Whereas, the Collector, Land Acquisition (ACR), Jammu videNo. DCJ/LA/ACR/NHIDCL/2017-18/1574 dated 23–01–2018 has reportedthat the notification issued under section 4(1) of the J&K State LandAcquisition Act was served upon the interested persons for filing objections,if any, to the proposed acquisition and some objections were received bythe concerned Collector within the prescribed period and were rejected onthe grounds that the land so proposed under acquisition is State land ;
Whereas, the report furnished by Collector, Land Acquisition(ACR), Jammu vide number referred to above duly endorsed byDeputy Commissioner, Jammu vide No. DCJ/LA/J-A Road/Jammu/2017-18/1598-99 dated 25–01–2018 and by Divisional Commissioner, Jammuvide No. 502/3080/Acq/NHIDCL/Jammu/J/18/4291-93 dated 15–02–2018has been examined and it has been found that some land owners fileobjections and after examination which were disposed off in accordancewith the law ;
Whereas, the Government is satisfied that the land particulars whereofare given above is required for public purpose viz. for widening/four laningof Jammu Akhnoor road in Village Jammu, Tehsil and District Jammu byNHIDCL.
Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that the land measuring 6 Kanalsand 13 Marlas situated in Village Jammu, Tehsil and District Jammu,particulars whereof are given above is required for public purpose viz. forwidening/four laning of Jammu Akhnoor Road in Village Jammu, Tehsil andDistrict Jammu by NHIDCL.

Further, the Collector, Land Acquisition (ACR), Jammu is directed
under section 7 of the said Act to take order for acquisition of the said land
after giving prescribed notice to the interested person(s) as required under
the Land Acquisition Act/Rules.
Now, in pursuance of section 17 of the Land Acquisition Act, Samvat
1990, it is ordered that on expiry of fifteen days from the publication of the
notification under Section 9 (2) of the said Act, the Collector will take
possession of the aforementioned land in Village Jammu, Tehsil and District
Jammu, required for public purpose, subject the fulfillment of the conditions
prescribed under Section 9(2) and Section 17–A of the Land Acquisition
Act and Rule 63 of the Land Acquisition Rules.
However, the Collector concerned shall be personally responsible for
identification and proper title verification of all types of land involved in the
case and apportionment of compensation amongst all the interested persons/
rightful claimants in accordance with the relevant laws/rules in force, while

Acquisition Act by him was served upon the interested persons for filing
objections, if any, to the proposed acquisition, but no objection was received
from the land owners/interested persons within the prescribed period as
required under sections 5 & 5-A of the Land Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition
(SDM), Marh vide above referred letter duly endorsed by District Collector
(DC), Jammu vide No. DCJ/LA/J-A Road/Gurah Singhu/2017-18/1589
dated 25–01–2018 and by Divisional Commissioner, Jammu vide No. 502/
3077/Acq/NHIDCL/Gurah Singhu/J/4285-87 dated 15–02–2018 has been
examined and it has been found that the land owners did not file any objection
to the proposed acquisition ;
Whereas, the Government is satisfied that the land particulars whereof

