Whereas, on the basis of an indent placed by ExecutiveEngineer, PWD Division, Ramban vide No. 15546-51 dated 09-03-2012,a notification under section 4 (1) was issued by Collector, LandAcquisition (SDM), Gool vide No. SDM/G/243-53 dated 02-11-2017for land measuring 53 Kanals and 15 Marlas situated at Village Tetharka,Tehsil Gool, District Ramban ;
Whereas, the Collector, Land Acquisition (SDM), Goolvide No. SDM/G/PWD/270-75 dated 02-11-2017 has reported that thenotification issued under section 4 (1) of the J&K State LandAcquisition Act by him was served upon the interested persons for filingobjections, if any, to the proposed acquisition, but, no objection wasreceived from the land owners/interested persons within the prescribedtime period as required under sections 5 & 5-A of the LandAcquisition Act ;
Whereas, the report furnished by Collector, LandAcquisition (SDM), Gool vide above referred letter duly endorsedby District Collector (DC), Ramban vide No. DCJ/LA/Rbn/123-25dated 06-01-2018, has been examined and it has been found that theland owners did not file any objection to the proposed acquisition ;
Whereas, the Government is satisfied that the land particularsabove is required for public purpose viz. for construction of Kanthamorhto Dalwah-Budhan road under PWD in Village Tetharka, Tehsil Gool,District Ramban.
Now, therefore, in pursuance of section 6 of the J&K StateLand Acquisition Act, Samvat 1990, it is declared that landmeasuring 53 Kanals and 15 Marlas situated at Village Tetharka,Tehsil Gool, District Ramban, particulars whereof are given above, atAnnexure-“A” is required for public purposes viz. for constructionof Kanthamorh to Dalwah-Budhan road under PWD in Village Tetharka,Tehsil Gool, District Ramban. Further, the Collector, Land Acquisition(SDM), Gool is directed under section 7 of the said Act to take order

Whereas, 51 vacancies in the Junior Scale of the Jammu andKashmir Administrative Service, J&K Accounts (G) Service and J&KPolice (G) Service were referred to the J&K Public Service

Combined Competitive Examination-2014 and the recommindations of
the J&K Public Service Commission, 48 candidates allotted to the Junior
Scale of Jammu and Kashmir Administrative Service, J&K Accounts
(G) Service and J&K Police (G) Service have been appointed vide
Government Order No. 299-GAD of 2018 dated 21-02-2018 ;
And whereas, cases of two more candidates namely; Mr. Ayaz
Ahmad and Mr. Jigmet Angchuk, were referred to Standing Medical
Board, Jammu by the J&K Public Service Commission with the advice
to convey the opinion of the Medical Board and consider their
appointment after getting their medical fitness reassessed ;
And whereas, the Standing Medical Board, Jammu, has declared
both the candidates fit for the Government Service.
Now, therefore, pursuant to the recommendation of the J&K
Public Service Commission and the reassessment of their physical
fitness by the Medical Board, sanction is hereby accorded to the
temporary appointment of Mr. Ayaz Ahmad S/o Mushtaq Ahmad R/o
Sawjian Village Sawjian Mandi-185105, to the Junior Scale of the
Jammu and Kashmir Administrative Service, and Mr. Jigmet Angchuk
S/o Padma Lundup R/o Ompohor Samker Leh-194101, to the J&K
Police (Gazetted) Service, with immediate effect. For purposes of
determining their seniority in accordance with Rule 24 of J&K Civil
Services (Classification, Control and Appeal) Rules, they shall
respectively be deemed to have been appointed to the Junior Scale of
KAS and J&K Police (G) Service w. e. f. 21-02-2018 i. e. the date
when other candidates figuring in the select list, prepared by the
Public Service Commission, were appointed vide Government Order
No. 16] The J&K Govt. Gazette, 19th July, 2018/28th Asad., 1940. 377–––––––––––––––––––––––––––––––––––––––––––––––––––––––No. 299-GAD of 2018 dated 21-02-2018. However, the deemed
appointment shall not confer any monetary benefit upon them.
It is further ordered that :–
(i) the appointment/allocation of the above candidates to the
respective services shall be without prejudice to the writ
petition(s), if any, pending before any competent court of
law ;
(ii) the candidate allotted to Junior Scale of KAS shall report
at J&K IMPA&RD, Jammu and the candidate allotted to
J&K Police (G) Service shall report to the Director General
of Police for undergoing the prescribed training ;
(iii) the candidates shall be allowed to join only on production
of various testimonials relating to their qualification, date
of birth, permanent resident certificate, category certificate
etc ;
(iv) the candidates shall be put on probation for a period of
two years during which they shall undergo such training and
pass such examination as may be prescribed by the
Government ;
(v) the salary of the appointees shall be drawn and disbursed
to them only after receipt of verification report from the
verifying agency viz. CID and subject to production of an
affidavit as per the enclosed proforma and in case they are
adversely reported upon by the verifying agency or the
relevant category certificate is found not to be genuine/valid,
they shall have no claim to hold the post to which appointed.
Their appointment shall automatically stand cancelled
(vi) any candidate who fails to join within a period of 21 days
of issuance of the order shall forego right to his appointmentwhich shall be cancelled forthwith.

