11/13 COMMUNITY OUTREACH: YOUTH MENTORING IN LAW: This two-unit course includes both an on-campus classroom component and an off-campus community outreach component. The on –campus sessions will begin with an introduction to the basics of community outreach work in underprivileged communities and strategies for teaching and mentoring youth. Subsequent sessions will focus on particular teaching exercises designed to introduce high school students to the legal system, the basics of criminal, civil and constitutional law and the skills of oral advocacy and alternative dispute resolution. The off-campus outreach component entails conducting teaching exercises and mentoring sessions with the selected students from the Law and Social Justice Academy at Jordan High School in Watts, California, as well as attending social activities with the mentees. Law students will be responsible for their own transportation to and from the Jordan campus, which is approximately 35 miles from the Malibu campus. These off-campus sessions will occur every other week, usually on Thursday afternoons and will be approximately two hours in duration, not including travel time. The Jordan students will be brought to the Malibu campus for several sessions during the semester and there will be other off-campus social activities at other locations as well.

DISTINGUISHED PRACTITIONERS IN RESIDENCE

ROGER COSSACK (Media and the Law): Roger Cossack was a prosecutor and a defense lawyer during his 22 years of practice and in 1984 he argued U.S. v. Leon before the U.S. Supreme Court. Prior to beginning his private practice of law he served (along with Professor Skip McDermott) on the faculty of the UCLA Law School. In 1994 he joined CNN as the co-host of their award winning legal show Burden of Proof and also was the CNN legal analyst. From 1994 to 2001 he covered all of the major U.S. legal events including breaking the Bush v. Gore decision, the impeachment of President Clinton, and the disputed election of 2000. Since 2002 he has served as the legal analyst for ESPN, reporting on how the law applies in various ways to sports.

