CHAPTER 1
EXECUTIVE SUMMARY
1.1 Project and public purpose
Development projects are boosting our nation’s growth. It aims to develop the
community at all levels like infrastructural, educational, economical etc. But in the
other side, most of the development projects affect people’s land and living
facilities. Rehabilitate the affected people in a safe way is the responsibility of the
government.
Urban regeneration and Integrated Water Transport System (IURWTS) project is
an integrated project for the development of canals and nearby areas in Cochin.
The project is implementing by M/s Kerala Shipping and Inland Navigation
Corporation Limited (KSINC), a Government of Kerala under taking. The house
holds living near to the buffer zone of five canals namely Thevara Canal,
Edappally Canal, Chilavannoor Canal, Market Canal and Thevara Perandoor Canal
are the project affected people under the IURWTS project. All these affected areas
are so close to township. Approximately 2000 families are residing in the buffer
zone and they have to be displaced for the IURWTS project. Even though most of
these families are living in unhygienic environment, all the basic facilities like
hospitals, schools, transportation etc. are easily available to these families. Hence
when rehabilitating these families it is essential to ensure that they are not
declining their existing living status. Government of Kerala find out 7.73 Acers of
land at Kakkanad Village to rehabilitate the Project Affected Families under the
IURWTS project and it is proposed to develop a holistic township there by

constructing 400 apartments. Administrative sanction was accorded for the project
by Coastal Shipping & Inland Navigation (A) Department (CSIND) vide GO(Ms)
No. 07/2018/CSIND dated 12.11.2018.
Revenue (B) Department, Government of Kerala published a notification
G.O.(P)No.11/2020/RD, S.R.O.No.105/2020 dated 10/02/2020 in Kerala Gazette
(Extraordinary) No. 427dated10.02.2020,stated that it is needed or likely to be
needs 7.73 Acers of Land in Kakkanad Village in Kanayannur Taluk for a public
purpose and it is appointed Rajagiri outREACH, Kalamassery to conduct Social
Impact Assessment Study of this land acquisition as per Rule 10 of Kerala
RFCTLARR Rules 2015. Moreover, as per Section 2 (1) f of The Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and
Resettlement Act 2013 (RFCTLAR&R Act), the project serves the public purpose.
1.2 Location
The proposed extension of rehabilitation project is planned to cover an area of 7.73
Acres of land at Kakkanad village in Thrikkakara Municipality, Kanayannur Taluk
of Ernakulam District, covering Survey Nos. 528/8 part, 528/11, 528/12 and 499/1.
Kakkanad is a major industrial and residential region in the city of Kochi in Kerala
and it is one of the fast growing areas in Kerala.
1.3 Size and attributes of land acquisition
The project is mapped to acquire 7.73 acres of land in Kakkanad village and as per
the land details issued by Special Tahsildar, the project site is suitable for
residential plot and except the land belongs to survey No.499/1 all belong to “Dry
land” category. The land in survey No.499/1 belongs to “Wet Land”. Many trees
and plants are growing and 3 structures such as pump house, cow shed and another
shed were found in the land. There is also a pond which was used for agricultural

purpose. There is a canal in the boundary of the project area, which is flowing
through Chithrappuzha. These land is owned by two families.

1.4 Alternatives considered
As per the information received from the Requiring Body no other alternatives
were considered since the proposed land acquisition cause only minimum impacts
and it is a better place to rehabilitate the affected population of IURWTS project
1.5 Social impacts
As per the alignment for the acquisition of land for the rehabilitation project, 2
families will be affected and will lose land which is understood to be the major
impact. Further, the project also disrupts three structures, trees and 1 water body

1.6 Mitigation measures
The affected persons in general are positive on the proposed land acquisition
and rehabilitation project. The impacts caused to the owners can be mitigated
by the following measures
• Providing compensation to the affected families as per the Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and
Resettlement Act 2013 and Kerala Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Rules
2015.
• Procedures should be undertaken for R&R package as per the Policies vide
G.O.(Ms)No.485/2015/RD dated 23/09/2015 and
G.O.(MS)No.448/2017/RD dated 29/12/2017 issued by Revenue(B)
Department, Government of Kerala for the rehabilitation and resettlement
package for acquisition of land in the state in lieu of RFCTLAR&R Act
2013