THE CRIMINAL LAW (AMEMDMENT) ORDINANCE, 2018
No. 2 of 2018
Promulgated by the President in the Sixty-ninth Year of the Republicof India.
An Ordinance further to amend the Indian Penal Code, the IndianEvidence Act, 1872, the Code of Criminal Procedure, 1973 and the Protectionof Children from Sexual Offences Act, 2012.
Whereas, Parliament is not in session and the President is satisfiedthat circumstances exist which render it necessary for him to take immediateaction.
Now, therefore, in exercise of the powers conferred by clause (1) ofarticle 123 of the Constitution, the President is pleased to promulgate thefollowing Ordinance :––
CHAPTER I
Preliminary
1. Short title and commencement.––(1) This Ordinance may becalled the Criminal Law (Amendment) Ordinance, 2018.
(2) It shall come into force at once.
CHAPTER II
Amendments to the Indian Penal Code
2. Amendment of section 166A.––In the Indian Penal Code(hereafter in this Chapter referred to as the Penal Code), (45 of 1960),in section 166A, in clause (c), for the words, figures and letters “section376B. section 376C, section 376D,”, the words, figures and letters “section376AB, section 376B, section 376C, section 376D, section 376DA, section376DB,” shall be substituted.
3. Amendment of section 228A.––In section 228A of the Penal Code,in sub-section (1), for the words, figures and letters “section 376A, section376B, section 376C, section 376D”, the words, figures and letters“section 376A, section 376AB, section 376B, section 376C, section 376D,section 376DA, section 376DB” shall be substituted.
4. Amendment of section 376.––In section 376 of the Penal Code,––
(a) in sub-section (1), for the words “shall not be less than sevenyears, but which may extend to imprisonment for life, and
shall also be liable to fine”, the words “shall not be less thanten years, but which may extend to imprisonment for life, andshall also be liable to fine” shall be substituted ;
(b) in sub-section (2), clause (i) shall be omitted ;
(c) after sub-section (2), the following sub-section shall be inserted,namely :––
“(3) Whoever, commits rape on a woman under sixteen yearsof age shall be punished with rigorous imprisonment for a termwhich shall not be less than twenty years, but which may extendto imprisonment for life, which shall mean imprisonment forthe remainder of that person's natural life, and shall also beliable to fine :
Provided that such fine shall be just and reasonable to meetthe medical expenses and rehabilitation of the victim :
Provided further that any fine imposed under this sub-sectionshall be paid to the victim.”.
5. Insertion of new section 376AB.–– After section 376Aof the Penal Code, (45 of 1860), the following section shall be inserted,namely :––
“376AB. Punishment for rape on woman under twelve yearsof age.–– Whoever, commits rape on a woman under twelve yearsof age shall be punished with rigorous imprisonment for a termwhich shall not be less than twenty years, but which may extendto imprisonment for life, which shall mean imprisonment for theremainder of that person’s natural life, and with fine or withdeath :
Provided that such fine shall be just and reasonable to meet themedical expenses and rehabilitation of the victim :
Provided further that any fine imposed under this section shall bepaid to the victim.”.
6. Insertion of new sections 376 DA and 376 DB.–– After section376D of the Penal Code, the following sections shall be inserted,namely :––
“376DA. Punishment for gang rape on woman under sixteenyears of age.––Where a woman under sixteen years of age israped by one or more persons constituting a group or acting infurtherance of a common intention, each of those persons shall bedeemed to have committed the offence of rape and shall be punishedwith imprisonment for life, which shall mean imprisonment for theremainder of that person's natural life, and with fine :
Provided that such fine shall be just and reasonable to meet themedical expenses and rehabilitation of the victim :
Provided further that any fine imposed under this section shall bepaid to the victim.
376DB. Punishment for gang rape on woman under twelveyears of age.–– Where a woman under twelve years of age israped by one or more persons constituting a group or acting infurtherance of a common intention, each of those persons shall bedeemed to have committed the offence of rape and shall be punishedwith imprisonment for life which shall mean imprisonment forthe remainder of that person’s natural life, and with fine or withdeath :

