    PROCEEDINGS:

    Government has issued orders in G.O. Ms. No 165, General Administration (Services. C) Department,Dt.22-6-97 to the effect that the govt. employees who have crossed 45 years of age be exempted frompassing of departmental test. Special tests prescribed for the purpose of promotion to the next higher categoryonly (i.e) promotion or appointment by transfer to a post above the one held by him/ her if they could not passthe same. These orders were adopted in the board in the reference fourth cited in respect of its employeessubject to the condition that the concessions therein are not applicable to those employees who are enjoyingexemption from academic qualification as per the existing policy. Certain clarifications have also been issuedthereon in the memoranda 5-6 th read above.

    2. Aggrieved by the above mentioned clarifications, certain representations were received for cancellationof the said clarifications as they are causing hardship to the senior unqualified candidates who were alreadyappointed to S.P.P in terms of the orders issued in the B.Ps first and second read above and continued assuch and where as the unqualified juniors are now eligible for promotion to the next higher cadre in terms ofthe orders in B.P. (P&G. Per) Ms.No.39,Dt.19-5-97.Certain qualified candidates challenged the orders issuedin the reference 4th read above in writ petition Nos.11391/97,13571/97,16618/97,21955/97 and obtained interimorders to the effect that any promotions made shall be subject to the result of writ petitions pending in HighCourt of Andhra Pradesh.

    3. The matter was also discussed with the recognized unions and after careful consideration of thevarious suggestions made , keeping in view the orders of the High Court referred to in Para 2 above and witha view to provide relief to the employees, the A.P. State Electricity Board issued orders in the reference last

    4:1 ration between qualified and un-qualified candidates who have crossed 45 years of age for promotionto the next higher cadre subject to the terms and conditions mention there in.

    4. Aggrieved by the said orders certain employees Unions filed W.Ps in High Court of A.P. Challengingthe orders issued in B.P. (P&G. Per) Ms.No.258 , dt,18-12-97 the Honble High court A.P. gave interim ordersin W.P. Nos 85692/97,35691/97,305/98,5916/99 suspending the operation of the orders issued in B.P (P&GPer) Ms. No 258 Dt.18-12-97 initially for a period of six weeks and later ordered continuing the suspensionuntil further orders. Consequently several vacancies of UDCs/JAOs and JPOS could not be filled up bypromotion of candidates for the respective feeder categories. Much inconvenience is being experienced dueto non filling up of several vacancies.

    5. The Honble High Court heard the petitioners is W.P. Nos 16618/97, 21955/97, 27109/97,29984/97,31848/97, 97 98,305/98,1689/98 and 5916 of 98 and gave the following direction on 31-12-1998.

    The Management of the Board is permitted to make promotions on ad-hoc basis to meet the needsand exigent of the services of the Board during the Pendency of the writ petitions. All promotions that may bemade by the Board during the pendency of writ petitions shall be subject to the final results of the writpetitions. The promotees shall be notified accordingly in clear and specific terms when the board issuespromotion orders.

    6 Pursuant to the above direction of the High court the matter was discussed with the recognizedEmployees Unions. The Unions have agreed in writing that a ratio between the qualified and un-qualifiedcandidates who have crossed 45 years of age may be prescribed for the purpose of promotion to the cadre of

    UDC, JAO in Accounts Service and JPO in P&G service from the respective feeder categories, subject tofinal results of the writ petitions pending in A.P High Court.

    7 After careful consideration, the A.P. S.E. Board makes the following Adhoc arrangement for filling upof the vacancies in the cadres of UDC, JAO & JPO by promotion from the respective feeder categories. Theseorders shall be subject to the final results of the writ petitions pending in high court of A.P on the subject.

    i) The qualified/Candiates and /the un-qualified candidates who have crossed 45 years of age andcovered in terms of B.P 4th read above shall be considered for promotion to the next higher cadrein the ration of 2:1 (i.e. 2 qualified and 1 un-qualified) as per the seniority and satisfying all other

    requirements.

