    Welcome!

    And thank you for your interest in having your Recovery Residence (formerly Sober Living)

    certified by Arcuria. In the United States there are no licensing requirements to operate a

    Recovery Residence . Unethical and illegal homes that are calling themselves sober living

    have been growing in number. They are hurting the people in recovery that reside in their

    homes as well as hurting the reputation of legitimate sober living. These homes are

    overcrowded and management does not care if they are clean and sober. These homes

    create problems with traffic, dealing drugs, and increased crime which results in a drain on

    the neighborhood and the reputation of legitimate Recovery Residences.

    We formed Arcuria to certify and recognize Recovery Residences that are a step above in

    quality. These are homes where recovery is a must and clients can feel safe at home.

    Arcuria provides support and education to all certified homes in an effort to create the best

    sober living homes. By meeting or exceeding our standards, you are showing people that

    you care about those in recovery and will do what it takes to help those on their way. We

    will recommend you to those that are looking for quality sober living Recovery Residences.

    Certification includes a Certificate of Certification, Certification seal you can use on

    websites and printed materials, and being listed on www.SoberLivingCertification.com as a

    Certified Recovery Residence. Certified California homes also receive a listing in California

    Recovery Resources The Official Directory of CAADAC and bed availability on California

    Recovery Resources website.

    In this packet you will find what is expected of an Arcuria Certified Recovery Residence as

    far as the building your Recovery Residence is located in, the safety requirements,

    documentation, and appropriate number of people for your particular home. We include

    guidelines for keeping the house alcohol and drug free while supporting the social model

    recovery that the homes provide. Our Certification is voluntary and will set your Recovery

    Residence apart from those that choose not to be certified. If we all come to support

    Arcuria Certification, we can keep Recovery Residences accessible to all while maintaining

    high standards which will eventually eliminate illegitimate sober living Recovery

    Residences from neighborhoods.

    Recovery Residence vs. Halfway House

    There are many types of transitional living. We want to clarify what is and is not a Recovery

    Residence(RR). A Recovery Residence is not a halfway house which houses prisoners on

    parole in transition back into society. Halfway houses are also used for the general

    homeless population and offer professional services, counseling, job training and life skills,

    as well as support services. Halfway Houses are required to be licensed. Sober Living and

    Halfway Houses used to be combined in the beginning but it was realized that separation

    was needed.

    A Recovery Residence is a place where people can live free of drugs and alcohol. It is

    recommended that a Recovery Residence be entered after completion of Residential

    treatment or during intensive outpatient treatment for addictions. The residents of a RR

    live as a family sharing chores, meals, household duties and providing emotional support

    to one another through difficult times while actively working on their continued recovery.

    Recovery Residences are environments with curfews, random drug and alcohol testing and

    good neighbor policies. They have a zero tolerance policy when it comes to using any

    addictive substance or any acts of violence or threats of violence.

    Recovery Residences can be in any residential neighborhood and it is recommended that

    all demographics of people have a Recovery Residence to go to. The home should be

    maintained to the standard of the neighborhood or better and charge an amount

    appropriate for that demographic. Recovery Residences are run as a family. Chores are

    shared and everyone has mutual care and interest in each other and emotional bonds

    occur. The money may be pooled to buy food for the house or they may shop separately.

    Residents should be in the action or maintenance stage of recovery. They should have

    accepted that they have a problem, participated in residential treatment or are currently

    attending outpatient treatment. Those who have sustained extensive sobriety and are

    working a self-help program and are able to demonstrate a willingness to actively

    participate in their recovery are also appropriate. In most cases, Recovery Residences are

    not appropriate for those straight from detox that have not had formal treatment.

