HB 1648FY 2014 Education Appropriation Bill

• Funds MAEP at $2,082,543,065– $27.2M above FY 2013 MAEP appropriation.– Increase is for PERS employer rate increase effective July

1, 2013. – High Growth districts reduced by a total of $5.3M– Lump sum allocation (same process as FY 2013) so no mid

year adjustments to add-ons or additional funding for new hires (spec. ed., voc. ed., gifted teachers).• Districts will be required to go through the teacher unit

reconciliation process even though funding will not change.

(iii) A requirement that each board member present be provided a copy of all required reports; and

(iv) A requirement that a copy of all required reports be included in the official minutes of the board meeting at which the reports were discussed.

(b) The State Board of Education is authorized to require school districts to submit any of the required reports to the State Department of Education on a basis determined by the department.(c) Failure to comply with any of the rules and regulations established by the State Board of Education with regard to reporting requirements shall constitute a violation of the Mississippi Public School Accountability Standards.

HB 1530 School Attendance And Absenteeism; Standardize For

ADA Calculations And Increase Age Of Compulsory School Attendance

• Provides that a compulsory-school-age child who is absent more than 37% of the instructional day must be considered absent the entire day

• Revises the definition of the terms “Minimum School Term” and “Average Daily Attendance” as such terms are used for determining allocations to school districts under the Adequate Education Program

• The act shall take effect and be in force from and after July 1, 2013

(4) An "unlawful absence" is an absence for an entire school day or during part of a school day by a compulsory-school-age child, which absence is not due to a valid excuse for temporary nonattendance. For purposes of reporting absenteeism under subsection (6) of this section, if a compulsory-school-age child has an absence that is more than thirty-seven percent (37%) of the instructional day, as fixed by the school board for the school at which the compulsory-school-age child is enrolled, the child must be considered absent the entire school day. Days missed from school due to disciplinary suspension shall not be considered an "excused" absence under this section. This subsection shall not apply to children enrolled in a nonpublic school.

HB 1530 (Continued)(ii) The State Board of Education shall define those activities

necessitating a pupil's absence that, for purposes of determining and reporting attendance for average daily attendance purposes, must be considered an excused absence. Such activities include, but are not limited to: official organized events sponsored by the 4-H or Future Farmers of America (FFA); official organized junior livestock shows and rodeo events; official employment as a page at the State Capitol for the Mississippi House of Representatives or Senate; subject-matter field trips; athletic contests; student conventions; music festivals or contests; and any similar school-related activity designated by the State Board of Education. The State Board of Education shall prescribe the means by which a pupil's absence due to participation in an activity authorized by the board pursuant to this subparagraph must be verified. This subparagraph (ii) shall stand repealed on July 1, 2016.

HB 74 Student Attendance; Allow Excused Absence For Those

Participating In 4-H And FFA Sponsored Events

• Allows for an excused absence for students participating in official organized events sponsored by the 4-H or Future Farmers of America (FFA)

• The excuse has to be in writing by the superintendent or the Extension Agent or High School Agricultural Instructor/FFA Advisor

• Allows for an excused absence for students officially being employed to serve as a page at the State Capitol for the Mississippi House of Representatives or Senate

• Extends the use of public school buses to transport citizens attending a military historic commemorative event held on a military base or military park

• This act shall take effect and be in force from and after its passage

HB 369The Mississippi Charter Schools Act of 2013

• Creates the Mississippi Charter School Authorizer Board as a state agency with exclusive chartering jurisdiction

• Charters can locate in all school districts – A, B, and C districts would have veto power

• Prescribes the Board’s membership and provides for the employment of an executive director and general counsel

• Requires the State Department of Education to provide technical information and assistance to the Authorizer

• Establishes requirements relating to the enrollment of students in charter schools

• Open enrollment includes all students residing in the geographical boundaries of the school district in which the charter school is located and a lottery process for selecting students when capacity is insufficient to enroll all students desiring to attend a charter school

• Requires school districts to publicize information about charter schools to the same extent as non-charter public schools

• Provides that charter schools are not subject to the rules and regulations adopted by the State Board of Education or the School Board of the school district in which the charter school is located

• Requires at least 75 percent of teachers in a charter school to be licensed by the state when the initial charter application is approved

• Exempts administrators from state licensure requirements• Prohibits charter school employees from participating in the

public employees’ retirement system

• Authorizes equal transportation funding under the adequate education program for charter schools

HB 716 School District Consolidation; Require In Certain County

• Creates the seven member Commission on Starkville Consolidated School District Structure

• The Commission is to study the current structure of the Oktibbeha County School District and the schools in Starkville and to make a report to the 2014 Legislature

• Provides for the administrative consolidation into one school district to be designated as the Starkville Consolidated School District in 2015

• This act shall take effect and be in force from and after the date it is effectuated under Section 5 of the Voting Rights Act of 1965, as amended and extended

HB 879 Students Of Military Personnel Residing On Base; Allow Parent Or Legal Guardian To Choose School Or School

