By Josh Randt Sports Editor Now that she’s in her second year com- manding the troops on the Glencoe-Silver Lake danceline, Brittany Johnson said that this year’s team will focus more on “the competitive aspect” of dancing. During her first season leading the squad, Johnson said she learned “that it takes a lot of dedication and patience, and a lot of drilling and cleaning for our team. But we can get there with hard work.” This year’s team is “right in the middle of the pack,” when it comes to conference and sections, according to Johnson, who said the team’s goal is to “improve our scores throughout the season, and keep our same place that we start in throughout the season, if not build (on) it.” GSL will have plenty of competition with- in its conference in both the high kick and jazz competitions. We had a big post, D1 (division one) player you could get the ball to down low. This year, we don’t have that player ... so we have to play the run-and-gun style of play.” He’s obviously been spending a lot of his time with the varsity players, but Otto-Fisher said he’s here to “make this a seventh-12th grade” program. “It is not just varsity that matters,” he said. “It is how we teach the seventh graders to shoot, dribble, rebound and play the game that really matters.” Adding later, “I spent Monday and Tuesday having all seventh-12th grade girls practicing together to show unity and ‘family’ ... Klockmann and Monahan played AAU ball this summer, while Lange took part in a local league. Look for those three to make an impact right away. As an eighth-grader, Monahan racked up some pretty dazzling numbers: 194 points, 68 rebounds, 43 steals, but most importantly, 105 assists. She also collected the least amount of fouls of any of last year’s starters with 40. “She’s so smart at the game,” coach Otto- Fisher said. “She’s already thinking ahead, and she works hard. Winter in Minnesota is a game changer for the active minds and bodies. Those ac- customed to leisure activities in nature typi- cally move inside, lose their wits all togeth- er, or look like the Stay Puft Marshmallow Man with all the layers necessary for out- door activities. Sometimes you see a person who’s been hit by seasonal depression. Dead giveaways for seasonal insanity include: rosy cheeks accompanied by a beard fortified with snot icicles; missing patches of taste buds upon ones tongue from accepting dares to lick frozen objects; muttering to one’s self; and an influx of shorts and hooded sweatshirts when the temperature goes above 30 de- grees for the first time in January. At one time or another, I’ve displayed all of these signs. Except for the snot icicle. My mus- tache grows in rather suspect. During the winter solstice in this state, one needs to find something to keep busy, or you’ll begin to question your mental state, and possibly start to resemble the creatures described above. Especially when it’s dark enough to hunt vampires at 5 p.m. Enter athletics. Athletic seasons can seem to drag on, es- pecially if you’re having an off year. Honestly, I’m really looking forward to this winter for a few reasons. Primarily because this season’s teams have me chomping at the bit for the sched- ules to start. The boys’ basketball team is looking to make a name for itself with some new faces on the court. While Trent Draeger and Ethan Maass won’t be walking through the door and elec- trifying audiences with alley-oops anytime soon, I’m excited to see Teddy Petersen run the point. I’m not a big basketball guy, but I love crafty point guards. And in my short amount of time watching Mr. Petersen, it’s evident the kid has quite a bit of talent. Secretly, I’m hoping for some sweet one-handed bounce passes, and maybe a few no-look dishes to the bigs down low to make the Panther gymnasium light up like it’s Rucker Park. The girls’ team is in a similar boat roster wise, and also has a new head coach in Zach Otto-Fisher. While optimism and hopefulness surround the beginning of every season, the girls seem genuinely excited to be in a smaller class (Class AA), and to be working with their new head coach, who’s been in the pro- gram for three years now. Likewise, Otto-Fisher seems like he’s up with the chickens thinking of ways to im- prove his team. He also has a crafty point guard in freshman Maddie Monohan, who I’m also hoping for the same type of plays. The gymnastics team has me thoroughly intrigued. I don’t know a whole lot about the sport, but whenever the summer Olympics come around, gymnastics captivates many, including myself. I know I won’t be seeing Olympic-caliber performances, but I will see some young ladies with talent in a sport that I wouldn’t even think of trying. At 6’3” and 235 pounds, there’s nothing elegant about any of my movements. The same appreciation goes for the girls in danceline, and I won’t even begin to ex- plore why. Last, but not least, I’m extremely excited for the wrestling schedule to start. Five wrestlers return with 31 wins or bet- ter from a season ago, including Jacob Je- witt who took sixth place in the Class AA state tournament at 106 pounds. Overall, the team looks primed to make a run at state, something that has eluded Glen- coe-Silver Lake for quite some time. Also, for some reason, I’ve decided it would be a good idea to roll around with some of the kids in the heavier weights to try and relive some of my high school wrestling days. Unfortunately, I’ve been sick for the past week and haven’t been able to get up to the wrestling room, plus I need to get checked out to make sure I’m able to be up there. Though, I surmise I’ll probably end up feel- ing worse than I do now once the high schoolers get their hands on this aging 26- year-old. Either way, I’m excited for the season’s activities to start, and hope all of you are as well. I hope to see many of you supporting GSL athletics this winter. If not for the kids, then for your sanity. Josh Randt

