1 INTRODUCTION

1.1 Background

Society and natural environment are two components of nature. The interaction between these

two components existed since the human species appeared in this planet. In the past as well as in

the present due to the degradation, deforestation and fragmentation of forest blocks many

wildlife species have lost their natural habitats and are in the verge of extinction.

Illegal wildlife trade is one of the threats for the survival of endangered species; especially the

trade of flagship species products is in ever-increasing trend. In recent years, the increased value

and demand of wildlife derivatives for traditional medicines and fashion accessories have

significantly contributed wildlife poaching and illegal trade throughout the world.

Multiple stratum and network of poachers, middleman, domestic and international traders are

supporting the illegal wildlife trade syndicate and have expanded at national, regional and

international levels. The intermittent confiscation of wildlife derivatives such as rhino horn,

tiger-otter-leopard skin, bones, musk pods and other trophies by the police and forestry

professional have proved that the illegal network is constantly active in wildlife trade and

trafficking in Nepal. So it is a huge challenge for the conservation stakeholders to control illegal

trade of endangered and protected flora, fauna and their parts.

Wildlife Conservation Nepal (WCN) is one among the many stakeholders working in the field of

protection and conservation of endangered species. It is the only organization monitoring illegal

wildlife trade ever since its establishment. It is established with a view to protect and conserve

natural heritage and disseminate information on environment and wildlife issues. It conducts

field level activities to safeguard wildlife species in their natural habitat. It designs and conducts

researches, trainings and workshops and enhances capacity of enforcement officials in combating

wildlife trade. And moreover, it provides leadership trainings to young individuals and students

so that wildlife is protected in their natural habitat.

This study is about illegal wildlife trade which is one of the major areas that WCN works.

1.2 Objectives of the study

The general objective of the study the environmental justice of different wildlife crime cases

registered in the different judicial bodies of Kathmandu Valley. The specific objectives of this

study are to:

Enumerate the wildlife crime cases recorded in different judicial bodies of Kathmandu

Valley.

Differentiate the wildlife crime cases registered.

List out the total seizures.

Involvement of different ethnic group in wildlife crime.

Analyze the time taken for decision making.

Analyze the judicial decision making on the wildlife crime.

Study the total contribution of WCN in illegal wildlife trade control.

1.3 Scope of the Study

The study has focused on the study of wildlife crime cases recorded in different judicial

organizations of the Kathmandu valley oversees the conservation related; works, issues, crimes

and judgment. The study includes 3 district forest offices and 2 courts located within the valley.

They are Kathmandu district forest office, Bhaktapur district forest office, Lalitpur district forest

office, Supreme Court and Appellate court.

1.4 Limitation of the Study

The major limitation of the study is inaccessibility in data collection in information centers. So

the study was confined to 5 years.

2 MATERIALS AND METHODOLOGY

2.1 Study Area

Kathmandu valley is the capital city of Nepal. It is the nation’s main business center and

largest market. People of different economic status reside in the Kathmandu. So people are

indulged in various activities for the livelihood. Every product that is produced within or out

of nation comes over this area. Wildlife trade is one among different types of trade that runs

over the valley. Though it is one of the least concern trades in the nation but it costs a lot and

carries huge amount of money. Different types of wildlife parts or organs are used in trade to

earn money and the trade goes within the valley. Killing or poaching of wildlife occurred

over the whole nation finally ends at Kathmandu valley. This is the biggest spot where

wildlife related trade occurs.

2.2 Data Collection

Data relevant to the objective of the study were collected from different judicial authorities.

The collected data were compiled and analyzed.

Data were filled in the Microsoft excel 2007.

3 RESULTS AND DISCUSSION

The numbers of wildlife crime cases registered in last five years i.e. from beginning of year 2063

B.S to the end of 2068 B.S at different organizations trademarked as the watchdog of the

conservation of nature and wildlife of Kathmandu valley varied highly. Altogether, 98 wildlife

related crime cases were collected from 5 different judicial information centers. The highest

cases; 43 cases out of total were recorded at Kathmandu district forest office and the least (5)

cases were recorded at the Appellate court. Figure 1 given below shows cases recorded in 5

different judicial information centers.

3.1 Specific Wildlife Cases

In total of 98 wildlife cases collected from information centers, it is further differentiated to

specific wildlife species as few recorded crime cases deals with two different species. A total of

102 cases were found after differentiation of total wildlife crime cases to species wise wildlife

crime cases; of which Rhinoceros cases was found as the highest and it is followed by Leopard

cases. Among the 102 specific species wise wildlife cases, 36 cases recorded were of Rhinoceros

and 18 cases were précised to Leopard. Within the 36 cases related Rhinoceros, 4 cases are of

illegal trade of duplicate Rhino horn. 8 cases recorded were related to different species of Deer

like Musk Deer and Barking Deer. 5 cases recorded were of illegal trade on different body parts

of charismatic species Tiger. 10 cases recorded 5 on each deals with trade of Red Panda and

Pangolin. Total of 5 cases were of birds that include illegal trade of birds like Kalij Phasant,

Peafowl and Owl. Crime related to an Owl was found to be higher among the total cases

recorded on birds. Similarly, 8 cases were found related to medicinal herbs. Of which case on the

illegal trade of Yarshagumba was found higher. There are 4 cases recorded on collection and

illegal trade of orchids. The species wise wildlife cases are presented in figure 2 below. Detailed

species wise wildlife cases are given in the appendix.