7. Amendment to section 53.––In section 53A of the IndianEvidence Act, 1872, (1 of 1872), (hereafter in this Chapter referred to as
the Evidence Act), for the words, figures and letters “section 376A,section 376B, section 376C, section 376D”, the words, figures and letters“section 376A, section 376AB, section 376B, section 376C, section 376D,section 376DA, section 376DB” shall be substituted.
8. Amendment to section 146.––In section 146 of the EvidenceAct, in the proviso, for the words, figures and letters “section 376A,section 376B, section 376C, section 376D”, the words, letters andfigures “section 376A, section 376AB, section 376B, section 376C, section376D, section 376DA, section 376DB” shall be substituted.
CHAPTER IV
Amendments to the Code of Criminal Procedure, 1973
9. Amendment of section 26.––In the Code of CriminalProcedure, 1973, (2 of 1974), (hereafter in this Chapter referred to as theCode of Criminal Procedure), in section 26, in clause (a), in the proviso,for the words, figures and letters “section 376A, section 376B, section 376C,section 376D”, the words, figures and letters “section 376A, section 376AB,section 376B, section 376C, section 376D, section 376DA, section 376DB”shall be substituted.
10. Amendment of section 154.––In section 154 of the Code ofCriminal Procedure, in sub-section (1),––
(i) in the first proviso, for the words, figures and letters“section 376A, section 376B, section 376C, section 376D,”,the words, figures and letters “section 376A, section 376AB,section 376B, section 376C, section 376D, section 3760DA,section 376DB,” shall be substituted ;
(ii) in the second proviso, in clause (a), for the words, figuresand letters “section 376A, section 376B, section 376C,section 376D,”, the words, figures and letters “section 376A,section 376AB, section 376B, section 376C, section 376D,section 376DA, section 376DB,” shall be substituted.
11. Amendment of section 161.––In section 161 of the Code ofCriminal Procedure, in sub-section (3), in the second proviso, for the words,figures and letters “section 376A, section 376B, section 376C, section 376D,”,the words, figures and letters “section 376A, section 376AB, section 376B,section 376C, section 376D, section 376DA, section 376DB,” shall besubstituted.
12. Amendment of section 164.––In section 164 of the Code ofCriminal Procedure, in sub-section (5A), in clause (a), for the words, figuresand letters “section 376A, section 376B, section 376C, section 376D,”, thewords, figures and letters “section 376A, section 376AB, section 376B,section 376C, section 376D, section 376DA, section 376DB," shall besubstituted.
13. Amendment of section 173.––In section 173 of the Code ofCriminal Procedure,––
(i) in sub-section (1A), for the words “rape of a child may becompleted within three months”, the words, figures and letters“an offence under sections 376, 376A, 376AB, 376B, 376C,376D, 376DA, 376DB or section 376E, (45 of 1960), of theIndian Penal Code shall be completed within two months” shallbe substituted ;
(ii) in sub-section (2), in clause (i), in sub-clause (h), for the figures,letters and word “376A, 376B, 376C, section 376D”, the figuresand letters “376A, 376AB, 376B, 376C, 376D, 376DA,376DB” shall be substituted.
14. Amendment of section 197.––In section 197 of the Code ofCriminal Procedure, in sub-section (1), in the Explanation, for the words,figures and letters “section 376A, section 376C, section 376D”, the words,figures and letters “section 376A, section 376AB, section 376C,section 376D, section 376DA, section 376DB” shall be substituted.
15. Amendment to section 309.––In section 309 of the Code ofCriminal Procedure, in sub-section (1), in the proviso, for the words, figures