    ii) The unqualified candidates already exempted for the purpose of S.P.P appointment in terms ofB.P (P&G Per) MS. No. 328, Dt.13-9-93 read with B.P (P&G. Per) Ms No.360 Dt.21-6-96 shallalso be considered for promotion to the next higher cadre in accordance with B.P (P&G.Per)Ms.No.39, Dt. 19-5-97 against the slot provided for Unqualified candidates as per seniorityand subject to satisfying all tother requirements.

    iii) Such of the employees already availed the facility of exemption from passing departmentaltests for promotion to higher cadre in terms of the orders inforce from time to time are noteligible for further promotion under B.P (P&G.Per) Ms.No.39,Dt.19-5-97.

    iv) Exemption from passing departmental test in terms of B.P.(P&G. Per) Ms.No.39, Dt.19-5-97shall be given for purpose of promotion to the next higher cadre only i.e the promotion to a postabove the one held by him /by her, if they could not pass the same.

    v) A fresh roster shall be drawn while filling up of the vacancies prospectively after the date of issueof these orders.

    vi) No carry forward for the un-qualified slot reserved to them in case of non availability of un-qualified candidates.It shall be filled up by eligible and qualified candidates.

    vii) While filling up of the slot reserved to the un-qualified candidate, it shall be ensured that thesenior qualified candidate shall not be by-passed, when such a situation arises, the un-qualifiedcandidate shall wait utill his senior qualified candidate gets his/her turn for promotion.

    viii) The exemption orders for un-qualified candidates who have crossed 45 years of age shall givenby the appointing authority concerned after thorough scrutiny.

    ix) The other clarifications issued in the references 5-6 cited shall hold good.

    x) It shall be made clear in the promotion orders that the promotions are made on adhoc basis andsubject to review as per the final orders of A.P. High Court that may be passed in the writpetitions pending.

    9. All the Chief Engineers /Superintending Engineers are requested to follow the above orders andtake necessary further action accordingly.

    ORDER:

    The Member Secretary, Andhra Pradesh State Electricity Board in the reference read above, hasfurnished Voluntary Retirement scheme for the employees of the A.P.S.E. Board for approval of the Governmentas it is one of the conditions of the Tripartite agreement entered into by the Government of Andhra Pradeshand A.P.S.E. Board with the service Associations as part of the Restructuring process. The scheme is to be

    announced before restructuring the A.P.S.E. Board.

    2. Government after careful consideration of the matter approves the Voluntary Retirement Schemefor the employees of the A.P.S.E. Board as per the annexure appended to this order.

    VOLUNTARY RETIREMENT SCHEME (VRS)

    Title and objectives:

    1 This scheme is called Voluntary Retirement Scheme (therein after referred to as 'VRS'). TheScheme is purely voluntary in nature. If it applicable to eligible employees presently working withthe Andhra Pradesh state Electricity board (APSEB) and who may be transferred to entitieswhich will succeed APSEB (thereinafter the Successor Entity) in accordance with the reformand restructuring of APSEB under the terms of the Andhra Pradesh Electricity Reform Act.,

    1998 (Act No30 of 1998) read with the Transfer scheme Rules framed under the said Act butsubject to the terms of the relevant Tripartite agreements signed between the state Government,APSEB and the Service Associations.

    Period of Operation:

    2 Voluntary Retirement scheme will be in operation for a period of three months from the date to benotified for the purpose.

    ELIGIBILTY:

    3 (1) Voluntary Retirement scheme under this scheme shall be applicable only to such of theregular or permanent employees to whom voluntary retirement has been offered under theapplicable Tripartite Agreement signed between the state Government, Andhra PradeshState Electricity Board and the service Associations. It is clarified that the voluntary Retirementscheme under this scheme shall not be available to other employees, members of theAndhra Pradesh State Electricity Board, the Directors of the successor entities, deputainniststo the Andhra Pradesh State Electricity Board or the Successor Entities and also toemployees Board or the successor Entities and also to employees appointed on a tenure orcontract basis.

