An Act Regulating the Practice of Chemical Engineering and Repealing for this Purpose Republic Act Numbered Three Hundred and Eighteen (R. A. No. 318), otherwise known
as "The Chemical Engineering Law"
Title
1. to supervise and regulate the practice of chemical engineering, vital to national development
2. to upgrade the chemical engineering education, ensuring that the country's chemical engineers are at par with the best in the world
3. to reserve the practice of the chemical engineering profession to Filipino citizens
POLICY
1. practice of chemical engineering - offering of professional chemical engineering service for a fee, salary, reward, or compensation, paid directly or through another person, even without such reward or compensation
2. industrial plant - any plant in which unit processes and/or unit operations are involved, including pollution control and abatement processes and operations

3. unit process - involves chemical change in the manufacture of industrial or consumer products or the treatment of industrial or chemical wastes
4. unit operation - physical operation by which a desired step in an industrial process is conducted or controlled

DEFINITION OF TERMS
6. chemical engineer - a person duly registered and a holder of a valid Certificate of Registration and Professional Identification Card issued by the Board of Chemical Engineering and by the Professional Regulation Commission (PRC)
DEFINITION OF TERMS
Professional chemical engineering practice shall include the following in relation to industrial plants:
• consultation requiring chemical engineering knowledge, skill, and proficiency
• investigation
• estimation and/or valuation
• planning
• preparation of feasibility studies
SCOPE OF PRACTICE
Professional chemical engineering practice shall include the following in relation to industrial plants:
• designing
• preparation of specifications
• supervision of installation
• operation including quality management, but not including chemical analysis and operation of a chemical laboratory
SCOPE OF PRACTICE
Teaching, lecturing, and reviewing of a professional chemical engineering subject in the curriculum of the Bachelor of Science in Chemical Engineering degree or a subject in the Chemical Engineering Licensure Examination given in any school, college, university, or any other educational institution shall also be considered a professional chemical engineering service.
SCOPE OF PRACTICE
1. It is under the administrative control and supervision of the Professional Regulation Commission.
2. It is composed of a chairman and two other members.
3. They are appointed by the President of the Philippines from among those recommended by the Commission from the nominees of the duly integrated and accredited national organization of chemical engineers.
The Chemical Engineering Board
1. natural born Filipino citizen and resident of the Philippines
2. at least a holder of a Bachelor's degree in chemical engineering as conferred by an engineering school of good standing, recognized and accredited by the government
3. a registered chemical engineer in active practice for at least 10 years
QUALIFICATIONS OF THE REGULATORY BOARD
4. a member of good standing of the integrated and duly accredited national chemical engineering profession
5. does not have any interest, directly or indirectly in any university, college, school, or institution conferring an academic degree necessary for admission to the practice of chemical engineering or where review classes in preparation for licensure examinations are being offered or conducted
QUALIFICATIONS OF THE REGULATORY BOARD
1. supervises and regulates the practice of the chemical engineering profession
2. determines and evaluates the qualifications of the applicants for registration
3. prescribes the subjects to be included in the licensure examination, determine the syllabi of the subjects and their respective weights, construct the test questions, score and rate the examination papers, and submit the examination results to the Commission

4. together with the Commission, issues Certificates of Registrations and Professional Identification Cards to applicants who have passed the licensure examination for registered chemical engineers
5. issues special permits to persons admitted to the practice of the profession and Certificates of Recognition for advance studies and researches and accomplishments in the profession that contribute to its enrichment

6. inquires into the conditions affecting the practice of the profession and adopts measures for the enhancement and maintenance of a high professional, ethical, and technical standard.
7. inspects establishments where chemical engineers practice their profession such as factories, plants, offices, and the like in order to determine and enforce compliance with the provisions of RA 9297 and issues Certificates of Compliance

8. in coordination with the Commission on Higher Education (CHED), inspects the facilities, faculty, equipment, and other aspects directly related to the chemical engineering program of educational institutions
9. adopts rules and regulations for the practice of chemical engineering
10.adopts a Code of Ethics and a Code of Technical Standards for the practice of chemical engineering

11. investigates violations to RA 9297, the ChE Code of Ethics, and the Code of Technical Standards
12. issues subpoenas to secure the attendance of witnesses or the production of documents in connection with any administrative case before the Board
13.hears and decides administrative cases filed against chemical engineers and firms employing chemical engineers

14.administer oaths in connection with the performance of its functions
15.adopt an official seal and prescribe the seal of the chemical engineering profession
16.submit annual reports to the Commission
17.prosecute and institute criminal action against any violator of RA 9297

18.prescribe guidelines and criteria on the Continuing Professional Education (CPE) program for chemical engineers in consultation with the integrated and accredited chemical engineering organizations
19.perform such other functions as may be necessary in order to implement the provisions of this Act

• neglect of duty• incompetence• tolerance of irregularities in the licensure
examinations• malpractice• unprofessional or unethical conduct
