I. INTRODUCTION

1.1. Preamble

1. This Semi – Annual Environmental Monitoring Report (SAEMR) is for the ADB Loan 3434/Grant 0498/9188 “Water Resources Management in the Pyanj River Basin (WRPRB) Project) which will improve institutional and physical capacities of water resources management (WRM) system in of southern Tajikistan. The project will provide three main outputs: (1) establish a PRB organization, council, and Joint PRB committee, and develop a PRB management plan; (2) modernize and climate-proof the Chubek Irrigation System (CIS); and (3) improve farm and water use management capacities.

2. ALRI through PIG “WRMPRB” will be responsible for the outputs 2 and 3. The project was approved on 28 September 2016 and became effective on 08 August 2017.

3. This is the 5-th SAEMR for the project and it covers July–December 2021 reporting period.

1.2. Headline information

4. The project is classified as environment Category B per ADB Safeguards Policy (SPS -2009) and assessed that potential impacts that are not likely to be significant adverse environmental impacts that are irreversible, diverse, or unprecedented. The project area is not adjacent to or within any environmental sensitive area. The physical activity is limited to rehabilitation of existing irrigation facilities and construction of hydrotechnical structures of “Sediment basin”.

5. Site-specific environmental impacts are expected during construction and operation. Thus, Initial Environmental Examinations (IEEs) with environmental management plans (EMPs) per ADB SPS requirements were prepared and disclosed on ADB website1 on October 2019.

6. According to IEE, the civil works are small-scale and is carried out within the framework of an existing and long-established irrigation system in a heavily modified agricultural landscape.

7. For implementation of environmental safeguards requirements, environmental specialists to be assigned by PIG “WRMPRB”of ALRI, by Construction Supervision Consultant (CSC) and by Contractors.

8. Purporse of the Semi-Annual Environmental Monitoring Report (SAEMR). In accordance with ADB requirements and PAM, ALRI is required to submit to ADB the report on compoliance with requirements of ADB SPS, implementation of environmental management plans, issues/concerns/complaints received, corrective actions, and other environment-related matters on a semi-annual basis.

9. This SAEMR covers reporting period of January to June 2021 and provides the results of monitoring activities for irrigation hydraulic structures, and work on starting the construction of a sediment excluding basin (Output 2). This SAEMR covers Hamadoni, Farkhor, and Vose districts of Khatlon region, which are pilot districts under the project.

II. PROJECT DESCRIPTION

2.1. Project Description

10. The aim of the project is to improve the institutional and physical capabilities of WRM systems in Khatlon region, which include three districts: Farkhor, Hamadoni and Vose.The project includes the following three interrelated components under the 3 outputs.

Output I: Institutional strengthening and management of the river basin with the aim of establishing the Pyanj River Basin Organization (PRBO), the Pyanj River Basin Council and the Joint Tajikistan / Afghanistan Commission on PRB, as well as the develPIUent of the PRB management plan and the joint monitoring program of Tajikistan / Afghanistan.The MEWR is responsible for the achievement of the given output.

Output II: Chubek Irrigation System (CIS) modernization of the irrigation system and its resilience to climate change, including the removal of sediment from canals and drainage collectors, the design and installation of Sediment basin and the rehabilitation of existing canal gates, spillways and water meters, as well as the design and rehabilitation of existing pump stations, including installation of new pumps, electric motors, electrical panels and flow meters (SCADA). ALRI is responsible for the achievement of the given output.

Output III: Improving farm management capacity for water use skills in the CIS in order to increase farm and water management capabilities through the involvement of NGO partners. Its target groups are CIS farmers and Water Users Associations (WUA), and they will be implemented through the involvement of government agencies responsible for crop management and irrigation control. ALRI is responsible for the achievement of the given output.

11. The components which which require civil works are under Output II: (i) modernization and rehabilitation of the CIS’Chubek Main Canal (CMC)and its climate-proofness; (ii) construction of a CMC Sediment basin and inter-farm canals; (iii) modernization and rehabilitationof pump units. The detail information on components of result 2 is shown in the next table:

2.2. Project Location

12. The CIS is located in Khatlon region on the right bank of the Pyanj river and provides water supply to four districts - Hamadoni, Farkhor, Vose and Kulyab (Kulyab district is not

covered by the project under Output 2). The CIS forms the main supply of irrigation water. Water is supplied on gravity and by 20 pumping units. Map 1 shows the location of sites in the country scale.

13. Water flows into the Chubek main canal (CMC), which is part of Chunek Irrigation system (CIS), from the Pyanj river through the diversion canal, 1 km long, 30 m wide and head water intake structure with an average flow depth of 2.5 m. The Chubek Main Canal, with original capacity of about 150 cubic meter per second (m3/sec), was constructed in 1950 while the distribution system was constructed during 1950–1987 during Soviet times, to supply water to command areas located in Farkhor, Hamadoni, Kulob, and Vose districts. The head water intake structure of CMC has five compartments controlled by gates.

14. During the vegetation season from April to October, the water flow from Pyanj river ranges from 27.16 to 82.82 m3/s, and in the remaining months it ranges from 9.0 to 13.5 m3/s. The flow rate from the Pyanj river to the CMCis 3.3–3.9 m3/s.

15. Although the state of CIS is relatively better than the canals of the downstream, it is characterized by sediment deposition in the upstream; In addition, the structures are in poor condition and need the repair and rehabilitation.

16. At the initial design stage, the CIS command area was 50,163 ha, which is about 73% of the total irrigated land of the four districts. However, the command zone has now been reduced to 43,201 ha (63%) of the total irrigated land. About 71% of the irrigated territories of CIS - water is supplied by gravity, and water is supplied to the remaining territories by pumps.

