I am an attomey with the Farm-to-Consumer Legal Defense Fund (FTCLDF), a nationalmembership nonprofit whose mission is to protect the rights of farmers and consumers to engage indirect commerce. FTCLDF has many New York members including Liberty farmer Sean ZigmundZoning and right-to-farm matters are of great importance to our members and we have litigated anumber of cases on these issues.
I am writing on behalfofour organization to express our concern about proposed changes to theTown of Libe(y zoning code. A number of the proposed changes contravene New YorkAgriculture and Markets laws; the proposed changes will make it more difficult for farmers to eama living in Liberty.
A stated goal ofthe proposed changes is to preserve the rural character ofthe town but if the zoningamendments are implemented it appears that just the opposite will happen. The proposal calls forrezoning 45 parcels within the town from AC and RD to R- I . The proposed rezoning will affect653.53 acres ofland, of which 404.35 are located within a county adopted, state certifiedagricultural district. Farm operations are not a permitted use within the R-l zone; the rezoning willdecrease the amount ofland in the town under agricultural use and lose farmland to commercialdevelopment.
The requirements for a special use permit (SUP) outlined in the proposed amendments to the zoningcode are a major concem. The SUP requirements are onerous, time-consuming and expensive forthose farms applying for the permit. Further, for activities protected under state law such as U-picks, CSAs and roadside stands, the SUP requirement is unreasonably restrictive and is in violationof state law because there is no demonstrative threat to the public health and safety with regard toany of these activities.

There is no need for these activities to be subject to the special use permit requirement; within the
past couple years the state of Virginia has passed legislation prohibitins any locality from requiringa permit on agriculturally zoned land for agri-tourism activities, the sale of agricultural products
"incidental to the farm operation", or other activities and events that are usual and customary at
Virginia agricultural operations unless there is a substantial impact on the public health and welfare.
The law has worked well since it went into effect in that state.
Activities not necessarily protected und Agriculture and Markets law such as farm stores and agri-
tourism activities should be given similar treatment as well. A good definition for the town to adopt
for agri-tourism would be one currently in Virginia statute that reads, "any activity carried out on a
farm or ranch that allows members ofthe general public, for recreational, entertainment oreducational purposes, to view or enjoy rural activities, including farming, wineries, ranching,
historic, cultural, harvest-your-own activities, or natural activities and attractions. An activity is an
activity whether or not the participant paid to participate in the activity."
The town zoning code should promote agricultural activity and community self-sufficiency in food
production. Through the rezoning proposals, the requirements for special use permits and site
plans, the town is taking land out ofplay that incurs the least net expense for the taxpayer and is
failing to adopt regulations suited for the stated goal ofpreserving rural character ofthe area.
Small-scale larming is the bedrock of the community; the town supervisors can take more effective
measures to promote and protect this activity.
We agree with the comments the New York Department of Ag & Markets made on the proposed
zoning changes and believe that the suggestions ofAg & Markets provide a path forward towards
creating an environment of cooperation among stakeholders that will benefit both agriculture and
the Town of Liberty.

The Board met with Rob Werlau to discuss the job done by his company repairing the curbs and stairs outside of TownHall. Mr. Werlau answered all questions that the Board had. He agreed to take off $1,500 off the bill due to the stairsbeing unrepairable. The Board accepted his offer and agreed to pay $16,740.00.