    (2) Voluntary Retirement scheme under this scheme shall be applicable only if the employee

    had completed a minimum 25 (twenty Five) continuous years of service in Andhra PradeshState Electricity Board or the Successor Entities and further had attained the age of 50 (fifty)years as on the last date notified for the submission of the Application for VRS.

    (3) Nothing in this scheme shall prohibit an employee from availing voluntary retirement underany other scheme prevailing provided that an employee shall opt either for this voluntaryRetirement scheme or for the voluntary retirement scheme but not both.

    VRS Benefits:

    4.1 An employee whose request for voluntary retirement had been accepted under this scheme bythe Andhra Pradesh state Electricity Board or the Successor Entities shall be entitled to thepayment equivalent of 15 (fifteen) days salary for each completed year of continuous service or

    fifteen days salary multiplied by the balance months of service left out for the normal date ofretirement whichever is less.

    For example , an employee who has put in 26 years of service and has got only one year of service leftfor normal retirement, will receive VRS payment of only 6(six) months salary and not 13 (Thirteen)months salary.

    Explanation Salary shall mean Basic pay and any others personal Pay or special pay, which is consideredfor payment of pension on the date of acceptance of the employees request for voluntary Retirement bythe Andhra Pradesh State Electricity Board or the successor entities.

    Normal Benefits:-

    5 In addition to the payment as per rule -4 above and employee shall be entitled to the following normalbenefits.

    (1) Balance in his General Provident Fund Accounts (GPF)

    (2) Gratuity and pension as allowed under the rules (However an employee opting for voluntaryRetirement under this scheme shall not be entitled to add to his or her qualifying service thebenefit allowed under Rules 29 and 43 of the Revised Pension Rules, 1980, as amendedfrom time to time.)

    (3) Cash equivalent of accumulated un-utilised earned leave to his credit not exceeding 240days.

    (4) TA/DA for self and family (as defined in traveling Allowance/Daily Allowance rules of theAPSEB or the successor entities) as per the entitlement under the Traveling Allowance /Daily Allowance rules of the Andhra Pradesh state Electricity Board or the Successor entitiesto the place where he intends to finally settle after his retirement.

    (5) Transportation cost of personal effects as per his entitlement under the rules of the board orSuccessor entities.

    Procedure and conditions:

    6 (1) Applications should be made in the prescribed form as per Annexure IA andCompleted in all respects before submitting to such authority as may be designated for thepurpose when the applications under the Scheme are invited by the Andhra Pradesh StateElectricity Board or the successor entities of APSEB by appropriate order.

    (2) The designated authority, in consultation with the departmental head of the employee andafter verification of particulars furnished by the employees shall forward the application orapplications to Member Secretary of the Andhra Pradesh State Electricity Board or theDirector of the successor entity designed for the purpose within a maximum period of 15

    (fifteen) days from the date of receipt of the application.

    (3) The Member Secretary or the Director designated for the purpose shall place all suchapplications in consolidated form to a committee constituted for the purpose of scrutinisingand recommending to the Andhra Pradesh State Electricity Board or the Board of Directorsof the Successor entities within a maximum period of 15 (fifteen) days from the date ofreceipt of such application under clause (2).

    (4) The Recommending Committee mentioned in clause (3) shall examine all such cases onthe basis of service records of the employees, organizational requirement and record theirrecommendation in the relevant portion of application. Where the recommending committeedoes not recommend the case of any employee, it shall record the reasons for such viewsin the application form. The recommendations of the committee shall be placed before theAndhra Pradesh State Electricity Board or the Board of Directors of the successor entitiesfor decision and approval .An officer of the Andhra Pradesh State Electricity Board of thesuccessor entities, as the case may be designated for the purpose will issue the appropriateorders as per the decision taken by the APSEB or the Board of Directors of the Successorentities.

    (5) The Andhra Pradesh state Electricity Board or the Board of Directors of the successorsentity reserves the right to reject an application under this VRS if it considers that a particularemployee or a class of employee, as the case may be cannot be discharged from servicein public interest or in the interest of the continued operation of the successor entity ofentities.

