NATIONAL LAND COMMISSION
INQUIRIES/INVESTIGATIONS ON PUBLIC LAND IN RESPECT OF THE FOLLOWING GRANTS AND ORDERS
IN EXERCISE of the powers conferred by Article 68 (c) (v) of the Constitution of Kenya and section 6 of the National Land Commission Act, 2012. the Chairman of the National Land Commission informs the general public that the National Land Commission, upon receipt of complaints from the National Government, County Governments and members of the public, undertook investigations/inquiries on public land to establish their legality or otherwise. The Commission via public notices in the national dailies invited all interested parties to appear before it to inspect documents and make written and oral representations and submissions. Consequently. the Commission has made recommendations in respect of the following grants/Titles and recommends for revocation, regularization, upholding of the titles where applicable as indicated or give further orders.

RECOMMENDATIONS OF THE COMMISSION
According to the report by the Director of Physical Planning it was noted that although the PDP that was used to inform the allocations was available in the records department the same could not be vouched for authenticity as there is no evidence of approval by the Commissioner of lands.
The report by the Director Land Administration notes that:
• There is no clear record of planning available to support allocation
• The letters of allotment of 1997 and 1999 do not indicate the authority of allocation and are based on controversial PDPs.
• A number of allotments or LR Numbers do not have deed plans or have had their deed plans cancelled.
• A number of allocations are also outside the area being claimed by Dupoto Settlement Scheme.
It was unanimously agreed that the said reports should be adopted as the Committees resolution to the effect that records available do not constitute procedural allocations as per the operational laws at the time of allocation.
The Commission also recognizes that there was an earlier process of allocation commenced by the Nairobi County Government in favor of the Welfare members and therefore recommends that the County Government should complete the process of allocation.
Further, National Land Commission in collaboration with the Ministry of Lands should actualize the recommendations of the Committee on the ground and at the same time ensure expunging of all the illegal documents from the records department of the Ministry of Lands.

REPORT ON THE INQUIRIES OF TITLES WITHIN .IOMO KENYATTA INTERNATIONAL AIRPORT (JKIA) LAND L.R. NO. 21919
Recommendations & Conclusion
I. It is noteworthy that KAA is seeking nothing short of revocation of all the disputed grants and reversion of the land to the JKIA. The Commission's recommendations must therefore, resonate with the above given that the irregular allocations jeopardize operations, security and safety of the airport.
2. The Commission however, took cognizance of the fact that already there are several private entities operating within the airport land on subleases. That being the case the Commission is of the opinion that such legitimate arrangements should not he disrupted unnecessarily.
3. In view of the foregoing observations and the enumerated findings the Commission made recommendations guided by public interest and by carefully weighing the possible impacts.
4. The Commission recommends that all the long term (99 years) grants affecting the KAA land be cancelled/ revoked and be replaced by short term subleases in accordance with the terms and conditions approved by KAA.
5. All private developments falling within the airport flight paths and funnels, or located close to the strategic positions such as flight paths and the airsidc or any other locations deemed unsuitable, should be demolished forthwith.
6 KAA should compensate for any approved developments and improvements made by private entities which will be demolished. There should be no compensation for land but where appropriate, KAA should offer the affected entities alternative sites on sublease basis.
7. The family of the late John Makuthi Kathumba who laid a claim on parcel LR No. 7075/3 within the JKIA land should be compensated on basis of a valid squatter claim on the land. KAA should compensate the family (in good faith) to facilitate resettlement elsewhere. The squatter's continued stay on JKIA land is not tenable since it is close to the flight funnel and is a security risk to the airport operations.
In conclusion, the Commission recommends that KAA shall, in conjunction with other relevant agencies, prepare a Master Plan for the airport for development, management and use of the reserved public land pursuant to section 17 of the Land Act, 20102. This will contain detailed guidelines on how the airport and related activities will be efficiently distributed on the available public land for posterity

