Modern Awards – what does it mean for super?You may be aware that, as part of its industrial relations reforms, the Federal Government has requested that the Australian Industrial Relations Commission establish a set of Modern Awards (approximately 150) to replace thousands of existing awards. The Modern Awards will take effect from 1 January 2010.

As well as covering wages and conditions of employment, the Modern Awards specify a selected range of superannuation funds, one of which the employer must use as its default superannuation fund if its workers are covered by a Modern Award. A default fund established after 12 September 2008 will not comply with the Modern Award specifications, unless the former super fund you used ceased to exist and the new fund was established by successor fund transfer.

The Modern Awards also require that any voluntary member contributions which you remit for employees who are covered by a Modern Award be paid within 28 days of the end of the month in which the deduction from the employee’s after-tax wages was authorised.

ING Australia has taken a strong interest in the Australian Industrial Relations Commission’s (AIRC) processes around the setting of default fund arrangements in Modern Awards. In particular, we’ve tried to influence the process so that the new superannuation provisions of the Modern Awards make life as easy as possible for employers with workers on Modern Awards.

Cooper Review of Australia’s superannuation system – an opportunity for improvement for employers?The Federal Government’s long awaited review of the superannuation system has commenced with the Chair of the Review, former ASIC Deputy Chair Jeremy Cooper, announcing a three phased approach to the review of the system. Phase one is underway and will consider issues of superannuation fund governance. Phase two which commenced in October 2009 will consider issues of operation and efficiency, and the third phase – on superannuation fund structure – commences on 14 December.

ING Australia will be using phase two of the review, along with the government’s consideration of a superannuation clearing house, to suggest ways of streamlining employers’ contributions to superannuation funds on behalf of their employees. We will also be submitting that default funds nominated in Modern Awards should be the subject of a rigorous selection process so that employers and employees can reasonably expect their fund to perform for them.

ING Australia has already completed its phase one submission which can be accessed at www.supersystemreview.gov.au > content > submissions, should you or any of your employees be interested.

Intra fund adviceASIC has recently granted relief to trustees, enabling them to provide limited-scope advice where the advice is sought by superannuation members on switching investment funds within the fund.

ING Australia already provides factual information and some limited general advice to customers. We are working through the detail of the ASIC relief to understand what it means for ING Australia and our customers.

We are constantly exploring ways and implementing measures to relieve the need for employers to have to address the superannuation concerns of their employees.

What’s happening in Canberra A regulatory snapshot

Modern AwardsAre your default super fund arrangements affected?As your employer super plan was established with ANZ Super Advantage prior to 12 September 2008, it is not impacted by the Modern Award super requirements and you may continue to make Superannuation Guarantee (SG) contributions for all of your current and future employees.

In other words, you do not need to do anything.ANZ Super Advantage will continue to provide you with a flexible super solution to suit the needs of you and your employees. By keeping your default super plan with ANZ Super Advantage, you and your employees will continue to have access to:

• a highly rated super solution

• a wide range of investment funds

• comprehensive insurance options

• competitive fees

• online education and transaction services

Super update

There have been a number of regulatory changes to super in 2009. These are important changes for both you and your employees to be aware of, as they may impact an individual’s retirement savings. Some of the key changes are outlined below.

Superannuation Guarantee Ordinary Time EarningsThe definition of what constitutes Ordinary Time Earnings (OTE) has undergone a number of revisions in recent times. OTE are used to calculate the amount of SG contributions to be made to your employees’ accounts.

Key clarifications include:

• Overtime is not included in OTE

• Parental leave is not currently included in OTE (review to be completed in 2013).

It is important that you are up-to-date with the correct OTE definition to ensure you are meeting your employer super obligations and avoiding penalties.

OTE can include bonuses, provided they are not solely related to working overtime, but does not include items such as leave payments paid as a lump sum upon termination of employment, payments relating to overtime, redundancy payments, jury duty and maternity or paternity leave.

Reportable Employer Super ContributionsFrom 1 July 2009, employers are required to track and report the ’Reportable Employer Superannuation Contributions’ (RESC) they make for an employee. RESC include all employer contributions made for the employee for which the employee had the ability to influence the amount. These include salary sacrifice contributions but not SG contributions.

RESC are required to be reported in your payment summary reporting.

RESC are included as income when calculating an individual’s eligibility for certain government payments and programs including the government co-contribution, income support payments, family assistance, child support and certain tax offsets.

Delayed super co-contribution payments for 2008/09Due to system problems within the Australian Taxation Office (ATO), some super co-contributions were not paid to super funds before the end of the 2008/09 financial year.

The bulk of the backlog has been cleared.

Those affected will receive co-contribution credit interest on any payment that has been delayed, at the rate specified by the Reserve Bank of Australia. This interest will be paid as an additional co-contribution to their super fund.

A note from Customer ServicesContribution tips for members aged 65 or over It’s important to make sure you’re aware of how your employer super obligations change when an employee turns 65. Please ensure any contributions you make to ANZ Super Advantage follow the rules outlined below.

Aged at least 65 but under 70 Contributions can be made by you, your employee and their spouse provided that the member has met the ’Work Test’. If the employee has not met the ‘Work Test’ for that financial year, then a contribution can only be accepted if it is a mandated employer contribution*.

Aged at least 70 but under 75 Contributions can be made by you and your employee provided that the member has met the ’Work Test’.

After an employee turns 70, you are not mandated to make SG contributions (one kind of ‘mandated employer contribution’), but may do so if the payment relates to a period when the employee was under age 70. Contributions need to be received within 28 days of the end of the month in which the employee turns 75.

If the employee has not met the ‘Work Test’ for that financial year, then a contribution can only be accepted if it is a mandated employer contribution*.

Aged 75 and over If an employee is 75 years of age and over, only mandated employer contributions* can be made, unless the contribution is made within 28 days of the end of the month in which the employee turned 75.

The Work TestThe ‘Work Test’ means the employee has been gainfully employed (employed or self-employed for gain or reward in any business, trade profession, vocation, calling, occupation or employment) for at least 40 hours during any 30 consecutive day period in that financial year. * A ‘mandated employer contribution’ is one made by, or on behalf of, an employee which:

– reduces the employer’s potential liability for the Superannuation Guarantee Charge – is a payment of a shortfall component – is a contribution to satisfy the employer’s obligation under an agreement certified, or an award

made, on or after 1 July 1986 by an industrial authority.

What’s new?Enhancements to benefit you and your employeesANZ Super Advantage enjoys excellent ratings from independent research houses. This is a testament to our commitment to provide you and your employees with a market-leading super solution.

During the course of 2009, a number of enhancements have been made to ANZ Super Advantage:

• Four new investment funds for members to choose from, were added in late April 2009

• New insurance arrangements and improved terms and conditions have been available to members since January 2009, including:

– higher amounts of maximum cover:

• unlimited amount of Death Cover

• Total and Permanent Disablement (TPD) Cover up to $3 million

• Group Salary Continuance (GSC) Cover of up to $25,000 per month

– superior TPD definitions

– TPD Continuation Option

– reduction in minimum working hours requirement in order to qualify for GSC cover.

And, depending upon your plan’s insurer, some members may have experienced premium rate reductions since April 2009. This would have been evident from this year’s Annual Statement.