16. Amendment to section 327.––In section 327 of the Code ofCriminal Procedure, in sub-section (2), for the words, figures and letters“section 376A, section 376B, section 376C, section 376D”, the words,figures and letters “section 376A, section 376AB, section 376B, section376C, section 376D, section 376DA, section 376DB” shall be substituted.
17. Amendment to section 357B.––In section 357B of the Code ofCriminal Procedure, for the words, figures and letters “under section 326Aor section 376D of the Indian Penal Code”, the words, figures and letters“under section 326A, section 376AB, section 376D, section 376DA andsection 376DB, (45 of 1860), of the Indian Penal Code” shall be substituted.
18. Amendment to section 357C.––In section 357C of the Code ofCriminal Procedure, for the figures and letters “376A, 376B, 376C, 376D”,the figures and letters “376A, 376AB, 376B, 376C, 376D, 376DA, 376DB”shall be substituted.
19. Amendment of section 374.––In section 374 of the Code ofCriminal Procedure, after sub-section (3), the following sub-section shall beinserted, namely :––
“(4) When an appeal has been filed against a sentence passedunder section 376, section 376A, section 376AB, section 376B,section 376C, section 376D, section 376DA, section 376DB orsection 376E of the Indian Penal Code, the appeal shall be disposedof within a period of six months from the date of filing of suchappeal.”.
20. Amendment of section 377.––In section 377 of the Code ofCriminal Procedure, after sub-section (2), the following sub-section shall beinserted, namely :––
“(3) When an appeal has been filed against a sentence passedunder section 376, section 376A, section 376AB, section 376B,
section 376C, section 376D, section 376DA, section 376DB orsection 376E of the Indian Penal Code, the appeal shall be disposedof within a period of six months from the date of filing of suchappeal,”.
21. Amendment of section 438.––In section 438 of the Code ofCriminal Procedure, after sub-section (3), the following sub-section shallbe inserted, namely :––
“(4) Nothing in this section shall apply to any case involving thearrest of any person on accusation of having committed an offenceunder sub-section (3) of section 376 or section 376AB or section376DA and section 376DB of the Indian Penal Code.".
22. Amendment of section 439.––In section 439 of the Code ofCriminal Procedure,––
(a) in sub-section (1), after the first proviso, the following provisoshall be inserted, namely :––
“Provided further that the High Court or the Court of Sessionshall, before granting bail to a person who is accused of anoffence triable under sub-section (3) of section 376 or section376AB or section 376DA or section 376DB, (45 of 1860), ofthe Indian Penal Code, give notice of the application for bail tothe Public Prosecutor within a period of fifteen days from thedate of receipt of the notice of such application.” ;
(b) after sub-section (1), the following sub-section shall be inserted,namely :––
“(1A) The presence of the informant or any person authorisedby him shall be obligatory at the time of hearing of the applicationfor bail to the person under sub-section (3) of section 376 orsection 376A or section 376DA or section 376DB, (45 of 1860),of the Indian Penal Code.”.
23. Amendment of First Schedule.––In the First Schedule to theCode of Criminal Procedure, under the heading “I.–OFFENCES UNDERTHE INDIAN PENAL CODE”,––
(a) against section 376,––
(i) for the entry under column 3, the following entries shallbe substituted, namely :––
“Persons Rigorous Congnizable Non- Court ofcommitting imprisonment bailable Session.”;offence of for a termrape on a which shall notwoman be less thanunder 20 yearssixteen but whichyears may extend toof age imprisonment