    Sober Living Homes Rights and Responsibilities

    Recovery Residences which are located in residential neighborhoods are protected under the Federal Fair Housing Act Amendment of 1988. Residents which are clean and sober and in recovery, but suffering from the disease of addiction, are considered disabled and are protected from discrimination. The same rules, regulations and zoning considerations of sober living homes must also apply to all residential housing in the surrounding neighborhood. This includes limitations to number of people residing in residential homes. Therefore, Recovery Residences must be treated just as every other residential home. There cannot be any special requirements that Recovery Residences must do that any other home doesnt. The protections are clear. It is extremely important to test and maintain a clean and sober home.     As a Recovery Residence you have a responsibility to your residents, neighbors and the community.

    The purpose of a Recovery Residence is to promote and support recovery and living a clean and

    sober lifestyle. Part of recovery is learning how your actions affect others. Living with dignity and

    respect for yourself and others is paramount. Being responsible for maintaining the home to the

    best it can be, having residents that support and follow the good neighbor policy, and becoming

    part of the solution by supporting responsible and respectful members of society is the goal of any

    Recovery Residence. It is important to keep the home in good standing not only for your residents,

    but for those in the community that want to see your home as a positive thing. Get involved. Help

    make your neighborhood better than it was when you moved in by participating in service in the

    community.

    Although Recovery Residences are protected by the Federal Fair Housing Act Amendment of 1988

    and the state of California, this doesnt stop cities from enacting policies and ordinances that are

    illegal. A case in San Rafael CA is a prime example. The owner of the home went to the city to find

    out what he needed to do to open and was told that the city could not regulate recovery residences

    and he could open up without problems. The neighbors, once learning of the home becoming a

    recovery residence, inundated city hall with letters and showed up at city council meetings to share

    their outrage. The city enacted a moratorium on the opening of group homes. An act that they knew

    was illegal but because of pressure from the community they felt they had to pass something to

    quell the neighborhood. The city has worked with sober living attorneys and has now come up with

    a resolution. This is with a city that knew the law and wanted to follow it. Some cities arent so

    forgiving. Issues of discrimination are handled by HUD only if a person or business files a formal

    complaint with them. If a complaint is not filed with them there is nothing they can do. ALWAYS file

    a complaint with HUD before hiring or consulting an attorney. An attorney will cost you money and

    maybe get you to stay open, HUD will file suit and win you a settlement for the illegal actions of the

    City. If discrimination is found to exist, HUD will refer the case to the Department of Justice to bring

    suit for you.

    Certification Requirements

    Recovery Residence Home Organization

    Recovery Residences are for the sole purpose of letting the person continue recovery after treatment by

    living with others focused on recovery. It is not intended for those who want to avoid treatment or are

    new in recovery or fresh out of detox. Residents offer mutual, emotional, support in their recovery and

    through tough transitions in life which create family bonds.

    Homes will have a Live-in Manager or Houseparent and some homes institute a Jr.

    manager/houseparent position for individuals with the proper temperament and personality to gain

    skills to become a manager or houseparent. The roll of the manager/houseparent is to make sure the

    house is running smoothly, ensure compliance with the house rules and maintain a clean and sober

    environment. Management or houseparent may be a hired employee that is compensated for performing

    this function. If staff are hired, proof of workers compensation insurance must be provided as well as a

    drug free workplace policy in effect. There must also be a written job description that details the

    minimum qualifications to hold that position, duties or responsibilities, as well as the essential functions

    of the job. Personnel records must be maintained in accordance with federal, state, and local regulations.

    In California, a home may not design or provide any activity that can be interpreted to alleviate/treat

    individual alcohol and/or other drug problems. They also may not require a resident to attend an

    alcohol and/or drug treatment or recovery activity (laws vary by state). The key words are design or

    provide or require. However, Management and houseparent can encourage, assist and influence

    residents to participate in recovery promoting activities without providing and requiring them.

    Residents can also be encouraged and assisted to organize themselves into a democratic self-

    management body that adopts its own rules and policies. The self-managing body has the right to

    provide and require their democratic family group members to be and remain involved in recovery

    activities.