ED WARREN (Natural Resources Law): Mr. Warren graduated from Yale (1966) and the University of Chicago Law School (1969). After clerking, he joined the Washington office of Kirkland & Ellis in 1970, became a partner in 1975, and served from 1980 to 1993 on Kirkland’s firm-wide management committee. Mr. Warren founded both the firm’s environmental practice (1974) and appellate practice (1993) groups. Since 2006, he has been Of Counsel with Kirkland’s Washington office. Mr. Warren has extensive litigation experience before federal agencies and courts under a broad range of federal statutes and has argued more than 50 significant cases before the U.S. Courts of Appeals, state Supreme Courts and the U.S. Supreme Court. Some of his more important cases include: Indus. Union Dept., AFL-CIO v. American Petroleum Institute, 448 U.S. 607 (1980); Arkansas v. Oklahoma, 503 U.S. 91 (1992); Whitman v. American Trucking Associations, Inc., 531 U.S. 457 (2001); Corrosion Proof Fittings v. EPA, 947 F.2d 1201 (5th Cir. 1991); Virginia v. EPA, 108 F.3d 1397 (D.C. Cir. 1997); Fox Television Stations, Inc. v. FCC, 280 F.3d 1027 (D.C. Cir. 2002).For more than ten years, Mr. Warren has been teaching part-time at various law schools including the University of Chicago (1995-2005) (Complex Appellate Litigation), George Mason University (1997-present) (Administrative Law, Federal Courts, Natural Resources Law), and Georgetown University (1995) (Administrative Law). ERIC WOLFF (Natural Resources Law): Eric Wolff is currently chief counsel for litigation, labor, and employment for The Boeing Company in Puget Sound, Washington. He graduated from the University of California - Berkeley School of Law in 1998. He then clerked on the U.S. Court of Appeals for the Ninth Circuit, the U.S. Court of Appeals for the D.C. Circuit, and the U.S. Supreme Court for Justice Anonin Scalia. From 2001 to 2005, he worked at Kirkland & Ellis LLP in Washington, DC with Professor Warren and was an adjunct professor at George Mason University School of Law. PAUL L. CARON (Selected Advanced Topics in Federal Income Taxation): Paul L. Caron is Associate Dean of Faculty and Charles Hartsock Professor of Law at University of Cincinnati College of Law. He is one of the leading entrepreneurial tax scholars in the country. Since joining the UC faculty in 1990, he has written numerous books and law review articles, and is active in a variety of scholarly projects. Dean Caron's most recent books include Tax Stories (Foundation Press, 2d ed. 2009) and Federal Wealth Transfer Taxation: Cases and Materials (Foundation Press, 6th ed. 2009) (with Paul McDaniel & Jim Repetti). His most recent law review articles concern the estate tax, law school rankings and the impact of new technologies on legal scholarship and teaching. He serves as Series Editor for Foundation Press in developing a Law Stories Series of books patterned after his Tax Stories book. In addition, he is the Publisher and Editor of TaxProf Blog, the most popular tax blog on the Internet. He is the Publisher and Editor-in-Chief of the Law Professor Blogs Network of more than 50 blogs edited by law professors around the country in other areas of law. Dean Caron has served as a visiting professor at the University of Florida College of Law, Florida State University College of Law, University of San Diego School of Law, and New York University/IRS Office of Chief Counsel Continuing Professional Education Program. JOHN COPELAND NAGLE (Climate Change Law): John Copeland Nagle was named the John N. Matthews Professor at Notre Dame School of Law in 2005. He joined the law faculty as an associate professor of law in 1998 and became a full professor in 2001. He was the law school’s inaugural Associate Dean for Faculty Research from 2004 to 2007.Professor Nagle is the co-author of casebooks on “The Practice and Policy of Environmental Law, “Property Law,” and “The Law of Biodiversity and Ecosystem Management. His book “Law’s Environment: How the Law Shapes the Places We Live,” will be published by Yale University Press in 2010. His other writings have explored such topics as the relationship between environmental pollution, cultural pollution, and other kinds of “pollution;” the role of religion in environmental law; Chinese environmental law; the scope of congressional power to protect endangered species; alternative approaches to campaign finance reform; and the competing roles of Congress and the courts in correcting statutory mistakes. His articles have been published in journals such as the Yale Law Journal, the Columbia Law Review, the Michigan Law Review, the University of Pennsylvania Law Review, and the New York University Law Review. Professor Nagle has participated in numerous activities outside of the law school. He has served as a member of the executive committee of the Section on Legislation of the American Association of Law Schools, and as a vice chair on the Endangered Species Committee of the American Bar Association’s environmental section. He helps organize the annual meeting of the Law Professors’ Christian Fellowship. He served as an elder in the Presbyterian church and is now an elder in the South Bend Christian Reformed Church. He is the faculty adviser for the Christian Law Students, the Journal on Legislation, and Young Life.