1. Short title and commencement.––(i) These rules shall be called

iv. Principals would continue to have lien in their mainacademic post where they would continue to get notionalpromotions while they are functioning as Principals. Aftercompletion of their tenure as Principals, they would goback to their academic post and draw salary due in suchrespective academic posts, and would not continue tohave the Principals’ Pay.
(2) The Pay Matrix based on the above propositions on AcademicLevels/Cells and Entry Pay is at Annexure-I.
5. Fixation of pay.––The fixation of pay in the revised pay structurefor different categories of Faculty Members (Teachers) and equivalentpositions shall be carried out as per the procedure/pattern prescribed underJammu and Kashmir Civil Service (Revised) Pay Rules, 2018 notifiedvide SRO-193 dated 24-04-2018.
6. Incentive increment for higher qualification.––The incentivestructure is built-in in the pay structure itself wherein those having M. Philor Ph. D. degree will progress faster under CAS. Therefore, there shall beno incentives in the form of advance increments for obtaining the degrees ofM. Phil or Ph. D. However, the existing provisions of assured careerprogression shall continue.
7. Increments.––The increments in the revised pay structure shallalso be regulated as per the procedure/pattern prescribed under Jammu and
Kashmir Civil Service (Revised) Pay Rules, 2018 notified vide SRO-193
dated 24-04-2018.

Overriding effect of rules.––The provisions of the Jammu andKashmir Civil Services Regulations, the Jammu and Kashmir GovernmentDegree Colleges (Adoption of UGC Scale) Revised Pay Rules, 1991,the Jammu and Kashmir Government Degree Colleges (Adoption ofUGC Scale) Revised Pay Rules 2002, and the Jammu and KashmirGovernment Degree Colleges (Adoption of UGC Scale) Revised PayRules 2009, shall not, save as otherwise provided in these rules, apply tocases where pay is regulated under these rules, to the extent they areinconsistent with these rules.
12. Interpretation.––If any question arises relating to interpretationof any of the provisions of these Rules, it shall be referred to theGovernment in Finance Department for decision, the decision whereof shallbe binding and final.

5. Pay Fixation method.––(1) The fixation of pay of the facultymembers and equivalent of the Institute is to be carried out in the revisedpay structure strictly as per the relevant provisions of Jammu and KashmirCivil Service (Revised) Pay Rules, 2018 notified vide SRO-193 of 2018dated 24-04-2018, moving from the concept of Pay Band and Grade Pay tothat of Pay Levels and Cells.
(2) A Faculty Member appointed as such from 01-01-2016 to thedate of issuance of these rules, shall be deemed to have been appointed

6. Non-Practicing Allowance (NPA).––(1) With effectfrom 01-04-2018, the doctors including Faculty Members of the Instituteshall be entitled to Non-Practicing Allowance @ 20% of Basic Pay, subjectto the condition that the Basic Pay+NPA shall not exceed to ̀225000/-(fixed pay of the Director). However, the NPA for the period 01-01-2016 to31-03-2018, shall be admissible/drawn at the existing rates in the existingpay structure (existing Pay Band and Grade Pay).
(2) The NPA shall count as Pay for all service and retirementbenefits.
7. Increments.––The increments in the revised pay structure shallalso be regulated as per the relevant provisions of Jammu and KashmirCivil Service (Revised) Pay Rules, 2018.
8. Fixation of Pay on Promotion.––The pay on promotion in therevised pay structure shall also be regulated as per the relevant provisions ofJammu and Kashmir Civil Service (Revised) Pay Rules, 2018.
9. Creation of new Posts.––No post shall be created in future underthe Government except in one of the revised Pay Levels shown in theSchedule appended to these rules. 11. Overriding effect of rules.––The provisions of the Jammu andKashmir Civil Services Regulations, the SKIMS Faculty Members(Revised Pay) Rules, 2000 and the SKIMS Faculty Members (Revised

Powers to Relax Rules.––Where the Government is satisfied thatthe operation of all or any of the provisions of these rules causes unduehardship in any particular case, the Government may, by order, dispensewith or relax requirements of that rule(s) to such extent and subject to suchconditions as may be considered necessary for dealing with such a case in ajust and equitable manner.
13. Interpretation.––If any question arises relating to interpretationof any of the provisions of these rules, it shall be referred to theGovernment in Finance Department for decision, the decision whereof shallbe binding and final.