Whereas, the Indenting Department/Collector have expressed urgency

(2) The Government shall at the interval of every five years or atsuch other intervals as may be necessary, re-examine the strength andcomposition of the cadre of the service and make such alternations thereinas it deems fit.
5. Qualification and Method of Recruitment.––(1) No person shallbe eligible for appointment or promotion to any post in any class, categoryor grade in the service unless he/she possesses the qualifications as laiddown in Schedule-II and fulfills other requirements of recruitment as providedin the rules and orders for the time being in force.
(2) First appointment to a service or class may be made,––
(a) by direct recruitment ; or
(b) by promotion ; or
(c) partly by (a) and partly by (b) in the ratio and in the manner asmentioned against each post in Schedule-II :
Provided that all the posts under direct recruitment shall befilled through Jammu and Kashmir Services SelectionBoard as per the rules/orders of the Government issued for thepurpose :
Provided further all posts to be filled by promotion/directrecruitment shall be filled through Board/DepartmentalPromotion Committee as the case may be unless any post/category of posts is exempted from the purview of the Services
qualifications prescribed for recruitment to such class or category of post.
The upper age limit of such Government servants shall be as provided in thegeneral rules :
Provided that in the case of a post which requires a higher degree ofspecialization and/or experience, the Government may prescribe higher agelimit.
10. Maintenance of seniority list.––Seniority of the members of theservice shall be regulated under the Jammu and Kashmir Civil Service(Classification, Control and Appeal) Rules, 1956. The Head of Departmentshall maintain an up-to-date and final seniority list of members of theservice.
11. Residuary Matters.––In regard to the matters not specificallycovered by these rules, the members of the service shall be governed byrules/regulations and orders applicable to the State Civil Service in general.
12. Interpretation.––If any question arises relating to the interpretationof these rules, the matter shall be referred to the Administrative Departmentwhose decisions thereon shall be final and binding.
13. Repeal and savings.––(1) The Jammu and Kashmir State MotorGarages (Subordinate) Service Recruitment Rules, 2004 are herebyrepealed.
(2) Notwithstanding such repeal, any appointment order made oraction taken under the provisions of these rules so repealed shall be deemedto have been made or taken under the corresponding provisions of theserules.

Deputy Commissioner, Ganderbal to be the competent authorityfor the purposes of the said Act within the territorial jurisdiction ofTehsils Lar and Wakoora of District Ganderbal.
Whereas, Shruti Sharma alleged that she was transferred from Jammu
to Samba without any reason and thereafter her services were terminated
by the Project Coordinator, Empower Project Vocational and StaffingPvt. Ltd., RMSA Office, Opposite Gurudwara Malik Market, Jammu ; and
Whereas, Shruti Sharma raised a dispute before the Conciliation Officer(Assistant Labour Commissioner), Jammu, against Chief Education Officer,Education Department, Jammu and Project Coordinator, Empower ProjectVocational and Staffing Pvt. Ltd., RMSA Office, Opposite GurudwaraMalik Market, Jammu with a prayer that the transfer order may be set asideand direction be passed to respondent to allow her to resume her duty withfull wages and continuity of the service ; and
Whereas, efforts were made by the Conciliation Officer (AssistantLabour Commissioner), Jammu to settle the dispute between parties but inview of the contrasting and conflicting stances of the parties, the same couldnot be settled ; and
Whereas,the ConciliationOfficer (Assistant Labour Commissioner),Jammu submitted his failure report recommending the case for its referenceto the Labour Court for adjudication ; and
Whereas, the Government after examination of the case, is of theopinion that an industrial dispute exists between Shruti Sharma andProject Coordinator, Empower Project Vocational and Staffing Pvt. Ltd.,RMSA Office, Opposite Gurudwara Malik Market, Jammu ; and
Whereas, the Government considers it desirable to refer the said disputeto the Labour Court for adjudication.
Now, therefore, in exercise of the powers conferred by clause (c) ofsub-section (1) of section 10 of the Industrial Disputes Act, 1947(XIV of 1947), the Government hereby refers the said dispute to the LabourCourt for adjudication on the following issues :––
1. Whether the transfer of the applicant, Smt. Shruti Sharma has
been done legally or not by her employer i. e. Empower
2. Whether the termination order of the applicant Shruti Sharma
issued by her employer i. e. Empower Pragati, Vocational and
Staffing Pvt. Ltd. is legally sound or not ?
3. If illegality of the action of the employer is proved, then to
what relief the applicant is entitled to.

SRO-328.––In exercise of the powers conferred by section 21 ofthe Jammu and Kashmir Employees Provident Funds (and MiscellaneousProvisions) Act, 1961, the Government hereby designate all AssistantProvident Fund Commissioners as primary assessing authorities, withintheir respective areas of jurisdiction for the purpose(s) of section 8-A ofthe Act.