17. There are 73 main and inter-farm canals in the CIS with a total length of about 396 km, of which 102 km are concrete and 499 various irrigation structures. All canals and structures were built in the 1950-1980s. The life of all structures has expired, and now they are in very poor condition and need to be rehabilitated and modernized.

2.3. Agreements (contracts) for project implementation and management

18. Project Implementation Group. ALRI as EA established a Project Implementation Group (PIG) to manage and coordinate on a daily basis the monitoring and organizational activity of the project.PIG is the leading operational institution for the implementation of the project in accordance with the Project Administration Manual. The PIG also ensures that the environmental management plan (EMP) provisions are fully implemented during project implementation, including the monitoring results and reporting required by ADB.One environmental specialist is assigned in the PIG with the following responsibilities2:

(i) Ensure that EMP will be updated during detailed design completed; (ii) Ensure that bidding documents include all requirement to implement IEE and its EMP; (iii) Ensure that the bidder selected will have adequate resources to implement and update EMP; (iv) Undertake environmental safeguards monitoring activities and prepare environmentalsafeguard reports to be submitted to ADB; and (v) Ensure that the any works are implemented in accordance with ADB SPS 2009 as well as thegovernment law and regulation related to environment.

19. In the PIG, from December 1, 2017 to September 6, 2018, Mr.Timur Nazarov performed the duties of an environmental specialist. After he left the Project, Ms. Anastasia Yerisova was hired for this position, who worked in the PIG from October 25, 2018 to April 1, 2019.From April 1, 2019, there wasno environmental specialist in the PIG. Engineers of Project implementation Units in Hamadoni, Farkhor and Vose performed partially the functions and responsibilities on environmental safeguards requirements. In February-March 2020, a tender was announced, and only on April 21, 2020, Bakhrom Gaforzoda, an environmental specialist was hired.

20. Project Implementation Units (PIUs). Three PIUs under ALRI are established inthree project districts (Hamadoni, Farkhor, and Vose). The PIU in Hamadoni district is responsible for the supervision and monitoring of activities for the maintenance and rehabilitation of CMC, silt prevention structures and irrigation and drainage network, as well as for Output III in Hamadoni district. The PIU in Farkhor district is responsible for the supervision and monitoring of activities for the maintenance and rehabilitation of the cascade of Urtaboz pump station and irrigation and drainage network as well as for Output III in Farkhor district. The PIU in Vose district is responsible for the supervision and monitoring of activities for the maintenance and rehabilitation of the Janubi pump station and irrigation and drainage network and Output III in Vose and Kulyab districts.

21. The Project Implementation Units (PIUs) are responsible for supporting of safeguards compliance and EMP implemenation at the district level. The PIU has overall responsibility for the dissemination of information on project activities to the communities and other stakeholders in project districts, their informing on beginning and progress of civil works.

22. Consultants. PIG and PIUs are supported of Construction Supervision Consultant (CSC) in ensuring of environmental safeguards compliance and fulfillment of EMP/SSEMP. Monitoring of EMP/SSEMP requirements by contractors is entrusted to CSC BETS Consulting Services Ltd. Bangladesh in association with LLC Panasia Ltd., Tajikistan (hereinafter referred to as BETS). The date of signing of the contract is February 13, 2017. The start date of the Consulting Services Contract is July 02, 2017, when BETS notified the Client that the Services have begun to be executed. The contract is to be implemented within 5 years. BETS is fully responsible for the implementation of services within the planned time.

23. BETS included an Environmental Specialist, responsible for: Assist the EA and IAs to (a) update as necessary the EMP implementation cost provided in the IEE, (b) include the EMP in bidding documents, (c) monitor and review the EMP in line with ADB’s SPS and as provided in the bidding document, (d) effectively implement and carry out activities related to

implementation of the EMP, and (e) assist the EA and IAs in preparing the environmental monitoring report on a bi-annual basis for submission to ADB. In this respect, the consultant will ensure that all project components are implemented as required by the environmental laws of the Republic of Tajikistan and ADB’s SPS-2009;

Assist the EA and IAs to assess the environmental impacts of all required works under the project;

Assist the EA and IAs to identify environmental sensitivities in the project area requiring further investigations and prepare plan on environmental mitigation measures;

Assist the EA and IAs to evaluate the requirements for environmental monitoringand prepare a long-term environmental monitoring program;

24. BETS does not currently have an international environmental consultant. The international consultant, Dr. Sayed Latif, was only hired to update the IEE from April 2019 to April 2020. Ms.Larisa Kamilova was contracted as national environmental consultant for the period of January 27, 2020 to July, 2020, with a further extension of the contract from December 2021.

25. ADB provides support through Malika Babadzhanova, Environmental Safeguards Consultant engaged under RETA 9541, who regularly provides advice on environmental protection measures in the form of face-to-face meetings, as well as email and mobile communications.

26. Contractors. Contractors are responsible for the implementation of rehabilitation works in accordance with environmental requirements specified in the tender documentation and EMP. The PIUs work closely with Committee for environmental protection under Republicof Tajikistan (CEP) in implementing EMP. The Contractor, LLC “Nun Ken Ziang Gun”, appointed Mr. Rakhmonali Muminov as the Environment, Health ans Safety (EHS) Manager. The Contractor, JSC “TGEM” assigned such responsibility to Mr. Bakhrom Ermadov, the leading EHS engineer, and Mr. Abdurofe Mirzoev, the environmental engineer, in connection with his dismissal in September 2021, from November 2021, issues on the implementation of the EMP / ESMP are assigned to the head of the Department for HSE and Environment of JSC TGEM Rafiyev Sharif. The main responsibilities are to carry out activities and control over the implementation of environmental protection worksper EMP/SSEMP requirements.