CHAPTER 2
DETAILED PROJECT DESCRIPTIONS
2.1 Background of the project, including developer’s background and
governance/ management structure
Bhavanam Foundation Kerala (BFK) is a public sector, non-profit company
registered under section 8 of the Companies Act, 2013 and fully owned by the
Government of Kerala under the Department of Labour and Skills. The Honorable
Minister for Labour, Skills and Excise Shri. T P Ramakrishnan is the Chairman of
the company. Directors of Bhavanam Foundation Kerala are Mr. Ajith
Balakrishnan, Mr. Sivankutty Nair, Mr.Vasudevan Pillai, Mr. Reji John, Mr.
Ramakrishnan Thazhatheparambil, Kariappa Bollanda Panduranga, Ms. Asha
Thomas, Mr. Bichu Balan, Mr. Chungath Parekat Varkey Sajan and Mr. Abdul
Salam. The company’s objective is to provide, promote, develop and establish
residential accommodation, education, healthcare, other associated infrastructure
and services to laborers, workers and low-waged employees in Kerala.
BFK has envisaged the project for the rehabilitation of the Project Affected People
under the “Integrated Urban Regeneration and Water Transport System
(IURWTS)” project in Cochin, an integrated project for development of canals and
nearby areas in Cochin of the M/s Kerala Shipping and Inland Navigation
Corporation Limited (KSINC),a Government of Kerala undertaking. Govt.of
Kerala entrusted M/s Kochi Metro Rail Ltd (KMRL) as the new Special Purpose
Vehicle for the IURWTS project.
Kochi city is the industrial capital of Kerala and also one of the developing metro
city in Kerala. 25% of the Kochi city is surrounded by water bodies and canals.

Kochi city consists of five major canals namely; Thevara-Perandoor canal (11.15
KM), Thevara canal (1.405 KM), Market canal (0.664 KM), Chilavannoor canal
(9.88 KM) and Edappally canal (11.23 KM). Earlier these canals were played a
significant role in travel and transportation of goods. As the development occurred
in road and rail transportation the inland waterways has been neglected. The
unscientific waste management and dumping of waste in to the canal created the
water ways dysfunctional. The aim of the project is to develop transportation
through canals, regeneration of Kochi city on development basis, strengthen the
tourism, and improve the quality of life of the Kochi city and urbanization with
proper waste management systems. If these canals are developed properly it will
bring a face change to the city.
In the process of developing transportation through canals and regeneration of
Kochi city, the families residing near to these canals need to be rehabilitated.
Hence it is proposed to develop a holistic township by constructing 400 apartments
for the rehabilitation of the Project Affected People of IURWTS project.
Accordingly, BFK has identified 7.73 Acers of suitable land in Kakkanad Village
in Kanayannur Taluk and procedures for land acquisitions have begun.
Administrative sanction was accorded for it by Coastal Shipping & Inland
Navigation (A) Department (CSIND) vide GO(Ms) No. 07/2018/CSIND dated
12.11.2018.
2.2 Rationale for project including how the project fits the public purpose
criteria listed in the act
As part of Integrated Urban Regeneration and Water Transport System (IURWTS)
project in Cochin many families will be evicted from their native places. It will

affect their day to day life and activities. So, rehabilitating these people without
affecting their routine life is actually a challenge for the government.
7.73 Acres of Land in Kakkanad Village in Kanayannur Taluk is identified for the
purpose and Revenue (B) Department, Government of Kerala notified through
Gazette (Extraordinary) No. 427dated10.02.2020,the survey numbers and extent of
land which is needed or likely to be needed for a public purpose and Rajagiri
outREACH, Kalamassery was appointed to conduct Social Impact Assessment
Study of the land acquisition as per Rule 10 of Kerala RFCTLARR Rules 2015.
Moreover, as per Section 2 (1) f of The Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013
(RFCTLAR&R Act), the project fits in for public purpose.
2.3 Details of project size, location, capacity, outputs, production targets,
costs and risks
The rehabilitation project involves acquisition of 7.73 Acres of Land in Kakkanad
Village in Kanayannur Taluk, covering Survey Nos. 528/8 part, 528/11, 528/12
and 499/1 which is owned by 2 families. The project site mostly covers with many
trees and plants. The proposed rehabilitation project is for the Project Affected
Peoples under IURWTS project and the families live in Konthuruthy Manava
Nagar colony. It is proposed to construct around 400 dwelling units of 700 sq. ft
area spread in 10 towers with 10 floors, each tower consisting of around 40 units.
2.4 Examination of alternatives
As per the information received from the Requiring Body no other alternatives
were considered since the proposed land acquisition cause only minimum impacts
and it is a better place to rehabilitate the affected population of IURWTS project

