1. BROADCAST E N G I N E E R I N G C O N S U L T A N T S I N D I A LIMITED invites tender for “Dismantling, Erection, Installation of Antenna system/RF Cable/cable tray at CTI Agartala and Gorakhpur sites for Private FM broadcasters”.
2. Type of work: a) Dismantling of existing installed antenna and Installation of New Antenna (wherever
required as per BOQ)
b) Dismantling of existing installed RF Feeder Cable and Installation of New RF feeder
Cable
c) Dismantling of existing installed Cable Tray and Installation of New Cable Tray
3. The joint measurements of work shall be done by the Contractor or their authorized representative a n d BECIL Personnel or his authorized a g e n t
4. The Contractor at his owns cost shall provide electricity, water, pumps/ generator& store for cement and tools and plants (T&P).
GENERAL CONDITIONS OF CONTRACT
1. The contractor's rates must include the cost of transportation of labour, T & P to the site etc.
2. The concrete/ mortar mix shall be determined based on standard weights.
3. For interpreting the specification, the following order of decreasing importance shall be
followed:
a) Drawings
b) Instructions from the BECIL Personnel in writing
c) Conditions of Contract
4. Any defect developed within Defect Liability Period of one year from the date of virtual completion will have to be rectified by the Contractor at his own cost.
5. The contractor shall ensure that during execution of work, no damage is caused to any of the
new equipment/material and other existing installation, structures at site. Any Loss/Damage, if reported by Prasar Bharti/BECIL, shall have to be rectified/compensated/paid by the contractor.The contractor will indemnify BECIL against all such risks and their consequences. Personal working shall be properly insured by the contractor against any injuries and death as the installation work involves working at height. BECIL shall not responsible for any claim
arising out of accidents 6. The Contractor shall not be entitled to any compensation for any loss suffered by him on
account of any delay in commencing or executing the work, whatsoever is the cause for such delays.
7. After acceptance of the tender, the tenderer shall submit the order of acceptance within 3
days of the information of acceptance. In any case of delay, the Earnest Money may be forfeited and the order may be get cancelled.
8. No extension of time will be allowed to the contractor due to weather conditions prevalent in the area. The contractor is expected to take all the precautions at his own cost so that the workmanship and the materials are not affected in the inclement weather.
9. EMD: An earnest money deposit (EMD) of as mentioned above will be submitted by
the Tenderer in a separate envelope along with the tender proposal in the form of DD in favor of Broadcast Engineering Consultants India Limited payable at New Delhi. The EMD of the successful tenderer shall be returned after submission of PBG, whereas the EMD of the unsuccessful tenderer shall be returned within 15 days of the finalization of the contractor. The EMD shall not carry any interest.
10. BECIL reserve the right to decide & Place work order on L1 basis on site offered by bidders.
BECIL decision will be final and will be binding on all bidders. In case, L1 does not accept the order work will go to L2.
11. Negotiation may be done by private broadcasters with L1 bidder.
12. The Competent Authority does not bind himself to accept the lowest or any other
tender and reserves to himself the authority to reject any or all of the tenders received without the assignment of any reason .All Tenders in which any of the prescribed conditions are not fulfilled or are incomplete in any respect are liable to be rejected.
PRO VISIONS FOR LABOURS
1 Labour – Payments to labour shall be as per law & shall be paid to the satisfaction of BECIL personnel. Photostat copy of receipt of payment made is to be supplied to the BECIL personnel by the contractor if desired by him.
2 Medical facilities (as per law) for workers will be provided by the Contractors including their insurance during the complete work at each site.
3 As the work involve high risk therefore it is compulsory that all the labours shall be
got insured according to the work compensation policy or equivalent . Without this the labour or any other person are not allow to enter in the premises of AIR HPT
sites.
SECURITY OF MATERIALS
Safe custody of Materials supplied by the BECIL is the responsibility of the Contractor,
including its watch and ward.
N.B. It may be noted that the installation work is to be carried out at the working
station of HPT sites. As such the Contractor shall have to adhere to all security
norms / procedure & instructions of the station-in-charge during complete period /while carrying out the work at site.