DETERMINATION OF INVESTIGATIONS ON GRANTS AND DISPOSITIONS ON PUBLIC LAND IN RESPECT OF KILIFI JIMBA
IN EXERCISE of the powers conferred by Article 68 (c) (v) of the Constitution of Kenya and Section 6 (2) (b) (c) of the National Land Commission Act 2012 has a mandate to hold inquiries and take necessary measures to ensure compliance with Article 60 of the Constitution.
Introduction
The outstanding historical land issues affecting the Coastal Region and land complaints emanating from Kilifi County informed the concern by the National Land Commission (NLC) on the need for a plot verification exercise in three land registration sections namely:- Kilifi/Chembe Kibambamshe, Kilifi/Jimba and Kilifi/Madeteni in Kilifi County where land adjudication and registration had taken place. The Commission then undertook hearings/inquiries between 8th Oct. - 12th Oct. 2018 at Watamu CDF hall.
Land Adjudication in Kilifi District
The Minister fqr Lands and Settlement applied the Land Adjudication Act (Cap.284) vide Legal Notice Number 155 of 1970 to Land within the former protectorate of Kenya of Kilifi District, Kilifi Chembe Kibambamshe. Kilifi/Madeteni, Kilifi/Jimba and Kilifi/Mtondia Roka Adjudication Sections. The effect of the Minister's action was that the aforementioned areas were adjudicated and registered between 1974 and 1986. The areas were Trust lands and therefore the land adjudication programme was applied and sections declared as adjudication sections. After the finalization of the adjudication exercise, the sections were registered in 1978 and titles issued under Registered Land Act (RLA) — Cap. 300). However, the then Commissioner of Lands through his Circular Ref. 113936/55 of 2e May, 1986 and Gazette Notice No. 2505 of 30th May 1986 declared the areas as Government Land and therefore not subject to the application of the Adjudication Act (Cap .284).

KIJIPWA SETTLEMENT SCHEME - KILIFI COUNTY
Pursuant to Article 67(2) (e) of the Constitution and Section 5 1 (e) of National Land Commission Act 2012, the Commission has a mandate to initiate investigations on its own initiative or a complaint on historical land injustices and recommend appropriate redress.
BACKGROUND
Kijipwa Settlement Scheme formally No.285 111/4 Mainland North in Kilifi County covers an area approximately 500 Ha. It was registered in 1987 with a total of 450 squatters who were allocated 2.5 acres each. However, eight (8) other people got more than 1.01 ha. Equivalent of 2.5 acres (as shown below) and who were subjected to these investigations:-

The Court sitting at Mombasa vide Civil case no.169 of 2010 issued an order dated 23 d̀ September, 2011 stating that the following parcels be vested to the plaintiffs as follows:-

b. Plot No. Kilifi/Kijipwa/361, 362 and 363 - Ibrahim Jumbale Nyamawi.
c. Plot No. Kilifi/Kijipwa/366 - Mangi Katana Mwaro.
d. Plot No. Kilifi/Kijipwa/365 - Leslie Robinson Mwajanji Mwangemi.
e. Case No. 169 of 2010 by Ibrahim Jumbale filed for vesting orders for Parcels 361, 362, 363 and then sold to Pink homes. Ibrahim Jumbale's father (Mr. Jumbale Nyamawi) was allocated Parcel 120 in Kijipwa Scheme, sold it and moved to squat on P/35.
The above mentioned parcels have since been transferred to third parties.
The following cases are pending in Court;

3. ELC No.122 of 2010 affecting Parcel. No. 41
4. ELC No.334 of 1996 affecting Parcel No.48

FINDINGS
The Commission after consideration of the above written and oral submissions and from the records available, we note that;
1. There were eight (8) persons in the subject area who were allocated more than the recommended 2.5 ha. of land,
2. In furtherance to the above, those who were allocated the 8 large proportions of land displaced the people already in occupation of the subject area,
3. The eight (8) persons allocated the said 8 parcels were either land officers or prominent civil servants,
4. That some of the large parcelt are subdivided with new numbers and sold to third parties,
5. That some of the affected parcels have pending Court cases i.e Plot No. 48, 96, 35 & 41,
6. That after a ground verification conducted by the Commission in January 2017, it was discovered that some parcels are densely occupied with approximately 700 people on the eight affected parcels,
7. All the proprietors of the subject plots under investigation appeared before the Commission during the public hearing conducted on 12th October, 2018 at Watamu Social Hall except Bertha Bockle (P/278) and Ravind Bhagat (P/277). These two individuals should be considered for 2.5 acres like the rest.
RECOMMENDATIONS
The Commission recommends the following:-
1. The Chief Land Registrar to revoke Titles for plot no. 43, 53, 277 and 278,
2. The relevant County Government together with the Ministry of Lands to regularize the registration of the people in current occupation of the subject parcels and implement the above mentioned directive,
3. The Commission should be enjoined in the cases to give expert opinion on parcels 35, 41, 48 & 96.