2.5 Phases of the project construction
It is proposed to construct a total of around 400 dwelling units of 700 sq. ft area
spread in 10 towers with 10 floors, each tower consisting of around 40 units. The
DPR of the project is under preparation and hence phases of the project are not yet
finalized.
2.6 Core design features and size and type of facilities
The proposed land acquisition is for the rehabilitation of Project Affected People
under IURWTS project and the families live in Konthuruthy Manava Nagar
colony. It is proposed to construct around 400 dwelling units of 700 sq. ft area
spread in 10 towers with 10 floors, each tower consisting of around 40 units.
2.7 Need for ancillary infrastructural facilities
Along with the housing units the infrastructural facilities like drinking water,
electricity, road facility etc. has to be ensured.
2.8 Work force requirements (temporary and permanent)
The DPR of the project is under preparation and so the work force requirement is
not yet finalized.
2.9 Details of social impact assessment/ environment impact assessment if
already conducted and any technical feasibility reports
Rajagiri outreach has conducted a Social Impact Assessment Study for IURWTS
Project, Kochi Scheme, which was assigned by Bhavanam Foundation, Kerala.
The study was conducted in the affected area of IURWTS project, ie Edapally
Canal, Market Canal, Thevara Canal, Chilavannoor Canal and Thevara -Perandoor
Canal. Presently SIA study is conducting for the land acquisition in Kakkanad
village for the rehabilitation of the Project Affected People of IURWTS project.

2.10 Applicable legislations and policies
The applicable laws on land acquisition, rehabilitation and resettlement for the
proposed land acquisition for rehabilitating Project Affected People under the
IURWTS project in Kanayannur Taluk of Thrikkakkara Muncipality in
Ernakulam District are:

TEAM COMPOSITION APPROACH, METHODOLOGY
AND SCHEDULE OF THE SOCIAL IMPACT ASSESSMENT
As per the Notification G.O (P)No.11/2020/RD dated 10th February 2020 of the
District Collector, Ernakulam, published in Kerala Gazette No.427 dated 10th
February 2020, Rajagiri outREACH Service Society, Kalamassery has entrusted to
study the Social Impact Assessment and to prepare a Social Impact Management
Plan as per section 4 (1) of the Right to Fair Compensation and Transparency in
Land Acquisition, Rehabilitation and Resettlement (RFCTLAR&R) Act,
2013.Further, a team was constituted with experts who have engaged in similar
projects and deployed them into the project with a set of specific roles and
responsibilities.
3.1 List of all team members with qualification
The study team is headed by the Director of Rajagiri outREACH, Rajagiri College
of Social Sciences, Kalamassery. A team of 5 members having experience in
conducting Social Impact Assessment Study and Socio-economic Surveys were
assigned for field level data collection, monitoring of data collection and co
ordination of the study. Representatives from Revenue Department supported the
investigators to identify the affected families. Details of the study team are given in
the Table 3.1.1

3.2 Description and rationale for the methodology and tools used to collect
information for the social impact assessment
As per the land details issued by Special Tahsildar (LA, N.H.,No.1,
Emakulam),the land is owned by Mr. Rajendra Mehta and Mr. Sandeep Mehta.
The SIA team visited the project site and assessed the land and its accessories.
During the visit it was reported that affected persons are living out of Kerala. So
the invigilator of the team contacted the affected families and interviewed them
with a structured questionnaire which contains information about the socio
economic background of the families, land details, their views of acquisition etc.