    Although management cannot tell residents how to live or what they can and cant do, they can see that

    house rules are followed. These rules must state and enforce that residents remain clean and sober from

    all mind altering substances. Alcohol, items containing alcohol, mind altering substances or

    paraphernalia are never allowed on the property, either in the residents personal possession or in a

    vehicle. No violence or threats of violence will be tolerated. Violation of any of these rules will result in

    immediateand permanent-expulsion. Additional house rules may be implemented that support a

    healthy lifestyle, respect to the neighbors and other housemates. They may include a curfew, chores and

    when they must be completed, and there is to be a minimum of one house meeting a week to discuss

    house issues and resolutions. Recovery Residences shall have a mission statement which promotes an

    environment that provides for residents to live as a family unit. A Residents Rights and

    Responsibilities handout must be given to every resident upon admission to the house. A grievance

    policy and procedure for residents and employees must be written and a grievance form shall be

    included in the intake/orientation materials provided to each resident and employee.

    Good Neighbor Policy

    Recovery Residences should have a good neighbor policy. This policy is to show that you

    are indeed working in recovery and have respect not only for yourself and your residents

    but have respect for the neighbors as well.

    A good neighbor policy should state that all neighbors are to be treated with the utmost

    respect. Residents and guests shall not congregate or hang out on the street, sidewalk, cars

    or the front of the house. Residents should not deposit trash or cigarette butts in the streets

    or neighbors properties and should pick up any trash they happen to see. Residents and

    guests must respect the speed limit, drive carefully at all times and be on the lookout for

    small children. The car radio must be at a level so it cant be heard outside of the car while

    in the neighborhood. If parking is limited, rules should be made as to not infringe on

    neighbors ability to park in front of their own home if needed.

    Residents are encouraged to be a part of their community, participate in local volunteer

    opportunities and get to know their neighbors. When neighbors get to know the residents,

    ignorance becomes less of a problem.

    Management

    Management or Houseparent should have demonstrated skills in living clean and sober. It

    is required that management have a minimum of one year clean and sober. House parents

    under a manager should have at least 6 months and be actively working a program of

    recovery with a sponsor and sponsees if appropriate. Management/houseparent may not

    engage in dual relationships with residents. Dual relationships include but are not limited

    to sexual relations or other sexual acts, going into business together or employment.

    Management shall not at any time be on parole or probation as infractions that may result

    in return to incarceration will adversely affect those in the house. The only exception is if

    the business is incorporated and there is a board of directors that will be responsible for

    the residents safety, well-being and security as well as replacement of appropriate

    management if needed.

    Documentation

    Management should keep minimum records of each resident. An application that is filled out with the

    residents basic information and emergency contact, as well as substance use history, criminal

    background, and probation/parole officer name and number if applicable, is required in all resident

    records.

    Homes should be in compliance with Megans Law. Which means if you let a PC 290 registrant (sex

    offender that must register their residence) into the home, know that the home will show up on the

    national sex registry which is available online at www.meganslaw.ca.gov. Most sober living homes do

    not allow sex offenders for this reason. All potential residents can be checked at the website listed above

    to see if they are required to register. Sex offenders are not protected under FHAA which may pose an

    issue for the home.

    There must be a resident agreement on file for each resident showing explanation of all fees, what is

    included in each fee, refund of fees and all activities expected of the resident. Homes may also require a

    testing fee deposit, an amount of money that will be used for testing and sending verification tests to

    the lab to ensure compliance and verify a positive test if the client refutes the test results. Any remaining

    testing fee balance will be returned to the resident upon vacating the home. There must not be a

    relapse fee or other named fee relating to relapse for an individual to remain in the house. Residents

    shall be given copies of all signed documents, rules, expectations and other information. It is permissible

    for a client to forfeit their deposit if they are asked to leave due to relapse. This would be in place of

    them being able to give proper notice before leaving.

    There must be accounting records for all fees received from each resident, what they are for and how

    they are held. This accounting must show deposits and testing fees placed in a holding account as well as

    the amount that is put into an expense account for house expenses and repairs.

