BY JASMINE CUPP Aſter taking heat recently in pub- lic reports that have been printed in area newspapers, Mark Mulligan, who has served as Oawa County’s Prosecuting Aorney since 1997, in- vited The Beacon to do an exclusive interview in an effort to get his side of the story heard in the community. On Friday, September 5, Mulli- gan sat down to do an interview to bring some of these important facts to light. The main topic that shown through during the interview was the importance of a fair trial to the client. “If a case is ongoing, we need to be very careful what we say,” said Mul- ligan. “If a prosecutor is acting mum on a case, then they are acting ethically; acting by man- dated Supreme Court rules. I do not want to interfere with their right to a fair trial.” Mulligan referred to the Ohio Rules of Professional Conduct from the Ohio Supreme Court specifically Rule 3.6 which is trial publicity. As stated in the above Supreme Court law, there are exceptions to this law; when the public is in danger facts about the case can be given to the media to protect the people. This is intended to protect the people, leaking of information is to not be used for the intent to entertain the people. “I don’t want to try cases in the newspaper or in the media,” said Mulligan, “I want to try them in a court of law.” Mulligan also states that aſter the trial is over, all the information in the trial goes into public record. “If people are worried that something inappropriate is happening in a trial, it will come out,” said Mulligan. “But, the information is not available until aſter the trial is over to ensure the trial is fair for the client.” “We agonize over our decisions, they are not black and white. We view them with the view to serve justice. It is helpful to brainstorm with the other aorneys in the office. Together we have many years of experience and that is invaluable. We are not afraid to voice our differences of opinion,” said Mulligan. There are times when there are “bumps in the road” as Mulligan put it. One instance that he shared was a trial where the client entered into a plea deal and the prosecutor negoti- ated the terms for them. Even though the client agreed to the terms at the time, there was confusion aſterward for the client how they got there. “In this case we went back into the courtroom and the client agreed to the terms. I could have explained it beer to them as it was happening. There was a break- down in communication; the outcome was good, but the process could have been beer,” said Mulligan. “There is a fine line between being objective and say- ing the bad things that can come out and effect a case, I have to point out what questions will be asked to pre- pare them for the realities of the trial. To the victim, they have been wronged. It isn’t in human nature to think about things objectively when you have been victim- ized,” said Mulligan. “There is not always an opportunity to communicate with people all the time in every case. We are mindful of that now and we are trying to do beer,” said Mulligan. “We are striving for perfection.” Exclusive interview with Ottawa County Prosecuting Attorney Mark Mulligan BY JASMINE CUPP Over September 6 and 7 Perry’s Victory Heritage Fes- tival, sponsored by The Perry Group, was held on Put- in-Bay. BY JASMINE CUPPAfter taking heat recently in pub-

quiring citizens to sign in for questions and make statements be-fore meetings begin. It is unclear why council would not want to hear what the people have to say about what they are doing. How can we comment if we haven’t heard what they have said yet?

Is this to stifle public input?Council President Hartlaub said that’s what other cities do.

Councilman Below said that’s what Oak Harbor, Huron, Vermil-

ion, Perrysburg, Clyde and Woodville do.What else do these cities do?These cities provide many things that Port Clinton does not

provide to its residents:Oak Harbor, population 2700: Three little league ball diamonds,

one softball diamond, two full size basketball courts, three half-basketball courts, two tennis courts and an ice skating rink.

Huron, population 7100: Amphitheatre, boat basin, boat access, lighthouse, 1.2 mile trail plus tennis courts, two batting cages, na-ture trail and three shelters.

Perrysburg, population 21,000: Eleven city parks with 189 acres of green space within the city limits, four miles of walking path, an 18-hole golf course as well as Fort Imagination.

Clyde, population 6300: Baseball/softball diamonds, volleyball courts and tennis courts.

Woodville, population 2100: Community swimming pool.Vermilion, population 10,500: Nine dedicated parks plus a

community pool. Most importantly the city of Vermilion is buy-ing lakefront property, not selling it. Vermilion acquired a 2.3 acre parcel on the lake for $1.65 million while accepting opinions from the community on how to transform the building for public use.

