Whereas, the undersigned duly authorized by the Government videSRO-235 and 236 of 2009 dated 11-08-2009 to exercise the powers undersections 6 & 7 of the Land Acquisition Act, 1990 (Svt.) is satisfied afterconsidering the report furnished by the Collector, Land Acquisition,Sub-Divisional Magistrate, R. Now, therefore, it is declared under section 6 of the said Act that theaforementioned land is needed for public purpose.
Further, the Collector, Land Acquisition, Sub-Divisional Magistrate,R. S. Pura is directed under section 7 of the said Act to take order foracquisition of the land of which specifications are given above and completefurther proceedings under due process.

3. Action against candidates found guilty of misconduct––
Candidates are advised that they should not furnish any particularsthat are false or suppress any material information. While submitting hardcopy of the application in the Commission, candidates are warned that theyshould, in no case, alter or otherwise temper with any entry in a documentor its attested/certified copy submitted by them, nor should they submit a

Government hereby makes the following amendments in the Jammu andKashmir Panchayati Raj Rules, 1996, namely :––
1. Substitution of Rule 155.––For Rule 155 of the Jammuand Kashmir Panchayati Raj Rules, 1996, the following shall besubstituted, namely :––
155. construction of the new buildings or extension oralternation of any existing building.––(1) No person shallconstruct or re-construct or commence to construct or re-construct a house or a building, or business establishment or anycommercial or residential complex or extend or alter any existinghouse or building of complex within a Panchayat area unless hehas sought previous approval, and has deposited fee, inaccordance with the procedure as may be notified by theGovernment in this behalf from time to time.
(2) Every person who intends to construct or re-construct ahouse or building or any commercial or residential complex oralter the existing building of complex shall give a notice in writingto the Halqa Panchayat and in absence of Halqa Panchayat tothe Panchayat Secretary of the Halqa Panchayat of suchintention.
(3) The application for building purposes shall be accompaniedby the site plan, record of ownership rights and constructionmap and such other documents, as may be notified by theGovernment in this behalf.
(4) No notice shall be considered unless the information/siteplan and specification of the house or building or complex hasbeen furnished to the satisfaction of the Halqa Panchayat.
(5) On receipt of the notice, under sub-rule (2) the HalqaPanchayat shall consider and examine such documents and aftersatisfying itself about the genuineness of the documents sofurnished by the person, recommend the case within 15 days of
the receipt of notice to the authority or authorities designated bythe Government for accord of sanction under sub-rule (l).
(6) The designated authority shall take a decision on suchapplication within such period as may be notified by theGovernment and convey its decision to the Halqa Panchayatconcerned in absence of Halqa Panchayat to the PanchayatSecretary of the Halqa Panchayat, as the case may be, eithergranting the sanction for construction or re-construction orextension or alteration or reject the same for seasons to berecorded in writing.
(7) If the designated authority grants sanction for constructionor re-construction or extension or alteration of any house orbuilding or business establishment or complex, the concernedperson shall deposit with the Halqa Panchayat the requisite feeas may be determined by the Government from time to timewithin a period of 15 days. If any person fails to pay the requisitefee within the stipulated period, the order of sanction issued bythe designated authority shall stand cancelled.
(8) If the designated authority fails to take a decision with regardto grant of sanction for construction or re-construction orrejection of such application within a period of 15 days of thereceipt of recommendation under sub-rule (5), the sanction shallexcept in so far as it may contravene any bye-law be deemed tohave been accorded unless the land on which it is proposed toconstruct or re-construct, extend or alter such building orcomplex or business establishment belongs to or vests with HalqaPanchayat or the Government.
2. Substitution of Rule 156.––For Rule 156 of the Jammuand Kashmir Panchayati Raj Rules, 1996, the following shall besubstituted, namely :––
156. Penalty.––If a person intends to construct/re-construct orcommences to construct or re-construct any house or building
or business establishment or residential complex or commercialcomplex or extending or altering any existing house or buildingor business establishment or residential complex or commercialcomplex without the proper permission of the Halqa Panchayat/Competent Authority, he/she shall be fined by the PanchayatAdalat/Competent Authority for an amount not exceedingRs. 5000/- in case of construction or re-construction or extensionor alteration of a residential house and not exceedingRs. 10,000/- in case of construction or extension or alteration ofa commercial complex or business establishment and if thebreach is a continuing one with a further fine which may extendto Rs. 2000/- after the date of the first conviction duringwhich the offence is proved to have commit/persisted and incase the construction and re-construction, extension or alterationis not removed within 10 days of the date of first conviction theHalqa Panchayat/Competent Authority may order demolition ofthe unauthorized constructed house or building or extension oralteration of an existing house or building at the cost of theoffender. Besides, the Block Development Officer concernedshall have the powers to seal the buildings being constructed/re-constructed in violation of Rule 155 so as to curb the menaceof unorganized growth in the rural areas and check the rampantconversion of Agricultural land for other construction purpose.

from the court, he threatened the SHO, Nigeen of dire consequences and
also used provocative language against the sovereignty of the State as well

Whereas, in this connection, Case FIR No. 07/2010 under
section 13(2) of the Unlawful Activities (Prevention) Act, 1967 and
section 506 RPC was registered in Police Station, Maisuma, Srinagar and
investigation initiated ; and
Whereas, during the course of investigation, on the basis of statements
of witnesses and other evidence, the Investigating Officer has established
a prima facie case against the accused person under section 13 (2) of the
Unlawful Activities (Prevention) Act, 1967 apart from other offence ; and
Whereas, the Authority appointed by the State Government under
sub-section (2) of section 45 of the Unlawful Activities (Prevention)
Act, 1967 has independently scrutinized the Case Diary file and all other
relevant documents relating to the case and has come to a definite conclusion
that this is a fit case for accord of prosecution sanction against the accused
person ; and
Whereas, after perusing the Case Diary, the relevant documents and
also taking into consideration the observations/views of the Authority
appointed under sub-section (2) of section 45 of the Unlawful Activities
(Prevention) Act, 1967, the State Government is of the view that there is
sufficient material and evidence available against the accused person for
his prosecution under the aforesaid provisions of law.
Now, therefore, in exercise of powers conferred by sub-section (1)