JAMES AZADIAN (Appellate Advocacy): James Azadian joined Horvitz & Levy LLP in 2008. He is admitted to practice in the California state courts, District of Columbia courts, the Supreme Court of the United States, the United States Courts of Appeals for the Second, Ninth, and Federal Circuits, as well as the United States District Courts for the District of Columbia and the District of Maryland. Prior to joining the firm, Mr. Azadian was an appellate associate in the Washington, D.C. office of Sidley Austin LLP, and earlier held judicial clerkships with the Honorable Consuelo M. Callahan of the United States Court of Appeals for the Ninth Circuit, and the Honorable Ricardo M. Urbina of the United States District Court for the District of Columbia. Mr. Azadian’s practice focuses on federal appellate litigation. He has substantial experience in regulatory matters and high-profile congressional investigations. In Los Angeles, Mr. Azadian serves as an instructor and mentor for the Appellate Court Experience Program, enabling at-risk youth to gain first-hand knowledge of state and federal judicial systems and encouraging their pursuit of higher education. In Washington, D.C., he assisted the Washington Legal Clinic for the Homeless in conducting interviews of the clinic's incoming clients. In August 2009, Ninth Circuit Chief Judge Alex Kozinski appointed Mr. Azadian to the Ninth Circuit’s Advisory Committee on Rules and Internal Operating Procedures. Mr. Azadian also serves as a court-appointed member of the Voluntary Settlement Conference Panel for the Los Angeles Superior Court. As a Settlement Conference Officer, Mr. Azadian hears presentations from both sides of pending commercial cases and designs settlements for the parties. Mr. Azadian received his Bachelors of Arts in Political Science and Economics from the University of California, Los Angeles and his Juris Doctor from Pepperdine University School of Law. STEPHANIE BELL (Mediation Theory and Practice): is a mediator, trainer, and most recently, the Program Manager of the King County Interlocal Conflict Resolution Group, a vibrant tri-county labor-management and public policy mediation program in the Seattle area. Prior to this she was the Alternative Dispute Resolution Coordinator for the City of Seattle where she designed and implemented a labor and employment mediation program for City government in a joint labor-management context. Stephanie started her career in mediation as the Program and Small Claims Court Manager for the King County Dispute Resolution Center, a private non-profit community based dispute resolution program. Stephanie has served as adjunct faculty at the Seattle University School of Law teaching Dispute Resolution and the Masters in Public Administration Program at the University of Washington, Evans School, teaching Negotiations and Conflict Resolution. Prior to entering the field of mediation, Stephanie practiced criminal defense as a research attorney for the Federal Public Defender for the Western District of Washington. Stephanie is a member of the Washington State Bar, ADR Section, and is currently a volunteer with the Ventura Dispute Settlement Center. She has presented on workplace dispute resolution and mediation skills to various organizations including the Northwest Alternative Dispute Resolution Conference, the Federal Mediation and Conciliation Service National Conference, and the Association of Conflict Resolution International Conference. THE HONORABLE HELEN I. BENDIX (Mediation Theory and Practice): Judge Helen I. Bendix presides over a general civil jurisdiction docket in Department 18 of the Los Angeles Superior Court. She is immediate past Chair of the LASC’s ADR Committee. Prior to her judicial appointment in 1997, she was Senior VP and General Counsel of KCET, and a partner in the Los Angeles office of Heller Ehrman White & McAuliffe. Judge Bendix has authored articles and treatises on federal practice and procedure, ADR, and international law, and has taught at the UCLA and American University Law Schools. MICHAEL BLAINE BROOKS (Patent Law): Michael B. Brooks is a patent attorney practicing in Southern California since 1995. Presently in private practice, he was patent counsel and general counsel for a Department of Defense contractor later acquired by Alliant Techsystems. He holds B.S., M.S., and Ph.D. degrees from UCLA School of Engineering and Applied Science — his doctorate received as a Howard Hughes Fellow while working as a research and development engineer in missile avionics. Dr. Brooks received his J.D. from Pepperdine University School of Law: a 28-month program that included the Franklin Pierce SOL Intellectual Property Summer Institute. He is a frequent lecturer on patent law for the Ventura County Bar Association and is a licensed California Professional Electrical Engineer. Dr. Brooks’s university teaching experience includes seven semesters as Adjunct Professor of Engineering and Computer Science, California State University, Northridge, and twelve quarters as Teaching Assistant/Associate (Lower Division Instructor), UCLA School of Engineering and Applied Science. He is a senior member of both the Institute of Electrical and Electronic Engineers and the American Institute of Aeronautics and Astronautics. In 2008, his book, The Patent Protractor, became available in a print-on-demand edition and as an e-book.

RICHARD S. REISBERG (Mediation Theory and Practice): Richard S. Reisberg has been a full-time mediator and arbitrator since joining JAMS in 2001. His specialties include business and commercial, entertainment, automobile and employment disputes. Prior to joining JAMS he was a senior executive in the entertainment industry having served as President of Viacom Productions, President of MGM/UA Television, President/COO of Reeves Entertainment Group and President/COO of Trimark. Earlier in his career he was Sr. Vice President, Legal and Business Affairs at Viacom and Director of Business Affairs at NBC. Mr. Reisberg gives Continuing Legal Education (CLE) lectures on ADR topics such as mediation techniques, employment, ethics and mediating entertainment disputes. He has also lectured at USC School of Law, the USC Stark Program and AFI.