Vermilion is buying, Port Clinton could be looking to sell lake-front property; I am CONFUSED.

Your government officials aren’t listening to you, they are mak-ing it difficult for you to speak out, so it’s even more important to vote on the park issue.

BY LYNETTE ELLISThough the fish weren’t biting, the fishing excursion for the

66 veterans of the past four major war conflicts was free along with the fish fry that followed. Tibbels Marina recently paid host to the Fourth Annual Veterans Fishing Excursion. What started as a way to remember the victims of 9.11 as well as the soldiers past and currently in fighting to keep our land free, has now also become a way to celebrate the life of the man who originated the veterans fishing day.

Jack Tibbel lived over 70 years on the shores Erie, making his livelihood from the waters. His knowledge of the joys as well as the pitfalls of the lake gained him the respect of fellow fisher-man. Tibbel became a charter boat captain; at one time charter-ing as many as 9 boats out of his marina. When fishing did not provide enough income to stay afloat, Tibbel was able to supple-ment his income by finding new ways to utilize his recourses. When the fish had been depleted during the 60’s, Jack chartered his boats to scuba divers who needed time under water in order to certify.

Tibbels Marina currently charters four boats with a passen-ger capacity of nineteen. These charter boats were designed by Jack with the assistance of a naval design engineer not only for buoyancy, but also for the comfort of the passengers. It is with these boats that Tibbel launched the first annual Veterans Fish-ing Excursion in 2011 after a conversation he had with his then 8 year old grandson, Will. Jack was explaining to his grandson

what had happened on 9/11 of 2001 and why remembering that day was so important. During that conversation he commented that he would like to do something to not only formally remem-ber the day, but also to pay tribute to the veterans who fight to keep our lands free and to show his appreciation. Will, who had been on innumerable fishing trips with his grandpa said, “Why don’t we taken them fishing?” Jack thought that was a great idea.

Over the past four years the annual fishing trip has grown in size and number. Word has been spread about the fishing trip through the VFW in Port Clinton and Marblehead to name a couple, as well as other VFW charters and veterans organiza-tions. During this year’s excursion, all four boats were utilized to accommodate the 66 veterans.

After the morning on the water, the veterans were then treated to a good ol’ fashion fish fry with all the accompaniments. Bar-beque specialist Opie Rohrer fried the fish to golden perfection. Before beginning the mean, everyone joined past VFW Post 2480 commander Richard Ellis and Devon, 14 year old grandson of jack Tibbel, in singing of God Bless America.

Unfortunately Jack Tibbel passed away before this year’s ex-cursion. His surviving widow, Kay, and family quickly decided to keep the Veterans Fishing Excursion going. Not only is it a way of giving back to the men and women who fight for the country, but also it is a lasting tribute to the man who made his life of the shores of Lake Erie.

Remembering 9/11: A tribute

Are these the dog days of summer?I don’t know about you, but I can’t tell if it’s still sum-

mer or the start of an early fall around here. There have been some mornings where we were headed out on the lake at sunrise and the morning air was chilly, and the sky had that cold crisp look to it that you often see in the fall. Normally, our attire would be shorts and a t-shirt with the hope that it wouldn’t get too hot out. But, late-ly, we’ve donned our pants and jackets over our shorts hoping it got warm enough later in the morning to take off our outer layers.

Along with this confusion on how to dress for the weather, is the confusion on how to approach the fish-ing. I have only been fishing for perch since my return from my dream vacation, so like many of you, I can only read about the walleye fishing, or talk to friends who have been walleye fishing.

While crankbaits will work from spring through fall, if you read my column then you already know that I typi-cally like to run crawler harnesses with live bait until the water temperatures drop back down below 60 de-gree mark. The water temperatures right now are still in the high 60’s to low 70’s.

There are very few reports on the walleye action right now, as the reports have been pretty spotty to say the least. That isn’t to say that they are not out there; it just means that they are scattered and harder to find than earlier in the season. I know a few Charters that drift cast for them have been taking some walleye off the rocks out by Gull Island Shoal. Some trollers have

been successful in finding walleye out by G Can and out in front of Green Cove on the reefs. Another friend is fishing over in Huron, and pulling cranks successfully. Hot-n-Tots, Rapala Tail Dancers, Deep Husky Jerks(12’s), Bomber Long A’s, and Reef Runners (both 800’s and Little Rippers) have been working well.