Whereas, during further course of investigation on the disclosureof the accused Subzar Ahmad Bhat @ Waza @ Basharat @ UsmanS/o Gh. Ahmad Bhat R/o Sehpora Kulgam an active terrorist of HM outfitone Sniper rifle and 08 rounds were recovered in a hideout constructed inthe house of Gull Mohd Naikoo S/o Ab. Rahim Naikoo R/o Such Kulgamand seizure memo was prepared.
Whereas, the site plan of the house of Gull Mohd. NaikooS/o Ab. Rahim Naikoo R/o Such Kulgam, wherein the hideout wasestablished, was prepared by Revenue Authorities. The revenue documentsregarding the ownership of the house wherein the hideout was constructed,to conceal the illegal arms/ammunition of militants of HM outfit and to useit as a place of escape of terrorists’ obtained from Tehsildar Kulgam hasbeen placed on record. Further, Photography of the hideout has beenconducted.
Whereas, statements of witnesses were recorded under relevantsections of law and placed on record. Investigation conducted revealed thatthe hideout has been constructed to conceal the illegal arm/ammunition ofmilitants of HM outfit and to use it as a place of escape of terrorists. Based
on the facts and evidence on record, prima facie offences punishable
the accused persons A1, A2, A4, and A5 for the commission of
offence punishable under section 13 ULA (P) Act, 1978, arising out of FIR
No. 45/2017 P/S Kulgam.

(II) These rules shall come into force from 1st day of January, 2016
with effective date of implementation as 1st day of April, 2018.
2. Application.––These rules shall apply to the faculty members of
the Government Colleges of Engineering and Technology, Jammu who
were in service on 01-01-2016 holding or would have, but for their deputation
or posting outside their parent cadre, held such posts either in substantive,
officiating or temporary capacity :
Provided that with effect from the commencement of these rules, the
organisational hierarchy of the faculty members of the Government Colleges
of Engineering and Technology, Jammu shall be as under :––
i. Assistant Professors ;
ii. Associate Professors ; and
iii. Professors :
Provided further that the revised hierarchy shall be adopted in
respect of the Government Colleges of Engineering &Technology, Jammu subject to such recruitment, promotion,selection process and criteria thereof as may be prescribed forthe purpose by the AICTE/MHRD.
3. Definitions.––In these rules unless the context otherwiserequires,––
a. “College” means a Government Colleges of Engineering andTechnology, Jammu established by the Government ;
b. “Faculty Member” means and includes a Professor, AssociateProfessor, Assistant Professor or any other employee notifiedby the Government as Faculty Member or Teacher of theCollege and includes the Principal of the College ;
c. “AICTE” means the All India Council of Technical Education
of India ;

d. “AICTE Pay Scale/Structure” means the pay scale/pay
structure adopted by the All India Council of Technical

e. “Existing basic pay” means the pay drawn in the prescribed
existing Pay Band and Grade Pay or Pay drawn in the existing
pay scale ;
f. “Existing Pay Band and Grade Pay” means the Pay Band and
the Grade Pay applicable to the post held as on the date
immediately before the commencement of these rules ;
g. “Existing scale” means the pay scale applicable to the post
held as on the date immediately before the date of
commencement of these rules ;
h. “Existing pay structure” means the present system of Pay
Band and Grade Pay or the Pay Scale applicable to the post
held as on the date immediately before the commencement of
these rules ;
i. “Existing emoluments” mean the sum of (i) existing basic pay
and (ii) existing dearness allowance as on 1st day of
January, 2016 ;
j. “Pay matrix” means Matrix specified in the Schedule, with
Levels of Pay arranged in vertical cells as assigned to
corresponding existing Pay Band and Grade Pay or existing
scale ;
k. “Academic Level” in the Pay Matrix means the Level
corresponding to the existing Pay Band and Grade Pay or
existing scale as specified in the Schedule ;
1. “Pay in the Academic level” means pay in the appropriate Cell
of the Level as specified in the Schedule ;
m. “Revised pay structure” in relation to a post means the Pay
Matrix and the Levels specified therein corresponding to the

existing Pay Band and Grade Pay or existing scale of the post

o. “Revised emoluments” means the pay in the Academic Level
in the revised pay structure ; and
p. “Schedule” means the Schedule appended to these rules as
Annexure-I.

3. In rule 7.––

“(4) Every application under sub-rule (1) for renewal oflicense shall be disposed of within a period of 30 days”.