    Miscellaneous:

    7(1) Income tax liability, if any, will be made to the employees account. The exemption undersection 10 (10C) of the Income Tax Act, 1961 will not be available.

    (2) For all intents and purposes, the age and the date of birth of an applicant recorded at thetime of joining APSEBs services alone shall form the basis. No fresh evidence or proof ofage will be entertained in this regard.

    (3) Voluntary Retirement means Voluntary Separation and will terminate the existing contractsof employment with mutual consent of the applicant and employer. It will become valid,effective and enforceable once the company has conveyed its acceptance to the applicant

    employee in writing.

    (4) Once the application is submitted by the employee in the prescribed form, he or she cannotwithdraw the same. On acceptance of the application the employee will retire from the date,which will be decided by the successor entity The employees under the scheme will normallybe relieved from his or her duties at the end of last day of next immediate month followingformal communication of acceptance of his application for early voluntary retirement.

    For example, if formal orders as regards to acceptance of his application had been issuedsay on 28th of a month he will be relieved form the service, on 30 th or 31st (last day) of thesucceeding month as the case may be.

    (5) The employees opting for voluntary Retirement scheme shall not be entitled to any

    retrenchment compensation of whatsoever nature or any other compensation under theIndustrial disputes Act, 1947 or any other law in force as on date.

    (6) The compensation in terms of voluntary retirement scheme will be final and shall not beliable to be reopened under any circumstance including for any revision in salary of suchcategory of employees due to operation of any award or settlement or other wise arrived ata later date.

    (7) Payments under the voluntary Retirement Scheme shall be subject to full recovery oradjustment of all outstanding loans, advances, recoveries and other dues.

    (8) In circumstances where an employee granted voluntary Retirement schemes expires before

    his or her release benefits accrued to him under the scheme will be payable to his spouseor legal heirs as if he or she has survived.

    (9) The employee applying for voluntary Retirement Scheme should not have availed the benefitfrom any other VRS in the past.

    Saving

    8. (1) Notwithstanding any of the aforesaid provisions the voluntary Retirement scheme does notconfer any right on any employee to have his request for voluntary retirement accepted bythe APSEB or the successor entity or entities.

    (2) The employees retired under the scheme shall not be eligible for re-employment in theAndhra Pradesh State Electricity Board or the successor entity or entities or any of theassociate companies or subsidiaries.

    Interpretation

    9. In all cases of interpretation of the scheme, decision of the Andhra Pradesh State ElectricityBoard or the Board of Directors of the successor entity or entities concerned as the casemay be shall be final and binding on the employees . In all matters not specifically providedherein the decision of the Andhra Pradesh state Electricity Board or the Board of Directorsof the successor entity or entities shall be final and binding.

    Power of Amendment of with drawal.

    10 The Andhra Pradesh State Electricity Board or the Board of Directors of Successor entity orentities shall have the sole authority to amend modify, after withdraw the scheme in whole orin part and extend the scope and coverage of the scheme to all eligible employees on aparticular group or category or cadre of eligible employees, at its discretion.

    ORDER:

    In the reference 1st and 2nd cited, orders have been issued stipulating some promotion policy among thenon-graduated R.Cs and L.D.Cs. for promotion as U.D.Cs in the ratio of 9:1.

    2. In the reference 3rd cited, a ratio of 2:1 (Two qualified : One unqualified) has been fixed for effectingpromotions among the employees as per which any incumbent who crossed 45 years of age has to beconsidered for promotion to the higher post by exempting from passing pre-requisite departmental tests onad-hoc basis as per the direction passed on 31.12.98 by the Honble High Court, of AP in W.P.Nos 16618/97,21995/97, 27109/97, 29984/97, 31843/97, 97/98, 305/98, 1689/98 and 5916/90 pending disposal of the saidW.Ps. Consequent on issuing the above orders, certain clarifications have been issued in memo. 4th cited forthe purpose of implementation of the orders issued in the reference 3rd cited and as such these orders are alsoon ad-hoc basis as per the directions of the Honble High Court of Andhra Pradesh indicated above.

