+HEREAS it is desirable to make better provision for the exercise of control over andfor the regulation of the management of certain minor canals in 4 [certain areas of West Pakistan];

CHAPTER I

%2& (t an! time after the commencement of this (ct the 7 [Provincial 8overnment] ma!

%a& include an! canal under either chedule or chedule as the case ma! be ortransfer a canal from one chedule to the other chedule and thereupon theprovisions of this (ct applicable to canals included under such chedule or suchof the said provisions as the :

change in the river the excavation of a ne" head necessitated b! a change in theriver or a change of "ater$courses to render existing irrigation more efficient;

%vi& =+reek> means an! channel of a river other than the main channel through "hichthe "ater of the river "ould unless obstructed b! deposit of silt naturall! flo" atsome period of the !ear;

%vii& =0istrict> means a district as fixed for revenue purposes;

%viii& =rrigator> means in respect of an! land "hich is irrigated from a canal an! personfor the time being directl! deriving benefit b! such irrigation and includes aland$o"ner or occupanc! tenant of such land;

%ix& =abour> includes labourers cattle and appliances necessar! for the execution ofthe "ork for "hich labour is to be supplied;

%x& =*ill> means an! contrivance "hereb! the "ater po"er of an! canal is used forgrinding sa"ing or pressing or for driving or "orking machiner! or for an! othersimilar purpose and includes all subsidiar! "orks and structures connected "ithan! such contrivance except the canal itself;

%xi& =ubsidiar! "orks> means all "orks re@uired for the control or maintenance of thesuppl! to a canal or for the maintenance of a canal in proper condition or for theregulating of the irrigation therefrom or for the prevention of floods or for theprovision of proper drainage in connection "ith such irrigation and includes also

the land re@uired for such "orks;%xii& =Water$course> means an! channel "hich is supplied "ith "ater from a canal and

"hich is maintained at the cost of the irrigators and includes all subsidiar! "orksconnected "ith such channel except the sluice or outlet through "hich "ater issupplied to such channel;

%xiii& =Water$due> means "hatever is pa!able to 8overnment in cash or kind b! theo"ner of a canal for the diversion b! such o"ner for the purposes of such canal orthe "ater of an! river creek or stream flo"ing in a natural channel or of an! lakeor other natural collection of "ater;

%xiv& =Water$rate> means the charge made for canal "ater other than a "ater$due or

canal advantage land$revenue rate/CHAPTER II

CONSTRUCTION O* CANALS AN +ATERUES

6 Prohi-itio# "."i#t %o#tr/%tio# of %"#" itho/t '!riio#6 When the1.

[Provincial 8overnment] has notified in this behalf an! natural channel lake or other collection

of "ater no person shall "ithout permission previousl! obtained in the manner prescribed inthe section next follo"ing construct a canal intended to be fed from an! such channel lake orother collection of "ater#

Provided that nothing in this section shall appl! to the construction of a "ater$coursefrom an existing canal/

permission prescribed in that section/

%2& Aver! application under sub$section %1& shall be in such form and shall containsuch particulars as the 1:

%3& 'he provisions of sections .- and 73 shall appl! to all proceedings of the +ollector

under sub$ section %1& of this section and under the preceding section and the po"ers conferredupon the +ollector b! this and the preceding section shall be exercised sub)ect to suchsanction as the 1,

[Provincial 8overnment] ma! prescribe and in accordance "ith the rules made

b! such 8overnment/

Provided that unless in the case of construction "hich "ould materiall! extend the areairrigable b! canal no such order or proclamation as the case ma! be shall be made or issued inrespect of an! canal "hich at the time "hen it is proposed to make or issue such order orproclamation has been used for irrigation for a period of three !ears "ithout interruption otherthan such as "as due to natural causes be!ond the control of the person aforesaid/

%2& f an! person shall at an! time after the commencement of this (ct construct acanal "ithout the permission necessar! under sections 4 and . of this (ct the +ollectorma! "ith the previous sanction of the 2-

the exercise of such right is pre)udicial to the interests of other irrigators or to the goodmanagement improvement or extension of the canal/

person "hose right is suspended or extinguished compensation to be assessed b! the+ollector under section ../ n assessing compensation for the purposes of this section the+ollector shall also have regard to the character of the right the period during "hich it hasbeen en)o!ed and the damage likel! to be occasioned b! its suspension or extinction/

"ater$rate is chargeable for the purpose ofinspecting or regulating the use of the "ater supplied or measuring the land irrigated thereb!or chargeable "ith a "ater$rate and of doing all things necessar! for the proper regulation andmanagement of such canal#

"t!r%o/r!6 Whenever application ismade to a +ollector for a suppl! of "ater from a canal and it appears to him expedient thatsuch suppl! should be given and that it should be conve!ed through some existing "ater$course he shall give notice to the persons responsible for the maintenance of such "ater$course to sho" cause on a da! not less than fourteen da!s from the date of such notice "h!

the said suppl! should not be so conve!ed; and after making in@uir! on such da! the+ollector shall determine "hether and on "hat conditions the said suppl! shall be conve!edthrough such "ater$course/

'he applicant shall not be entitled to use such "ater$course until he has paid theexpense of an! alteration of such "ater$course necessar! in order to his being supplied throughit and also such share of the first cost of such "ater$course as the +ollector ma! determine/

decision it shall be la"ful to the +ollector to act on behalf of the o"ner in an! such matterand the re@uest consent or decision of the +ollector in an! such case shall be bindingupon ever! person "ho possesses an! share in the o"nership of such canal/