Petition

STATE OF MINNESOTACOUNTY OF MCLEOD

DISTRICT COURTCIVIL DIVISION

FIRST JUDICIAL DISTRICTCourt File No.

Case Type: No. 14 Declaratory Judgment

In the Matter of the Proceeds oftheAnnamarie Tudhope EstateMcLeod County,

PetitionerPETITION

Michael Junge, McLeod CountyAttorney, on behalf of Petitioner,McLeod County, does hereby state:

1. That this is an action for De-claratory Judgment brought pursuantto Minnesota Statutes Chapter 555,which allows a district court to inter-pret provisions of a will, and pur-suant to Minn. Stat. § 501B.31, subd.4, which allows the court to reviewprovisions of a constructive trust. This action is also authorized byRule 57 of the Minnesota Rules ofCivil Procedure.

2. That the McLeod County Audi-tor-Treasurer has received a settle-ment of funds from the Estate of An-namarie Tudhope with a total amountreceived, including interest throughNovember 8, 2013, of $3,865.650.30.See Exhibit 6.

3. That the Will of AnnamarieTudhope states that the funds shallbe, “for the specific purpose of usingthe funds obtained from my estate inthe construction of the new McLeodCounty Jail to be located in Glencoe,

Minnesota. These funds are to beused only towards the expense of theconstruction of the building and notfor the purchase of real estate, archi-tectural expenses, studies, or otherexpenses not directly related to theconstruction of the building.” SeeExhibit 2, Article VI.

4. That the McLeod County Boardof Commissioners is desirous ofbuilding an addition to the McLeodCounty Jail, whereby the capacity ofthe jail will be increased from 35 to55 beds. The plans for the project areincluded as Exhibit 3.

5. That the McLeod County Boardof Commissioners has directed theMcLeod County Attorney to petitionthis Court for interpretation of theWill, and specifically asked that theCourt allow the proceeds from theWill to be used for new constructionas an addition to the current McLeodCounty Jail located in Glencoe,McLeod County, Minnesota. See Ex-hibit 4, page 4.

6. That the reason that interpreta-tion is necessary is that there is notnow, nor is there likely to be withinthe next 25 years, and possibly wellbeyond that, ever going to be a needfor a new McLeod County Jail sepa-rate and apart from what is currentlyin existence. The current McLeodCounty Jail is attached to theMcLeod County Courthouse and isconvenient and efficient for the trans-portation of prisoners to and fromcourt and for the service of their sen-tences, and that any new jail not at-tached to the current jail would nec-essarily be detached, and therefore, would be inconvenient and ineffi-cient. See the Affidavit of SheriffScott Rehmann, which is Exhibit 7.

7. That this Court has jurisdictionto consider this Petition both as a De-claratory Judgment Act under theMinnesota Uniform DeclaratoryJudgment Act located in Chapter 555and as a Constructive Trust, pursuantto Minn. Stat. § 501B.16.

8. That the Minnesota AttorneyGeneral, pursuant to MinnesotaStatute 501B.34, is assigned the dutyof supervising the administration andenforcing of charitable trusts and hasthe ability to intervene in this matterif the Attorney General so desires.

9. That the County of McLeodasks this Court to apply the equitabledoctrine of cy pres to interpret thelanguage of the Annamarie TudhopeWill since the construction of a newjail separate and apart from the cur-rent jail is impractical and/or unlikelyto ever occur. The County respectful-ly requests this Court to interpret theintent of Annamarie Tudhope toallow for new construction of a jailaddition to the current McLeodCounty Jail. See In the Matter of theRuth Easton Fund, 680 N.W.2d 541(Minn. Ct. App. 2004).

10. Further your petitioner statesthat the above is true and correct tothe best of your petitioner’s knowl-edge and belief, as is supported bythis Petition and Exhibits 1-9.