    3. Certain employees of Operation circle, Nalgonda have filed W.P.No.3228/98 for quoshing theclarifications issued in the memo 4th cited and the Honble High Court of Andhra Pradesh quashed the said

    Memo.vide Judgement dt.23.2.99 on the following grounds.

    i. Memo 4 th cited was not issued in exercise of the powers conferred under Sec,79 of the Electricity(supply) Act. 1948

    ii. B.P.Ms.No.99, dt.29.198 cannot be amended or altered or clarified by an ordinary Memo i.e, Memo4th cited.,

After careful examination of the issue having regard to the judgement dt.23.2.99 passed by theHonble High Court of Andhra Pradesh in W.P.No.3228/99, and in exercise of the powers conferred underSection 79 of the Electricity (supply) Act.1948, the following instructions are issued on ad-hoc basis as perthe directions passed by the Honble High Court of AP on 31.12.98 in WP NOS.16618, 21955, 27109, 29984,31843 of 97 and 97, 305, 1689 & 5916 of 98 pending finalization of the said for the purpose of implementation

    i) The BCs appointed after 11.7.74 converted as R.Cs and figuring in the integrated seniority list ofLDCs and UDCs available as on 1.5.82 do not require to possess the graduation qualification forpromotion as UDCs. They should however, have to pass the Pre-requisite departmental testsfor Promotion as UDCs.

    ii) Non-graduate LDCs appointed prior to 11.7.74 and have passed Pre-requisite departmentaltests are eligible for promotion as UDCs.

    iii) The Candidates who are in service as on 11.7.74 and appointed by transfer as LDCs after11.7.74 need not have the qualification of graduation for promotion as UDCs.

    iv) The passing of Pre-requisite departmental tests is compulsory for promotion as UDCs in re

    spect of all these cases subject to regulating the cases of un-qualified employees in accordance with BPMs.No.263, dt.11.1.99

    v) Any promotions made to the category of U.D.Cs. from 11.1.99 to the date of issue of theseorders shall be reviewed and regulated as per the above instructions.

    5. The Chief Engineers/Superintending Engineers of TRANSCO and GENCO are requested to followthe instructions scrupulously.

    ORDER:

    The note (2) under Regulation 6(b) of APSEB SRs Part-III as adopted inter alia. Stipulates as follows.

    AAEs who acquire while in service the qualification of B.E./B.TECH/AMIE (India) shall be entitled to be reckoned as Assistant Engineers from the date of acquisition of the requisite qualification and count 50% of their regular service rendered as Addl. Asst. Engineer prior to the dateof conversion as Asst. Engineer subject to a maximum limit of 4 (four) years, as if such servicehad been rendered in the post of Assistant Engineer for the purpose of fixation of seniority list ofAssistant and Engineers at the appropriate place based on the length of service and date arrivedat on the principle set out above subject to the following conditions.

    (2) It is noticed that Sub-over seer, Asst. Section Officers and Sub-Engineers appointed by transfer as

    Addl.Asst. engineers are being converted as Assistant Engineers with effect from the same date of theirjoining as Addl.Asst. Engineers if they have acquired B.E./B.Tech./AMIE (India)qualification prior to that date.Their Inter-se-seniority in the cadre of Assistant Engineer is also being fixed taking the same date of joining asAddl.Asst.Engineer. It is adopted based on approved precedents since a long time.

    3) Representatives have been received contesting the above procedure of conversion and fixation ofinter-se-seniority of these Addl.Asst.Engineers in the category of ASSt. Engineers on the plea that a Sub-Overseer/Asst. Section Officer/Sub-Engineer being appointed as Addl. Asst. Engineer on completion of therequired experience on a particular date is also getting conversion as Asst. Engineer on the same date if hehas acquired B.E./B.Tech./AMIE (India) prior to the date of appointment as Addl.Asst. Engineer. It wastherefore requested to re-examine the entire issue and cause necessary orders setting right the procedure toregulate such cases as per existing Regulations

    After careful consideration the APTRANSCO appoints the following committee to study all aspects of theabove issue in detail and give its recommendations.