The findings and suggestions of this study in the following chapters are based on
the Questionnaire Survey conducted among the 2 affected families and other
qualitative data collection methods used in project location.
The collected data were analyzed and findings have interpreted and Social Impact
Management Plan is recommended by an expert team to further the process of land
acquisition. The SIA study draft reports are prepared in English as well as in
Malayalam language and submitting for Public Hearing Meeting. In short,
following are the steps taken for the study are as follows:
• Study of relevant documents received from the office of Special Tahsildar
(LA), Kakkanad and Bhavanam Foundation Kerala.
• Site visit
• Socio-economic survey and enumeration of affected properties
• Analysis of socio-economic survey data
• Draft Report Preparation
• Conducting Public Hearing
3.3 Sampling methodology used
As the size of land to be transferred for the project by the affected person and
extent of impact due to latter is unique for each, a population Socio-Economic-
Impact Survey was found to be appropriate over sampling method. Further, the
respondent size was found to be 2 land owners only it was possible to collect the
information in the limited timeframe as per the scheme of the study.
3.4 Overview of information/ data sources used
Both primary and secondary information were collected and analyzed through
mixed method by the expert quantitative and qualitative researchers. Secondary
information and published reports from concerned offices of Bhavanam/ Revenue/

Panchayat/ Civil Stations were collected and referred by the field investigators at
multiple stages.
A unique structured questionnaire was prepared, tested and validated to collect
information from affected persons through Socio-Economic-Impact Survey. The
questionnaire contained questions aimed to collect the information such as
Demographic/ Economic/ Family/ Livelihood, details of performing/non-
performing assets in the project land and the types/degree of impact. The land
owners were participated in the telephonic survey. The response and data points
were analyzed and findings have reported along with recommendations.
3.5 Schedule of consultations with key stakeholders and brief description of
public hearings conducted
As part of the study, multiple meetings/interviews/discussions were held with
important stakeholders.

LAND ASSESSMENT
4.1 Description with the help of the maps, information from land
inventories and primary sources
The land to be acquired is 7.73 Acres of land in Kakkanad Village in Kanayannur
Taluk which was identified for the rehabilitation of the project affected people
under the IURWTS project. These land plots are owned by 2 affected persons and
are presently being used for plantation. The project area belongs to Thrikkakara
Municipality and locates nearly 6 K.M away from Kakkanad town and nearly 2.5
K.M. from the District Administration. Except the land in survey No. 499/1, all
land is classified as “Purayidam” as per revenue records. The land in survey
No.499/1 belongs to “Nilam” category.
4.2 Entire area of impact under the influence of the project (not limited to
land area for acquisition)
Kakkanad comes under Thrikkakkara Muncipality in Kanayannur Taluk and is
located 10 km away from Ernakulam. Kakkanad is a fast developing region in the
city of Kochi, Kerala. The locality is also the administrative headquarter of the
District of Ernakulum. The Seaport - Airport Road passes through the area that
further connects to Info park Road, thereby offering excellent connectivity to the
nearby places. Kakkanad is home for a portion of the industrial base of Kochi and
there are many IT and MNC companies that make the location a prime place.
There are many bus stations nearby from where buses travel frequently, enabling
the commuters to travel easily.

There are many schools and colleges like Bhavans Adarsha Vidyalaya, Christu
Jayanthi Public School, Rajagiri School of Engineering, Rajagiri Center for
Business Studies and many others in the vicinity. There is an entertainment and
theme park, Veegaland, nearby the location for recreation and amusement. And
also hosts religious institutions of different faith.
The project site is located about 6 KMs from Kakkanad town and200 meters close
to Bhavans Adarsha Vidyalaya. It is an agricultural field dominated by different
type of trees. The site can be accessed by road from Thrippunithura, Ernakulam
and Aluva.

4.3 Total land requirement for the project
The project is proposed to be implemented in 7.73 Acers of land covering Survey
Nos.-528/8p,528/11, 528/12 and 499/1 in Kakkanad Village of Kanayannur Taluk
in Ernakulam District. Classified as ‘Purayidom’ and ‘Nilam’ in Revenue records
and the land is being used for agricultural purpose.

