RECOMMENDATION: That Council approves a by- law to stop up and close and add to the adjoining lots on the proposed subdivision on Clover Crescent shown as parts 1- 8 on Plan 6R- 8955. EXPLANATION: When the proposed subdivision was originally created there was an area surveyed for drainage and a portion of the subdivision had been set aside for the City to ensure adequate drainage in the area. As development occurred in the area over time and new developer assumed development of the proposed subdivision it was discovered that the previous drainage system had been impacted and would not be sufficient. The City looked at number of options to rectify the drainage issue. All options using the originally designed drainage right of way would have been very expensive to the City with the costs ranging from $ 250, 000. 00 to $ 300, 000. 00. It was determined that the best and least costly option would be to survey out a small portion of the 66 foot road allowance and add it to the front of each lot. An area five ( 5) feet deep the width of each lot in the subdivision was surveyed out and will be stopped up and closed and added to the proposed lots in the subdivision. This will reduce the road allowance from 66 feet to 61 feet. In return, the City will retain an easement over the rear portion of each lot and use this to rectify the drainage issue in the subdivision. This was done to ensure that the developer was not negatively impacted by reducing the lot sizes available for sale.
