1. PURPOSE

The purpose of this procedure is to describe the requirements and to effectively manage the hazards and risks associated with the effects of alcohol at the Vulcan Mine.

This procedure has been developed to ensure compliance with the following section of the CMSHR:

• s41 ‘safety and health management system for alcohol’.

2. SCOPE

This procedure is applicable to all persons at the Vulcan Mine including employees, contractors and visitors. The controls within this procedure are mandatory.

3. DEFINITIONS

Authorised Person A person who has the required competencies and who has been appointed by the Site Senior Executive to carry out a designated scope of duties.

BAC Breath Alcohol Concentration.

CMSHA Queensland Coal Mining Safety and Health Act (1999).

CMSHR Queensland Coal Mining Safety and Health Regulation (2017).

CMW Coal Mine Worker.

Competent Person A person who has, through a combination of training, education and experience, acquired knowledge and skills enabling that person to perform correctly a specified task.

DNRME Department of Natural Resources, Mines and Energy.

Fit for Duty A condition in which an employee’s physical, physiological and psychological state enables them to continuously perform assigned tasks safely.

IMS Integrated Management System.

JHA Job Hazard Analysis.

SHMS Safety and Health Management System.

SOP Standard Operating Procedure.

4. PROCEDURE

4.1. Mandatory Requirements

The core mandatory requirements and expectations of Vulcan Mine are that all workers (including internal employees, contractors and visitors) will follow the SHMS as it applies when working. Should a system gap be identified, a Supervisor must be notified immediately, and a risk assessment conducted before the work can continue.

Further mandatory requirements identified include the following:

• all workers will comply with CMSHA s. 39 Obligations of persons generally; • all workers shall be trained, competent and authorised to be on site and to carry out those tasks

specific to their role; • all workers must present themselves in a state fit for duty and unaffected by drugs, alcohol, fatigue

and other physical or psychological impairment; • all workers will conduct a personal risk assessment (i.e. Take 5) prior to undertaking tasks and in

the event of a change to the conditions, process or environment; • there are risk assessments (JHAs) in place under which tasks are being carried out. These risk

assessments may indicate controls that go above and beyond the legislative or SHMS requirements and must be followed;

• errant behaviours are prevented through compliance to the training scheme, and managed appropriately through supervision and site discipline procedures;

• at any stage should a worker feel unsafe or at risk when undertaking a task, they are to stop work, make the area safe (if necessary and possible) and immediately report this to their Supervisor; and

• if a worker sights another worker undertaking a task, which they feel is unsafe or at risk, that work may be stopped, and a Supervisor immediately notified.

4.2. Shared Responsibility

The Vulcan Mine and its workers have a shared responsibility for the management of alcohol:

• Vulcan Mine will ensure alcohol education is provided to employees and suitable alcohol testing arrangements are provided;

• all individuals have a duty of care to actively manage their fitness for work including alcohol consumption;

• if an individual reports to work and is not fit for duty, it is their responsibility to notify their Supervisor; and

• if an individual does not notify their Supervisor that they are unfit for work, the supervisor shall interpret this as the individual being fit for work.

4.3. Education and Training

All CMWs and visitors shall be made aware of the alcohol requirements of the Vulcan Mine as part of the site induction.

4.4. Consumption of Alcohol

The consumption of alcohol is prohibited at the Vulcan Mine other than in circumstances as defined in Section 39 of the Coal Mining Safety and Health Regulation.

4.5. Alcohol Testing

Personnel whose fitness for duty may be impaired by the use or misuse of alcohol can pose a risk to themselves and other personnel.

Alcohol testing will be conducted under the following circumstances:

• during the pre-employment recruitment process; • voluntary self-testing; • daily at prestart; • post incident; and • on-suspicion (challenge testing).

Mandatory Testing

A breath alcohol test shall be conducted as part of the pre-employment assessment for all employees. Prior to commencing work each shift at the Vulcan Mine, all workers shall achieve a negative breath test reading.

Post-incident Testing

Any individual involved in an incident shall undergo alcohol testing.

Challenge Testing (Suspicion)

When the Supervisor’s observations identify a person’s behaviour or appearance is not consistent with Fit for Duty attributes and may compromise or threaten the safety or health of themselves or others, the person will be required to undergo alcohol testing.

Any person suspecting another person is not fit for duty, should communicate their suspicions to their immediate Supervisor.

Refusal to undergo an Alcohol Test

A person who refuses to undergo an alcohol test will be treated in the same manner as a person returning a positive result.

Tampering with an Alcohol Test

Any attempt to tamper with a sample or falsify an alcohol test will be regarded as serious misconduct and will be treated in the same manner as a person returning a positive result.

4.6. Managing personnel who are Unfit for Work

General Guidelines

If a Manager or Supervisor considers a person unfit for work for any reason:

• the person must be immediately removed from the workplace and prohibited from driving a vehicle or operating any machinery. The worker shall be transported back to their place of residence;

• if there is an immediate danger due to the individual’s state (e.g. drug overdose or potential for suicide), the Manager or Supervisor must take appropriate action such as contacting the police and/or appropriate medical assistance; and

• a person must not participate in the return-to-work process until they can demonstrate that they are fit for duty. Fitness for duty will be demonstrated by presenting a negative test result on their following rostered shift.

Positive Alcohol Samples

No person may work at the site if they are affected by alcohol. The BAC for site is 0.007%.

Any person returning a positive alcohol test will be subject to a secondary test within 20 minutes of the initial test.

Any circumstance where a person returns a positive secondary test shall be treated as an incident.

4.7. Employee Assistance Program (EAP)

An Employee Assistance Program is in place for employees and their immediate family offering independent and professional services for those requiring further education or personal assistance in the areas of fitness for duty.

Where an employee has been identified with a potential fitness for duty issue, their Supervisor shall make the employee aware of the assistance that can be provided by the program.

4.8. Confidentiality

Documents and information obtained as a result of the application of this procedure will be kept confidential and only be utilised for the purpose of determining a person’s fitness for duty.

4.9. Record of Test Results

The results of every positive alcohol test shall be recorded securely in the IMS and include:

• the name of the person tested; • the name of the person conducting the test; • date of test; and • result of on-site tests;

5. ROLES AND RESPONSIBILITIES

SSE Shall review and approve this procedure. SHET Superintendent Shall ensure that all provisions of this procedure are implemented, and

that compliance is achieved. Superintendents Shall be responsible for their area of operations and the

implementation and application of this procedure; Provide adequate training, information, structure and supervision to ensure that this procedure is implemented; Carry-out a periodic review of activities to ensure the appropriate application and understanding of this procedure; and Ensure immediate and appropriate steps are taken to investigate and rectify any risks to health and safety arising from these activities.

Supervisors Ensure all CMWs are familiar with, have access to and comply with the requirements set out in this procedure.

All CMWs (including visitors and contactor)

Shall comply with the requirements of this procedure.

6. REFERENCES

7. REVIEW

This document shall be reviewed as follows:

• when there is a change of method and/or technology and/or legal or other requirement that may affect the accuracy of this document;

• when operational changes occur that effect the currency of the document; • when there has been a significant event to which this document was relevant; and • as a result of relevant audit findings.

8. AUTHORISATION