27. In general, the project includes 5 (five) packages for civil works. On July 26, 2019, a contract No. ICB-W-2 was signed between PIG and “Nun Ken Dziang Gun” for the implementation of 3 Lots, including Lot 1.: “Rehabilitation of irrigation systems in the M.S.A. Hamadoni", Lot 2:" Rehabilitation of irrigation systems in the Farkhor district"and Lot 3:"Rehabilitation of irrigation systems in the Vose district". Practically all work under this contract consists in the rehabilitation of hydraulic structures on the irrigation canals of CIS.

28. As so as the vegetation period in Tajikistan starts from March 1 to September 30, the contractor was not able to complete works on the irrigation canals properly, since in this period water is supplied to dekhkan farms on these canals. Thus, during the vegetation period it was not possible to carry out construction works on these canals and construction work can only be carried out from the period of October to February. PIG has informed ADB that after the recent mudflows in Kulyab zone, there was a need to manufacture concrete cubes for bank protection works. It should be noted that recently in Tajikistan the impact of climate change and temperature increase has been strongly felt, which results the melting of glaciers in the formation zone of Pyanj River, which leads to mudflows and floods in the CIS zone. Consequently, there was a need to manufacture reinforced concrete cubes for bank protection works in order to prevent or reduce the risks of natural disasters. Therefore, after the PIG contacted ADB on these issues, negotiations and agreement between the PIG and ADB, there was signed a contract on all three lots to extend the ICB-W-2 contract, taking into account the end of the vegetation season and use the remaining funds for the manufacture of concrete cubes for bank protection works. This contract was extended until December 31, 2021. During the reporting period, the progress achieved under the contract as a whole is: for the M.S.A. Hamadoni Lot-1

district: 84.09%, for Farkhor district Lot-2 - progress is 61.51 % and Vose district Lot-3 is 7.52%. Total for lots 69.29%.

29. On July 24, 2020, an agreement was concluded with the Contractor, JSC "TGEM”, to implement tworemained packages on Construction of lake-type sedimentexcluding basin in Hamadoni district and Rehabilitation of PS in Farkhor and Vose districts. The data on contracts between ALRI and contractors are presented in Table 2.

30. As of the end of December 2021, the progress of the contractor, TGEM JSC, for Lot 1. of the construction of a lake-type sediment basin makes 22.49%, and for Lot 2. Rehabilitation and modernization of PS in Farkhor and Vose districts are 79.47%. Total for lots 29.20%.

31. Summary of civil works contracts and works’ progress is summarized in Table 2. All awarded contracts included EMPs cleared by ADB and conditions of applicable national IEE clearance, such as:

During conduction of rehabilitation works, regulations and requirements of the legislation of the Republic of Tajikistan in the field of protection and improvement of Environmental status, construction and sanitary, regulations and requirements should be strictly observed;

To implement the Environmental management plan, an administrative control should be introduced;

During the operation of irrigation facilities, the sectoral technology, should be strictly observed. Bogging and salinization of lands should not be allowed;

For protection of water sources, lands, flora and fauna and atmospheric air, the Environmental management plan of the Protect should be strictly observed;

A certain operating mode should be cstablished during civil works;

Building and solid domestic wastes should be collected in locations of temporary storage and in the future, they should be located in an official places for wastes storage;

32. The environmental impact assessment report covering entire scope of the project works was submitted by the PIG (ALRI) to the State Ecological Expertise (Committee for environmental protection under the Government of Tajikistan) on 12.05.2020, which provided “environmental appraisal” on 15.05.2020 (Registration No. 746/15).

36. Information about the number of workers (maximum, minimum) in the current reporting period from July to December 2021 for the modernization and rehabilitation of irrigation infrastructure of Hamadoni, Vose and Farkhor districts, as well as for the modernization and rehabilitation of pump stations in Vose and Farkhor districts and commencement of the construction of the sediment excluding basin in Hamadoni district is shown in Table 4 below.

37. Employees of LLC “Nun Ken Ziang Gun” are mostly local residents. Only one office was established by the contractorin a rented house in Hamadoni district. The contractor's international staff (the company director, a Chinese resident) has housing in a rented apartment in Dushanbe. To achieve the project goals and objectives related to the construction of a sediment excluding basin in Hamadoni district, the other Contractor, JSC "TGEM" has arranged a construction camp in the district, and also installed mobile offices (trailers) for the field personnel in Vose and Farkhor districts.

2.4.1. Modernization and rehabilitation of irrigation infrastructure in Hamadoni district

38. There are two authorized bodies under ALRI in Hamadoni district that are responsible for hydraulic structures – State Agency of Land Reglamation and Irrigation and State Enterprise of Chubek Canal (SECC). Modernization and rehabilitation of hydraulic structures of irrigation canals is carried out in accordance with the approved Certificate of surveyed structures under the control of SEALRI and SE "Chubek canal" of Hamadoni district. There are 66 HTS on the balance of ALRI, and 57 HTSon the balance of State Institution “Chubek canal”. Detailed lists are given below in Tables 5 and 6.

39. The structures are consisting mainly of control structures, water distributors, aqueducts, water intake structures and outlet canals. Also, the rehabilitation of existing hydroposts and steel gates are considered. Map 2 below shows the view of subproject area in Hamadoni district. The list and characteristics of all the irrigation structures in theHamadoni district, which are shown in the tables on Map 3, requiring modernization and rehabilitation, are given in Appendix 2 of the SAEMR for June-December 2019.

40. Most of the canal cleaning work, which commenced in October 2019, have been completed. Almost all work under this contract consists of rehabilitation of hydraulic structures on CIS irrigation canals.