CLAUSES OF CONTRACT
1. DEFINITIONS M/S Broadcast Engineering Consultants India Ltd. (BECIL) - The Principal.
THE CONTRACTOR (To whom work is awarded)
a) Any of those mentioned above as such in the agreement shall include their
Legal representatives, assignees or successors and are treated through out the contract
document as if each were of singular number and masculine gender.
b) “The Site” shall mean the site of the contract work including any building, tower
and i n s t a l l a t i o n thereon and any other land allotted by the Principal for contractor’s
use.
c) The term “Sub-contractor “ , as employed herein, includes those having a direct
contract with the Contractor and it includes one who furnishes material worked to a
special design according to the plans or specification of the work but does not include
one who merely furnished material & not so worked. Anyone doing work on a piece
rate basis shall be deemed a sub-contractor.
d) Written notice shall be deemed to have been duly served if delivered in person to the
individual or to a member of the firm /Contractor or if delivered at or sent by
registered mail to the last business address know to him who gives this notice.
e) The term “work” of the Contractor or sub-contractor includes labour.
f) All time limits stated in the Contract Document are the essence of the Contract.
g) The law of the place of work shall govern the construction under this Contract.
h) The date of virtual completion of a project. or specified area of project is the
date when Installation is sufficiently completed in accordance with the contract
document as modified by any change on variation orders agreed by the parties;
so that the Principal can occupy the project for the use it was intended.
2. CONTRACT DOCUMENT
The following documents shall constitute the contract documents.
a) Preface
b) General Condition of Contract.
c) Bill of Quantities
d) Drawing issued by BECIL from time to time.
2.1 The contract o r d e r is Complementary. What is called for in any one shall be as
binding as if called for by all. The contract document shall remain in the custody of
the Principal.
2.2 After the award of the contract, the Contractor will arrange and get approved from the BECIL personnel all such further drawings and details as may be necessary along with structural drgs. from a Structural Engineer by BECIL .These drawings shall be a reasonable development of the work described in the contract document.
2.3 The Contractor shall keep one copy of the specification, with descriptive schedule
or other like document referred to in this clause and one copy of the Contract
Drawings and such other drawings and supplied to him from time to time so as
to be available to the Principal or his representative at all reasonable times.
2.4 Upon final payment under the clauses of these conditions, the contractor shall, if
requested by BECIL forth with, return to BECIL all drawings, details specifications
and other document of like nature which bears his name or that of the Consultant.
3. TYPE OF CONTRACT
The Contract shall be an Item Rate Contract.
4. ERRORS
Any error in description or omission of items from the contract bills shall not
vitiate this contract but shall be corrected and deemed to be a variation
required by BECIL representative.
6. SCOPE AND INTENT
6.1 SCOPE: - The general character and scope of the work is illustrated and
defined by specification and by the signed Drawings. If the Contractor
shall find any discrepancy in or divergence between the contract drawings and
or the Contract Bill shall immediately given to the BECIL personnel a written
notice specifying the discrepancy or divergence and the BECIL personnel shall
issue instruction in regard there to.
6.2 INTENT: - The contractor shall carry out and complete the work in every
aspect in accordance with the Contract and with the direction of and to the
reasonable satisfaction of the BECIL personnel and Principal. BECIL from time to
time, may issue further drawings and which are collectively referred to as
BECIL personnel’s instruction. All such drawings and instructions shall be
consistent with the contract document, true development there of, and
reasonable inferable there from.
6.3 The Contractor shall not without the written consent of the Principal,
assign this contract or sublet any portion of the work failing which the
Principal may serve a notice in writing rescinding the contract where upon the
security deposit may be forfeited.
7.0 BECIL INSTRUCTIONS
7.1 If within seven days after receipt of written notice from the BECIL personnel
required for compliance to an instruction & the Contractor does not comply
there with, then BECIL may employ and pay other person/ firm to execute
any work what so ever at Contractor’s risk and cost.
7.2 All instructions issued by the BECIL personnel shall be in writing. Any instruction
issued orally shall be of immediate effect but shall be got confirmed in writing
by the Contractor within seven days and if not dissented by the BECIL
personnel, the Contractors confirmation shall take effect as from the expiry of
the said period of seven days.
8. FACILITIES AND CO-OPERATION
In case of the work indicated on the drawings but not included in the schedule of
work, the Contractor shall provide necessary facilities and co-operation for
execution of such work including all cutting, filling or patching of his work that
may be required or execute such work so as to receive the work of other
contractor shown upon or reasonably implied by the drawings and
specification for the completed structure and he shall make good after
them the BECIL personnel may direct. Any cost caused by the defective or
ill- timed work is to be borne by the party responsible thereof.
9. WORK SCHEDULE CHART
The Contractor shall prepare PERT chart/ Bar chart and submit the same for
approval of BECIL.