District Of Enrollment• Allows parents or legal guardians who are active members

of the United States Armed Forces or Civilian military personnel and who reside on a military base to enroll their children in any school district of the parent’s or legal guardian’s choosing

• Subject to certain conditions:– Cannot violate the 30 mile rule– Service member must be serving in an active duty status

• This act shall take effect and be in force from and after July 1, 2013

Students With School Choice• Establishes the Mississippi Speech-Language Therapy

Scholarship for students with speech-language impairments program

• Provides for student eligibility requirements for receipt of a scholarship and restricting eligibility

• Provides for the term of the scholarship• Stipulates the obligations of parents or legal guardians,

students and schools and school districts

• Prescribes the duties of the Department of Education and the State Board of Education regarding the administration of the scholarship program

• Provides the Department of Education with the authority to verify the eligibility of nonpublic schools and to establish the process for notifications of violations

• Requires that all compulsory-school-age children be screened for speech-language impairment during the period between the spring of kindergarten and the Fall of Grade 1 and other appropriate times as deemed necessary in the public schools of this state

• Requires the Department of Education to submit an annual report to the legislature summarizing student performance, student assessments, funding and any recommended changes

• Provides for a special school board election to fill vacancies in school districts under conservatorship where there are no remaining school board members at the time of reconstitution or reorganization of the district

• This act shall take effect and be in force from and after the date it is effectuated under Section 5 of the Voting Rights Act of 1965, as amended and extended

SB 2188 Teacher And Administrator Licensure; Clarify Grounds For License Denial And Procedures For Reinstatement

• Clarify the grounds for teacher and administrator licensure denial by the State Board of Education

• Provides for certain standards and procedures for reinstatement of teacher or administrator licenses

• Establishes criteria for a teacher candidate to be licensed in Mississippi for entrance into an approved teacher education program

• 21 ACT or achieve the nationally recommended passing score on the Praxis Core Academic Skills for Educators examinations

• No less than 2.75 GPA on pre-major coursework of the institution’s approved teacher education program provided that the accepted cohort of candidates meets or exceeds a 3.0 GPA on pre-major coursework

• This act shall take effect and be in force from and after July 1, 2013

SB 2347Literacy-based Promotion Act; Establish In Public

Schools To Achieve Grade-level Reading By End Of 3rd Grade

• Establishes the “Literacy-Based Promotion Act” to improve kindergarten and first through third grade public school students’ reading skills so that every student completing third grade reads at or above grade level

• Requires school districts to provide intensive reading instruction and intervention to students exhibiting a substantial deficiency in reading in kindergarten and grades 1 through 3

• Prohibits the promotion of students whose reading deficiency is not remedied before the end of third grade

• Requires notice to be given to parents of kindergarten and first through third grade students exhibiting a reading deficiency

• Requires the State Department of Education to establish the Mississippi Reading Panel to recommend appropriate alternative standardized assessments

• Prohibits the promotion of public school students based solely on a student’s age or other social promotion factors

• Specifies certain actions school districts must take in implanting the literacy-based promotion act in kindergarten and grades 1 through 3

• Requires school boards to submit annual reports to parents on their respective student’s progress in reading

• Requires school boards to publish data reflecting students progression and performance in a local newspaper

• Provides for an excused absence when it results from students participating in official organized event sponsored by 4-H or Future Farmers of America and students serving as a page at the State Capitol

• This act shall take effect and be in force from and after July 1, 2013

SB 2395 Prekindergarten Programs; To Be Implemented By The

State Department Of Education

• Authorizes and direct the State Department of Education to implement a prekindergarten program in the State of Mississippi on a phased-in basis

• Amend codes to transfer duties and responsibilities of the Department of Human Services relative to the “Early Learning Collaborative Act” to the State Department of Education

• Redesignates the prekindergarten program as the “Early Learning Collaborative Act of 2013”

• Authorizes local school districts to implement the “Early Learning Collaborative Act of 2013”

• Provides qualifications for state or federal funded early childhood education program personnel

acting through the Mississippi Commission on School Accreditation, to establish a single “A” through “F” school and district accountability system satisfying federal and state accountability requirements

• This act shall take effect and be in force from and after July 1, 2013

• Will be known as the “Schoolchildren’s Religious Liberties Act”

• Prohibits local school districts from discriminating against students based on their expression of religious perspectives on otherwise permissible subjects

SB 2637School District Consolidation; Require In Certain County

• Provides that in Clay County there shall be an administrative consolidation into one school district to be designated as West Point Consolidated School District

• Authorizes and directs the State Board of Education to develop and promulgate a consolidation order for the school districts in the county under certain standards

• Provides for the new Board of Trustees to be elected in the consolidated school district in a November 2014 special election

• Establishes a Mississippi Community Oriented Policing Services in schools (MCOPS) grant program in the State Department of Education

• Would assist law enforcement agencies in providing additional school resources officers to engage in community policing in and around primary and secondary schools

• Prescribes requirements and standards for the program

• Would allow school boards to apply for grants under the MCOPS program for training of security personnel employed by the school district

• This act shall take effect and be in force from and after July 1, 2013