Mr. Rosen has briefed numerous cases in the California Supreme Court, arguing five of them. His cases in the Supreme Court have involved important issues regarding the scope of California’s anti-SLAPP statute, the Unruh Act, the Statute of Frauds, the Uniform Single Publication Act, the protection afforded to commercial speech, the application of the First Amendment to intra-church property disputes, the enforceability of arbitration clauses, and the application of the primary assumption of risk doctrine. He has been lead appellate counsel in dozens of appeals in a wide variety of areas (his name currently appears on 20 published opinions and many more unpublished opinions). In particular, Mr. Rosen has developed an expertise in the First Amendment, California’s anti-SLAPP statute, the law of defamation, and the application of the litigation privilege. Mr. Rosen has been invited to speak on these and other topics at numerous conferences. Mr. Rosen has held judicial clerkships with the Hon. Ferdinand F. Fernandez, U.S. Court of Appeals, Ninth Circuit and the Hon. Wm. Matthew Byrne, Jr., U.S. District Court, Central District of California. Mr. Rosen received his Bachelor of Arts from Cornell University and his Juris Doctor and L.L.M. from Duke University School of Law, where he served on the Editorial Board of the Duke Law Journal. DAVID TALBOT (Selected Issues in D.R.: Ombuds): David Talbot has been an ombuds for Coca Cola Enterprises, Inc. (CCE) since March 2003. The CCE ombuds office addresses workplace conflict for approximately 65,000 employees across North America. He has worked as a conflict resolution professional and trainer for the past 12 years. Prior to his current role as ombuds for CCE, he served as manager for Community Mediation Services in Vancouver, Washington; and director for the California Academy of Mediation Professionals in Los Angeles, California. He holds a J.D. from the University of Idaho and a master of dispute resolution from Pepperdine University, Straus Institute for Dispute Resolution.

http://law.pepperdine.edu/academics/catalog/ ADVANCED LEGAL RESEARCH: This course will provide students with the research skills needed in the practice of law. Topics to be covered will include use of primary and secondary sources, complex case law research, statutory research, and legislative history. In depth coverage of specialized topics will include administrative law, intellectual property, labor and employment law, tax, securities, foreign and international law. Advanced training in Lexis and Westlaw will be provided. Emphasis will be placed on appropriate and effective research strategies and evaluation of sources, both print and electronic. APPELLATE ADVOCACY: This course has the twin objectives of providing intensive instruction in appellate brief writing as well as the study of the methods and procedures used in appellate oral advocacy. Students will draft an appellate brief and will participate in an appellate argument in a moot court setting. This course must be taken by all Interschool Moot Court Competition Team members, but is also open to students who are not on the Team or otherwise involved with Moot Court. CLIMATE CHANGE LAW: Climate change has become the dominant problem in discussions of environmental law today. The area has generated a substantial amount of litigation, legislation, and scholarship in recent years, so there is now ample material for a course on the subject. The goal for this course is to provide an opportunity for an in-depth study of a problem that has become so prominent in our society. The readings combine theory and practice, the law and other disciplines, and domestic and global approaches. The course is intended to teach not just about the specifics of climate change, but also how different institutions employ the law and other tools to address evolving societal problems. COMMUNITY OUTREACH: YOUTH MENTORING IN LAW: This two-unit course includes both an on-campus classroom component and an off-campus community outreach component. The on –campus sessions will begin with an introduction to the basics of community outreach work in underprivileged communities and strategies for teaching and mentoring youth. Subsequent sessions will focus on particular teaching exercises designed to introduce high school students to the legal system, the basics of criminal, civil and constitutional law and the skills of oral advocacy and alternative dispute resolution. The off-campus outreach component entails conducting teaching exercises and mentoring sessions with the selected students from the Law and Social Justice Academy at Jordan High School in Watts, California, as well as attending social activities with the mentees. Law students will be responsible for their own transportation to and from the Jordan campus, which is approximately 35 miles from the Malibu campus. These off-campus sessions will occur every other week, usually on Thursday afternoons and will be approximately two hours in duration, not including travel time. The Jordan students will be brought to the Malibu campus for several sessions during the semester and there will be other off-campus social activities at other locations as well. HONORS MEDIATION ADVOCACY: This class is designed to provide individualized assessment and coaching for students interested in representing the School of Law in the ABA interschool mediation advocacy competition. Each student in the class will be required to participate in multiple mediations as an advocate and to create and implement strategies specific to the inter school problem. Up to four students from this course will be selected to participate in the interschool competition. This advanced mediation advocacy practice class requires the approval of the professor for enrollment. All students requesting approval to enroll must have completed Law 1422 Mediation Theory and Practice or be concurrently enrolled. FREEDOM OF SPEECH AND ASSOCIATION IN AMERICA: This course will trace the historical development of free speech law in America from its surprisingly late birth in the cauldron of World War I, to its modern blossoming as one of the most fundamental constitutional rights the U.S. Supreme Court recognizes today. Among other things, the course will focus on the theories and justifications for the Court's recognition of "lesser-protected" categories of expression (e.g., advocacy of illegal conduct, obscenity and child pornography, and commercial advertising), its approach to evaluating the constitutionality of "fully-protected" expression (including political campaign contributions and expenditures), and its methods for evaluating speech rights when the government is regulating it in special capacities (such as when the government acts as property manager, employer, educator, or controller of the broadcast airwaves). This course will also cover several important ancillary First Amendment rights, such as the right not to speak and the freedom of expressive association (including the right not to include others in one's association). INTERNATIONAL BANKRUPTCY LAW: This course will be conducted at the Columbia University School of Law and transmitted simultaneously through interactive telecommunication to students at several other law schools across the country. Leading bankruptcy law scholars will conduct the classes which will cover topics such as international bankruptcy principles and problems, basic issues in business bankruptcy, area bankruptcy studies (e.g., British Commonwealth, Latin America, Western Europe, Asia, Eastern Europe and use of Chapter 11 by foreign nationals). NATURAL RESOURCES LAW: The Old West and the New West. The first part of this course examines the historical and constitutional context out which grew the modern movement to conserve our Nation's public land and natural resources. Statutes enacted since 1970, including the National Environmental Policy Act, the Endangered Species Act among others, have enhanced citizen participation and judicial oversight in the protection of natural resources. In the second part of the course, students will select from the major resource categories -- wildlife, water, minerals, forestry, rangelands -- specific problems or topics about which the student will be required to write a paper and give an oral presentation. SELECTED ADVANCED TOPICS IN FEDERAL INCOME TAXATION: This course will study selected advanced topics in federal income taxation through the prism of landmark cases explored in the book, Tax Stories (Foundation Press, 2d ed. 2009). Among the topics covered will be (i) income; (ii) realization; (iii) debt; (iv) divorce; (v) business deductions; (vi) capitalization; (vii) accounting; (viii) assignment of income; and (ix) tax shelters. Students will be required to write a 15-page paper on one of the topics.