41. In connection with the need to manufacture concrete cubes for bank protection works to prevent and reduce the risk of natural disasters (See clause 28), in the reporting period from July to December 2021, the Contractor LLC “NunKenZiangGun”, carried out work on the manufacture of concrete cubes.

2.4.2. Modernization and rehabilitation of irrigation infrastructure in Farkhor district

44. There are 78 hydraulic structures in Farkhor district proposed for rehabilitation and modernization. The list of structures is given in Table 8 below. These are mainly сontrol structures, water outlets, aqueducts, water intake structures and outlet canals. Also, the issue of rehabilitation of existing hydroposts and steel gates installed on structures and drainage systems is considered.

46. The contractor, LLC “Nun Ken Ziang Gun”, has completed rehabilitation works, which commenced earlier in October 2019 on 4 (four) irrigation canals of the district. All thosesites were accepted by the State Commission comprising of representatives of ALRI, Hukumat Farkhor, BETS, PIG, lokal organisation ALRI, SES, Chief architect of the district, Contractor and handed over to the State Institution of Land Reclamation and Irrigation’s balance in September 2020, and there was conducted an environmental audit in completed sites of Farkhor district on December 7, 2020, (Appendix 2 Semi-annual Report of SAEMR for the period of June – December 2020).

47. In the reporting period from July to December 2021, the Contractor LLC “Nun Ken Ziang Gun”, has carried out the main scope of work in Hamadoni district (see paragraph 28). Table 9 shows the volume of works carried out during the reporting period to modernize and rehabilitate the irrigation infrastructure in Farkhor district.

2.4.3. Modernization and rehabilitation of irrigation infrastructure in Vose district

49. There are 58 hydraulic structures in Vose district designed for rehabilitation and modernization. The list of structures is shown in Table 10. These are mainly control structures, outlets, aqueducts, water intake facilities and spillways.

50. Map 4 below shows the location of irrigation structures requiring rehabilitation and modernization in Vose district. Map 5 presents a list and characteristics of all irrigation structures in the table form. The same tables with information on the irrigation structures in Vose district are also given in Appendix 4 of the previous SAEMR for July-December 2019 reporting period.

51. By the end of the first half of 2020, the contractor, LLC "Nun Ken Ziang Gun", completed works on cleaning of Arpa Tuguldi, Arpa Tuguldi -2 and Kaftarkhon canals from sediments and leveling of slopes by bulldozer. During the reporting period from July to December 2021, no other works were carried out on this component, all works on modernization and rehabilitation of hydraulic structures of Vose district were planned for the second phase of the project. During the reporting period from July to December 2021, no work was carried out in the Vose district by the contractor. (see item 28). As of the end of December 2021, the volume of completed works in the Vose district makes 7.52%.

In September 2020, all three canals were accepted by the State Commission (representatives ALRI, Hukumat Vose, BETS, PIG, local organisation ALRI, SES, Chief architect of the district, Contractor) after being cleaned and handed over to the State Institution of Land Reclamation and Irrigation. There was conducted an environmental audit in completed sites of Farkhor district on December, 2020, (Appendix 1 Semi-annual Report of SAEMR for the period of June – December 2020).

2.4.4. Construction of the lake-type sediment excluding basin in Hamadoni district

53. In July 2020, a tender was held and JSC "Tajikgydroelectromontaj" (TGEM) was selected on a competitive basis for the construction of the lake-type sediment excluding basin in Hamadoni district. The main technical characteristics of the lake-type sediment excluding basin are shown in Table 11, and Figure 2 below shows the general plan of the sediment basin.

2.4.5. Modernization and rehabilitation of pump stations in Farkhor and Vose districts

56. The project provides modernization of 8 PS and two cascades of pump stations Urtabuz and Janubi. The cascade of of Urtaboz PS is located in Farkhor district and have 4 (four) pump stations, these are: Urtabuz No. 1, No. 2, No. 3, and No. 4. In the PS cascade of Vose district, there are Janubi 1 and Janubi 2, as well as Moskva 1 and Perekachechnaya pump stations.

In November 2021, a Working Commission was organized in Vose district for the preliminary inspection/commissioning of the completed modernized Pump Stations of the district: Janubi 1, 2, Perekachechnaya and Moscwa-1. An environmental audit on the completed facilities also was carried out, some small comments have been given and the shortages were eliminated. (see Annexes 2-5 of this report).

2.5. Description of any changes in the design of the project

61. No changes have been done in project design during the reporting period from July to December 2021.

62. Construction methods, for all types of work are being carried out in accordance with GOSTs and SNiPs, which are given in the Feasibility Study of the Project and agreed between PIG, PIU and the Contractor.

III. ENVIRONMENTAL ACTIVITY

3.1. General Description of Environmental Activities

64. During the reporting period, contractors submitted 9 (nine) environmental monitoring reports, which reflect activities carried out by the contractors to mitigate environmental impacts during construction work, as well as the health and safety measures.

65. Consultants of PIG and BETS company held meetings and consultations with representatives of the Contractors, PIGs and supervision engineers to discuss issues, problems and discrepancies revealed during the inspection visits to the construction sites. Contractors were assisted in upgrading and revising the SSEMP in accordance with ADB requirements related to health risks to workers and populations due to the COVID-19 pandemic situation. Contractors were provided with hard copies of the ADB guideline “Suggested standard operating procedure for ensuring the safety of work from infectious diseases (for example, COVID-19).

66. Activities carried out by national consultant of Supervision consultant BETS during the monitoring period is provided in Table 15 below. During the reporting period July-December 2021, there was no International environmental expert hired by SC.