Is it time to give my night crawlers to my little bluegill friends in my neighbor’s pond and pull out the crank-baits again? Or, is it too early to put them away? These are questions we can never really answer, so my thought is, start using both! Let the fish tell me what they want. If they hit the cranks more than the harnesses, then it’s time to put the harnesses away and put more crankbaits out, or vise versa. Unfortunately, finding them first is the hard part. Figuring out what they want once you find them is the easy part.

As for the perch fishing, it’s been awesome…simply awesome. If you like to eat perch, get out there and get some. You do not have to go to Canadian waters right now to get some really nice sized perch. They are all over the Western Basin right now and the shiner supply of minnows in the local bait shops has been outstanding.

Good luck and be safe!

Marblehead sets open house for Village bike path meetingBY RON ROYHAB

Marblehead Mayor Jackie Bird has scheduled an informational meeting at Village Hall for Marblehead residents and merchants who may want to learn more about Village plans to construct a bike-way path along two-miles of SR 163 to improve the safety of bikers and walkers. The meeting will be held on Monday, Sep-tember 15, from 5:30 p.m. to 7 p.m. and is open to the public.

In 2013, Marblehead received a grant for this project from the Ohio Department of Transportation. ODOT will pay 80% of the project cost and the Village 20%. There will be no assessment or charges to the residents or businesses. Construction, un-der the supervision of ODOT, is scheduled to begin September 1, 2015 and completed by November 1, 2015.

The bikeway will start downtown about 600-feet west of Alexander Pike and ends just past Lake Point Park. Most of the trail

will be an expanded four-foot shoulder of asphalt on each side of the road. In downtown Marblehead, an on-road trail is planned to more safely accommodate bicycle traffic. In both cases, the road will be well-marked with signs posted along the roadside and anti-skid roadway mark-ing on the pavement.

Mayor Bird said that engineering draw-ings showing the planned improvements for the bikeway trail will be available for review at the Village Hall meeting and that representatives from the Village’s en-gineering design firm will be there to an-swer questions.

The project is part of the Village of Mar-blehead Trail System Master Plan that en-visions additional improvements includ-ing an expanded bikeway trail throughout the Village that promotes a healthier com-munity through walking, biking, running and other alternative methods to driving.

Flying to Carl Keller Field for the 21st year, the Septem-ber 21st meeting of the All-Ohio Ninety-Nines, Interna-tional Organization of Women Pilots, will be held this year at the Liberty Aviation Museum. For many years the group celebrated with the Gypsum Reunion at the hangar.

Pilots and spouses, who are called 49 ½’s, will fly or drive to Port Clinton for a business meeting to hear in-formation on the airport presented by Stan Gebhardt, to visit the museum and eat at the diner.

Ninety-Nines were named for 99 chartermembers. They formed in 1929 when all 117 licensed American female pilots were invited to assemble for mutual sup-port and advancement of aviation. Amelia Earhart was the first president. International and local chapters give scholarships to pilots for furthering their education.

Chairman of the All-Ohio Chapter, chartered in 1933, is Roberta Jones of Put-in-Bay. Other chapters in Ohio are Lake Erie (1974), Scioto Valley (1981), Greater Cincin-nati (1986) and Women with Wings (1993) in the Akron-Canton area. Ottawa Soil and Water Conservation District announces its fall fish sale. Area Pond owners have the opportunity to stock their pond with fish through this conve-nient and low-cost program until Friday, September 26. The fish are supplied by F e n d e r ’ s Fish Hatch-ery, Baltic, Ohio. Their tank truck, with aerator, will distrib-ute the or-dered fish on T h u r s d a y , October 2, in the after-noon. Fish available are: Bluegill, Chan-nel Catfish, Fathead Minnows, Large-mouth Bass, Yellow Perch, Redear Sunfish and White Amur.