4.4 Present use of any public, utilized land in the vicinity of the project area
No land utilized by the public was found in the vicinity of the project area.
4.5 Land (if any) already purchased, alienated, leased or acquired, and the
intended use for each plot of land required for the project
As per the available information from the concerned departments, no land has been
either leased or purchased for the project yet.
The present land acquisition of 7.73 acres of land is proposed to rehabilitate the
project affected people under the IURWTS project. It is proposed to construct
around 400 dwelling units of 700 sq. ft. area spread in 10 towers with 10 floors,
each tower consisting of around 40 units.
4.6 Quality and location of land proposed to be acquired for the project
The project land is located at Kakkand village of Kanayannur Taluk and the
surroundings are known for industries and companies. Presence of a Canal in the
boundary of the project area which is flowing to Chithrappuzha ensure the
availability of water in the project area. The project area is using for agriculture
purpose. Coconut, Teak, Jack fruit tree and many other trees and plants are there in
the land. The land deem suitable for living and a better access to major towns and
the administrative headquarter will help the project affected people under the
IURWTS project to fulfill education, medical and other requirements.
4.7 Nature, present use and classification of land and if agriculture land,
irrigation coverage and cropping patterns
As per the Socio-Economic survey conducted among 2 (Two) affected persons, the
land plots are classified as Purayidam and Nilam and are being used for agriculture
purpose. Coconut and much different type of trees are also cultivated in the area

and due to presence of canal and Pond; land is water-rich for farming as well as for
living. One (1) Pond is found as source of water for farming. In addition there are
3structures (cow shed, pump house and another shed) existing in the project area.
The project land also has various types of crops and Table 4.7.1 details the
classification of tress and units to be affected.

4.8 Size of holdings, ownership patterns, land distributions and number of
residential houses
It is understood that 7.73 Acers of land proposed to be acquired for the
rehabilitation project is owned by 2 relatives. As per the information received
through the survey the Project land plots are bought by the affected persons in
2007. Presently nobody is residing in the project affected land. So no residences
are mapped to be affected, but three structures being used for agricultural purpose
will be disrupted due to land acquisition.
4.9 Land prices and recent changes in ownership, transfer and use of lands
over the last three years
The market value of the land per Ares is reported to be around INR 12,70,500/- as
per the recent sale of land in the vicinity. No transaction in the project land has
been held in the last three years and also there were no major changes in the
farming and other uses of land in the project area in the recent past.

OF AFFECTED FAMILIES AND ASSETS
5.1 Estimation of families
As per the schedule notified by the Principal Secretary to Government
(Notification No G.O.(P)No.11/2020/RD dated 10/02/2020) in Kerala Gazette
Extra Ordinary No.427 dated 10th February 2020, 7.73 Acers of land is reported to
be acquired for the rehabilitation of Project affected people under the IURWTS
project. The land is owned by 2 persons. Information about these2 (Two) affected
families are detailed in the following sub-chapters.
5.1.1 Families which are directly affected (own land that is proposed to be
acquired)

The project area largely covers different type of trees and plants. Approximately
900 trees from 23 different categories in 7.73 acres of land will be affected along
with Coconut Tree, Teak, Jack fruit tree, Aanjili, Mango Tree, Cashew nut Tree
and other trees.3stuctures constructed as shed, cow shed and pump house will also
be affected. Also one water body is found in the project site.

SOCIAL ECONOMIC AND CULTURAL PROFILE
(AFFECTED AREA AND RESETTLEMENT SITE)
6.1 Demographic details of the population in the project area
There are 2 families which will be affected due to the land acquisition for the
project and the demographic details of those families are given below:

Table 6.1.1 reveals the age group and sex of the affected persons of the project. In
total 4 members (2 male and 2 female) are in the affected families. Among them 1
male member and 2 female members belongs to the age group 46 to 59 and the
remaining 1 male member iselderly,ie in 60 and above age group.
Religion & Social Group
Both the affected parties are belonging to Hindu religion and General category.

