LETTER TO SUPPLEMENT HEARING MEMORANDUMIN OPPOSITION TO TRIAL MEMORANDUM OF
SQUIRE, SANDERS & DEMPSEYAT EVIDENTIARY HEARING BEFORE
SPECIAL BOARD ON DISQUALIFICATION
At the hearing before the Licensing Board on February 2,1976,,
the City was requested to address a portion of its Hearing Memorandum to the
question of the Licensing Board's jurisdiction over the conduct of attorneys !
appearing before it. .
| The City's Hearing Memorandum, Section V, addressed that question
by reference to the Commission's Rules of Practice and Federal case law, as ati
!the time there did not appear to be any Nuclear Regulatory Commission precedents
directly on point. l

The City would respectfully submit to the Licensing Board two decisions )l

from the Appeal Board that recently came to its attention.

The Appeal Board in Northern Indiana Public Service Company, ALAB-
204, RAI-74-5, page 835, makes it quite clear that the ABA Code of Professional
Responsibility is applicable to proceedings before the Commission.
Also of interest is the Appeals Board's decision in Louisiana Power &
Light Company, ALAB-121, RAI-73-5, page 319, in which the Appeal Board sua
sponte struck a brief filed by the would-be intervenor because it contained insulting
references to the Licensing Board chairman. The Appeal Board noted that attorneys
practicing before the Commission "are under an express mandate to conform to the
standards of conductrespdredin the-zzamrss d.the Umted States" . Louisiana Power,.
supra, at 319.
These two Board decisions reinforce the City's contention that the
conduct of an attorney before the Licensing Board is identical with that of an attorney
practicing before the Federal Courts. Since the Federal Court would consider the
matters raised by the City, to wit, the disqualification of an attorney from appearing
on behalf of a party because of a conflict of interest, it follows that the Licensing
Board must also consider the matter.