    The resident agreement must state that it is not a landlord tenant agreement and that residents have no

    protections under the landlord tenant law. It is an agreement to participate in the Recovery Residence

    and the ability to participate is contingent on continued management agreement, payment of fees and

    the resident remaining free from any mind altering substance. This may be tested at any time to ensure

    compliance.

    There shall be one log documenting residents as they establish residency and when they vacate. The log

    shall include referral that led them into the home and circumstances of exit. This will provide a quick

    review of residents registered in a given year, along with the number of people moving out, and why.

    All documentation is to remain confidential and be protected by lock or password.

    Testing

    Testing for mind altering substances to ensure a clean and sober environment is mandatory for

    certification. Testing may be conducted with urine, saliva, or breath testing kits and equipment.

    Testing should be random, unannounced, and can be determined by management or

    houseparent. Every client must test negative in order to be accepted into the house initially or

    after relapse. A policy must state that if a client relapses they are required to leave the house

    until they can produce a negative test. . Every house must have a minimum 5 panel immediate

    result urine or saliva testing supplies on hand. Waiting two days for results can be detrimental

    to a house.

    Documentation is required for Arcuria Certification. Tests should be documented with the date,

    type of test used, substances tested for, client initials or number for confidentiality, and results.

    There must be a written disciplinary process and documentation for residents who test

    positive for prohibited substances or who are otherwise determined to be in violation of the

    homes abstinence rules. This is for each house and will be done in permanent ink. Arcuria

    requires a minimum of one test per week be performed. This can be by random draw, new

    entrants to the house, after a pass or if use is suspected. The written toxicology testing protocol

    must be uniformly enforced.

    We also require an agreement with every manager/houseparent that in the event that Arcuria

    receives any complaints of substance use by management/houseparent, we reserve the right to

    test any manager/houseparent. Testing by Arcuria would be an uncommon situation. As a

    certifying agency, our most important client is the alcoholic and addict fighting for their

    recovery and Recovery Residences should have that same policy. We know that relapse

    happens and it is impossible to guarantee a clean and sober environment, but when using is

    overlooked by management or management relapses and continues to run the home, the

    damage that can be done is immeasurable.

    Should management relapse, there must be provisions for management replacement or

    notification of all residents so they can choose what course they want to take. If management

    isnt replaced, certification will be revoked until management maintains a minimum of one year

    of continuous sobriety. Managers should also become familiar with other substances that can

    be obtained legally and used that are addictive and mind altering. Residents should not be

    allowed to use or possess these substances. Examples are spice, k2, plant food, bath beads

    or salts or medical marijuana.

    Building

    Recovery Residences come in all types of structures. The only requirement is that they are located

    in a residential neighborhood and are zoned as residential housing. The residential structure,

    maintenance, and landscaping should be kept in a manner equal to, or better than, the surrounding

    neighborhood. There should be no holes in the walls or broken items, furnishings or fixtures.

    Fireplaces should follow local code and if wood burning is illegal in your area, the fireplace should

    be made unusable. There shall be working heat in all areas of the home (if applicable to your

    climate) as well as a water heater substantial enough for the number of residents. There shall be a

    meeting space or living room that is suitably furnished for all residents to be able to gather for

    house meetings and socializing.

    All furniture is to be of good quality, clean and functional without any major stains, rips or tears.

    The dining area must be clear and suitable for at least 4 people to sit and eat a meal at the same

    time. There must be adequate food storage for all residents as well as a minimum of one full size

    refrigerator for every 4 people (approx. 5 cu feet per person). There shall be no more than 5

    residents per bathroom.

