sector. The 15-year plan will be financed by the central government, development partners, local government and private sector.

The urban indicators’ database

The database is intended to enhance the capacity of MoLHUD and urban centers to improve delivery of services through the provision of reliable and timely data for evidence based planning, monitoring, decision making and to inform the policy formulation process and implementation. Currently:

The Community Upgrading Fund was intended to enable settlement-based community organizations to access grants to finance initiatives that meet certain clearly defined criteria.

In addition to having a measurable impact on the quality of life of slum dwellers the process builds skills of participatory planning and participation, and also helped raising the profile of Settlement level Urban Poor Organizations.

The activity entailed the establishment of a CUF Operational Manual and CUF guidelines which described clearly how the fund will function including procedures to apply, criteria for evaluating applications, a safeguards framework, as well as monitoring and supervision.

Experiences, Achievements and Lessons Learnt Under the CUF Program in the 5 Municipalities:

The Ministry documented these projects and also demonstrated the intended aim of collaboration and teamwork in service delivery processes among the MCs, local authorities, the communities leading to improved living environments with improved access to basic health and infrastructure services like proper solid waste management, environmental conservation and beautification, safe water supply, improved accessibility and connectivity especially in the informal settlements, street lighting for security among other home-grown and localized initiatives.

Lessons Learnt & other Experiences:

1. The issuance of Expenditure guidelines for the sub-components in phase II & III was a step in the right direction.

2. Involvement of communities in project identification and implementation ensures ownership and sustainability of projects

3. Communities can effectively and efficiently manage their own projects as long as their capacity is built.

4. Confidence has been built between the communities and the Municipal local government. 5. Communities now know how the government system operates. 6. Consultation with the communities before project implementation is crucial if projects are to

succeed at community level

Conclusion:

The TSUPU Program has built and improved on systems development and enhanced institutional linkages especially between the urban managers at the Municipal Local Governments and Communities.

The Program has provided many learning lessons through exchange programs and interactive seminars and workshops and above all communities been closely connected to the urban managers through inclusive popular participation in planning, budgeting and implementation of programs, interventions and activities in their settlements.

The 5 MCs are committed to upscale and enhance the program principles of the Forums, CUF Projects, Research and Internship and Community Procurement in their routine planning and development processes.