White Amur (more commonly known as “Grass Carp”), members of the min-now family, have been reported to attain

weights in excess of 100 pounds and to live up to 15 years. They bear little resemblance to the common carp. Although cultured in Asia as a source of food, the sterile White Amur is primarily used in the United States to control aquatic vegetation. Leafy, root-

ed aquatic plants, such as pond-weed and coontail, are the preferred food of these fish. Lack-ing these, they will c o n s u m e f l o a t i n g

duckweed, green algae and even cattails. All fish must be pre-ordered and pre-

paid. To receive an order form, please call the office at 419-898-1595, stop in at 240 W. Lake Street, Oak Harbor, or visit OS-WCD website at www.ottawaswcd.com.

Bay Point Resort and Marina: Growing for the fun of it!Anyone who has driven “around the horn” of the Mar-

blehead peninsula has to be amazed at the number of construction vehicles they have seen entering Bay Point Resort and Marina. “It’s due to our continued growth,” says Chris Malfara, Bay Point’s General Manager, adding “We’re now a full service resort and real estate develop-ment. It’s really a fun place. The Members love it.”

Bay Point has re-invented itself, adding several resort amenities along with one of the most successful real es-tate developments in the Midwest. Since 2008, total real estate sales have been in excess of $30 million dollars (land only) in the four distinct residential neighborhoods in Bay Point. The neighborhoods: Bay Point Shores (33 lakefront lots), Sunset Cove (16 bayfront lots), and the newest neighborhood called The Reserve at Bay Point (10 lakefront lots), have all been met in the market with great enthusiasm. All of the residential lots have been sold in these neighborhoods except for six remaining lots in The Reserve, which was only platted in July of this year. The fourth neighborhood is Sunset Cove Villas, a condomin-ium development with its focus on Cape Cod style villas. Three villa sites remain available in the current phase, with twenty villas being sold in the last three years.

Growth has not been limited to the residential areas. Al-

ways known for its world class sand beaches, state of the art marina and picturesque campground, improvements made to the resort amenities now truly make Bay Point a premier resort destination. Investments made in the last five years include The Shores Club restaurant, along with several other smaller eating and drinking places (Bay Point has a full liquor license); the clubhouse pool complex; an additional resort pool complex, and instal-lation of several utility infrastructure projects that have enhanced the experience for all Bay Point Members. This has been rewarded with record numbers of beach mem-bers and great occupancy rates in the marina and season-al campground. “We still have a little bit of room for some boaters, but our retention rate in the marina is among the industry best,” says Manager of Operations, John Dress. He added, “We’re also very excited about the new oppor-tunities for additional seasonal campers with our recent campground investment.”

All of the construction activity benefits the local area from a tax base perspective, as well as providing employ-ment opportunities and increasing traffic in local busi-nesses. These improvements have added approximately $60 million to the local tax base, not including the value of the beautiful private homes that have been built on the

purchased real estate. Bay Point has become a driver of economic growth

in our area at a time when the economy has struggled. “We’ve made these investments because we believe in Marblehead and Ottawa County,” said Malfara. “We will continue to do everything we can to provide a solid eco-nomic engine for our local community. It really has paid off for the community and for Bay Point.”

For additional information on Bay Point Resort & Ma-rina, call 419.798.4434; visit the administrative office at 10948 E. Bayshore Road, Marblehead, OH, 43440 or www.baypointmarina.com.

About Bay PointBay Point is a 200+ acre resort community in Marble-

head, Ohio on Lake Erie. Bay Point is elevating the tradi-tional lakefront lifestyle with an enclave of resort-style villa and single family waterfront residences. Anchored by a 730 boat slip marina, a wide array of amenities for owners and guests include private beach access, an out-standing beachfront restaurant offering music and spe-cial events, a clubhouse, fitness facility and swimming pool – all set between the shores of Lake Erie and San-dusky Bay. www.baypointmarina.com

pions for Children are a few of the organi-zations that have openings for volunteers. Some are short term commitments and others are for an involved role in the life of a child.