    Bedrooms should be adequate for the number of residents. Specifically, each resident shall have a

    minimum of a twin bed, chest of drawers and closet space. If there isnt enough closet space then

    there must be a wardrobe locker for those that dont have closet space. All of these items must fit in

    the room and on the floor with reasonable room to walk around. If bunk beds are used, the space

    requirements are the same. For each bunk bed there should be enough space for two twin beds and

    a chest of drawers for each on the floor. The only reason for a bunk bed would be to allow more

    space for the residents NOT more space for another bed. Bedrooms must not require passage

    through another bedroom to gain entry. Bedrooms will be located in rooms designed for such

    purpose and will have a door as well as a minimum of one window to escape fire.

    No room shall be enclosed in another unfinished room such as a garage. Permits for alterations to

    the structure must be submitted to show compliance. Plumbing and electrical requests shall be

    addressed within 24 hours and maintenance requests shall be addressed within 30 days.

    Laundry services must be available and easily accessible to all residents. There should be a policy

    covering the security of the home and the procedures residents must follow for a secure home.

    If the building is not owned by the operator of the Recovery Residence, a letter of documentation

    from the owner must be provided that states that the owner of the property understands that the

    property is being used as a business to house people in recovery from addictions. Management

    MUST have appropriate Sober Living Insurance to cover liability.

    Safety

    Safety must be thought about throughout the house. All windows must be in working order and not

    stuck. They must not be blocked by furniture or other impediments which can prevent use or

    escape in case of fire. If bars are used, they must be able to be unlatched from the inside to allow for

    escape in case of fire. They should be tested monthly to ensure safety. Testing must be documented.

    There must be at least one fire extinguisher per house and it must be inspected regularly by the fire

    department to ensure good working condition and charge. It must be mounted in an area near the

    kitchen which would allow retrieval if the fire was in the kitchen. A good place is the entry to the

    kitchen. Regulations regarding the placement of fire extinguishers state that fire extinguishers must

    be placed where the occupants of a building will normally pass them. Mountings must be fixed to a

    wall and the bottom of the fire extinguisher must be at least four inches off the floor, and the top

    must not be more than five feet off the floor. Free standing fire extinguishers, placed on floors,

    counters or desktops, are not allowed. Fire extinguishers must be located no more than 75 feet

    from people who might need to use them. So if there is any point in your home that is over 75 feet

    from the extinguisher then a second extinguisher must be installed to comply with this standard.

    Working smoke detectors must be installed in each home. There must be one located in the

    bedroom vicinity or hallway as well as one in each bedroom. In Homes with more than one story,

    there shall be a smoke detector on every floor including basements and attics if habitable. A Carbon

    Monoxide detector must be installed in all homes that have any gas appliances or wood burning

    fireplaces. Management maintains documentation of proper maintenance of smoke detectors and

    fire extinguishers. There shall be no smoking inside the home and a designated smoking area must

    include a safe way of disposing of smoking materials. Stoves and cooking areas shall be kept clean

    and free of grease accumulation at all times.

    Second and third story homes shall have fire escape procedures established and one or more fire

    ladders if needed. Residents of second and third floors must have the physical ability to use the fire

    ladders if necessary. Emergency contact information and phone numbers must be posted in a

    conspicuous location which includes the phone number and address of the home. A first aid kit that

    includes tweezers and scissors inside must be available. If any parts of the kit are missing,

    certification will be put on hold until it is replaced. Each RR must have comprehensive liability

    insurance that provides coverage for injury to residents, visitors or property damage with a

    minimum amount of coverage of $500,000.

    Insurance

    A minimum of $500,000 insurance is required. Standard Homeowners insurance or rental insurance does not cover loss due to running a sober living home. Truth is, most insurance companies dont understand your business or what it is that you do. They will tell you it is covered but once a claim is

    Structures that are not owned by the SLE operator but are rented are required to have sober living insurance as well as a declaration from the homeowner that states that the homeowner knows the home is being used as a Recovery Residence.

    Self evaluation check sheet to make sure your house will pass certification

    Home: ___The Residential structure, maintenance, and landscaping should be kept in a manner equal to, or better than, the surrounding neighborhood.