SELECTED ISSUES IN COMMUNICATION LAW SEMINAR: This course will examine telecommunications law and regulation in the United States. The course will begin with an historic overview of the U.S. telecommunications industry that will highlight the legal and economic underpinnings of regulation. This overview will include discussion of wireless communication, telephone, cable, satellite and information services. In turn, selected provisions of the Telecommunications Act of 1996 will be examined with emphasis on current policy challenges before the FCC and other regulatory bodies such as Internet neutrality, network interconnection and media ownership.

• Students must enroll in BOTH (Fieldwork AND Seminar) through the Clinical Programs Office in room 331A.

• All externships must be approved in advance by Professor Serafino, Director of Clinical Programs. Students must register with the Clinical Programs Office by February 1, 2010. All clinical courses are graded High Pass/Pass/Credit/Fail.

• Private law firms are not approved externship sites unless they are nonprofit public interest entities (cf. section 501 (c)(3) of the Internal Revenue Code) and the student is unpaid.

If you think you are interested in participating in an externship during the spring semester but have not yet secured a position, you must notify Rian Schoeffling (room 331A; [email protected]) or Professor Serafino (room 376; [email protected]) of that intention by February 1, 2010.

If you have a pending or secured externship, you must also attend one of the mandatory orientation meetings as well as a weekly clinical seminar.

37 The Mediation Clinic offers students the opportunity to mediate actual disputes. The Mediation Clinic will require 2 hours of class time weekly

(scheduled) and approximately 8 hours of fieldwork per week. Students are advised to leave two time blocks (2 mornings, 2 afternoons or 1 of each) in

their schedule to accommodate mediations at various courthouses throughout Los Angeles County. This should not include the afternoon scheduled for

class. Prerequisite: LAW 1422 Mediation Theory and Practice.