3.2. Site Inspections

67. For the reporting period, 54 different field visits and meetings were conducted. The purpose of field visits in the construction sites is to conduct inspections on environmental issues, monitor the progress of construction and rehabilitation works in accordance with the requirements of EMP/SSEMP, check the compliance with the legislatiion and regulatory acts of the Republic of Tajikistan and the requirements of ADB.

68. During the inspections, visual observations were carried out in the places, meetings with workers, personnel of the Contractor, engineers and specialists.

3.3. Issues Tracking (Based on Non-Conformance Notices)

70. Inspection results in Hamadoni, Farkhor and Vose districtsin July –December 2021. During the monitoring of works performed by the Contractor, LLC "Nun Ken Ziang Gun", on the project implementation at the construction sites in Hamadoni, Farkhor and Vose districts conducted by the BETS and PIG consultants, the following was revealed:

The contractor carried out work on the manufacture of concrete cubes for bank protection works;

No fuel spills were found at the construction site in Hamadoni area;

The fuel tank base in Hamadoni District is no longer used by the contractor LLC "NunKenZiangGun", and all vehicles are filled up at the district refuelling station;

Waste container was organized and labeled at the construction site, no hazardous waste was stored;

Plastic waste and paper found on the ground of a construction site;

There are no warning signs at the construction site;

Not all environmental documents (permits, contracts) were available at the Contractor's field office. Complaints log, waste and training logs are missing;

The sanitary condition in and around the medical center is poor. Missing COVID-19 posters and masks;

Workers used protective clothes and personal protective equipment at work;

Safety and health briefings were held due to the COVID 19 pandemic situation;

Fire shields available at the base in Hamadoni and other offices;

First aid kits and fire extinguishers are available in equipment cabins (dump trucks, bulldozers, etc.);

Employees are organized and provided with food and water from the nearest settlement.

Trees were not damaged during construction works.

During the reporting period, no complaints were received from the population

71. The following non-compliances in categories of LLC “Nun Ken Ziang Gun” were revealed:

Lack of warning signs at the construction site;

Plastic waste and paper found at the construction site;

Not all environmental documents (permits, contracts) were available at the Contractor's field office. Complaints log, waste logs and training logs are missing;

Lack of posters on COVID-19, masks;

The sanitary condition in the first-aid post and around is poor;

72. During the monitoring, the following instructions were presented to eliminate the identified inconsistencies during the construction work by the contractor “Nun Ken Ziang Gun”:

Install information board/warning signs/instructions.

Remove all plastic and other type of waste from the construction camp and ensure their proper disposal;

Ensure that all environmental documentation (EMP/EMP, monitoring reports, complaint log, permits, etc.) is kept in one place at the Contractor's local office.

Ensure good sanitary condition of the area around and inside the health center;

Provide and install posters on COVID-19, HIV/AIDS, masks.

73. While the visit of the project areas to monitor the implementation of environmental measures during construction work by the contractor JSC "TGEM" with whom the Contract was concluded for the implementation of work on the modernization and rehabilitation of pump stations in Farkhor and Vose districts, as well as work on the construction of Sediment basin in Hamadoni district, ADB’s environmental safeguards review mission conducted on 21-22 December 2021 identified the following:

At visiting the construction site, works on the construction of a Sediment basin in Hamadoni district and the modernization of the PS in Farkhor and Vose districts, all construction works were carried out from July –December, with no delays from the work plan.

Construction sites in Hamadoni district, and in Farkhor and Vose districts are fenced, landscaped, warning signs and instructions are in place, no leaks of fuel and lubricants were observed.

The tank for fuels and lubricants at the construction site in Hamadoni is no longer used by the Contractor OJSC "TGEM", a special concreted platform for refueling equipment has been built in Hamadoni district. All equipment used in Hamadoni, Farkhor and Vose districts is refueled by a specialized vehicle in accordance with the requirements of all environmental standards.

Fire protection and first aid equipment provided by the Contractor were completed during inspection and meet all the requirements.

Sanitary and amenity facilities - premises for workers, (toilet, water, showers), kitchen, met the requirements.

Plastic waste found at a construction camp in Hamadoni district.

Garbage was not taken out and there was no labeled container in the site intended for temporary storage of waste in PS Urtaboz-4 in Farkhor district.

Medical rooms are equipped with an appropriate equipment for first aid, there are beds and first aid kits. There are no containers for medical waste, no demonstration materials (leaflets, posters) on COVID-19, HIV/AIDS products and masks at the Medical Station in Hamadoni and Farkhor districts. There was no medical book;

Safety and health briefings were held in response to the situation with the COVID 19 pandemic;

Workers used protective clothing and personal protective equipment at work; At a crushing plant some workers were using hear protection devices in Hamdoni district;

Monthly environmental monitoring reports for September-November 2021 were submitted in early December;

Environmental documentation was submitted (SSEMP, Complaint Logs, Visit Logs and other);

Trees were not damaged during construction works.

Containers for waste at the construction site of JSC "TGEM" and PS in Vose and Farkhor for various wastes are marked;

Food and water were provided to the workers.

During the reporting period, no complaints were received from the population

Waste from the construction site of the Urtaboz-4 pump station in Farkhor district is not removed on time and there is no labeled waste container;

There are no containers for medical waste, no demonstration materials (leaflets, posters) on COVID-19, HIV/AIDS products and masks in the Medical station in Hamadoni and Farkhor districts. There was no medical book;

Not all workers used hearing protection device in the area of the operating crushing plant;

Monthly environmental monitoring reports for September-November were not submitted on time.

75. During the monitoring, the following instructions have been presented to eliminate the identified inconsistencies during the construction work by the contractor JSC “TGEM”.