10. ACCESS TO THE WORK
BECIL personnel, the Principal and their representatives shall at all
reasonable time have access to the works and to the workshops or other
places of the contract where work is being prepared for the Contract including
workshops of sub contractors.
11. BECIL PERSONNEL STATUS AND DECISIONS
11.1 The term BECIL personnel means the Engineer/Site Incharge appointed or nominated by BECIL who shall supervise and be in charge of the work at site. Such work shall be subject to be guidance of the BECIL officials and under control and direction of the Principal.
11.2 BECIL personnel shall be the Principal’s representative during the construction period.
He shall periodically visit the site, familiarize himself generally with the progress
and the quality of the work to determine in general if the work is
proceeding in accordance with contract document.
11.3 BECIL personnel or its representative shall have power to give notice to the
Contractor or to his representative for non approval of any work or
material and such work shall be suspended or the decision of the principal be
obtained. The work will, from time to time, be examined b y the BECIL personnel
but such examination shall not in any way exonerate the Contractor from
obligation to remedy any defects which may be found to exist at any stage of
the works or after the same is completed. Subject to the limitation of this
clause the contractor shall take instructions only from the BECIL personnel.
11.4 Decisions: BECIL personnel shall within a reasonable time give decision
on all claims of the Contractor and all other matters relating to the execution
and progress of the work. The BECIL personnel may in consultation with the
Principal so desire to find it necessary, and from time to time issue further
drawings, details and/ or written instructions, written directions and written
explanation.
11.5 Dismissal: The Contractor shall on the written request of BECIL
personnel / Principal immediately dismiss from the work any person employed
thereon by him who may be in the opinion of the BECIL personnel and/ or
the Principal be incompetent . The same Person may not be employed on the
work without the permission of the Jr. Manager or the Principal as the case may
be.
12.0 CONTRACTORS FIELD ORGANISATION AND EQUIPMENT
12.1 Equipment: The contractor shall provide and install all necessary hoists,
ladders, Scaffolding, tools, plants, motors, pumps, all transport for labour and plant
necessary for the proper carrying out execution and completion of the work to
the satisfaction of the BECIL personnel /Principal.
13.0 MEASUREMENT OF WORK DONE /CERTIFICATES AND PAYMENTS
13.1 The BECIL personnel shall except as otherwise provided, ascertain and
determine by measurement the value in accordance with the contract of the
work done. All measurement of all items having financial value shall be entered in
Measurement book and /or level field book so that a compete record is obtained
of all work performed under the Contract.
13.2 At the period of interim certificate named in the appendix to these
conditions, the BECIL personnel shall issue a certificate stating the amount due to
the Contractor from the Principal and the contractor will be entitled to
payment thereof within the period for honoring certificate. Interim valuations
shall be made whenever the BECIL personnel considers it to be necessary.
The certificate shall be issued when the Contractor executes the net work of
25% of the contracted amount.
13.3 The amount stated as due in an interim certificate shall be total value of
the work properly executed and of the materials and goods delivered to or
adjacent to the work for use thereon up to and including a date not less
than seven days before the said certificate, less any amount which may be
retained by the Principal and less any installment previously paid under this
condition.
13.4 The Principal shall retain 10% of the total value of the work done as security
deposit subject to the conditions agreed upon in respect thereof in the contract
documents.
13.5. The Contractor shall be entitled to the payment of the final balance in
accordance with the final certificate Issued in writing by the BECIL personnel
at the expiry of the period referred to as the Defects Liability Period of
twelve months from the date of virtual completion or as soon as after the
expiry and all defects made good according to the true intent and meaning
here of which ever shall last happen provided always that the issue by the
BECIL personnel of any certificate during the progress of the work or after
completion shall not relieve the contractor from his liability . In case of
dishonesty or fraud or fraudulent concealment relating to the works or
material or of any matter dealt with in the certificate and in case of all defects
and insufficiency in the work or materials which on reasonable examination
would have disclosed .The rates of extra items though approved during the
currency of work are subject to changes in the final bill which can be finally
approved by the Principal or Consultant of the Principal, if Principal so desires.
13.6 The measurement and valuation of the work shall be completed with in the
period of final Valuation and measurement stated in the appendix to these
conditions. The Contractor shall be supplied with the copy of the priced bill of
valuation not later than the end of the said period and before the issue of final
certificate.