Whereas, in this connection, Case FIR No. 49/2012 undersections 18, 20, 21 and 40 of the Unlawful Activities (Prevention)Act, 1967, 7/25-A Act and section 489-C RPC was registered in PoliceStation, Parimpora and investigation initiated ; and
Whereas, during the course of investigation, the involvement ofother 08 accused persons affiliated with LeT outfit was also establishedand further cash of Rs. 1,50,000/- was also recovered from one of theaccused ; and
Whereas, during the course of further investigation, on the basis ofstatements of witnesses and other evidence, the Investigating Officer hasestablished a prima facie case against 10 accused persons undersections 18, 20, 21 and 40 of the Unlawful Activities (Prevention) Act,1967 apart from other offences ; and
Whereas, the Authority appointed by the State Government undersub-section (2) of section 45 of the Unlawful Activities (Prevention) Act,1967 has independently scrutinized the Case Diary file and all the otherrelevant documents relating to the case and has come to a definiteconclusion that this is a fit case for accord of prosecution sanction againstthe accused persons ; and
Whereas, after persuing the Case Diary, the relevant documentsand also taking into consideration the observations/views of the Authorityappointed under sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967 the State Government is of the view that there issufficient incriminating material and evidence available against the accusedpersons for their prosecution under the aforesaid provisions of law.
Now, therefore, in exercise of powers conferred by sub-section (1)of section 45 of the Unlawful Activities (Prevention) Act, 1967, the StateGovernment hereby accords sanction for launching prosecution against

SRO-457.––Whereas, on 03-03-2011, Police Station, Kothibagh,Srinagar received reliable information to the effect that one Abdul HameedMalik S/o Ab. Gani Malik of Mohalla Trehgam, Kupwara has beendistributing Hawala Money received from abroad, among the terroristgroups in the State with an intention to augment the subversive activities,disturb the peace and tranquility and to secede the State of J&K from theUnion of India ; and

Whereas, in this connection, Case FIR No. 22/2011 under sections17 and 40 of the Unlawful Activities (Prevention) Act, 1967, was registeredin Police Station, Kothibagh, Srinagar and investigation initiated ; and
Whereas, during the course of investigation, the accused wasapprehended and during his personal search, one I-Card, five lac Indiancurrency (500 Indian currency notes of Rs. 1000 denomination) wrappedin handmade container of newspaper “AUSAF” dated 21-11-2010 ofMuzaffarabad, PoK and objectionable documents were also recoveredfrom his possession ; and
Whereas, during the course of further investigation, it was establishedthat one Zaffar Ahmad Bhat @ Khursheed, Financial Advisor of HMoutfit presently in PoK had sent the consignment to Ab. Hameed MalikS/o Ab. Gani Malik R/o Trehgam, Kupwara on the directions ofMohammad Ashraf Malik S/o Mohammad Yousuf Malik R/o Trehgam,Kupwara which was delivered to one Firdous Ahmad Dar S/o Ab. RashidDar R/o Sangam, Bijbehara, an OGW of banned HM outfit at FruitMandi, Pampore. The accused Firdous Ahmad Dar approached ShameemAhmad Sofi S/o Ab. Khaliq R/o Sangam, Bijbehara and MohammadAbass Mir S/o Saif-ullah Mir R/o Sangam, Bijbehara by offering them jobopportunities on monthly salary of Rs. 3000/- with sole objective to distributeHawala money among the widows and orphans of killed militants ; and
Whereas, on the basis of statements of witnesses, the seizure memoand other evidence, the Investigating Officer has established aprima facie case against the accused persons under sections 17 and 40of the Unlawful Activities (Prevention) Act, 1967 apart from otheroffence ; and
Whereas, the Authority appointed by the State Government undersub-section (2) of section 45 of the Unlawful Activities (Prevention) Act,1967 has independently scrutinized the Case Diary file and all otherrelevant documents relating to the case and has come to a definiteconclusion that this is a fit case for accord of prosecution sanction againstthe accused persons ; and

SRO-459.––Whereas, on 24-10-2007, Police Station, Shopian receivedan information through a reliable source to the effect that an unknownperson entered in J&K Bank, Branch, Imamsahib, Shopian carrying apacket in his hand. On being asked by the guard personnel deployed inthe Bank, the accused reported that he had to deposit the cash in theBank. As soon as the guard personnel started to check thepacket, the accused fled away. The guard personnel tried to nab him, but

the accused managed to escape on his motorcycle creating hustle andbustle in and outside the Bank. On opening the envelope (Packet), 380currency notes of 500 denomination counterfeit currency amountingto Rs. 01 lakh and 90 thousands were found in the packet. Besides,one 7.62 mm cartridge and a letter pad of banned outfit, Harkatul Mujahideenaddressed to the Bank Manager was also found in the packet ; and
Whereas, in this connection, Case FIR No. 199/2007 under sections489-C RPC, 7/25 Arms Act and section 38 of the Unlawful Activities(Prevention) Act, 1967, was registered in Police Station, Shopian andinvestigation initiated ; and
Whereas, during the course of investigation, on the basis of statementof witnesses, the seizure memo and other evidence, the InvestigatingOfficer has established a prima facie case against the accused personunder section 38 of the Unlawful Activities (Prevention) Act, 1967 apartfrom other offences ; and