Ensure timely removal of waste from the construction site of Urtaboz-4 pump station in Farkhor district;

Organize containers for medical waste at health posts in Hamadoni and Farkhor districts, purchase demonstration materials (leaflets, posters) on COVID-19, HIV/AIDS products and masks. Get a medical book.

Submit monthly environmental monitoring reports on time.

78. In the previous reporting period from January to June 2021, totally 13 non-conformances were identified, 11 of them were resolved. The two remaining non-complianeces were included in the CAP for July-December 2021 and were eliminsted by the and of July 2021. In the second half of 2021, 10 new non-conformances were identified. By the end of the reporting period, until December 30, 2021, the Contractors have resolved all 12 non-compliances.

3.5. Unexpected environmental impacts or risks

81. No unforeseen environmental impacts4 except of COVID-19, were identified within reporting period.

82. Contractor’s personnel wear mask, gloves, helmets and working wear, but not all the time. PMC advised the Contractor to monitor its workers on wearing the full set of PPE.

83. The Contractors developed Occupational Health and Safety Plan as part of its SSEMP which includes, inter alia, corresponding measures on prevention of the spread of COVID-19. The Contractor’s SSEMP also includes Emergency Management Plan.

IV. ENVIRONMENTAL MONITORING RESULTS

4.1. General monitoring during the current period

84. For the reporting period, the Contractor submitted 9 (nine) environmental monitoring reports from July to December 2021, no other reports were submitted due to the start of the irrigation season from July to September 2021. Contractor’s reports generally contain information only on the executed scope of works and on the compliance with environmental protection measures.

85. The environmental monitoring consists of the following two parts:

monitoring of compliance with the Environmental Management Plan (EMP/SSEMP) to review the conditions necessary to comply with the Project Construction Phase; and

environmental monitoring. EMP compliance assessment began with a review of the environmental management conditions required for compliance during the Project construction phase.

4.2. Wastewater

86. In accordance with the requirements of the EMP / SSEMP, the contractor is obliged to provide employees with appropriate temporary sanitary conditions and showers. Toilets should be equipped with water storage tanks. The reservoirs should be pumped out as needed and the sewage water should be transported for cleaning by the local sanitation department.

87. All hired workers of the Contractor, LLC “Nun Ken Ziang Gun”, arethe local people and during carrying out the works near the settlements, only local toilets were used. There were no other toilets arranged during the reporting period. For the construction sites located at the big distance from settlements, the traditional cesspool toilets were arranged. The cesspools are enclosed with cloth or plywood, and after completion of works in this area, the pits are filled up by soil.

88. The Contractor, JSC "TGEM", has installed toilet facilities, shower rooms, eating rooms, laundry facilities in the work areas of its employees (Photo 40-41). The workers are obliged to keep the issued protective clothing in good working order and clean, wash and repair in a timely manner. Wastewater from the construction camp, toilet and from the utility area is strictly controlled so that there is no unintentional discharge into water bodies or the river.

4.3. Air quality

89. The works were carried out from July to December 2021, before the start and after the irrigation season, mostly quite far from settlements. Emissions of dust and pollutants into the atmosphere occurred during leveling earth deposits, earthworks, uploading from vehicles, mixing of cement and sand in the concrete mixing unit, roadbed leveling, transportation of dismantled metal parts or concrete works. Appropriate dust suppression measures were taken, such as spraying with water (Photo 42), using a curtain or fencing off the construction site. Use of masks, gloves and protective clothing. Limiting vehicle speeds and selecting suitable transport routes to minimize exposure to dust-sensitive receptors. Access roads and construction sites near populated areas were sprayed with water when necessary to suppress dust emissions. Construction equipment was in good condition, regularly inspected by engineers of the Contractor and PIG.The construction company received a licence for 5 years from the licensing department of the Committee on Architecture and Construction. For the receiving of licence the Company submits all required documents regarding the construction methods, types of construction equipment, etc. No other permits are required.

4.4. Noise and vibration

90. According to the EMP, no instrumental noise measurement is foreseen. During the reporting period, work on cleaning canals of sediments was carried out mostly at the big distance from the settlements. When working near settlements, to minimize the impact of noise, Contractor restricted the activity time of one excavator (from 8 am to 18 pm). Сommunities were informed of the construction activities. Distance of the settlement "Chubek" up to the construction site is about 700 m. Noise-related works are carried out during the day time.

4.5. Flora and fauna

91. Contractor did not cut trees along canals and collectors during sediment excavation, as well as while construction of the sediment excluding basin and rehabilitation of pump stations. No cases of illegal poaching were reported and recorded by the project PIG and local environmental departments of the districts.

4.6. Use of Material Resources

92. Data on the use of material resources by the Contractors during this reporting period (July-December 2021) are presented in Table 21-22 below.

4.6.1. Cumulative use of resources

93. Contractor, LLC “Nun Ken Ziang Gun” consumed: 1260kW of electricity, 11700 liters of drinking water, 24 m3 of non-hazardous waste (there was no hazardous waste), 2700 liters of fuels and lubricants.

94. The contractor, JSC "TSEM", consumed: 28799 kW of electricity, 272099 liters of drinking water, produced and disposed of 24 m3 of non-hazardous waste, 0.71 m3 of hazardous waste temporarily stored in warehouses, 20096.2 liters of fuel and lubricants

4.7. Waste management

95. Contractor, LLC “Nun Ken Ziang Gun” has eliminated two non-conformancies, namely: a Contract was concluded with the municipal authorities of Hamadoni district for collection and disposal of non-hazardous waste (paper, food leftovers and etc.). by the end of July 2021. Waste containers have been labeled (see photo 45), a log of waste movement is maintained. The implementation of the action was verified and confirmed by PIG environmental specialist in September 2021.

