The family company, Asian Pacific Group has committed $25 million dollars to bring this building into its prime. The 12-storey building is currently being converted into 150 single and double bedroom apartments, offices, a conference room, gymnasium, shops and a multi-level car park.

An important part of managing your business is managing everything to do with taxes and the tax office. This includes:

• making sure you are operating under the correct taxation structure to ensure that the tax on your profits at the end of the year is minimised, for example – you may be able to distribute money to other family members if you are trading within a discretionary trust, or you may be able to use your superfund within your trading structure to reduce your tax payable to effectively 15%.

• ensuring that you have the correct structure to take advantage of capital gains tax concessions should you decide to retire or sell your business, for example a company may not be eligible for capital gains tax 50 % concessions, whereas a Trust may be eligible and can then pass these on to the related beneficiaries.

• ensuring that you lodge your BAS’s and income tax returns on time to avoid penalties. The ATO can be very stringent on applying fines of $110 per month that your BAS return is late.

• paying your taxes on time to avoid interest charges on late payment or even worse, the tax office taking debt recovery or legal action against you. This involves careful cash flow management for example, GST collected from customers should be set aside to pay the ATO at the end of the

quarter; a percentage of your sales should be set aside to pay your income tax at the end of the year once your tax return has been completed.

• The new PAYG instalment system is something you may have to plan for. Once you lodge your year end tax return, the ATO will adjust your PAYG or tax in advance amounts on your next BAS return, so the timing of your lodgement could be important for your cash flow.

Doors open on the future of Melbourne

The state government is currently holding two simultaneous consultations; and the outcome of each will have a substantial impact on how the city changes for the future.The Plan Melbourne process, which will replace Melbourne 2030, will provide a plan for the city’s growth.Melbourne is a dynamic city and strategic plans for its development need to be updated to reflect that.No single plan has been perfect, as each plan had been shaped by the time of its creation and the priorities for the relevant government. Most people are familiar with Melbourne 2030 but the strategic planning at its core – housing the growing population partly in existing areas and in new growth suburbs – was clearly established in the 1995 plan Living Suburbs.At the same time the state government has released revised planning zones for Victoria. The new zones seek to replace the well-known ones such as ‘Residential Zone’ and ‘Business Zone’ with ones entitled ‘Residential Growth Zone’ and ‘Neighbourhood Residential Zone’. Central to this change is a wider range of controls designed to concentrate development and change in some areas as opposed to others. If approved and then applied by Councils, these zones should provide greater certainty to land owners.

While both processes are separate, they have in common the key themes of managing growth and change.As the state government is consulting on both these plans, it is a critical time to have a say if you have views about how the city should change. Disputing a WillWhen someone prepares a Will, there is a principal which exists recognising a person’s right to decide who will inherit their estate. However, there also exists a moral duty for a Will maker to provide to people who are closest to them as well. The reasons for contesting a Will relate to instances where someone believes they were treated unfairly in a Will and they were perhaps financially dependent on the Will maker.

A Will can also be challenged if someone believes the Will maker lacked the mental capacity to make out their last Will. This could be due to undue influence from someone, the Will maker did not properly understand what they were signing or the Will maker was pressured to sign a Will which did not properly reflect their true wishes.

Who can make a claim?Anyone who the Will maker had a “responsibility to” to make a provision has the ability to make an application to the court to contest the Will. The question which is tested is focused around “responsibility to” and can include a wide range of family members, friends and even carers.

What are the time limits?A person making a claim must bring their claim within 6 months from the Grant of Probate or Administration. Outside of this time you must get special permission from the court.

Some reasons for claims concerning Wills are:

• Lack of Capacity or Undue Influence: A beneficiary from a previous Will can mount a challenge to the latest Will if it

can be shown the Will maker lacked the mental capacity to sign the Will or was unduly influenced.

• Family Maintenance: Someone who has either been left out of a Will completely or has not been provided for adequately in a Will can make a challenge.

• Breach of Trust: If an executor of Will has failed in executing the provisions contained in the Will a beneficiary can make an application to the court to have the executor replaced.