3.2 Total Arrestees

In total of 98 wildlife crime cases, 210 persons were found indulged in the wildlife trade. 202

among the total persons indulged in the wildlife trade were captured and were taken legal action

as per rule specified in “National park and Wildlife Conservation Act- 2029”. And remaining 8

persons were unable to capture and take in charge. Detailed information on those absconded

persons was unknown. The figure 3 below represents the percentage of captured and absconded

people indulged in wildlife trade.

3.3 Involvement of Ethnic groups in Wildlife Crime

In total of 210 persons indulged in the illegal wildlife trade in 98 different cases, majority of

people were found to be of Indigenous background. 125 persons among the total of 210 people

recorded as a wildlife criminals were indigenous people. This accounts 60 percent of the total

people involved in the wildlife crime. Persons of Brahmin and Chhetri as an ethnic identity

involved in wildlife crime were found to be 4 times lower in comparison to people of indigenous

background involved in illegal wildlife trade. 16 percent of people listed as wildlife criminals are

of this ethnicity. The reason behind the higher involvement of indigenous people in wildlife

crime might be because of their settlement nearby the protected areas; these people are highly

marginalized, uneducated and unemployed which cause the involvement in illegal wildlife trade

as best alternative job to earn and sustain life. 21 percent of people found to be involved are

unidentified due to privacy of information centers which denied collecting detailed information.

3 percent of total people involved in wildlife crime were foreigners. Most foreign illegal wildlife

traders were Chinese and some were of Czech Republic. The figure 3 below represents the

involvement of ethnic groups involved in wildlife crime with their percentage.

3.4 Seizures

Among the total of 98 wildlife crime cases studied, the quantity of the seizures enlisted in the

table below is the minimal number of seizures recorded. Seizures specification and quantity

ought to be more and higher than the listed in table because all the cases that were recorded in

the different information centers are not stated completely. Most of cases recorded had not

mentioned the seizure type and quantity. Different wildlife trophies that were seized are shown

in the Table 1.

3.5 Wildlife Crime Cases Contributed through WCN Intelligence

In total of 98 wildlife cases collected from information centers, 13 cases were contributed

through WCN Intelligence and among 210 persons recorded involved in the illegal wildlife trade

41 persons were captured with help of WCN intelligence that counts 12 percent contribution in

total wildlife crime and 20 percent contribution in capturing the convicted persons. The seizures

and its percentage contributed in specific seizures are given in table 2 below.

3.6 Time Taken and Change in Decision Making

Time taken for the decision making varied highly. Decision for some convicted crime cases were

made in few days of capture while in some cases it took years. Among the 98 wildlife cases

collected from information centers, 40 percent of cases were found to judged and convicted

person/s were charged as per specified in the rules and regulation while 52 percent of wildlife

crime cases are in process of decision to charge the convicted persons. Decisions of 8 percent

among 98 recorded crime cases were unavailable and exact judgments made were unknown.

Judgment status of the recorded wildlife crime case was shown in figure 5 below.

There are 52 wildlife crime cases which in process for decision making. Among the 52 pending

cases, 19 cases are in process of judgment in Kathmandu District Forest Office and 30 cases are

from the Supreme Court. Supreme Court is the ultimate judicial authority of every nation where

people discontent in initial judgment reapplied for the best judgment. Among the total 30 cases

reapplied at Supreme Court, 29 cases were of illegal trade of Rhinoceros and 1 case was of Musk

Deer. All Cases dealing with the Rhinoceros were from Chitwan National Park (CNP) and 1 case

dealing with Musk Deer was from Annapurna Conservation Area which was applied at their

respective Appellate Courts in Hetauda or Pokhara for better judgment. In total of 30 cases

recorded at Supreme Court, judgments of 17 cases were found to be agreed upon judgment made

by the initial judicial authority i.e. CNP or ACAP whereas in rest 13 cases respective Appellate

Courts had given the new judgment. Some selected cases with judgment made different judicial

bodies are present as case studies below.

4 CONCLUSIONS

Illegal wildlife trade is one of the threats for the survival of endangered species. Increased value

and demand of wildlife derivatives for traditional medicines and fashion accessories have

significantly contributed wildlife poaching and illegal trade on enormous amount. Altogether 98

wildlife crime cases were found to be recorded in last 5 years from date 2063 B.S to 2068 B.S at

five different judicial organizations of Kathmandu Valley. The data collected was filled in MS

Excel 2010 for the analysis. Among total cases studied the highest-43 cases were recorded at

Kathmandu district forest office and the least 5 cases recorded at the Appellate Court. A total of

102 cases were found after differentiation of total wildlife crime cases to species wise crime

cases; of which the highest-36 recorded were Rhinoceros cases followed by 18 Leopard cases

and the least-2 recorded were Elephant Cases. 210 persons were found involved in total 98

studied wildlife crime cases, of which 60 percent were indigenous people, 16 percent were of

Brahmin and Chhetri ethnic background, 3 percent were foreigners and rest 21 percent were

unidentified. Different body parts of wildlife used in the illegal trade were seized. Among the

seizures, skins of fauna like Leopard, Tiger, and Red Panda were seized in higher numbers and

some fauna like Pangolin, Barking Deer and Owl were seized in living condition which later on

were submitted to Central Zoo. A total of 13 cases among the total 98 cases studied were

contributed through WCN Intelligence and contributed 12 percent in total arrestees (45 of 210

persons). More than half i.e. 52 percent of the total wildlife crime cases studied is in process of

decision making, 40 percent of wildlife crime cases had been judged and the decision of the

remaining 8 percent of enlisted wildlife crime cases were not available.