96. The Contractor, OJSC "TGEM", has established points for the collection and temporary disposal of construction waste at the sites. Waste is sorted in a timely manner and temporarily placed in the designated area. Municipal solid waste incineration is prohibited at construction sites and is strictly controlled under the SSEMP. During the joint inspection, the debris from the PS Urtaboz-4 site was not removed in time. This discrepancy was eliminated the next day (Appendix 1, Photo 3)

4.7.1. Current period

97. The main waste during the rehabilitation works during the reporting period for the Contractor LLC “Nun Ken Ziang Gun”, was non-hazardous construction waste generated during the manufacture of concrete cubes for bank protection works. Cement bags were used as bedding material for ready-made concrete cubes, temporarily stored until they were installed in a permanent place for bank protection. In the future, cement bags, as well as other waste (paper, plastic, etc.) are taken out by the municipal company for their further disposal. Wooden structures are decommissioning for firewood, which is distributed and used by local workers in their households.

98. The Contractor, LLC “Nun Ken Ziang Gun”, in Hamadoni district has its own base in rented building and area at the Kolkhoznaya street, h.26. (office), as well as offices in Farkhor and Vose districts, where the warehouses for construction materials are located. During the

reporting period the Contractor did not store or use any chemicals or hazardous materials, and all contractor's vehicles were refueled at gas stations in Hamadoni, Farkhor and Vose districts.

99. At the construction sites in Vose and Farkhor districts, all machinery of the Contractor, JSC "TGEM", is also refueled at gas stations. There is a construction camp in Hamadoni district, which is located in the border area of the Republic of Tajikistan with Afghanistan. This area is considered to be protected by the Border Troops of the Republic of Tajikistan. The camp is located 600 m to the south of the construction site and approximately 800 m to the bank of Pyanj River, 500 m in the north direction to the beginning of the border of the settlement of Chubek jamoat, 200 m in the east direction is the office of State Institution “Chubek Canal”. There are 18 sleeping carriages, toilet facility and 3 carriages – dining room, medical station, storage are installed at the construction site. Workers are provided with clean drinking water and sanitary conditions, including three hot meals a day; fire shields, information boards, posters and a safety corner are available. The camp follows the principle of "closed doors" to prevent entry or uninvited visits by citizens from nearby settlements.

100. Fuel and lubricants for other vehicles are provided by specialized vehicles. Technicians refuel in a designated area 70 m from the construction site at the allotted fenced concreted area with warning signs.

101. During the reporting period, the paint for painting of the metal pipes, frames and internal walls of PS building in Vose and Farkhor districts were used. All cans of paints and solvents are temporarily stored in a special room with a concrete floor, without access to water. After completion of all painting works at the end of the reporting period, a representative of the distributor company collected the empty used containers from under paints and solvents.

102. Bags of cement used for manufacture the concrete cubes for bank protection works are placed under these concrete cubes by contractor workers during their drying and temporary storage before the cubes are installed in a permanent place. Then the cement bags are collected and hauled away by the utility company.

4.8. Health and Safety

4.8.1. Community safety

103. During the reporting period, works at construction sites of the contractor, LLC “Nun Ken Ziang Gun”, were carried out mainly far from settlements at the distance up to 5 m. But the sites of the other contractor, JSC “TGEM”, are located at the minimum distance of 1 km.

104. For the reporting period, not any accident was registered, including road traffic accidents among the local population near the construction sites of the project sites.

4.8.2. Workers’ health and safety

105. The Contractor’s staff (LLC “Nun Ken Ziang Gun”) includes mainly local people and served at local health centers. Personnel (LLC “Nun Ken Ziang Gun”) consists mainly of local residents and is served in local medical centers. Hamadoni district has its own base (office), storage facilities. During the reporting period, a medical item with a bed, a first aid kit was organised, but the condition of the medical center during the joint inspection did not meet sanitary standards. At the same time, there were no posters on HIV / AIDS and COVID-19, as well as a medical book. By the end of December 2021, the identified discrepancies (Appendix 1, photo 8). Hot meals (mobile kitchen) and clean drinking water were organized for the Contractor’s workers, in agreement with the nearest settlement). There are fire-fighting equipment. According to the Rules of the Road (RR), each driver of working equipment (bulldozers, excavators, etc.), has a first aid kit, a fire extinguisher and an emergency stop sign.

106. The Contractor JSC "TGEM" in the camp in the Hamadoni area has a first-aid post, in Vose and Farkhor districts, the workers' wagons also have everything they need to provide first aid on the spot. First aid kits are available and are replenished quarterly. Control over the timely passage of medical examinations is entrusted to an occupational health and safety engineer, health and safety records of each worker are kept, a logbook is kept on the state of occupational health and safety at the facility. Sanitary conditions, laundry are provided, and regular antiparasitic treatment is carried out. All areas have fire-fighting equipment. Workers are provided with PPE. Drinking water is available in sufficient quantity. Sufficient number of electrical outlets for the use of electrical appliances. Environmental documentation: EMP, Complaints logbook, visit log, safety, waste movement log book are available and demostrated. There were no containers for medical waste and medical books in the medical posts, there were no demonstration materials in Farkhor district (leaflets, posters) on COVID-

19, HIV/AIDS products and masks. Corrective actions were taken before the end of the reporting period (Appendix 1, photos 5-6).

4.9. Physical cultural resources

107. During earthworks in Hamadoni district, no historical and cultural chance find were found at the construction site of the Lake-type Sediment basin with hydraulic sediment washing.

4.10. Training

108. All employed local workers, on average 35 years old, have work experience in the construction industry, before starting work they undergo safety training and emergency response. All workers, starting from the first week of work at the construction site, underwent safety training courses. The contractor has a logbook on occupational safety, in which records of trainings and briefings are kept. Each worker who has been instructed signs in this logbook.