    ___There must be no evidence of insect infestation, bedbugs, cockroaches, or rodents. ___There are no holes in the walls or broken items, furnishings or fixtures. ___There is working heat in all living areas ___Water heater is large enough to provide for the number of residents. ___One room in the home must provide enough space and seating for every resident to participate in house meetings. ___A deadbolt lock will be installed. It is recommended that an electronic passcode or fingerprint lock

    be installed. This allows easy removal of a code when resident leaves and reduces the cost of key replacement. Most of these locks can have up to 19 user codes. Key boxes can be used but management must be aware that residents can access the key to copy. ___A First Aid Kit complete with scissors and tweezers is present. Furniture:

    ___Clean, functional and unbroken furniture must be present with no major stains, rips or tears that would bring the furniture to a below average standard. Living Room: ___A Living room must be present, providing enough space for relaxed, seated assembly

    Sleeping Areas: ___Sleeping areas must include a bed for each person ___Sleeping areas must include a dresser or drawer space as well as closet space for each individual ___Bedrooms are the only rooms to be used as sleeping areas ___Bedrooms used as sleeping areas may not be used for any other purposes ___Proof of builders permit is required for any remodeled and/or newly built bedrooms in use

    ___No room may be enclosed within another unfinished room (including a garage) ___Each room shall have a door and at least one working window for fire escape purposes. ___Smoke detectors shall be installed in each bedroom ___Each room can have no more beds than is reasonable for the size. If bunk beds are used, the room must be large enough to comfortably use twin beds on the floor and dressers for each individual. They may be used to maximize space but not to put more people than reasonable into a room. Kitchen and Dining Areas: ___Dining Room tables and chairs must be suitable for family meals for a minimum of 4 people. ___Kitchen and Dining Tables are kept clear for frequent use ___Space must be provided for dry food storage for all residents ___5 cubic feet of cold food storage per person (1 large fridge per 4 people) must be provided ___Adequate hot water for dish washing and showering must be provided

    Safety: ___Windows are in working order, unblocked and bars must release from the inside if present. ___Charged fire extinguisher shall be installed as described ___Working smoke detectors are installed as described ___Carbon monoxide detector is installed if gas appliances are used or fireplace is present ___Fire ladder is present on second and third story if applicable ___Emergency contact numbers as well as house phone number and address are posted Management: ___Live in Management monitors safety and sobriety of residents and testing supplies are on hand ___Gas, Electric, Water, Sewer and Garbage must be provided and paid for by management. ___Management has not had, and agrees not to have, dual relationships with residents

    ___Plumbing and electrical requests are responded to and addressed within 24 hours. ___Maintenance requests are responded to and addressed within one month. ___Cleaning supplies, toilet paper and laundry soap are provided for upkeep of sanitation ___Waste and unused items are dealt with properly ___Records of signed house rules and resident agreement. (kept for at least 2 years post discharge) ___Drug and Alcohol testing must be conducted and documentation completed ___Records of testing dates and results are to be kept for 2 years ___All records should be kept confidential and protected by either lock or password ___Management must be clean and sober and agree to submit to drug or alcohol testing upon request by Arcuria which would be triggered by someone filing a complaint. ___Place the phone number for Arcuria in a conspicuous place so residents can call if they believe management/house parent is using. Signed Agreement: Pre-signed House Rules must state: ___No alcohol or drug use allowed ___No alcohol, items containing alcohol or drugs are allowed on the property ___Anyone possessing drugs or alcohol, under the influence of drugs or alcohol, or refusing to submit to a drug or alcohol test will immediately be asked to leave in order to preserve the environment as clean and sober ___Fees must be paid on time ___Attendance at weekly house meetings is required ___Good Neighbor policy is written and enforced

    Each Recovery Residence location is Arcuria Certified for a period of 1 Year.

    Failure to continue to meet any of the above requirements will result in revocation of certification and

    removal from website. Investigations will be conducted when claims are made that a Recovery

    Residence is not meeting certification requirements.
