DUTY RULES, 1962

[28th September 1962]

REAMBLE

In exercise of the powers conferred

by sub-sections (1) and (2) of

section 12 of the Bombay Electricity

Duty Act 1!"# (Bom$ %& of 1!"#)

the 'oernment of aharashtra

hereby ma*es the followin+ rules

the same hain+ been preiously published as re,uired by sub-

section (1) of the said section 12

namely -

(1) These rules may be

called the Bombay Electricity

Duty Rules, 1962.

(2) They shall come into

force on and from the 1st

day of ctober, 1962.

licensee under his

such month shall be

named after that

calendar month, and

of days of such

(1) Eery licensee $ho

su++lies ener/y to any

consumer may +re+are his

bill of char/es accordin/ to

his billin/ month, but shall

include the electricity duty

leiable under the 'ct as a

se+arate item in the bill of

char/es for the ener/y

su++lied by him to the

consumer and shall recoer

the same from the consumer

alon/ $ith his o$n char/es

for the su++ly of such

ener/y. The duty leiable in

accordance $ith the different

+arts shall be indicated by

the licensee se+arately in

the bill.

(2) 0here in res+ect of any

billin/ month, the licensee

ordinarily com+letes the

readin/ of meters of all his

consumers of any class,

$ithin a +eriod of seen days

from the date on $hich hecommences such readin/, he

shall, in res+ect of such

billin/ month, +ay to tate

-oernment on or before the

last date of the succeedin/

calendar month, the $hole

of the duty +ayable in

res+ect of the ener/y

consumed by such class of

consumers durin/ the billin/

month.

() !n all cases not fallin/

under sub%rule (2) the duty

+ayable in res+ect of ener/y

consumed by the consumers

durin/ each billin/ month

may be +aid by the licensee

by three instalments as

hereinafter +roided %

(i) the first instalment

of a sum e#ual to

l=2>th of the total

duly collected and

+aid to the tate

-oernment durin/

the +recedin/

financial year in

res+ect of ener/y

consumed by the

aforesaid class of

consumers durin/

that year shall be

+aid on or before the

1th day of thesucceedin/ calendar

months;

(ii) the second

instalment e#ual to

the sum mentioned in

(iii) the last

5(2) 0here any licensee hasbeen +ermitted under sub%

$hich he is re#uired to +ay

electricity duty under these

rules shall, tor the +ur+ose

of these rides, be deemed to

be the date on $hich the

licensee has +aid the

electricity duty ;

<roided that, if on

account of any

default on the +art of

the licensee, the

amount +aid by him

by the che#ue so

de+osited is not

transferred to the

credit of the tate

-oernment, the date

on $hich the said

amount is actually

transferred to the

credit of the tate

-oernment shall, for

the +ur+ose of these

rules, be deemed to

be the date on $hich

the licensee has +aid

The Electrical !ns+ector shall

of the meter tested in

accordance $ith the

+roisions of section 26 of

the !ndian Electricity 'ct,

consumer to be read as far

in each month and to hae

duty in each month

the +ur+ose of com+utation

of electricity duty and

submission of #uarterlyreturns under these rules ;

referred for decision under

+erson concerned or li8ely to

be concerned $ith such

#uestion to +roduce before it

such information (oral or

documentary), as in its

o+inion is necessary or

re#uired for the +ur+oses of

recordin/ its decision.

(2) 'ny +erson a//rieed by

the decision of the authority

under +ara/ra+h !! in the

chedule to the 'ct or any

licensee hain/ any interest

in such decision shall, on

+ayment of a co+yin/ fee at

the rate of t$enty%fie naye

+aise +er ty+ed +a/e and on

an a++lication made in that

behalf to the authority, be

seniormost officer of the

licensee residin/ at the +lace

$here boo8s of account and

re/isters of the licensee are

8e+t in +ursuance of rule

or to such +erson as the

case may be, to +ay the

clues to/ether $ith the

interest accruable thereon,

re+ort to the tate

-oernment for the recoery

of the dues as an arrear of

land reenue.

(2) 0here any consumer

$ho is liable to +ay the

electricity duty directly to

the tate -oernment fails

to +ay the same $ithin the

time +rescribed in that

behalf, the Electrical

!ns+ector shall send a

$ritten notice to the last