Terra State Fall Job Fair Sept. 24

The annual Terra State Community Col-lege Fall Job Fair is just a couple of weeks away and now is the time to prepare.

“We encourage any job seekers who plan to attend to update their resumes and pre-pare a list of questions to ask employers,” said Joan Gamble, Coordinator of Career Services at the college. “And while they’re at it, they should pick out appropriate at-tire and dress to impress.”

The Job Fair is 11 a.m. to 1 p.m. on Sept. 24 in the Student Activities Center. It is open to Terra State students, alumni and community members.

Gamble expects more than 50 employ-ers to participate in the event. Currently, the list includes companies seeking indi-viduals with skilled trades training, busi-ness, financial services and allied health training.

Some employers will take resumes and offer job applications while others will meet job seekers but expect them to ap-ply online. They will be looking to fill full-time, part-time and internship positions.

For more information on the Job Fair, contact Joan Gamble at 419-559-2252.

Ottawa County Juvenile Court receives state certification

Judge Kathleen L. Giesler and Intensive Supervision Officer Mike Reynolds.

Judge Kathleen L. Giesler is pleased to announce that the Families and Court Together program (FACT) has earned fi-nal certification from the Ohio Supreme Court’s Commission on Specialized Dock-ets. In order to receive the certification, the court had to submit an application, undergo a site visit, and provide specific program materials in response to certifi-cation standards.

Ohio Supreme Court Chief Justice Mau-reen O’Connor congratulated the Ottawa County Juvenile Court and Judge Giesler for receiving final certification. “Special-ized dockets have proven effective at ad-dressing persistent criminal behaviors,” said Chief Justice O’Connor. “Specialized dockets result in significantly lowering re-cidivism rates which means offenders be-come productive members of society, for which we all benefit.”

Specialized dockets are courts that are

dedicated to specific types of offense or offenders and use a combination of dif-ferent techniques for holding offenders accountable while addressing the under-lying causes of their behavior. The new standards provide a minimum level of uniform practices for specialized dockets throughout Ohio and allow local courts to innovate and tailor their program to meet the community’s needs and resources.

“We have operated our juvenile inter-vention court since 2006, and many of the youth who have participated through the years have been successful”, said Judge Giesler. “We are honored to have the abil-ity to now continue our efforts as a spe-cialized docket certified by the Supreme Court of Ohio and greatly appreciate all the work Intensive Supervision Officer Mike Reynolds and Specialized Dockets Coordinator Gaye Winterfield did to make this a reality”.

Port Clinton routs Rossford, 47-14BY YANEEK SMITH

After winning just one game in the last two season, Port Clinton has opened this year with a 2-0 record.

The Redskins came out firing on all cyl-inders Friday, scoring 33 points in the first quarter on their way to a 47-14 victory over Rossford in non-conference action.

Wide receiver Nathan Stubblefield caught two touchdowns (7, 62) to open the scoring for Port Clinton, helping them to an early 13-0 lead. Emerson Lowe later scored on a one-yard run, Stefan Dan-iels caught a 71-yard pass from Brandon Moore and Jordan Kleinhans’ 46-yard interception return were the other touch-downs in the quarter.

The ‘Skins had three interceptions in the first quarter as the defense held the Bull-

dogs in check and the offense scored on big plays as Port Clinton took control from the outset.

Lowe added two more scores (3,7) in the fourth quarter to account for the ‘Skins’ final scores.

The two dominant wins to begin the sea-son are a sign of the job head coach Beau Carmon has done in getting his team ready after they struggled to an 0-10 season in 2013. Clearly, the players have bought into his system and relish playing in it.

This Friday, Port Clinton will have a great opportunity to avenge last year’s de-feat to Genoa. The Comets, one of Ohio’s best programs over the last seven years, defeated Oak Harbor, 33-25, last week, but are not as talented as they were in the past, giving the ‘Skins the opportunity for a victory.

Nathan Stubblefield had a huge game against Rossford, as he got behind the Rossford secondary again for another big play.

Darius Daniels sprints down the right sidelines for a Redskin touchdown at Rossford.

Oak Harbor falls to Genoa, 33-25

Danbury edges Woodward, 21-6BY YANEEK SMITH

For the second time in four years, Dan-bury is 2-0.