Marital Status & Educational Qualification
All members are married. Educational qualification is not available. Affected
families depend upon business for their livelihood.
6.2 Income and poverty levels
Monthly income and monthly expenditure of affected families are not available.
Both the parties have no ration card.
6.3 Vulnerable groups
One of the affected family member who belongs to the age group of 60 and above
would be considered as vulnerable group.
6.4 Land use and livelihood
The affected land belongs to “Purayidam” and “Nilam” category. The land covers
approximately 900 trees and many plants. It looks like a small forest. Presently
there is no farming except 267 coconut trees, 18 Jack fruit trees, 3 Groups
Bamboos, 2 Cashew nut trees, 8 Mango trees and many other trees. The land
owners do not take income from these crops and land. They consider it only as an
asset.
6.5 Local economic activities
None of the local economic activities are affected due to the land acquisition.
6.6 Factors that contribute to local livelihoods
A large population in the localitypossess higher/college education and are
employed with governement/private companies in India and abroad.
6.7 Kinship patterns and social and cultural organization
As observed by the expert team of SIA, the people in the locality generally live in
harmony and work together for the development of the region. To render school

and college education, Bhavans Adarsha Vidyalaya, Christu Jayanthi Public
School, Rajagiri School of Engineering, Rajagiri Center for Business Studies are
functioning in the vicinity. Healthcare requirements of the people in the locality are
facilitated through Thrikkakkara Muncipality Co-Operative hospital, National
Ayurveda Hospital, Sunrise Hospital etc. Also Kusumagiri Psychiatric Hospital is
located in Kakkanad. Further the region also has different clubs and associations to
promote sports, art, reading etc. in the community.
6.8 Administrative organization
District Collectorate and District Panchayath are situated in Kakkanad. There is a
civil station in Kakkanad include all major government offices. Further, Kakkanad
have all major banks’ branches. Ernakulam District Prison (Sub Jail) is also
located in Kakkanad.
6.9 Political organization
No political organization is observed to be located in the vicinity of the project
location.
6.10 Community based and civil society organizations
The project area has presence of all major religions like Hinduism, Islamic and
Christianity. Major temples in the region are Mariyamman Kovil, Bhagavathy
Temple, Chittattukara and Bhagavathy temple, Kakkanad. Two known churches in
the region are St. Joseph Church, Puthiyur and St. Mary’s Church, Puthiyur Juma
Masjid, Chittattukara is one main mosque in the region.

6.11 Regional dynamics and historical change processes
Kakkanad is a place included in Thrikkakkara Muncipality. Also it is very close to
Thrikkakara. Thrikkakara is notable for its significance in the festival of Onam,
and in the tale associated with it linked to the famous Thrikkakara temple.The very
name Thrikkakara owes its origin to the term ThiruKaal, or the feet of Lord Vishu.
It gradually evolved into the place name, Thrikkakara. It was the capital of the
Kingdom of Kochi.
Kakkanad is a major industrial and residential region in the city of Kochi in Kerala,
India. It is situated in the eastern part of the city and houses the Cochin Special
Economic Zone, Info Park, Smart City and KINFRA Export Promotion Industrial
Park.
6.12 Quality of the living environment
Majority of the population in the project area live Above Poverty Line with access
to facilities such as Schools, Hospitals, Civil Organisations, and Social Groups etc.
Due to its close access with Cities-Ernakulam and Kalamassery, the facilities in the
city are also being used widely for hospitals, higher education etc. The distance to
closes Railway Station (Ernakulum) Metro Rail (Cochin Metro) and Airport
(Cochin International Airport) is estimated at 10 KMs, 6 KMs and 24KMs
respectively.

CHAPTER 7
SOCIAL IMPACT M ANAGEM ENT
7.1 Approach to mitigation
To assess the mitigation, the expert research team of SIA Unit has adopted an
approach that is spanned in three phases. In the first phase, a physical observation
of the area was held and conducted a pilot study to understand major risks and
opportunities involved with the project. Through a structured questionnaire,
detailed dynamics of risks of each affected person is collected and analyzed in the
second phase. A public hearing is proposed for a comprehensive measurement of
risk and to mitigate it in the third phase.
7.2 Measures to avoid mitigate and compensate impact
The proposed land acquisition in Kakkanad for rehabilitation of Project Affected
Persons under the IURWTS project is planned by the requiring body by
minimizing the risk in the most possible manner. Except three structures being
used for agricultural purpose, no major structure is there in the affected land.
Further the project area will be a suitable place to rehabilitate the affected families
of IURWTS project. However 2 families (owners) will be adversely affected and
the following measures may be taken to avoid, mitigate and compensate impact
• Compensation for the land owners as per the Right to Fair Compensation
and Transparency in Land Acquisition, Rehabilitation and Resettlement Act,
2013 and Kerala Right to Fair Compensation and Transparency in Land
Acquisition, Rehabilitation and Resettlement Rules, 2015.
• The procedures for R&R package as per the Policies issued by Revenue(B)
Department, Kerala vide G.O (Ms) NO.485/2015/RD dated 23/09/2015 and