14. CLAIMS FOR EXTRAS
When any instruction or decision given involves an extra amount or whereby the
Contractor may plan to claim an extra amount it shall be the responsibility of the
Contractor to inform the Principal of the extra amount and get written authorization
from the Principal before proceeding with the work involved.
15. DEDUCTION FOR UNCORRECTED WORK
If the BECIL personnel deems it inexpedient to correct work damage or not
done in accordance with the Contract, an equitable deduction from the
contract price shall be made by the Principal there of on the basis which is
applicable for extra work/items.
16. FLUCTUATIONS
The Contractor shall not claim any extra for fluctuation of prices and the contract
price shall not be subject to any rise for prices except as provided for especially
in any clause in the Contract Document.
17. WORKMANSHIP
All workmen shall be of best trade practices and the Contractor shall
immediately remove from the works workman which in the opinion of the
Principal or their representative are defective or unsuitable and shall substitute
proper workman at his own cost.
18. INSPECTION:
The contractor shall furnish promptly without additional charges all reasonable
facilities and labour necessary for the safe and convenient inspection and
test that may be required by the BECIL personnel or Principal.
19. INSPECTION OF WORK
As and when required by the Principal or the BECIL personnel, Contractor
shall organize inspection of works at his cost to prove their soundness and
efficiency. If after tests any work or portions of work are considered defective or
unsound by the Principal or the BECIL personnel, the Contractor shall remove the
defective work from the site, or pull down and re- execute the works at his own
cost to the satisfaction of BECIL personnel and the Principal.
20.0 POSSESSION, COMPLETION AND POSTPONMENT
20.1 On the date of commencement stated in the appendix to these conditions,
possession of the site shall be given to the Contractor who shall there upon
begin the work regularly and diligently proceed with the same and he shall
complete the same on or before the date for or in accordance with
provisions of extension of time contained in these conditions.
20.2 The BECIL personnel may issue instruction in regard to the postponement
of any work to be executed under the provisions of this Contract.
20.3 If at any time or times before virtual completion of the work the Principal
with the consent of the Contractor may take possession of any part or parts of
the same for handing over to other agency, then not withstanding anyt hing
expressed or implied elsewhere in this Contract, such a part shall not be
deemed to be virtually completed. The Contractor shall not claim that such parts
are complete and refund of payment in lieu thereof.
21. EXTENSION
Upon it becoming reasonably apparent that the progress of the work is
delayed, the Contractor shall forthwith give written notice of the cause of the
delay to the Principal that the completion of the work is likely to be or has
been delayed beyond any extended time previously fixed under the clause.
The BECIL personnel may grant extension of time for such period for which delay
occurred for reasons beyond the control of Contractor.
22. TERMINATION OF CONTRACT
If the contractor is found faulting at any instance of the period of execution of project by his misdeeds or conduct OR attitude towards work in terms of deviation from
specifications and drawings, the contract will be terminated without assigning any reason. All decisions will be taken at the discretion of BECIL and contractor will not have any legal binding on the contract.
23. ARBITRATION AND JURISIDICTION
The CMD BECIL reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rate quoted. In case of any dispute, the Principal shall appoint in consultation and agreement with the Contractors, an Architect of repute in Delhi (India) as Arbitrator whose decision shall be final and binding on both the parties i .e the Principal and the Contractors However , the jurisdiction of only the Delhi High Court shall be accepted incase a reference of dispute ismade to a court.
SUMMARY WORK:- DISMANTLING, ERECTION AND INSTALLATION OF ANTENNA SYSTEM, RF CABLE AND CABLE TRAY
1 Earnest Money Deposit Rs 14000 For Agartala site, Rs 6000 for Gorakhpur

get the work done from a third party at your risk & cost.

THE QUANTITY OF ITEMS MENTIONED IN BOM MAY VARY ACCORDING TO THE SITE
CONDITION AND HENCE PER METER RATE MUST BE MENTIONED.
IT IS UPTO THE DISCRETION OF BECIL WHETHER THE WHOLE OR PART OF THE WORK IS IMPARTED TO ITS VENDOR. IN ORDER TO EXECUTE THE WORK ON TIME, BECIL RESERVE THE RIGHT
TO DISTRIBUTE THE SITES AMONG THE VENDORS ON L1 BASIS.
AS PER THE PROJECT REQUIREMENT, NUMBER OF SITES MAY INCREASE OR DECREASE
AS PER THE SITE REQUIREMENT, ITEMS IN THE BOM MAY BE INCREASED OR DECREASED