The Lakers won their second consecu-tive game to begin the season, defeating Toledo Woodward, 21-6, on Saturday.

Danbury, which fell behind 6-0 midway thru the second quarter, took the lead for good when James Dorko caught a 14-yard touchdown pass from Justin Tibbels with 1:09 remaining in the first half, and Dorko’s extra point made it 7-6.

But the Lakers missed out on several op-portunities before finally putting the game away with two touchdowns in the fourth quarter. Running back Taylon Molnar scored from 11 yards out and quarterback Seth Vargo scored on a 52-yard scamper to give Danbury some breathing room.

Despite getting the win, the Lakers’ per-formance was not a welcomed sight after they dominated Elyria Open Door Chris-tian in the opener, defeating the Patriots, 47-18. Danbury struggled at times, mak-ing some critical mistakes throughout the course of the game, but ultimately, the

Lakers persevered, coming through in the clutch to take control.

The key drive came midway thru the fourth quarter when Danbury, after ben-efiting from a short punt by the Polar Bears, drove 40 yards in 12 plays, scoring a touchdown on Molnar’s run with 4:15 left to create some breathing room. The touch-down came on fourth-and-4 from the 11-yard-line, making the run that much gutsier. The Lakers converted a fourth-and-1 earlier in the drive when Vargo ran for four yards, and also recovered after a penalty set them up with a first-and-25 at the Woodward 32. Vargo’s 12-yard run on third-and-16 set Danbury up with man-ageable fourth-and-4.

The real stars of the night were the Lak-er defense, which held the Polar Bears in check for the duration of the evening. Woodward’s only touchdown came on 21-yard drive that began after a bad snap on a Danbury punt set the Polar Bears up with great field position.

This Saturday, Danbury travels to San-dusky to face St. Mary Central Catholic.

BY YANEEK SMITH

Another game, another tough loss for Oak Harbor.

In a back-and-forth game that saw the Rockets come up short for the second week in a row, Genoa defeated Oak Har-bor for the seventh consecutive time, 33-25, to win the Celestial Bowl.

The Comets led throughout, tak-ing the lead for good at 7-0 after Jake Wojciechowski scored on a 57-yard run in the first quarter. The Rockets responded, however, cutting the deficit to 7-6 when Andre Ramsey scored on a 57-yard run.

Ten consecutive Genoa points, three on a 37-yard field goal by Cody Pickard, and seven on a 61-yard pass from Kyle Edwards to Nick Wolfe, pushed the Com-ets’ advantage to 17-6 before Cole Weirich hauled in an 80-yard pass for a touch-down to make it 17-12 at halftime.

The teams alternated touchdowns in the second half, with Genoa scoring first and the Rockets answering. Oak Harbor’s best chance to take the lead came midway thru the third quarter with the ball at its own 26-yard-line, but a fumble that was recovered by the Comets swung the mo-

mentum in Genoa’s favor as Wolfe scored on the next play from 31 yards out to stake the Comets to a 25-12 advantage.

“Our kids came ready to play and played hard for four quarters,” Oak Harbor head coach Mike May said. “We had the mo-mentum going into halftime and we were hoping to finish the game on Friday night. On defense, we gave up a couple of big plays in the first half, but overall we’re playing solid defensively. Andre Ramsey made some big plays in the first half to lead the offense.”

Ramsey finished 16-of-30 for 216 yards, three touchdowns and an interception and rushed 13 times for 52 yards and a score. Weirich caught five passes for 116 yards and a touchdown.

Ultimately, timely mistakes have cost the Rockets dearly.

“The difference has been turnovers and a few big plays that we’ve given up,” May said. “Our players have competed hard for 48 minutes in each game, but we’ve come up a little short. As long as we keep com-peting hard and improving each week, we will be fine in the long run.”

This Friday, Oak Harbor hosts Eastwood.

Danbury’s Mike Stys (#56) rushes into help teammates Justin Tibbels, Alex Duez and Austin Holmes put the stops to Toledo Woodward quarterback, Trevon Edwards.