FRAM EW ORK
8.1 Description of institutional structures and key person responsible for
each mitigation measures
The project of Land Acquisition in Kakkanad Village in Emakulam District for the
rehabilitation of the PAP under the IURWTS project is proposed by Bhavanam
Foundation Kerala. Government of Kerala has appointed various key persons
through formal order with clear roles and responsibilities in accordance with the
Right to Fair Compensation and Transparency in Land Acquisition, Resettlement
and Rehabilitation (RFCTLAR&R) Act, 2013.
RTFCTLAR&R Act, 2013 defines the Administrator appointed by the State
Government would be the person responsible for Preparation of Rehabilitation
and Resettlement Scheme for affected families of Land Acquisition. Subject to the
superintendence, directions and control of the appropriate Government and the
Commissioner for Rehabilitation and Resettlement, the formulation, execution
and monitoring of the Rehabilitation & Resettlement Scheme shall vest in the
Administrator.
As per G.O. (Ms) No.485/2015/RD dated 23/09/2015, The Kerala State Policy for
Compensation and Transparency in Land Acquisition, the District Level Fair
Compensation, Resettlement and Resettlement Committee comprising :

ANALYSIS OF COSTS AND BENEFITS
AND RECOM M ENDATION ON ACQUISITION
11.1 Final conclusions on assessment of public purpose, less displacing
alternatives, minimum requirements of land, the nature and intensity of social
impacts, and viable mitigation measures will address costs
Integrated Urban Regeneration and Water Transport System (IURWTS) project in
Cochin aiming to develop transportation through canals, regeneration of Kochi city
on development basis, strengthen the tourism, and improve the quality of life of the
Kochi city and urbanization with proper waste management systems. If these
canals are developed properly it will bring a face change to the city. But as after
effect of Urban Regeneration and Integrated Water Transport System (IURWTS)
project many households from buffer zone of five canals namely Thevara Canal,
Edappally Canal, Chilavannoor Canal, Market Canal and Thevara Perandoor Canal
will be displaced. The present land acquisition of 7.73 Acers of land from
Kakkanad Village in Kanayannur Taluk in Ernakulam District is to rehabilitate
these families. The project site is assessed as better place for good living because
the area is a fast developing one. The people will get easy accessibility to the basic
facilities like education, hospital etc.
With the present land mapping done for the project, only 2 (Two) persons are to be
affected. The proposed acquisition will not cause any displacement since no
residential buildings are found to be in the project site. However, 2 persons will
lose their land and assets. The acquisition will not have an adverse impact on the
livelihood of affected persons. Presently affected persons are not using this land.

They consider it only as an asset. So the acquisition will only reduce their
ownership and possession of land. Fair compensation, Rehabilitation and
Resettlement Package based on RFCTLAR&R Act, 2013 and environmental
measures to replant trees are expected to be the major mitigation measures.
Further, the neighborhood in general are positive on the proposed rehabilitation
project as it helps to create a better and connected living for the PAP of IURWTS
project.
11.2 The above analysis will use the equity principle as a framework of
analysis for presenting a final recommendation on whether the acquisition
should go through or not.
Based on the analysis and assessment of the positive and negative impacts of the
Land Acquisition for the Rehabilitation of Project Affected People under the
IURWTS project, SIA Team recommends the project to implement with the
existing land mapping and acquisition plans. The project site is very good for
living due the access of all facilities. The following are recommended to mitigate
the impact
• Compensation shall be provided for the land owners as per the Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and
Resettlement Act, 2013 and Kerala Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Rules,
2015.
• The measures to be taken for R&R package as per the Policies issued by
Revenue(B) Department, Kerala vide G.O (Ms) NO.485/2015/RD dated
23/09/2015 and G.O.(Ms)No.448/2017/RD dated 29/12/2017 in lieu of
RFCTLAR&R Act 2013.

• Protect the trees in the affected land as far as possible and take initiative to
plant trees in lieu of the affected trees to safeguard the environment
• Protect and preserve the water body in the project area