109. According to the Program 1, while recruitment, the Health and Security officer carried out induction training for workers on first aid activities to injured workers and also daily intructions before start of work. All employees were also familiarized by the Occupational Health and Safety oficer with the approved fire safety instruction.

110. In response to the outbreak of the СOVID-19 pandemic, the Contractor JSC "TGEM". conducted training and took all necessary measures to protect the health of workers: maintaining social distance, using masks, sanitizers to reduce the likelihood of infection of workers. The СOVID 19 Action Plan was added to the SSEMP. All contractors received hard copies of the ADB Recommendations “Suggested Procedure for Ensuring Work Safety from Infectious Diseases (e.g. COVID-19)” and briefed on it by the contractor, Photo 57 below.

111. On December 22, 2021, a meeting was held in PIG office on the results of a ADB’s environmental safeguards review mission, (December 21, 2021 in Hamadoni and Farkhor districts). Corrective actions after the mission were discussed and agreed upon.

4.11. Grievance redress mechanism

112. PIG ALRI, as part of the WRMPRB project, has developed and approved a grievance redress mechanism in October 2019. The contact persons for various GRM items (Contractors, WUA, regional ALRI departments, local authorities) were identified prior to construction and operation. GRM organizational charts, including contact personts of theses items, are presented at major construction sites. The project trained employees and contact persons of GRM items to ensure clarity of the responsibilities and procedures.

113. There were no complaints log books at the contractor’s offices during the reporting period. PIG requested Contractor to arrange the complaints log books. Engineers of PIG and PIU informed that they did not receive complaints within the reporting period from local people and workers as per records in complaints log books in assigned districts and jamoats.

V. FUNCTIONING OF SITE SPECIFIC ENVIRONMENTAL MANAGEMENT PLAN (SSEMP)

5.1. Review of the SEMP (SSEMP/SEMP)

116. On March 27, 2018, the IEE was submitted to Committee for Environmental protection (CEP) for consideration, and on January 28, 2019, a positive conclusion (Appraisal) was received from the State Environmental Expertise for this project (Annex 1).in April 2020. The IEE has been re-updated by international environmental expert Dr. Syed Latif, due to the changes in the parameters of the lake-type sediment excluding basin. In May 2020, a second positive conclusion was received from the CEP (Appendix 2).

117. One of the requirements under the EMP is that the construction Contractors must prepare the SSEMP before starting construction activities. On September 25, 2019, the contractor prepared SSEMP for subprojects in Hamadoni, Farkhor and Vose districts before the start of civil works to avoid risks to the health of personnel in the workplace, as well as to protect the environment. The contractor, LLC "NunKenZiangGun", has already submitted, reviewed and upgraded version of SSEMP in accordance with the ADB requirements and Corrective Action Plan for June-December 2020, as well as including safety measures due to COVID-19 pandemic situation began in 2020.

118. On July 24, 2020, the contractor, JSC “TGEM” signed the contract with PIG and on August 17, 2020, submitted the first version of SSEMP with the COVID-19 management plan before the civil works commenced. The SSEMP was reviewed by PIG and three times was returned to the contractor for revision (September 7,28 and October 27, 2020). Thus, on November 24, 2020, final approval for the last version of SSEMP was received. Table 24 shows the status of SSEMPs.

VII. CONCLUSIONS AND RECOMMENDATIONS

7.1. Conclusions

120. During the reporting period, the following was noted:

No complaints from the population were recorded during the reporting period from July December 2021;

Timely safety measures (ADB Recommendations "Suggested Workflow for Safe Work from Infectious Diseases (COVID-19)" are available in hard copies in all Contractor's offices as required in the context of the COVID-19 pandemic conditions;

no accidents or injuries have been registered, no cases of COVID-19 have been registered among Contractor staff since the beginning of 2020. Most of the workers are vaccinated, some of them are revaccinated;

Compliance by the Contractor with the rules of the road;

Occupational health and safety - Before starting work, employees are provided with precautionary measures, as well as food and clean water;

Since the contractor's LLC "Nun Ken Ziang Gun" are local residents, they can be serviced monthly in medical centers and outpatient clinics. Nevertheless, during the reporting period, the Contractor was at the stage of signing a contract with local medical centers. The contractor has equipment for providing first aid at the facilities and in the cabins of working equipment (bulldozers, dump trucks, excavators, etc.).;

The contractor JSC “TGEM” has medical points, and the contract is signed with the medical center.

Community health and safety - contractor drivers reduce speed when driving through communities;

People were informed about the start of construction work;

No accidents or incidents have been reported.

2 non-conformances identified in previous reporting period were solved by LLC "Nun Ken Ziang Gun".

121. Areas for improvement and consideration in a corrective action plan are listed below:

Health and safety of workers – workers are provided with a full set of PPE. Not all workers of the contractor, OJSC “TGEM”, use PPE, to protect hearing in the area of operating concrete plant, despite daily safety briefings;

Waste management (offices) – Cleanliness and timely removal of waste are not always observed at the construction sites of the Contractors;

Emergency and Accident Procedures – Emergency and Accident procedures – The Contractor, LLC “Nun Ken Ziang Gun”, agreed that medical institutions in the districts are ready to provide services and accept all residents and employees in these districts in the event of various accidents, during the reporting period, Contractor has signed a contract with a medical institution and created such medical institution in Hamadoni district. But the contractor, OJSC “TGEM", has already created such medical institutions with the appropriate equipment.

7.2. Recommendations

122. The following actions and measures are recommended (Table 26) as a Action Plan to be implemented by PIG, Сontractors, and BETS Consulting Company in order to strictly comply with the requirenments of the EMP/SSEMP.
