1. Having examined the tender documents contained thereby relating to the words specified in. The

memorandum herein after set out and having visited the examined the source of works specified in the said

memorandum and having acquired the requisite information relating thereto affecting the tender. I / We

hereby offer to execute the works specified in the said memorandum at the rates mentioned in the bill of

quantities hereto and in accordance with all respects of specifications, and instructions in writing referred to

in the tender notice, General Conditions of contract, Schedule of quantities in all other respects accordance

with such conditions so far as they may be applicable.

MEMORANDUM

NOTICE INVITING TENDER

1. Sealed item rate tender for ‘’ ELECTRICAL WORKS FOR NEWLY PROPOSED S.B.I.RACPC AT

YALAHANKA NEW TOWN AT PRESTIGE TOWER , OUTER RING ROAD YALAHANAKA BANAGLORE ‘’

2. Tenderer is advised to go through all the documents in connection with this contract carefully.

3. Tenderer shall deposit the sealed tender in the Office of The Chief Manger [GB] State Bank Of India

Administrative Office Zone –I Bull Temple Road Bangalore - 4 Tenderer shall deposit the sealed envelopes

separately containing the following

PART ‘B’

1. Schedule of quantities duly filled in figures and words and signed on each page with seal and date tenders

will be received up to 2P.M. On 05.06.2017 and shall be opened on the same day @ 3.30PM at the

Administrative office Zone -I STATE BANK OF INDIA, Bangalore-4. Tenders received after fixed time

and date due to postal delay will not be considered.

2. Earnest Money Deposit (EMD) Rs. 17,500/- (Rupees Seventeen Thousand Five Hundred only) as Demand draft drawn in favour of State Bank of India, payable at Bangaluru.

3. Tenders not properly filled, mutilated with incorrect calculations or generally not complying with

conditions will be rejected.

4. Tenderer should quote their rates both in figures and in words. The Schedule of quantities must be fully

priced with rates quoted for both unit rate specification and the total of each page along with carried

over figures of previous page shall be given in ink and signed by the Tenderer. No blank space shall be

left. Figures in words shall be deemed to be final figures, in case of cuttings or over writings. However, it

is essential that the contractor should ensure that he has signed on all pages of the tender document.

5. PERIOD OF VALIDITY

The tender shall remain valid for acceptance of a period of 90 days from the date of submission of tenders.

If any Tenderer with draw his tender before the said period or make any modifications in the terms and

conditions of the tender, then the employer has the liberty to disqualify the Tenderer

Every Tenderer is expected to inspect the site of the proposed work and acquaint him with site conditions,

approaches, availability of the raw materials, geological and weather conditions etc. before quoting his rates.

He must go through all the specifications, and other tender documents. Any further clarifications in the

documents can be had from this Office at the above mentioned address.

6. QUANTUM OF WORK

A schedule of probable quantities in respect of each work and specifications accompany these conditions.

The schedule of probable quantities is liable to alterations, omissions or additions at the discretion of the

Bank. The schedule of the probable quantities may vary considerably on the higher or lower side.

7. ALL INCLUSIVE RATES

Quoted Rate shall include the cost of transportation of material to the site, all taxes such as sales tax, excise

duty, octroi, works contract and any other statutory levy, (GST, if any)etc. and fixing or placing in position

for which the item of work is intended to be operated. The rates quoted by the contractor shall be firm

throughout the contract period and there shall be no upward revision of the rates. It should be clearly

understood that any claims for extra ,sales tax, excise duty, octroi, works contract and any other statutory

levy (GST, if any), etc shall not be entertained in any case whatsoever once tenders are opened.

11. INTERPRETING SPECIFICATIONS

In interpreting specifications, the following order of decreasing importance shall be followed:

1. Schedule of quantities with detail specifications

2. Unit rate specifications and technical specifications

3. General Specifications

Matters not covered by the specifications given in the contract, as a whole shall be covered by the relevant

Indian standard codes. If such a Codes on a particular subject have not been framed, the decision of the Bank

Engineer shall be final.

12. The acceptance of the tender shall rest with the authorized representative of the employer, who does not

bind himself to accept the lowest tender and reserves to himself the authority to reject any or all the tenders

received without assigning any reasons, whatsoever.

13. The work shall be carried out under the direction and supervision of the Bank Engineer or their

representative at site. On acceptance of the tender, the contractor shall intimate the name of his accredited

representative who would be supervising the work and would be responsible for taking instructions for carrying

out the work.

14. Bank Engineer decision with regard to the quality of material and workmanship will be final and binding,

any material rejected by the Bank Engineer shall be immediately removed from the site by the

Contractor.

15. SUB-LETTING

No part of the contract shall be sublet without the written permission of the employer nor shall transfers be

made by the power of attorney authorizing others to carry out the work or receive payment on behalf of the

renderer.

16. DEFECTS LIABILITY PERIOD

Any defect developed within the defect liability period of 6 months will have to be rectified by the agency at

their own cost and in case and the defects are not rectified by the contractor, employer or their

representative shall get the work done at the risk and cost of the contractor.

17. CERTIFICATE OF VIRTUAL COMPLETION

The work shall not be considered as completed until the Bank has issued in writing “certificate of virtual

completion” stating that the work has been completed and defects liability period shall commence from such

certified date of virtual completion.

18. DELAYS IN COMMENCEMENT

The contractor shall not be entitled to any compensation for any loss suffered by him on account of delays in

commencing or executing the work, whatever the cause for such delays may be including delays in procuring

government controlled or other materials.

19. The contractor should inspect the source of material, their quality, quantity, and availability. The

material must strictly comply with the relevant specifications attached.

20. PERIOD OF COMPLETION

Time is deemed to be the essence of the contract; the completion period shall be twenty days. The contractor

shall draw a detailed schedule of program in the form of BAR/PERT CHART of whole work, within two weeks of

the award of the work and submit to the Bank for its approval.

21. CONTRACTORS STORE

Suitable area near the site of work shall be allowed to the contractor free of cost for storing his tools and

plants, materials and for his site office. The contractor shall remove all temporary constructions constructed

by him at site for the purpose of completing the work after the work is over

22. MEASUREMENT AND BILLING

Whenever mode of measurement is specified, measurement will be taken at site as per the latest IS code of

practice for measurement.

The contractor or his representative shall accompany the employer or their representative in taking/checking

Measurements. All necessary tapes and shall be supplied by the Contractor. The Contractor shall then

present his bill based on the agreed and recorded measurements and if the contractor fails to accompany the

employer for measurement, then he shall be bound by the Measurement s taken by the Bank Engineer

Contractor shall raise first and final bill or for minimum payment of a Running Bill

Payment towards all interim bills will be made by the employer within the time limit specified in the summary,

form of the tender

Period of final measurement shall be 30 days from the date of completion of the project.

23. WATER AND ELECTRICITY

The employer will make water supply and electricity to the site at one convenient point available. The

contractor should make his own arrangements in case of supplementary supply points are required for both

water and electricity. The consumption charges shall be borne by the contractor.

24. INSURANCE

The successful contractor shall take out the contractor’s all risk insurance policy, jointly in the name of the

employer and the contractor and the original policy shall be deposited with the employer. The insurance policy

shall be obtained within 14 days of date of commencement of the work.

25. STATUTORY REGULATION

The whole work is to be complied with as per the requirements and by laws of relevant statutory authorities,

including contract labor (Regulation and Abolition) act 1970.
